REVISED POLICY FOR DEVELOPMENT OF LAYOUTS IN<br />

THE NAGPUR METROPOLITAN AREA<br />

After considering various aspects, following revised policy for development of<br />

layouts in <strong>Nagpur</strong> Metropolitan Area is prepared for perusal & consideration.<br />

I) Layouts sanctioned after appointment of NIT as Special Planning<br />

Authority i.e. 31/8/2010:<br />

a) The layouts which are sanctioned by the NIT as a Special Planning<br />

Authority, it shall be mandatory for every developer to enter into the<br />

development agreement with NIT.<br />

b) The development in the layout shall be carried out as per the standard<br />

drawings and specifications prescribed by NIT as below :<br />

c) There shall be option for the developer to carryout development on its own<br />

under the periodic supervision of NIT OR on the request of the developer<br />

NIT may carryout the development in the layout as a Deposit Work. After<br />

receipt of estimated development cost from the developer, NIT shall float<br />

the tenders and carryout the development work.<br />

d) If the amount of development is deposited with NIT, the NIT shall release<br />

the proportionate number of plots for sanction of building plans.<br />

e) If the development is carried out by the developer on its own the plots shall<br />

be released in proportion to the development works actually carried out on<br />

the site as stipulated in the development agreement. In case of private<br />

development of the layout to be carried out by the developer on its own, the<br />

developer shall have liberty to furnish the Bank Guarantee for a period of 3<br />

years towards the estimated cost of the development works plus 5% for cost<br />

variation as decided by NIT. On submission of Bank Guarantee; NIT shall<br />

release the plots proportionate to the tune of 90% of the plottable plots area<br />

regardless of the actual development on site. Remaining 10% plots subject to<br />

minimum 01 no. of plot shall be released after completion of all the<br />

development works in the layout including completion of development of<br />

amenity space.<br />

f) If the developer fails to carry out the development within the stipulated<br />

period of the Bank Guarantee, the NIT shall encash the Bank Guarantee and<br />

carryout the development works at the risk & cost of the developer<br />

proportionate to the amount of Bank Guarantee and after adjusting for any<br />

dues outstanding against the developer.<br />

g) It shall be permissible for the developer to furnish Bank Guarantee for<br />

different stages of development and plots shall be released in proportion to<br />

the amount of Bank Guarantee [subject to limitation as put forth in clause-<br />

(e)]. After release of plots, building plans on the released plots shall be<br />

sanctioned.


h) As an incentive to the developer, for the observance of the standards and<br />

specifications of development, initially 10% plots subject to minimum 1 no.<br />

plot shall be released after the execution of agreement and handing over of<br />

open space to NIT. This shall also be applicable in respect to the layouts<br />

wherein development agreements are already executed.<br />

II For layouts sanctioned after 1/7/2008 and prior to 31/08/2010.<br />

a) It shall be mandatory for every developer to enter into development<br />

agreement with NIT, wherein a specific condition regarding development<br />

has been stipulated by the Collector <strong>Nagpur</strong> while granting N.A.<br />

permissions, where by 20% plots were retained by the Collector for<br />

observance of the conditions of development works in the layout.<br />

b) However, in case of layout wherein some of the plots are already sold out;<br />

individual building plans shall be sanctioned after recovery of proportionate<br />

development cost from the plot holders irrespective of the development<br />

agreement. However, the development shall only be carried by the NIT on<br />

recovery of 50% of total development cost of layout or sufficient amount to<br />

undertake particular development work this condition be incorporated in the<br />

Building Permit at the time of sanction of Building Plan and an undertaking<br />

shall be taken from individual for the same. The NIT shall take up the work<br />

limited to 90% amount of deposit. 10% amount shall be charged by NIT<br />

towards administrative and supervision charges. The development charges<br />

shall be as given in III below.<br />

III Layout sanctioned by the Hon. Collector, <strong>Nagpur</strong> prior to 1/7/2008<br />

For the layouts sanctioned prior to 1-7-2008 and where the developers<br />

have already sold out the plots and wherein the standard specifications of<br />

development works were not mentioned in N.A. order, the development<br />

charges shall be recovered on the pro rata basis from the individual plot<br />

holders for minimum basic amenities like C.I. /D.I. pipe line, B.T. roads,<br />

Sewer line, storm drains, Common Septic Tank interceptor sewers etc. This<br />

shall be regardless of the existing development works on site not confirming

to NIT specifications. In this category, there shall be no development<br />

agreement by the individuals with NIT. The development charges shall be<br />

recovered at the time of sanction of building plans. The NIT shall carryout<br />

development works only after recovery of 50% of the development cost for<br />

stage wise development of the layout and this condition be incorporated in<br />

the Building Permit at the time of sanction of Building Plan and an<br />

undertaking shall be taken from individual for the same. The NIT shall take<br />

up the work limited to 90% amount of deposit. 10% amount shall be<br />

charged by NIT towards administrative and supervision charges. The<br />

development charges shall be as below:<br />

Note : 1) Every year, the above rates shall be increased by 10% OR as per<br />

D.S.R., whichever is higher, every year. The first increase shall be<br />

on 1/8/2012.<br />

2) The NIT shall not be responsible for maintenance of development<br />

works of the layout.<br />

3) The developer shall be responsible for handing over of<br />

development works of the layout to the Grampanchayat/ Municipal<br />

Council / NMC.


4) In the absence of developer/land owner it shall be the<br />

responsibility of the plot holder in the layout to form the society<br />

and handover the layout to the Grampanchayat for maintenance.<br />

5) Till the layout is taken over by Grampanchayat for maintenance it<br />

shall be the responsibility of developer /plot owner to maintain the<br />

layout at their own cost.<br />

IV Policy Regarding Cement Concrete Roads/ C.C. Paving Blocks.<br />

It shall be mandatory to provide C.C. roads/ C.C. paving blocks for all the<br />

layouts sanctioned by NIT after 31/8/2010 in N/S/E/W Sectors of sanctioned<br />

R.P. and upto outer Ring Road only. The Cement Concrete/C.C. paving<br />

block road shall confirm to the standards and specifications as stipulated by<br />

the NIT in the Development Agreement. The cement concrete roads/cement<br />

concrete paving block roads are applicable to only about 10% of the total<br />

villages of the <strong>Nagpur</strong> Metropolitan Area in which lot of urban activities<br />

have taken place.<br />

V Policy Regarding Asphalt Roads<br />

The asphalt roads shall be mandatory for all the layout sanctioned prior to<br />

31/08/2010. For new layouts sanctioned by the NIT after 31/8/2010 and<br />

which are situated beyond the outer Ring Road and out side the N/S/E/W<br />

Sectors of R.P. roads in the layout need not be of Cement Concrete and<br />

asphalt road shall be permissible. This area covers about 90% of the total<br />

villages of the <strong>Nagpur</strong> Metropolitan Area.<br />

VI Provision of Common Septic Tank for the layout:<br />

1. It is observed that in many layouts, the sewer lines have not been provided<br />

by the developer. The plot holders have constructed septic tank in their<br />

individual capacity in their plots. This shall become extremely unhygienic<br />

over a period of time and shall pollute the underground water table.<br />

2. The plot holders are dependent on the well water for drinking and other<br />

domestic purposes. The developers have not provided any common water


pipe lines in the layout as is being done in the city area, the individuals<br />

have constructed open wells/ bore wells in their respective plots.<br />

3. To prevent contamination of underground water table, it is essential to lay<br />

sewer lines and construct common septic tank in each layout.<br />

VII Policy regarding Sewage Treatment Plants (S.T.P.)<br />

1. The NIT has adopted a policy of providing STP for each layout.<br />

However it is observed that the S.T.P. for individual small layout is not<br />

practicable & financially viable.<br />

2. Therefore it is proposed to provide common STP for a group of layouts/<br />

cluster of layout which may be geographically suitably located. It is<br />

proposed that the individual layout shall contribute for the construction<br />

of common STP for group of layouts.<br />

3. NIT shall recover these charges as peripherial development charges and<br />

construct the STP for the group of layouts. If suitable land is not<br />

available for STP, then NIT shall acquire the land and construct the STP<br />

and subsequently hand it over to the local Gram Panchayat for its day<br />

today operation & maintenance. The Grampanchayat shall recover the<br />

property tax / water tax etc. from the plot holders and carry out operation<br />

& maintenance of the STP. The charges towards common STP fund<br />

shall be recovered by NIT as below;<br />

• For layouts @ Rs. 2.00 lac per Ha.<br />

• For individual @ Rs. 3/- per sqft. of plot area.<br />

4. However for special townships & layout exceeding 100 acres in area;<br />

it shall be the sole responsibility of the developer/land owner to<br />

provide & maintain STP at its own cost.


Note : If the collected common STP fund is not sufficient then<br />

balance cost of common STP will have to be funded from<br />

Govt. or other sources.<br />

VIII. Policy Regarding C.I./D.I. pipe line water pipe line<br />

It shall be mandatory for all the layouts to have C.I./D.I. pipe line for water<br />

supply arrangement. It has been the experience of the NIT and NMC that,<br />

the PVC water pipelines are often tampered by the plot holders /public<br />

leading to huge leakages and contamination owing to damaged PVC lines<br />

and waterborne diseases.<br />

IX Regarding Security Deposit (S.D.) charges for development agreement.<br />

As per NIT’s prevailing policy 10% of estimated development cost @ Rs.<br />

50.0 lacs/ Ha is recovered as S.D. however owing to financial constraints<br />

most of the developers/Builders have strongly opposed it. Therefore it is<br />

proposed to recover 5% S.D. instead of 10%. and assuming development<br />

cost as below ;<br />

Note : 1. The above rates are indicative and for the purpose of development agreement<br />

only where development works are to be carried out by the Developer at its own<br />

cost as per NIT’s specifications. Actual estimates for the development works<br />

shall be prepared by the NIT where development works are to be carried out by<br />

the NIT as deposit work.<br />

2. Electrification of the layout will have to be carried out by the layout owners<br />

or Individual applicants directly through the MSEDCL.<br />

X Regarding Supervision charges<br />

1. For private development by the developer the NIT shall recover 5%<br />

supervision charges of the estimated development cost as stipulated in IX<br />

above.<br />

2. It shall be 10% of the estimated development cost if the development work<br />

is carried out by NIT as deposit work instead of 15% as per NIT’s prevailing<br />

policy.<br />

XI. Bank Guarantee in lieu of development cost<br />

As per NIT’s prevailing policy the Bank Guarantee of total amount of<br />

development cost is accepted and plots are released accordingly for<br />

construction purpose. However, it is proposed to accept Bank Guarantee<br />

proportionate to the stage wise development of the layout and proportionate<br />

plots shall be released, where developer is carrying out the development.<br />

However the developer shall be solely responsible for the execution of<br />

development works at his own cost. If the developer fails to carry out the<br />

development works, NIT shall encash the Bank Guarantee and carry out the<br />

development works in the layout proportionate to the amount of Bank<br />

Guarantee..


XII. Regarding Scrutiny fees of the Layouts<br />

It is proposed to charge scrutiny fees Rs. 1000/- per acre for <strong>Nagpur</strong><br />

Metropolitan Area instead of Rs. 3750/- charged earlier.<br />

XIII. Regarding Policy for development in respect of Educational, Petrol<br />

Pumps, Farmhouses, Transfer Godwons & Similar nature Restaurants,<br />

Industrial, Hotel Motel & Amusement parks. (Users permissible in No<br />

Development Zone (NDZ)/ Agriculture Zone as per provisions of<br />

Regional Plan (R..P.)<br />

No development agreement & release of plots in respect of above & similar<br />

category layouts and necessary development condition shall be stipulated at<br />

the time of sanction of layout. For ensuring observance of terms &<br />

conditions of development, 5% supervision charges and security deposit of<br />

5% of development cost, subject to minimum of Rs. 25,000/- shall be<br />

recovered at the time of sanction of layouts/building plans. The<br />

development cost shall be about 50% of the total development cost as<br />

stipulated in table of sr. no. IX and 50 % STP fund shall charges.<br />

XIV. Policy regarding Open Spaces (O.S.)<br />

1. The developer shall have to handover the Open Space in all residential<br />

layouts to NIT for a nominal consideration of Re. 1/- as per provision of<br />

DCR. However on the request of the developer / plot owner NIT may permit<br />

the development of the Open Space as per provisions of DCR and subject to<br />

terms and condition as it may deem fit.<br />

2. For the Group Housing schemes the Open Space shall not be taken over and<br />

shall be left for the exclusive use of the members of the Group Housing<br />

Schemes as per the provisions of DCR.<br />

3. The play ground/ Open Space of the Educational Institutional shall not be<br />

taken over & Institutions shall use it exclusively for play ground purpose.<br />

3. Similarly same policy as per 3 above shall be adopted for the Open Space of<br />

Petrol pumps, Amusement Parks, Hotel/Motels, Industrial and layouts of


similar nature on the condition that the use of the O.S. shall be strictly as per<br />

provisions of DCR.<br />

Note: Respective Sub-Registrars / Joint Registrars shall be intimated about<br />

the Open spaces in the layouts so that layout owners will not be able to sale<br />

such open spaces.<br />

XV. Regarding provision of open spaces and amenity spaces of ULC layouts<br />

sanctioned by Hon. Collector/Competent Authority prior to 31/08/2010.<br />

As per the provisions of DCR if the total area of the layout is more than 0.4<br />

Ha. then 10% of area has to be provided as open space and 15% area to be<br />

provided as amenity space in the layout upto 10 km. area of <strong>Nagpur</strong><br />

Metropolitan Area from NMC limit and within Butibori Growth Center. (As<br />

per notification dated 15/7/2010)<br />

However it is observed that in some layouts sanctioned by the competent<br />

authority prior to 31/8/2010, the layout comprised of retainable and surplus<br />

land having total area more then 0.4 Ha., while sanctioning the layout open<br />

and amenity spaces have been provided in respect of surplus land only and<br />

not for retainable share regardless of total area of layout.<br />

It is proposed that in the layout where in appropriate open & amenity spaces<br />

has not been provided it shall be mandatory to comply with the provision of<br />

DCR and 10% open space & 15% amenity space shall be provided on the<br />

retainable/surplus land as the case may be wherein the above provisions has<br />

not been complied.<br />

It is further clarified that if the layout is sanctioned by the competent<br />

authority by providing 10% open & 10% amenity spaces for part area of the<br />

layout, the same shall be held valid and the open & amenity spaces shall<br />

have to be provided only in respect of the remaining area of the layout.


XVI. Amenity Spaces<br />

If the Layout Owner fails to develop and use the amenity spaces of the layouts,<br />

within 5 years, for the prescribed purpose, otherwise such amenity spaces will be<br />

required to be handed over to the NIT for a nominal consideration of Re.1/- only.
