<strong>Channel</strong> 5 DRL<br />

(b) training and retraining persons whom he employs in or in<br />

connection with the provision of the <strong>Channel</strong> 5 Service or<br />

the making of programmes for inclusion in the <strong>Channel</strong> 5<br />

Service.<br />

(2) The Licensee shall take appropriate steps to make those affected<br />

by the arrangements to be made in accordance with Condition<br />

36(1) aware of them including publishing the arrangements in<br />

such manner as <strong>Ofcom</strong> may require.<br />

(3) In particular (but without limiting the generality of the foregoing),<br />

the Licensee shall from time to time (and at least annually)<br />

publish, in such manner as he considers appropriate, his<br />

observations on the current operation and effectiveness of the<br />

arrangements required by virtue of this Condition.<br />

(4) The Licensee shall, in making and reviewing the arrangements<br />

made in accordance with Condition 36(1), have regard to any<br />

relevant guidance published by <strong>Ofcom</strong> as revised from time to<br />

time.<br />

(5) This Condition 36 shall apply if the requirements of Sections<br />

337(7) and (8) of the Communications Act are satisfied in the case<br />

of the <strong>Channel</strong> 5 Service.<br />

(6) <strong>Ofcom</strong> will treat the Licensee’s obligations under Conditions 36(1)<br />

to (5) above as discharged where a member of a group of<br />

companies to which the Licensee belongs has discharged those<br />

obligations in relation to employment with the Licensee.
