2.3 ADMINISTRATIVE ARRANGEMENTS LEGISLATION<br />

2.3.1 The Administrative Arrangements Act 1983 came into operation on<br />

21 <strong>June</strong> 1983. Section 3 <strong>of</strong> <strong>the</strong> Act anpowers <strong>the</strong> Governor in Council to<br />

make Orders on matters relating to administrative changes. The<br />

Goverrxjr in Council may also make Orders under Section 4 <strong>of</strong> <strong>the</strong> Act<br />

specifically concerning <strong>the</strong> issue or ^plication <strong>of</strong> moneys<br />

appropriated by Parlianent, where respor^ibility <strong>for</strong> <strong>the</strong> per<strong>for</strong>mance<br />

<strong>of</strong> functions has been transferred from one department to ano<strong>the</strong>r.<br />

2.3.2 During 1983-84, a total <strong>of</strong> 13 Orders were made by <strong>the</strong> Governor in<br />

Council, 12 under <strong>the</strong> authority <strong>of</strong> Section 3 <strong>of</strong> <strong>the</strong> Act and one under<br />

<strong>the</strong> authority <strong>of</strong> Section 4.<br />

2.3.3 Some technical problems were experienced by <strong>the</strong> Department <strong>of</strong> <strong>the</strong><br />

Premier and Cabinet in <strong>the</strong> first <strong>year</strong> <strong>of</strong> operation <strong>of</strong> <strong>the</strong> legislation.<br />

These problems arose mainly from questions <strong>of</strong> interpretation <strong>of</strong> <strong>the</strong><br />

Act and identification <strong>of</strong> all circumstances under which Orders<br />

involving appropriations by Parlianent are necessary. It is evident<br />

from audit's discussions with <strong>the</strong> Department <strong>of</strong> <strong>the</strong> Pranier and<br />

Cabinet that action has been taken to avoid <strong>the</strong> difficulties<br />

experienced in 1983-84.<br />
