<strong>The</strong> author <strong>of</strong> this report could identify no case-law <strong>of</strong> the monitoring bodies <strong>of</strong> the <strong>European</strong> Convention on<br />
<strong>Human</strong> Rights having dealt with age-based discrimination. This is illustrative <strong>of</strong> the novelty <strong>of</strong> the prohibition <strong>of</strong><br />
discrimination on this ground, which – like disability, health or sexual orientation – forms part <strong>of</strong> second<br />
generation rights to equal treatment, the prohibition <strong>of</strong> discrimination based on sex, race or ethnic origin, religion<br />
or belief, political opinion and perhaps nationality, forming first generation rights in this field. <strong>The</strong> lack <strong>of</strong> case-law<br />
from the <strong>European</strong> Court <strong>of</strong> <strong>Human</strong> Rights on this issue only raises the importance <strong>of</strong> any developments in the<br />
jurisprudence <strong>of</strong> the <strong>European</strong> Committee <strong>of</strong> Social Rights on the basis <strong>of</strong> Article 23 <strong>of</strong> the Revised <strong>European</strong><br />
Social Charter (or Article 4 <strong>of</strong> the 1988 Additional Protocol to the <strong>European</strong> Social Charter), which concerns the<br />
right <strong>of</strong> elderly persons to social protection, especially since the <strong>European</strong> Committee on Social Rights has read<br />
into this provision a requirement to adopt legislation prohibiting discrimination based on age. 139<br />
