UV-C treatment 

Over 100 years ago German scientists discovered that the top surface of lake-water was sterile when exposed 

to sunlight. Investigation led to the discovery of Ultraviolet light. Situated in the electro-magnetic spectrum 

between X-rays and visible light, Ultraviolet (UV) light has many beneficial properties. UV light is split into four 

main categories, UV-A, UV-B, UV-C and Vacuum UV. The UV-C spectrum (200 to 280 nanometers) is the most 

lethal range of wavelengths for microorganisms. This range, with 254 nanometers being the peak germicidal 

wavelength, is known as the Germicidal Spectrum. 

UVC light has the ability to cause permanent damage to a wide variety of nuisance microorganisms in water. 

Certain species of microorganisms have now developed or adapted immunity to traditional disinfection techniques 

such as chlorine. 

The Targeted Microorganism 

Each type of microorganism requires a specific UV-C radiation exposure rate to successfully complete the disinfection process. The 

targeted microorganism must be directly exposed to the UV-C radiation long enough for the radiation to penetrate the 

microorganism’s cell wall. However, it takes only seconds for UV-C light rays to inactivate waterborne microorganisms by breaking 

through the microorganism’s cell wall and disrupting their DNA. This often totally destroys the organism, or at the very least will impair 

its ability to reproduce.

450.000 litres. In the Blue Lagoon UV-C Pro Buster is a UV-C radiation generated from 253,7 nm wave length by 3 special UV lamps, 

ensuring a lethal effect on bacteria (including Legionella bacteria). The Blue Lagoon UV-C Pro will ensure that your pool water is clean, 

fresh and clear in an efficient and environmentally-friendly manner. The water is led through the UV-C device via a pump. The UV-C

This revolutionary combination of ozone and UV-C makes a pool with a minimal amount of chlorine possible! With this Blue Lagoon 

Ozone UV-C unit on your pool system you´re able to keep your pool water fresh, crystal clear and especially hygienic clean. This can 

reduce chlorine use up to 90%! You connect the “Blue Lagoon Ozone UV-C” on to your swimming pool system. Using a pump, the 

water is pumped into the unit through the supplied reactor. Because of the water pressure in the reactor, air is sucked through the 

Venturi system. Air is sucked into the unit via the air valve and flows through the area between the quartz glass and the ozone UV-C 

lamp. Because air enters the unit via the lamp, it becomes loaded with ozone particles that were generated by the special ozone UV-C 

lamp, which produces 0.6 grams of ozone. After it has passed the ball valve, the ozone enriched air is then mixed with water in the 

reactor. The oxidation and sterilisation take place here, and a powerful disinfection process is achieved. The water-ozone mixture is 

then exposed to the 25.000 Microwatt UV-C output generated by the 75 watt lamp in the stainless steel housing. The lamp has a 

double function, producing ozone and UV-C light at the same time. The ozone particles in the water are completely broken down again

The Compact4pool is specially designed for smaller swimming pools, above-ground swimming pools and spas up to 20,000 litres. 

Safety and ease of use are the main features of this 4-in-1 device, consisting of a professional pump, a UV-C device, a filter and a

The Blue Lagoon Copper Electrolyzer will clean the water in your swimming pool through copper electrolysis. We recommend to 

use this device in combination with a UV-C device for the best result. The Blue Lagoon Copper Electrolyzer will, before the water 

goes back to the pool, be mounted between the pipes. The swimming pool water then flows through the housing of the Blue 

Lagoon Copper Electrolyzer. A copper unit, or Electrolyzer, is positioned within the housing, and the copper unit discharges a 

minimal amount of copper into the water flowing through the housing. These copper ions (Cu2+) in the water have a positive charge

HIDROLIFE ELECTROLYSIS SALINE SYSTEMS contribute a new concept for the treatment of your pool, improving the quality of the 

water, avoiding the manipulation of chemical products and simplifying in great measure the tasks of maintenance! 

Salt electrolysis 

In slightly salty water (between 2 and 30gr NaCl/liter) generates on-line sodium hipochlorite automatically for water disinfection. 

It eliminates the addittion of chlorine for 100%, eliminates the cloramines and obtains an exempt water of smells and unpleasant 

flavors. Salt electrolysis systems generate chlorine from the common salt disolved in the water. The necessary salt for their operation 

should be added to the pool in a concentration of 4-6 Kg/m³ (5-6 lower times to sea water). Water treatment by electrolysis is a closed 

system in which there is no loss of salt. The chlorine generated destroys the organic matter and present pathogens in the water, being 

transformed again in sodium chloride (common salt). The products break down, they act and they are regenerated again. This explains 

that the concentration of salt remains constant. Only by washing your filter, water with salt will be washed away, which makes that you 

have to fill up your salt sometimes. Following electrochemical reactions occurs at the electrolysis cell: 

2NaCl + 2H2O = 2NaOH + H2 + Cl2 Cl2 + H2O = HOCl + HCl 

(salt + water = soda + hydrogen + chlorine) (chlorine + water = hypochlorous acid+ hydrochloric acid) 

2HOCl = 2HCl + O2 NaOH + HCl = NaCl + H2O 

(hypochlorous acid = hydrochloric acid + Oxygen) (Soda + hydrochloric acid = salt + water) 

The chlorine generated by electrolysis does not harm the health of the bather. It irritates neither the eyes nor the skin, does not bleach 

the swimsuits and obtains a total satisfaction of bath, avoiding the manipulation and storage of chemical products. Suitable for persons 

allergic to chlorine.

The UVscenic system incorporates an Ultraviolet treatment and a low concentration (from1,5gr NaCl/l) SALT ELECTROLYSIS system. 

Together they achieve an integral water processing of chlorination and algae elimination without chemical products. 

The Ultraviolet system submits to the water to the radiation UV-C of a wave length of 253,7 nanometers, produced by a special lamp. 

This radiation neutralizes the bacteria, virus and other primary organisms detaining their reproduction. With this system we reduce the 

consumption of chlorine or oxidizers up to 80%.

integral water processing of oxidation-floculation without chemical products. 

The Hydrolysis. The water (H2O) is composed of 2 parts of hydrogen and 1 part of oxygen (H2O). Hydrolysis signifies, 

etymologycally, disorder by the water. When the electric current passes through the water breaks the chemical link, the negative loads 

or ions of oxygen emigrate to the positive electrode (anode).Reaction produced is as follows:

WHAT IS AFM? 

AFM is an advanced filtration media designed to replace filter grade sand in pressure filters and gravity flow filters. AFM is far superior to a 

good quality filter sand. Changing from sand to AFM will result in some major improvements to the performance of your filtration system. AFM 

is manufactured and activated from reprocessed glass by Dryden Aqua. AFM is therefore an environmentally sustainable product. 

WHY SHOULD YOU USE AFM? 

AFM is a direct replacement for sand in all pressure or gravity flow sand filters. In all applications tested by Dryden Aqua over a period of 5 

years, AFM has proved to be superior to a high quality filter sand. AFM will remove smaller particles from the water. Under controlled 

conditions using 16 x 30 sand, at a flow of 10 cubm/hr/sqm sand removed approx. 90% of all particles down to 10 microns. AFM grade 1 under 

the same conditions reduced particle size down to 5 microns. In addition to removing solids by physical processes, AFM has a surface -ve 

charge which allows it to remove very small particles and organic modules by surface adsorption. AFM is excellent at removing +ve ions such 

as iron and manganese. In addition to the surface -ve charge we have developed surface catalytic properties for AFM. When AFM is used to 

filter water containing at least 1mg/l of dissolved oxygen, the AFM will dissociate the oxygen molecule to generate two free radicals of oxygen. 

The free radicals provide a degree of surface disinfection as well as cracking organic molecules on the surface of the AFM. The performance 

of sand deteriorates, due to surface contamination. However AFM is largely self sterilizing and is cleaned with approx. 50% less back-flush 

water. The life of AFM may therefore span the life of the filter. In the tertiary treatment of sewerage the media can last for 5 years, in clean 

water applications it is likely to be in excess of 15 years. 

HOW TO USE AFM 

AFM is very easy to use. It is a direct replacement for sand in all pressure or gravity flow sand filters. Simply remove the sand and replace with 

AFM. In all applications and water flowrates tested, AFM out-performed sand. However in both cases, best performance is achieved using the 

slowest water flowrate. The filter should be layered with either pea gravel or grade 2 AFM as the bottom layer. The quantity of base material 

will depend on filter design, however, it is normally 30% of the total bed volume. Grade 1 AFM is placed on top of the grade 2. 

Chemical Composition: 

Si0² 74%, Na²O 11%, CaO 10%, MgO 3%, Al²O³ 1%. 

AFM is processed to have a very low dust content, however, the dust does not 

contain any free silica like sand. Free silica is carcinogenic and can cause 

serious respiratory disease. AFM is therefore safer to use than sand.

MULTI CYCLONE CENTRIFUGAL PRE-FILTER code 721 

The MultiCyclone is a filtration device that is capable of saving water and reducing filter maintenance. The MultiCyclone works on the 

basis of centrifugal water filtration. There are no moving parts to wear and tear and no filter media to clean or replace. 

HOW DOES IT WORK? 

Incoming water is guided by a diverter plate so that it enters multiple hydro cyclones tangentially, generating a strong centrifugal effect. This 

spins the sediment out to the hydro cyclone’s wall and then spirals it down to the sediment sump, while the cleansed water spirals upwards. 

The accumulation of sediment can be visibly monitored through the MultiCyclone’s clear sediment sump. It is cleaned by simply opening the 

purge valve. Only 15 litres of water is discharged to clean the unit of sediment. 

The MultiCyclone is ideal as a pre-filter to extend the life of your existing filter. The filtration efficiency of the MultiCyclone was tested by 

feeding 5 to 80 micron dust particles through the MultiCyclone and analyzing the percentage of dust particles trapped in the sediment bowl. 

The laboratory test revealed that the Multi Cyclone was effective in filtering particles sized 40 to 80 microns. The unit works together with 

a sand, cartridge, bead or DE filter to polish the water. It allows the installation of finer filtration systems, such as cartridge filters with finer 

cartridges and the sand filters with finer filter media. Finer filtration systems can be installed without the burden of extra maintenance. The 

water ends up clearer with less maintenance.

Technical Specifications: 

ROTOR 

The rotor is the heart of the driving force and needs to fulfill the highest of demands. The 8 pole rotor is built around the 

tungsten or titanium shaft. This static and dynamic balanced rotor consists of 16 high quality neodymium super magnets. The 

rotor is protected by a composite layer of aramid fiber reinforced carbon. Both ends have double shaft seal with smooth 

bearings which sit in a resonance free silicon bedding. As well as making theses pumps capable of handling seawater it also 

prevents vibrations which can be sensitive to some invertebrates and koi. 

STATOR 

The 27 poles stator not only gives an equal propulsion, due to the True Sine Wave technique it also has 

an unmatched torque. 

PUMP HOUSING 

The pump housing is made from blended ABS and PC (polycarbonate) that unifies the positive features of both 

materials. Inside the housing the stator is fully cast in epoxy resin is protected by a strong layer of aramid fiber 

reinforced carbon. 

POWERMODULE 

The power module uses True Sine Wave technology for high reliability. Unlike brushless DC motors with square wave 

technique, BLUE ECO pumps use True Sine Wave technology for the best features: high efficiency (90%), noise free

BEARINGS 

For pumps, the bearing system is the most important part for reliability and life span. Blue Eco pumps have a 

diamond-hard bearing system of doped silicon carbide with or without the combination of the super strong

guarantee a long and trouble free operation. 

LEAKAGE FREE 

The way BLUE ECO pumps are constructed prevents any internal leakage. The rotor rotates in the same 

water that lubricates the bearings. With a unique rinse-system, different for both models, the water inside 

will be continuously changed during operation. 

WATERPROOF 

The pump is completely waterproof confirming to class IP68 (up to 12 meters of water head). The controller is waterproof up 

to class IP64 (splash proof). Outdoor use in a covered environment is recommended. 

CABLE 

The cables on the BLUE ECO have extra protection for maximum safety in case of damage. The outer mantle 

is made of TPE and is fully saltwater proof. Due to this cable the pump can be fully submersible in (sea)water. 

CONTROLLER 

The controller is developed by Estrad BV and produced under supervision of the University of Shenzen, 

China. This leading university is working close together with Europe’s biggest companies and universities in

CERTIFICATION

Blue Eco and Swimming pools 

Due to the fact that Blue Eco pumps are not self-priming, the application in swimming pools 

can be different compared to traditional swimming pool pumps. However, when the pump is 

placed below water level and is manually filled with water, the Blue Eco Pump can be 

used for: filter installations, jetstreams, and water attractions. 

Some big advantages compared to traditional swimming pool pumps: 

- 100% waterproof. Blue Eco pumps may get wet and are seawater resistant. 

So they can be used in a wet or dry situation

The Marine has smaller connections (inlet 40/50mm, outlet 50/63mm) and has a thicker 

epoxy housing to reduce noise. The 240/320 use the same pump but have a different 

controller. A 240 watt model is a 320 pump with a 240 watt controller. This controller is 

similar to the 320 watt controller but has a smaller True Sine Wave power module 240/ 

320: inlet 2½” male thr., outlet: 50/63mm. 

500/900/1500/2200 watt 

These models are suited for the heavier work. The controller offers many extra options. 4 optional timer programs that can control the 

pump capacity and duration up to 5 times per day. A cruise control option and a full automatic protection against dry running (optional). 

Even the possibility for a second, external, control panel for remote control can be installed. Like the 240/320/500, the display shows 

the hour counter, power consumption, amperage and RPM but also offers a vast number of messages to indicate problems, etc. 

A Blue Eco pump can pay for itself within one year. Up to 50% less energy consumption, thus environmental friendly and good for CO2

The energy is collected from the air outside and transferred to the pool water. For each kW consumed by the DURATECH® heat 

pump, 4 to 5 kW are returned to the pool.The DURATECH® heat pump has to be installed outside and will even work with outside

You know the problem: a swimming pool/pond without extra heating is only pleasantly warm for about 3 to 4 weeks during the summer 

- a very short amount of time compared to the high investment and high maintenance a pool requires. An indoor pool even needs to be 

heated the complete year, which, considering the conventional energy sources, costs a lot of money and is not very environmental 

friendly. There is an other possibility! The heating of pools is the perfect application for the free and environmental friendly solar 

energy. Because no high temperatures are needed, but relatively a large amount of water needs to be heated, it is very effective to 

operate these installations at a high flow rate and on a relatively low temperature. 

OKU collectors are moulded in one peace and are colored homogeneous black. The system can normally be used with the existing filter 

pump. Corrosion and pool water resistant. The (pool)water is pumped directly through the collectors. 

OKU collectors are frost resistant and can hold human weight. 

There are 3 easy connection variations: 

1. With the filter pump over a automatic 3-way ball valve with thermostat. 

2. With an own pump and thermostat in a circular flow. 

3. With an own pump, thermostat and plumbing, disconnected from the filter system. 

See table on the right for the recommended collector size in 

% of the pool size for outdoor pools with covers or indoor 

pools (beginning of may up to september). Temperature 

increase 4 - 7°C in comparison with not heated pools. Without 

a cover the collector size ought to be 50% bigger. The local 

differences in hours of sun per day can in- or decrease the 

collector size with 20%. 

Pumps: recommended flow rate is 150 up to 250 liters per m² 

collector surface per hour. The recommended capacity of the 

pump can be easily calculated: the collector surface x 200 

liters. The pressure loss can be determined by taking the 

difference in height between the water level and collectors 

and add 5 metre.

TERMS AND CONDITIONS SIBO BV, THE NETHERLANDS 

1 APPLICABILITY 

1.1 These terms and conditions apply to all offers and all agreements between Sibo BV, having its registered office in Veghel, The Netherlands, hereinafter referred to as “the 

Supplier” and the client, hereinafter referred to as “the Buyer”. 

1.2 Other terms and conditions shall only form part of an agreement concluded between the parties if and insofar as both parties have agreed to them expressly and in writing. 

1.3 Stipulations deviating from these terms and conditions shall only become binding upon confirmation in writing from the Supplier. 

1.4 The acceptance and retention of a quotation or order confirmation, in which reference is made to these terms and conditions, by the Buyer without comment, shall indicate the 

Buyer’s approval of the application of these terms and conditions. 

1.5 Invalidity of a provision of these general conditions, or part thereof, shall not affect the validity and applicability of the remaining provisions. 

2 AGREEMENTS 

Agreements and additions and changes to them shall only become binding upon confirmation in writing from the Supplier. 

3 OFFERS 

3.1 Unless they contain an explicit acceptance term, all offers shall be free of obligation. If an offer free of obligation is accepted by the Buyer, the Supplier shall have the right to 

withdraw the offer within two days of receiving the acceptance. 

3.2 All pictures, drawings and further details will be as accurate as possible, but shall only be binding on the Supplier if such has been recorded in the offer and/or the order 

confirmation. 

3.3 Any additions and/or changes made at a later date as well as any promises made by the Supplier or its personnel, representatives, agents or other intermediaries, shall only be 

binding upon confirmation in writing from the Supplier. 

3.4 With respect to deliveries for which, due to their nature or size, no offers or order confirmations are sent, the delivery note and/or invoice shall also be considered to be an order 

confirmation, representing the agreement correctly and in full. 

4 PRICES 

4.1 The prices are quoted excluding turnover tax, transport costs, packing costs, and, if applicable, insurance. 

4.2 The price for installing goods in working order is specified separately. 

4.3 The prices are based on the cost-determining factors as known at the time the agreement was concluded, i.e. purchase prices, wages, labour costs, national insurance 

contributions, freight rates, insurance premiums and other costs. The Supplier has the right to raise these prices in accordance with the increases in these factors occurring between 

the date of concluding the agreement and the delivery. 

4.4 The quoted prices shall only refer to the offered amounts. 

5 PAYMENT 

5.1 Payment must be made net in cash within 30 days of the invoice date. 

5.2 If an invoice has not been paid in full after expiry of the term specified in paragraph 1: 

A. from that point onwards the Buyer shall be charged a credit restriction surcharge of 2%, without there being any requirement for further notification of default. 

B. the Buyer shall be liable to the Supplier for late payment interest in the amount of 2% per month cumulatively, calculated on the principal sum. In this regard, parts of a month shall 

be considered as full months. 

C. after having been requested to do so by the Supplier, the Buyer shall pay the extrajudicial costs incurred by the Supplier i n this case, which shall amount to a minimum of 15% of 

the sum of the principal sum, as well as a late payment interest with an absolute minimum of € 70.00. 

5.3 At the supplier’s discretion, in the aforementioned or equivalent circumstances, the agreement may be dissolved in whole or in part, without further notification of default or judicial 

intervention, which measure may or may not be combined with a demand for compensation. The Supplier may then also invoke the reservation of title, as described in clause 10 of 

these conditions, and reserves the right to repossess the supplied products. If the products are repossessed, they will be credited at purchase value, provided they are in their original 

condition. The balance of the debt will have to be paid by the Buyer. 

5.4 If the Buyer has not fulfilled its payment obligations in good time, the Supplier shall be entitled to suspend the fulfilment of the obligations entered into with the Buyer for 

deliveries/performance of activities until payment has been made or reliable security has been provided for this. The same applies before the moment of default/omission if the 

Supplier suspects that there are reasonable grounds to doubt the Buyer’s creditworthiness. 

5.5 Payments made by the Buyer are always used to settle all due interest and costs and then the invoices which have been outstanding the longest, even if the Buyer specifies that 

the payment relates to a later invoice. 

5.6 If the Buyer, for whatever reason, has or will acquire one or more counterclaims against the Supplier, the Buyer renounces the right to adjustment with regard to this (these) 

claim(s). The said renunciation of the right to adjustment also applies if the Buyer requests suspension of payment or is declared insolvent. 

6 DELIVERY 

6.1 The agreed delivery time or completion period commences as soon as the Supplier has received all the necessary details for implementing the order. 

6.2 Specified delivery periods may never be regarded as a deadline, unless expressly agreed to the contrary. In the event of late delivery, the Supplier must therefore be notified in 

writing of being in default, if the Buyer should wish to dissolve the agreement. 

6.3 The supplier reserves the right to deliver and to invoice up to 10% more or less than the agreed quantity. The allowable tolerances for dimensions shall be in accordance with the 

international standards for the items concerned, this insofar as not provided otherwise in the offer or insofar as the parties have not agreed upon special specifications. 

6.4 If the delivery time is exceeded or completion is not effected within the agreed period, the Buyer has no right whatsoever to compensation of any kind or to nonfulfilment of any 

obligation entered into with the Supplier. 

6.5 The delivery of goods, which are installed in working order, will be deemed to have taken place on the day that the Buyer has received a message from the Supplier to this effect. 

6.6 The Supplier accepts no responsibility for slight colour deviations, and these shall not constitute any grounds for the Buyer to refuse a delivery. 

7 EXECUTION 

7.1 The Supplier shall see to it that all the work to be performed by third parties in connection with the order will be done correctly and in a timely manner, and that all the facilities and 

materials will be ready and delivered, so that the Supplier will be able to carry out the order without delay. If the Buyer does not fulfil these obligations and thereby causes delay, the 

completion period will be prolonged proportionally and any costs incurred by the Supplier as a result of this will be charged to the Buyer. Moreover, for the Buyer, the term of payment 

shall remain the same, even if the goods have not yet or not entirely been delivered. 

7.2 The order is executed under the Supplier’s management and exclusively in accordance with the Supplier’s instructions. The Supplier is authorised to employ third parties for 

correct execution of the agreement. 

8 TRANSPORT AND HANDLING FEES 

8.1 The transport of all items related to the order will be at the Buyer’s expense and risk, even if the delivery note states otherwise. If so desired, insurance will be taken out at the 

Buyer’s request and expense. 

8.2 Return shipments shall only be accepted if the Supplier has given its express approval in writing and in advance and if the return shipment is free of charge. 

8.3 With respect to orders involving an insubstantial invoice amount, the Supplier shall be entitled to charge an extra handling fee. 

9 INTELLECTUAL PROPERTY RIGHTS 

9.1 The intellectual property rights on the drawings, models, dies and moulds made by the Supplier and/or on the instructions of the Buyer, and all that has any further bearing on the 

execution of the order, shall remain vested in the Supplier, even if the costs involved have been charged to the Buyer. 

9.2 It is only upon payment of the amount due to the Supplier as a result of the concluded agreement that the Buyer acquires the right of use with respect to the above. 

9.3 The Buyer shall not be entitled to use, copy, disclose or make known to third parties the items referred to in paragraph 1 without prior permission in writing from the Supplier, 

except when this is for own use. If this provision is violated, the Buyer shall compensate the Supplier for any damages sustained as a result of it. The Supplier may then also demand 

the return of these items.

10 RESERVATION OF TITLE 

10.1 All products supplied and to be supplied remain the property of the Supplier until such time as the Buyer has fulfilled the relevant payment obligations towards the Supplier. These 

payment obligations consist of the payment of the purchase price, claims relating to work performed in connection with the delivery, as well as claims relating to any compensation on 

account of shortcomings on the part of the Buyer in the fulfilment of its obligations. 

10.2 In the event that the Supplier invokes the reservation of title, the relevant agreement shall be considered to have been dissolved, without prejudice to the Supplier’s right to 

demand compensation for damages, lost profit and interest. 

10.3 The Buyer is obliged immediately to inform the Supplier in writing of the fact that third parties are asserting rights to products to which a reservation of title applies in accordance 

with this clause. 

11 PLEDGE / WARRANTAGE 

11.1 Insofar as the Supplier cannot claim the reservation of title as described in clause 10, the Supplier will transfer to the Buyer the products to be supplied while at the same time 

establishing a right of pledge. If the Buyer does not fulfil its obligations towards the Supplier, the Supplier shall have the right to create a right of pledge on all current and future 

movable property of the Buyer, whether or not supplied by the Supplier, as well as on the Buyer’s current and future claims on third parties. In connection with the aforementioned the 

Buyer shall be obliged to cooperate with, and bear the costs of, the legal effectuation thereof. 

11.2 The Buyer is not entitled to give the supplied products to third parties as security and/or to establish a right of pledge on them, and/or supply the products for storage under the 

actual control of one or more financiers (warrantage), since such actions will be regarded as culpable non-fulfilment of the Buyer’s obligations. The Supplier may then immediately 

suspend, without being required to issue any notification of default, its own obligations in connection with the agreement, or dissolve the agreement, without prejudice to the Supplier’s 

right to demand compensation for damages, lost profit and interest. 

12 FORCE MAJEURE 

12.1 In the event that the Supplier is not able to execute the order because of force majeure, the Supplier is entitled to execute the agreement at a later time or to declare the 

agreement completely or partially annulled without judicial intervention. Force majeure includes in any case: strike actions, excessive absenteeism due to illness among personnel, 

transport problems, insufficient supply of raw materials/spare p arts, fire, government measures, interruption of operations at ancillary industries, as well as non-performance of 

ancillary industries. 

12.2 In case of annulment as referred to under paragraph 1, the Buyer is obliged to take the goods which are available and pay the purchase price in proportion thereto. 

12.3 In case of force majeure, the Supplier cannot be held to pay any damages whatsoever. 

12.4 In the event that force majeure leads to additional costs being incurred by the Supplier, the Supplier is entitled to pass on these additional costs to the Buyer. 

13 LIABILITY 

13.1 The Supplier guarantees the quality of the products it has delivered and/or installed. 

13.2 In the event of defects of these products the Supplier’s liability shall be limited to the obligations as set out in clause 14. 

13.3 The Supplier cannot be held liable for damages caused to the property of the Buyer or third parties or for harm inflicted upon personnel during or because of the execution of 

work, except insofar as these damages are the result of gross negligence and/or intention on the part of the Supplier, unless the damages are covered by the insurance taken out by 

the Supplier. The same restriction applies with respect to personnel and third parties used by the Supplier. 

13.4 Without prejudice to the provisions in the other paragraphs of this clause, the Supplier’s liability – on whatever account – shall be limited to an amount equal to the net price of the 

supplied products or work performed. Compliance with this guarantee shall be considered the sole and complete compensation for any losses. 

13.5 The Supplier cannot be held liable for damages that are the result of compliance with legal or other government requirements concerning the products delivered by the Supplier 

or the use thereof. 

13.6 The Supplier cannot be held liable for damages that are the result of errors or omissions made by third parties whom the Supplier, with the approval of the Buyer, entrusted with 

the delivery of materials or with the execution of work. 

13.7 Without prejudice to the provisions in the other paragraphs of this clause, the Supplier can never be held liable for damages exceeding the sum insured, insofar as the damage is 

covered by the product liability and/or consequential loss insurance taken out by the Supplier. 

13.8 The Buyer shall lose its rights with respect to the Supplier, shall be liable for all damages and shall indemnify the Supplier against any claim by third parties relating to 

compensation for damages if and insofar as: 

A. the aforementioned damages have arisen as a result of injudicious use and/or use contrary to the Supplier’s instructions of the supplied products by the Buyer; 

B. the aforementioned damages have arisen because the Buyer has acted in a manner not in accordance with the instructions and/or recommendations given by the vendor. 

C. the aforementioned damages have arisen due to errors and inaccuracies in information, materials, data carriers and suchlike, which the Buyer has provided to the Supplier and/or 

the use of which has been prescribed to the Supplier by or on behalf of the Buyer. 

14 WARRANTY AND COMPLAINTS 

14.1 When taking receipt of the products the Buyer is obliged immediately to inspect the items. If noticeable errors, irregularities and/or defects are detected, they must be brought to 

the Supplier’s attention within 24 hours, followed by immediate confirmation in writing. Other complaints – also those with regard to work performed – must be reported by the Buyer by 

registered mail within 8 days of the receipt of the items or execution of the work. 

14.2 If the aforementioned complaint is not made known to the Supplier within the specified deadlines, the items shall be considered to have been received in good condition and the 

work shall be considered to have been executed satisfactorily, such without prejudice to the provision in paragraph 3 of this clause. 

14.3 If, within six months after delivery or completion, the supplied products show defects that are exclusively the result of faulty manufacture, construction or installation, these 

products will either be repaired or, for once, replaced by new ones, such at the discretion of the Supplier. In such a case the Supplier shall not be liable for any additional costs of 

whatever nature incurred by the Buyer. 

14.4 Insofar as the products supplied by the Supplier come with a manufacturer’s guarantee, this guarantee will apply equally t o both parties. 

14.5 Complaints do not suspend the Buyer’s payment obligations. 

14.6 The Supplier must be allowed to investigate the complaint. To this end, the product(s) in question must be present in unchanged condition. 

14.6 In the case of justified complaints, the damages will be compensated for in accordance with the provisions of clause 13. 

15 INVOLUNTARY LIQUIDATION, LOSS OF ACCESS TO ASSETS etc. 

Without prejudice to the provisions of the other clauses of these terms and conditions, the agreement concluded between the Buyer and the Supplier shall be dissolved without any 

requirement for judicial intervention or notification of default, at the point at which the Buyer is declared insolvent, or when a request for a temporary moratorium on payments has been 

made, or when it has lost access to and/or full legal capacity with regard to its assets or parts thereof, due to an attachment order or being placed in receivership or otherwise, unless 

the receiver or administrator considers the obligations arising from this agreement to be debts of estate. 

16 CANCELLATION / DISSOLUTION 

16.1 The Buyer renounces all rights to dissolve the agreement arising from Article 6:265 and following of the Dutch Civil Code or other legal provisions unless cancellation is agreed in 

accordance with the paragraph below. 

16.2 Cancellation by the Buyer is only possible if the Supplier agrees. In this case the Buyer, in addition to paying compensation to the Supplier of at least 20% of the purchase price, 

shall be obliged to buy already ordered items, whether or not they have been worked or processed, at the cost price. The Buyer shall be liable to third parties for the consequences of 

the cancellation and indemnifies the Supplier accordingly. 

16.3 Amounts already paid by the Buyer shall not be refunded. 

17 GOVERNING LAW / COMPETENT COURT 

17.1 Agreements concluded between the Supplier and the Buyer shall be governed exclusively by Dutch Law. Any disputes arising from the agreements shall also be settled in 

accordance with Dutch Law. 

17.2 In the case of international agreements in the sense of the Vienna Sales Convention, the provisions of said Convention shall apply as well. 

17.3 Any disputes shall be adjudicated by the competent court in the locality in which the Supplier has its registered office, unless the Subdistrict Court is competent in the matter.
