Section 217 of the<br />

Communications Act<br />

<strong>Channel</strong> 5 DRL<br />

compliance with Conditions 7, 8, 9 10, 11, and 13;<br />

(b) it proposes to grant a fresh <strong>Channel</strong> 5 licence for the<br />

provision of a service replacing the <strong>Channel</strong> 5 Service<br />

which would differ from the <strong>Channel</strong> 5 Service in:<br />

(i) the area for which it would be provided; or<br />

(ii) the times of the day, or days of the week, between<br />

or on which it would be provided;<br />

(c) it appears to <strong>Ofcom</strong> that there are grounds for suspecting<br />

that any source of funds to which the Licensee might<br />

(directly or indirectly) have recourse for the purpose of:<br />

(i) paying the amount of the Renewal Payment;<br />

(ii) paying the amount of the Renewal Payment as<br />

increased by the Appropriate Percentage in respect<br />

of each subsequent year falling wholly or partly<br />

within the Renewal Period;<br />

(iii) paying an amount, determined under Section<br />

217(1)(b) of the Communications Act, representing<br />

a specified percentage of qualifying revenue in<br />

respect of each accounting period of the Licensee<br />

falling within the Renewal Period;<br />

(iv) otherwise financing the provision of the <strong>Channel</strong> 5<br />

Service,<br />

is such that it would not be in the public interest for the<br />

<strong>Licence</strong> to be renewed; and <strong>Ofcom</strong> having referred the<br />

Licensee’s renewal application to the Secretary of State<br />

together with a copy of all documents submitted to it by<br />

the Licensee and a summary of its deliberations on the<br />

application, the Secretary of State has refused to consent<br />

to the renewal on the grounds that the source of funds is<br />

such that it would not be in the public interest for the<br />

<strong>Licence</strong> to be so renewed.<br />

(4) On the grant of any such application <strong>Ofcom</strong> shall determine:<br />

(a) the amount of the Renewal Payment; and<br />

(b) a percentage of qualifying revenue for each accounting<br />

period falling within the Renewal Period which the<br />

Licensee will be required to pay to <strong>Ofcom</strong>.<br />

(5) For the purposes of Condition 24(4) above:<br />

(a) the amount of the Renewal Payment shall be determined<br />

(as necessary) in accordance with Section 217(2) of the<br />

Communications Act; and
