the constitution grants the Governor the more specific lineitem<br />

veto authority, through which an item <strong>of</strong>appropriation<br />

can be vetoed without striking the entire bill.ld. Ifthe<br />

Governor exercises the veto power, the <strong>Legislature</strong> may<br />

reconsider the bill or items vetoed, and ifapproved by a twothirds<br />

vote, the vetoed bill or item becomes law. 86<br />

89. Ifthe process <strong>of</strong>the legislature fails to produce a budget within the regular<br />

legislative session, the Governor has the sole authority to call the <strong>Legislature</strong> into special<br />

session under Minn. Const. art. IV, § 12:<br />

Ifthis process <strong>of</strong>legislative passage and gubernatorial<br />

approval or veto does not succeed in producing a balanced<br />

budget within the normal legislative session, the Governor<br />

has the authority to call the <strong>Legislature</strong> into special session. 87<br />

90. Because the separation <strong>of</strong>powers is the central principle <strong>of</strong><strong>Minnesota</strong>'s<br />

state government, the <strong>Minnesota</strong> Supreme Court has been steadfast in respecting that<br />

principle. 88 In Sharood v. Hatfield, this Court struck down as unconstitutional a statute<br />

that required attorney registration fees be diverted to the state's general fund based on the<br />

separation <strong>of</strong>powers doctrine: "ifit is a judicial function that the legislative act purport to<br />

exercise, [this Court] must not hesitate to preserve what is essentially a judicial<br />

function. ,,89<br />
