Iowa Code Sections<br />

In order to be justified, the force used by the Iowa St<strong>at</strong>e P<strong>at</strong>rol officers must<br />

have been reasonable. Reasonable force is th<strong>at</strong> force which a reasonable<br />

person, in like circumstances, would judge to be necessary to prevent an<br />

injury or loss and can include deadly force if 1) it is reasonable to believe<br />

th<strong>at</strong> such force is necessary to avoid injury or risk to one’s life or safety or<br />

the life or safety of another; (2) it is reasonable to believe th<strong>at</strong> such force is<br />

necessary to resist a like force or thre<strong>at</strong>; (3) if an available altern<strong>at</strong>ive course<br />

of action entails a risk to life or safety or the life or safety of a third party; or<br />

4) the altern<strong>at</strong>ive course of action requires one to retre<strong>at</strong> from one’s dwelling<br />

or place of business. Iowa Code Sections 704.1, 704.2 and 704.3 and St<strong>at</strong>e<br />

v. Harris, 222 N.W.2d 462 (Iowa 1974).<br />

<strong>Students</strong> <strong>Shine</strong> <strong>at</strong> <strong>Solo</strong> <strong>Contest</strong><br />

On S<strong>at</strong>urday April 2nd, <strong>Eddyville</strong> <strong>Blakesburg</strong> High School hosted St<strong>at</strong>e<br />

<strong>Solo</strong> and Ensemble <strong>Contest</strong>. The E/B students earned 12 Division I R<strong>at</strong>ings<br />

and 6 Division II r<strong>at</strong>ings. Those students earning division I r<strong>at</strong>ings (superior)<br />

were: Riley Arnold; alto sax solo, Jessica Jones, Flute & Piccolo solos, Kai<br />

Ishida; marimba solo, Anna Haselhuhn; trumpet solo, Brooke Lunsford; alto<br />

sax solo, Samantha Claypool; alto sax solo, Megan Street; flute solo, Clarinet<br />

& Flute Duet; Neisha Van Gorp & Shelby Dunwoody, Saxophone trio:<br />

Brooke Lunsford, Riley Arnold, and Jacob Lane, Flute Trio; Jessica Jones,<br />

Megan Street, & Kelly Lane, and Brooke Lunsford; vocal solo.<br />

<strong>Students</strong> receiving Division II r<strong>at</strong>ings (excellent) were: Kai Ishida; tympani<br />

solo, Kelly Lane; flute solo, Riley Arnold; snare drum solo, Paula Morrison;<br />

vocal solo, Aislynn Stockdall, vocal solo, and Vocal Sextet; Jessica<br />

Bay, Anna Haselhuhn, Morgan Kurimski, Morgan Lee, Courtney Lopez and<br />

Paula Morrison.<br />

Also performing vocal solos or duets were: Morgan Kurimski, Kindra<br />

Mallonee, Kai Ishida, Laynie Mahan, Ocelia Zimmerman, and Kristiina Carpenter.<br />

Hedrick Postal Carrier Retires<br />

Joanne Roquet retired February 28th from her position of Rural Route<br />

One carrier in Hedrick.<br />

Joanne began with the postal service in 1982 as a substitute on the same<br />

route and became the regular carrier in February of 2006. She’s missed <strong>at</strong><br />

work but I’m sure her family will be glad to have her home to help with<br />

spring planting!<br />

Shooting Ruled Justified as County Mourns Loss of Sergeant<br />

The official facts and details<br />

in the f<strong>at</strong>al stand-off on Monday,<br />

April 4, between law enforcement<br />

officials and suspect Jeffrey Krier,<br />

which ended in the de<strong>at</strong>h of Sergeant<br />

Eric Stein and Krier, were released<br />

during a press conference held <strong>at</strong><br />

the Keokuk County Courthouse on<br />

Monday, April 11.<br />

These details have been<br />

reviewed, torn a part and dissected by<br />

most, if not all, of the media outlets<br />

across Iowa since then, but wh<strong>at</strong><br />

some of these larger agencies miss<br />

in their haste to get the ‘big story’<br />

is the pride and neighborly affection<br />

found in a small communities such<br />

as Keokuk County.<br />

This is a community grieving,<br />

but it is also a community who<br />

values its integrity and takes pride in<br />

a job well done. The Iowa Attorney<br />

General’s Office determined, based<br />

upon the facts and their review of<br />

the case with the DCI (Division<br />

of Criminal Investig<strong>at</strong>ion) and the<br />

circumstances surrounding the de<strong>at</strong>h<br />

of Sgt. Eric Stein as well as the<br />

actions of the Iowa St<strong>at</strong>e P<strong>at</strong>rol, the<br />

officers engaging Jeffrey Krier were<br />

fully justified under the laws of the<br />

St<strong>at</strong>e of Iowa in using deadly force.<br />

The de<strong>at</strong>h of Jeffrey Krier<br />

is determined to be a justifiable<br />

homicide and the Iowa Attorney<br />

General’s Office considers this<br />

m<strong>at</strong>ter closed.<br />

“Each officer involved acted<br />

professionally and did not devi<strong>at</strong>e<br />

from training or established<br />

protocols,” st<strong>at</strong>ed the Attorney<br />

General’s Office in a st<strong>at</strong>ement<br />

released <strong>at</strong> the conference on<br />

Monday. “The rules of engagement,<br />

as established by command staff,<br />

were strictly adhered to. The officers<br />

on scene were confronted with deadly<br />

force being used against them by<br />

Krier. All had the inform<strong>at</strong>ion Krier<br />

had killed an officer earlier in the<br />

day. All were aware if Krier escaped<br />

the immedi<strong>at</strong>e area surrounding the<br />

residence other lives would be in<br />

jeopardy.”<br />

“Casey (Hinnah) and<br />

Eric (Stein) were<br />

nothing short of heroic<br />

th<strong>at</strong> day.”<br />

These sentiments were echoed<br />

in the emotional st<strong>at</strong>ement given by<br />

Keokuk County Sheriff Jeff Shipley<br />

<strong>at</strong> the beginning of Monday’s press<br />

conference, “We, Chief Deputy<br />

Casey Hinnah, Sergeant Eric Stein<br />

and myself, collectively made the<br />

decision to not let help (other law<br />

enforcement officers and tactical<br />

units) any closer because we feared<br />

for their safety.” He added, “Casey<br />

(Hinnah) and Eric (Stein) were<br />

nothing short of heroic th<strong>at</strong> day. They<br />

knew the decision could cost them<br />

everything or they could perish; but<br />

th<strong>at</strong> is the type of people we have in<br />

law enforcement in Keokuk County.<br />

They think more of others than they<br />

do of themselves.<br />

Shipley spoke of how<br />

neighboring counties dropped<br />

wh<strong>at</strong> they were doing and brought<br />

everything they had to come to<br />

the aid of a fellow officer, “I am<br />

extremely proud to be associ<strong>at</strong>ed<br />

with each and every one of these<br />

gentlemen. We suffered a tragic,<br />

tragic loss with the loss of Sergeant<br />

Eric Stein. He was my friend. We<br />

are all friends.” Shipley also offered<br />

support and encouragement to each<br />

of the responding officers by telling<br />

them, “We had so much help and<br />

support out there.” He wanted them<br />

to know they did all they could and<br />

everything was done right.<br />

It was this pride, sense of duty<br />

and integrity which caused Sheriff<br />

Shipley and Keokuk County<br />

Attorney John Schröeder to share<br />

the details leading up to the f<strong>at</strong>eful<br />

day of Monday, April 4 with the<br />

media. The Attorney General’s<br />

Office st<strong>at</strong>ed, “The action of each<br />

officer was objectively reasonable<br />

under the circumstances.”<br />

The following is the detail<br />

account of communic<strong>at</strong>ion <strong>at</strong>tempts<br />

between the Keokuk County<br />

Sheriff’s Department and Jeffrey<br />

Krier until the first shot was fired on<br />

Monday, April 4, 2011:<br />

February 28, 2011<br />

• A court order for the detention<br />

of Jeffrey Krier was sought by his<br />

family members.<br />

• Order st<strong>at</strong>ed Jeffrey is alleged<br />

to be Seriously Mentally Impaired.<br />

• Keokuk Co. Sheriff’s Office<br />

Deputy transported Krier to the<br />

Lutheran Hospital in Des Moines.<br />

Friday, April 1, 2011<br />

• At approxim<strong>at</strong>ely 9:30 p.m.,<br />

April 1, 2011, Krier placed a phone<br />

call to the Keokuk County Health<br />

Center and requested to speak with<br />

a particular employee.<br />

• When Krier was advised<br />

the employee was not available,<br />

Krier became agit<strong>at</strong>ed and made<br />

thre<strong>at</strong>ening st<strong>at</strong>ements and indic<strong>at</strong>ed<br />

“we” have weapons.<br />

• The Keokuk County SO<br />

(Sheriff’s Office) was notified of<br />

the call by Krier.<br />

Sunday, April 3, 2011<br />

• At approx. 4:19 a.m. Krier<br />

called the Keokuk Co. SO<br />

indic<strong>at</strong>ing his wife Melissa Gentry,<br />

36 years old, had been kidnapped<br />

and was taken to Texas (This was<br />

not a 911 call and was not recorded;<br />

Authorities have not been able to<br />

identify or loc<strong>at</strong>e the woman Krier<br />

identifies as his ‘wife’).<br />

• Deputy Jeff Runnells was<br />

notified of Krier’s call to the SO and<br />

called Krier’s cell phone.<br />

• Krier, while driving around<br />

in his vehicle, informed Runnells<br />

his wife Melissa Gentry had been<br />

kidnapped and was in Texas.<br />

• As Deputy Runnells <strong>at</strong>tempted<br />

to clarify inform<strong>at</strong>ion, Krier became<br />

agit<strong>at</strong>ed and his st<strong>at</strong>ements were<br />

incoherent.<br />

• Deputy Runnells instructed<br />

Krier to go home and go to bed.<br />

• At 5:35 a.m. the Keokuk Co.<br />

SO received a call from Mike Rankin<br />

of rural Keokuk County advising<br />

a subject who identified himself as<br />

Jeff Krier had entered his home and<br />

was looking for “Melissa Gentry”.<br />

• At 7:18 a.m. Chief Deputy<br />

Casey Hinnah arrived <strong>at</strong> the Rankin<br />

residence and took a report of the<br />

incident.<br />

• Rankin indic<strong>at</strong>ed he had never<br />

met Krier before.<br />

• Rankin st<strong>at</strong>ed Krier searched<br />

the house and then left in a truck<br />

when he did not find Melissa (both<br />

front and rear doors were locked,<br />

authorities were unable to determine<br />

how Krier entered the house).<br />

• At 7:30 p.m. the Steinhart<br />

family contacted the Keokuk Co SO<br />

and advised someone had shot up<br />

their house and tore up their yard.<br />

•Deputy Runnells processed<br />

the scene and determined there<br />

were 20 rounds fired into the house<br />

and garage. Rusty cans and 9 mm.<br />

shell casings, which appeared to be<br />

rel<strong>at</strong>ed to the incident, were found in<br />

the yard.<br />

•Deputy Runnells also<br />

discovered blue paint transfer on the<br />

damaged garage door.<br />

•The Krier residence is<br />

approxim<strong>at</strong>ely 1¼ mile from the<br />

Steinhart residence (This was a<br />

random act of violence.).<br />

Monday, April 4, 2011<br />

• Sheriff Shipley, Chief Deputy<br />

Hinnah and Sgt. Eric Stein discussed<br />

the events of the weekend and were<br />

concerned Krier may be suffering<br />

from mental health issues.<br />

February 28, 2011<br />

• A court order for the detention<br />

of Jeffrey Krier is<br />

sought by his family members.<br />

• Order st<strong>at</strong>es th<strong>at</strong> Jeffrey<br />

is alleged to be Seriously<br />

Krier’s home phone <strong>at</strong> 10:35 a.m.,<br />

and 10:38 a.m. Krier answered and<br />

advised he was willing to meet with<br />

Tales of the Ancient Sportsman<br />

Wh<strong>at</strong> a devast<strong>at</strong>ing and sad week. The senseless<br />

killing of deputy Eric Stein has covered the area with<br />

a heavy gloom. Once again we are made aware th<strong>at</strong> the<br />

handling of the mentally ill falls far short of good sense.<br />

The idea of not doing anything until they do something<br />

bizarre is totally wrong.<br />

I was in Kansas City Monday, Tuesday and Wednesday<br />

for the Missouri Travel Exchange and arrived home<br />

to hear of this terrible tragedy. I just feel and ache for the<br />

members of both families.<br />

The meeting in KC was a good one and it was held<br />

in the Holiday Inn across from the sports complex. From<br />

my sixth floor room I could look into Kaufman Stadium.<br />

The Royals were playing the White Sox and the stadium<br />

appeared to be nearly empty. The Royals are definitely<br />

a small market team and I do not see th<strong>at</strong> changing. The<br />

days of George Brett are far in the rear view mirror.<br />

My Cardinals have started with a thud. Right now<br />

they are terrible and if this continues, it is going to be a<br />

very long summer. To show how bad we are, we are even<br />

behind the Flubs.<br />

The time in KC was well spent as we were given a<br />

tour of the city and taken to some of the finer places. Of<br />

course, you can’t be in KC and not be fed a KC Strip<br />

steak. Most of the other food was Italian, which is not<br />

my favorite food. We were limited in wh<strong>at</strong> we could see<br />

in a morning tour, but we did visit the sunken steambo<strong>at</strong><br />

Arabia, the WWI museum and Crown Center. I would<br />

have liked to visit the Negro Baseball Hall of Fame, but<br />

it was not on the itinerary.<br />

I was able to meet with several new Missouri <strong>at</strong>tractions<br />

and discovered some interesting things. It was also<br />

a good time of visiting and sharing ideas with old friends<br />

and others in the travel business.<br />

Wednesday was a big day for the Ancient-ess. She<br />

had one of those big birthdays with an ugly zero <strong>at</strong> the<br />

end. I got back from KC in time to console her with supper<br />

<strong>at</strong> Taso’s. She found wh<strong>at</strong> she wanted for her birthday<br />

<strong>at</strong> the Thomas Kincade store in Savannah. It is a<br />

beautiful painting of a castle th<strong>at</strong> she wants to put in<br />

her redecor<strong>at</strong>ed bedroom. The $1800 price tag led me<br />

to believe th<strong>at</strong> the bedroom has been decor<strong>at</strong>ed enough<br />

already.<br />

Thursday and Friday were spent trying to get our income<br />

tax finished. Wh<strong>at</strong> a farce! Each year I vow to get<br />

things in order early and each year we are still pushing<br />

the deadline. A fl<strong>at</strong> tax would be so much more efficient<br />

and profitable for all.<br />

S<strong>at</strong>urday we made a trip to Cedar Falls to visit family.<br />

The Ancient-ess has a cousin who was back from California,<br />

another cousin th<strong>at</strong> lives in Cedar Falls and an<br />

aunt who is in a<br />

We all g<strong>at</strong>hered<br />

for lunch <strong>at</strong><br />

the Village Inn<br />

and while there,<br />

I was surprised<br />

to see Don Lee<br />

walk in the door with his son A. J., who is a student <strong>at</strong><br />

UNI. Don is a gradu<strong>at</strong>e of Osky High and has served<br />

as a missionary all over the world. He and his family<br />

have served in the Philippines, Russia and most recently,<br />

India. Don’s support level has dropped to the point th<strong>at</strong><br />

they will not be able to go back to India. They will be<br />

starting a new ministry in Memphis, TN.<br />

On the way home I decided to do a little trip scouting<br />

and took the blacktop west of Hudson to the Hansen<br />

Dairy. This is a unique dairy farm and they process their<br />

own milk and cream products as well as cheese, butter<br />

and ice cream. After the tour by Mrs. Hansen we were<br />

able to make our own butter and sample the ice cream.<br />

I must say th<strong>at</strong> their hard freeze raspberry is right there<br />

with the Frosty Udder soft freeze. It was mighty good.<br />

There was a couple from Cedar Falls along with their<br />

three boys and a set of grandparents th<strong>at</strong> joined us for the<br />

tour. I would guess the boys to be ages seven, five and<br />

three. They were wide eyed during the milking and then<br />

Mrs. Hansen gave them each a large bottle of milk to<br />

bottle feed the calves. Th<strong>at</strong> really turned them on.<br />

The Hansen’s have a retail store in W<strong>at</strong>erloo called<br />

the Moo-Roo Dairy. The name stems from the five kangaroos<br />

th<strong>at</strong> live <strong>at</strong> the farm. There are three adults and<br />

two babies. The babies were very comfortable in their<br />

mother’s pouch and would peek out to see wh<strong>at</strong> was going<br />

on. If a noise distracted them, they quickly ducked<br />

back inside and you would not see them for a while.<br />

I had hoped to get some sports coverage in, but it<br />

will not happen for a while. I will spend the most of this<br />

week <strong>at</strong> Mercy Hospital in Des Moines. I have to take a<br />

high powered medic<strong>at</strong>ion Monday morning and then be<br />

observed for three and one half days, before a defibul<strong>at</strong>or<br />

is installed on Thursday. Hopefully th<strong>at</strong> will get me<br />

going <strong>at</strong> full speed again.<br />

I did notice th<strong>at</strong> the North Mahaska girls track team<br />

won the PCM meet and th<strong>at</strong> <strong>Eddyville</strong>-<strong>Blakesburg</strong>’s<br />

Sam Taylor has turned in an outstanding time in the high<br />

hurdles.<br />

Let’s see wh<strong>at</strong> happened in our yesterdays.<br />

75 years ago: April 17, 1936- Barnes City bombs<br />

Deep River 29-0. Dick Lester pitched the shutout for<br />

BC. April 18- New Sharon tops Lacey 12-6. Barney<br />

Meyers and Hull each had three hits for NS. Junior Jones<br />

and Bertie Leeper each had a pair of hits for Lacey. April<br />

20- Don Barnard fired a no-hitter as the Cedar Independents<br />

be<strong>at</strong> the Osky Indees 1-0. Blackie Wells scored on<br />

an error in the bottom of the ninth for the win.<br />

50 years ago: April 20, 1961- <strong>Eddyville</strong> tops Fremont<br />

6-2. Glenn Knoot pitched the win and slapped a double<br />

and a single. Ken Epperson had a pair of hits for <strong>Eddyville</strong><br />

and Keith Dinsmore had two hits for the C<strong>at</strong>s.<br />

25 years ago: April 12, 1986- New Sharon’s Becky<br />

Harkema and Montezuma’s Lance Elliott were the winners<br />

of a 5-K race through the streets of Oskaloosa. April<br />

17- Tri-County was second <strong>at</strong> the Savage Relays. Greg<br />

Thomas won the 110 high hurdles and the 400, Larry<br />

Smith won the pole vault, Troy Krumm won the long<br />

jump and Krumm, Wade Maxwell, Smith and David<br />

Hemsley won the 4 X 200 relay.<br />

The Cummings Boys of Cedar, Iowa<br />

Growing up in the Cedar community in the 1950’s<br />

is the theme of a 134-page book of memoirs by the four<br />

sons of the l<strong>at</strong>e Howard and Ruth Cummings, who lived<br />

in the first house north of the old Cedar Elev<strong>at</strong>or. They<br />

describe how the community was self-sufficient with a<br />

post office, school, grocery store, lumber yard, grain elev<strong>at</strong>or,<br />

café, auto repair shop, and two gas st<strong>at</strong>ions along<br />

with two churches.<br />

“The character of a community is determined by its<br />

citizens,” they write, and “Cedar had many prominent<br />

families with long-time ties to the area. The McBurneys,<br />

the Randells, the Moores, the Wards, the Beavers, the<br />

Fergusons, the Barnards, the Browns, the Hardgroves,<br />

the Krusemark and the Veldhuizens are but a few of the<br />

names th<strong>at</strong> shaped the quality of life in Cedar.”<br />

They point out th<strong>at</strong>, without any formal local government<br />

as an unincorpor<strong>at</strong>ed village, “These citizens<br />

helped make the community wh<strong>at</strong> it was – a place where<br />

crime, unemployment, welfare, homelessness and poverty<br />

did not exist.” The authors emphasized th<strong>at</strong> people<br />

looked out for each other in the community. “If someone<br />

had health issues, the work was covered by neighbors<br />

until they were back on their feet. You just couldn’t hide<br />

from reality and responsibility in a community the size<br />

of Cedar.”<br />

The character of the Cedar community shines<br />

through in the chapter of the book th<strong>at</strong> describes the “car<br />

wreck th<strong>at</strong> changed everything” on Mar. 15, 1955. Their<br />

dad was driving their mother to a doctor’s appointment<br />

in Fremont th<strong>at</strong> morning when a collision occurred on<br />

Highway 63 three miles east of Cedar th<strong>at</strong> injured their<br />

f<strong>at</strong>her and killed their mother. At the time, the Cummings<br />

boys ranged in age from 15 to 7 years.<br />

“If ever it took a village to raise a child, we were<br />

th<strong>at</strong> example times four,” they write in their book. As<br />

deeply distressed young boys without a mom, confused<br />

and wary of the future, they returned to school after two<br />

weeks. “Rel<strong>at</strong>ives and neighbors took turns looking after<br />

us,” they write. “The support and help was unbelievable.”<br />

Since their dad was still recovering from the accident,<br />

they describe how neighboring farmers scheduled<br />

a day th<strong>at</strong> spring when 50 tractors showed up to plow the<br />

fields, clean the farm buildings and fix the fences – all<br />

in one day. Meanwhile, their wives spent the day in the<br />

Cummings house cleaning everything and cooking up a<br />

storm. “We had a freezer and refriger<strong>at</strong>or full of pies and<br />

cakes and food enough to e<strong>at</strong> for weeks (or months),”<br />

they write. “It was an expression of love and support<br />

unlike anything we have ever since witnessed.” They<br />

also pay tribute to the loving care given by their Grandmother<br />

Masterson and two aunts, Vera and June, who<br />

often scheduled their days to assure th<strong>at</strong> the Cummings<br />

boys were well cared for.<br />

Chapters on farm life, the Cedar school, pets and hobbies,<br />

the two churches (“the Methodist and the Dutch”),<br />

and their evolution “from singers to <strong>at</strong>hletes” complete<br />

the narr<strong>at</strong>ive of their coming of age in the 1950s. While<br />

noting the changes over the past 50 years with the decline<br />

of smaller communities, they write: “We are so<br />

happy th<strong>at</strong> we had the opportunity to grow up during a<br />

time and in a place where people looked after people and<br />

everyone was expected to succeed. It was a wonderful<br />

experience th<strong>at</strong> we will never forget.”<br />

Appendices to the book include biographical m<strong>at</strong>erial<br />

about both Howard and Ruth Cummings, genealogical<br />

d<strong>at</strong>a and inform<strong>at</strong>ion about Don’s service in Vietnam.<br />

In the preface, Dick Cummings expresses the hope th<strong>at</strong><br />

this collabor<strong>at</strong>ive effort will inspire others to record their<br />

memoirs for the enjoyment of family members and others.<br />

Their book is a loving tribute to their parents and to<br />

the big-hearted community th<strong>at</strong> helped to raise the Cummings<br />

boys of Cedar, Iowa.<br />

Mahaska County Supervisors Meetings and Claims<br />

March 7, 2011<br />

The Mahaska County Board of Supervi-<br />

sors met in regular session on the above d<strong>at</strong>e<br />

<strong>at</strong> 9:00 a.m. in the third floor conference room<br />

of the Mahaska County courthouse. Present<br />

were the following board members: Chairman<br />

– Henry W.VanWeelden; vice chairman – Greg<br />

Gordy and member – Ken Rozenboom. Also<br />

present were the following: Scott Dailey, KBOE<br />

Radio; Duane Nollen, Oskaloosa Herald; Ken<br />

Allsup, Osky News; Jon Sullivan; Joe Warrick;<br />

Sone Scott, Mahaska County Treasurer; Eric<br />

Dursky, Mahaska County Sanitarian, and Kay<br />

Swanson, Mahaska County Auditor.<br />

Chairman VanWeelden called the meeting<br />

to order with a moment of silence.<br />

It was moved by Gordy seconded by<br />

Rozenboom to approve the agenda with the ad-<br />

dition of approval of Larry’s Berries & Vi’s Vines<br />

Wine permit. All present voted aye. Motion car-<br />

ried.<br />

It was moved by Rozenboom seconded by<br />

Gordy to approve the minutes of February 22,<br />

2011. All present voted aye. Motion carried.<br />

It was moved by Rozenboom seconded by<br />

VanWeelden to approve the bills for February<br />

in the amount of $432,236.55. 2 aye – 1 nay.<br />

Motion carried.<br />

It was moved by Gordy seconded by<br />

Rozenboom to approve the request of Sone<br />

Scott, County Treasurer to place Shirley Mi-<br />

trisin on the payroll beginning March 21, 2011<br />

<strong>at</strong> $7.58 per hour and Diane Maddy beginning<br />

March 21, 2011 <strong>at</strong> $7.25 per hour. These em-<br />

ployees are seasonal part time during tax col-<br />

lections. All present voted aye. Motion carried.<br />

Chairman VanWeelden will sign the health<br />

insurance documents from last meeting.<br />

Rozenboom to approve the resign<strong>at</strong>ion of As-<br />

sistant County Attorney Misty White effective<br />

March 11, 2011. All present voted aye. Motion<br />

It was moved by Gordy seconded by<br />

Rozenboom to approve the applic<strong>at</strong>ion for<br />

Class C N<strong>at</strong>ive Wine Permit for Tassel Ridge<br />

Winery, loc<strong>at</strong>ed <strong>at</strong> 1681 220th Street, Leigh-<br />

ton, IA effective May 1, 2011 for 12 months. All<br />

present voted aye. Motion carried.<br />

It was moved by Rozenboom seconded<br />

by Gordy to approve the applic<strong>at</strong>ion for Class<br />

B N<strong>at</strong>ive Wine Permit for Larry’s Berries and<br />

Vi’s Vines loc<strong>at</strong>ed <strong>at</strong> 1155 Hwy 102, Pella, IA<br />

effective May 3, 2011 for 12 months. All present<br />

voted aye. Motion carried.<br />

It was moved by Gordy seconded by<br />

Rozenboom to open the public hearing for<br />

Mahaska County Budget for fiscal year 2011-<br />

2012. All present voted aye. Motion carried.<br />

There was present a quorum as required by<br />

law. Thereupon the board investig<strong>at</strong>ed and<br />

found th<strong>at</strong> the notice of time and place of public<br />

hearing have according to law and as directed<br />

by the Board, has been published in the Oska-<br />

loosa Herald on February 24, 2011, The Village<br />

Vine on February 24, 2011 and New Sharon<br />

Sun on February 24, 2011 official newspapers<br />

in said county and the affidavit of said publica-<br />

tion is on file with the Mahaska County Auditor.<br />

There were no written or oral comments. It<br />

was moved by Gordy seconded by Rozenboom<br />

to close the public hearing for the fiscal year<br />

2011-2012 Mahaska County Budget. All pres-<br />

ent voted aye. Motion carried.<br />

Economic Development Funding Reso-<br />

lution No. 2011-03-01<br />

BE IT RESOLVED BY THE Mahaska<br />

County Board of Supervisors th<strong>at</strong>:<br />

1. The st<strong>at</strong>e of Iowa generally and the<br />

Mahaska County, Iowa, in particular have<br />

in the past several years experienced adverse<br />

economic effects, including the<br />

loss of businesses and erosion of tax base and<br />

out-migr<strong>at</strong>ion of popul<strong>at</strong>ion.<br />

2. The economy of Mahaska County<br />

is not sufficiently diversified to provide a stable<br />

economic base but is in large part dependent<br />

on agriculture and agribusiness.<br />

3. The current economic problems<br />

in the agriculture and agribusiness industries<br />

have reached sufficiently serious proportions<br />

th<strong>at</strong> the general welfare of the citizens of the<br />

County is thre<strong>at</strong>ened thereby.<br />

4. It is therefore in the best interest of<br />

the citizens of Mahaska County, Iowa to take<br />

steps reasonably calcul<strong>at</strong>ed to lead to diversi-<br />

fied economic development in Mahaska Coun-<br />

ty, Iowa.<br />

5. Th<strong>at</strong> Mahaska County does not<br />

have sufficient resources to hire a Director of<br />

Economic development as a county employee<br />

and lacks sufficient resources to effectively op-<br />

er<strong>at</strong>e an economic development program on its<br />

own.<br />

6. Other cities and counties in Iowa,<br />

re-engaging in economic development efforts.<br />

7. Therefore, Mahaska County, Iowa<br />

finds th<strong>at</strong> it is in the best interests of its citizens<br />

to cooper<strong>at</strong>e with the cities in Mahaska County,<br />

Iowa and the Oskaloosa Area Chamber & De-<br />

velopment Group, a non-profit corpor<strong>at</strong>ion, as<br />

well as other organiz<strong>at</strong>ions which may arise in<br />

order to promote diversified economic develop-<br />

ment in Mahaska County, Iowa.<br />

THEREFORE, BE IT RESOLVED th<strong>at</strong><br />

Mahaska County, Iowa has and will continue to<br />

support in efforts to enhance economic devel-<br />

opment by its financial contribution to such ef-<br />

fects as Oskaloosa Area Chamber & Develop-<br />

ment, Rural Utility Service Systems; Mahaska<br />

Community Recre<strong>at</strong>ion Found<strong>at</strong>ion; Mahaska<br />

County Agricultural and Rural Development and<br />

The Board of Supervisors of Mahaska<br />

County, Iowa, met on March 7, 2011, <strong>at</strong> 6:30<br />

o’clock p.m., <strong>at</strong> the Mahaska County Court-<br />

house, Oskaloosa, Iowa, for the purpose of<br />

taking action for the design<strong>at</strong>ion of an urban re-<br />

newal area and the adoption of a proposed ur-<br />

ban renewal plan and project. The Chairperson<br />

presided and the roll being called the following<br />

shall receive oral or written objections from any<br />

resident or property owner of the County. All<br />

There being no further objections, com-<br />

ments, or evidence offered, the Chairperson<br />

announced the hearing closed.<br />

Supervisor Rozenboom moved the adop-<br />

tion of a resolution entitled “A Resolution to De-<br />

clare Necessity and Establish an Urban Renew-<br />

al Area, Pursuant to Section 403.4 of the Code<br />

of Iowa and Approve Urban Renewal Plan and<br />

Project for the Mahaska County Hospital Urban<br />

Renewal Area”, seconded by Supervisor Van-<br />

Weelden. Gordy filed objection to this resolu-<br />

tion as it was not on agenda and therefore not<br />

an actionable item. The only resolution on the<br />

agenda is “Resolution for Hospital Urban Area”<br />

Agenda did not allow for approval of the Urban<br />

Renewal Plan and Project. After due consider-<br />

<strong>at</strong>ion, the Chairperson put the question on the<br />

motion and the roll being called, the following<br />

named Supervisors voted: Ayes: Rozenboom,<br />

VanWeelden Nays: Gordy.<br />

Whereupon, the Chairperson declared the<br />

resolution duly adopted and signed approval<br />

thereto.<br />

RESOLUTION NO. 2011-03-02<br />

A Resolution to Declare Necessity and<br />

Establish an Urban Renewal Area, Pursuant<br />

to Section 403.4 of the Code of Iowa and Ap-<br />

prove Urban Renewal Plan and Project for the<br />

Mahaska County Hospital Urban Renewal Area<br />

WHEREAS, as a preliminary step to exer-<br />

cising the authority conferred upon Iowa coun-<br />

ties by Chapter 403 of the Code of Iowa, the<br />

“Urban Renewal Law”, a county must adopt<br />

a resolution finding th<strong>at</strong> one or more slums,<br />

blighted or economic development areas exist<br />

in the county and th<strong>at</strong> the development of such<br />

area or areas is necessary in the interest of the<br />

public health, safety or welfare of the residents<br />

of the county; and<br />

WHEREAS, it has been proposed th<strong>at</strong> the<br />

Board of Supervisors (the “Board”) of Mahaska<br />

County, Iowa (the “County”) take action to es-<br />

tablish the Mahaska County Hospital Urban Re-<br />

newal Area (the “Urban Renewal Area”) on the<br />

property (the “Property”) lying within the bound-<br />

aries set out in Exhibit A to this Resolution; and<br />

WHEREAS, the proposal establishes the<br />

need to design<strong>at</strong>e the Urban Renewal Area as<br />

being appropri<strong>at</strong>e for commercial development;<br />

and<br />

WHEREAS, the proposal demonstr<strong>at</strong>es<br />

th<strong>at</strong> sufficient need exists to warrant finding the<br />

Property to be an economic development area;<br />

and<br />

WHEREAS, notice of a public hearing by<br />

the Board of Supervisors on the question of es-<br />

tablishing the area identified above as an urban<br />

renewal area and on a proposed urban renewal<br />

plan and project for the area was heretofore<br />

given in strict compliance with the provisions of<br />

Chapter 403 of the Code of Iowa, and the Board<br />

has conducted said hearing on March 7, 2011;<br />

and<br />

WHEREAS, Section 403.17 of the Code<br />

of Iowa requires a joint agreement between a<br />

county and a city with respect to the establish-<br />

ment of a County urban renewal area to be lo-<br />

c<strong>at</strong>ed within the city limits of a city; and<br />

WHEREAS, the property proposed to be<br />

included in the Urban Renewal Area is loc<strong>at</strong>ed<br />

within the city limits of the City of Oskaloosa,<br />

Iowa; and said City has executed a joint agree-<br />

ment with respect to such inclusion;<br />

NOW, THEREFORE, It Is Resolved by the<br />

Board of Supervisors of Mahaska County, Iowa,<br />

as follows:<br />

Section 1. An economic development area<br />

as defined in Chapter 403 of the Code of Iowa is<br />

found to exist on the Property within the bound-<br />

aries set out in Exhibit A.<br />

Section 2. The area identified in Section<br />

1 hereof is hereby declared to be an urban<br />

renewal area, in conformance with the require-<br />

ments of Chapter 403 of the Code of Iowa, and<br />

is hereby design<strong>at</strong>ed the Mahaska County Hos-<br />

pital Urban Renewal Area.<br />

Section 3. The development of the Prop-<br />

erty is necessary in the interest of the public<br />

health, safety or welfare of the residents of Ma-<br />

haska County, Iowa.<br />

Section 4. It is hereby determined by this<br />

Board of Supervisors as follows:<br />

A. The proposed urban renewal plan con-<br />

forms to the general plan of the county as a<br />

whole;<br />

B. Proposed development in the urban<br />

renewal area is necessary and appropri<strong>at</strong>e to<br />

facilit<strong>at</strong>e the proper growth and development of<br />

the County in accordance with sound planning<br />

standards and local community objectives.<br />

Section 5. The urban renewal plan for the<br />

Mahaska County Hospital Urban Renewal Area<br />

is made a part hereof and is hereby in all re-<br />

spects approved in the form presented to this<br />

Board, and the proposed project for such area<br />

based upon such plan is hereby in all respects<br />

approved.<br />

Section 6. The Joint Agreement between<br />

the County and the City of Oskaloosa, Iowa as<br />

has been presented to the Board is hereby ap-<br />

proved, and the Chairperson and County Audi-<br />

tor are hereby authorized and directed to ex-<br />

ecute said agreement on behalf of the County.<br />

Section 7. All resolutions or parts<br />

thereof in conflict herewith are hereby repealed,<br />

to the extent of such conflict.<br />

The Mahaska County Board of Supervi-<br />

sors met in regular session on the above d<strong>at</strong>e<br />

<strong>at</strong> 9:00 a.m. in the third floor conference room<br />

of the Mahaska County courthouse. Present<br />

were the following board members: Chairman<br />

– Henry W.VanWeelden; vice chairman – Greg<br />

Gordy and member – Ken Rozenboom. Also<br />

present were the following: Scott Dailey, KBOE<br />

Radio; Duane Nollen, Oskaloosa Herald; Ken<br />

Allsup, Osky News; Jon Sullivan; Eric Dursky,<br />

Mahaska County Sanitarian, Miranda Johnson,<br />

MCARD; Dave Sedivec, Mahaska County Con-<br />

serv<strong>at</strong>ion Director; David Dixon, Oskaloosa City<br />

Attorney; Michael Schrock, Jr. Oskaloosa City<br />

Manager; Ben Hoskinson. Mahaska County<br />

IRVM Director; Jerry Nussbaum, Mahaska<br />

This meeting was filmed by Communica-<br />

Chairman VanWeelden called the meeting<br />

to order with a moment of silence.<br />

It was moved by Rozenboom seconded by<br />

Gordy to approve the agenda for today’s meet-<br />

ing. All present voted aye. Motion carried.<br />

The m<strong>at</strong>ter of the minutes for March 7th<br />

meeting was tabled.<br />

Eric Dursky, Mahaska County Sanitarian<br />

gave the board his monthly report and it was<br />

placed on file.<br />

Miranda Johnson, Mahaska County Agri-<br />

cultural and Rural Development Director gave<br />

the board her monthly report and it was placed<br />

on file.<br />

Dave Sedivec, Mahaska County Conser-<br />

v<strong>at</strong>ion Director gave the board his monthly re-<br />

port ant it was placed on file.<br />

It was moved by Gordy seconded by<br />

Rozenboom to approve the Veterans Affairs<br />

Commission Report for February, 2011. All<br />

present voted aye. Motion carried.<br />

It was moved by Rozenboom seconded by<br />

Gordy to approve the 2nd amendment to the<br />

28E agreement for the Cooper<strong>at</strong>ive use of one<br />

cent sales tax proceeds. All present voted aye.<br />

Motion carried.<br />

It was moved by Gordy seconded by<br />

Rozenboom to approve the Medical Exam-<br />

iner Fees Policy to be effective July 1, 2011.<br />

All present voted aye. Motion carried.<br />

It was moved by Gordy seconded by<br />

Rozenboom to approve the request of Ben<br />

Hoskinson, Mahaska County IRVM Director to<br />

publish the Notice of Destruction of Noxious<br />

Weeds. All present voted aye. Motion carried.<br />

It was moved by Rozenboom seconded by<br />

Gordy to approve the request of Ben Hoskin-<br />

son, Mahaska County IRVM Director to place<br />

Barbara VanP<strong>at</strong>ten on the payroll as seasonal<br />

position <strong>at</strong> $11.85 per hour beginning April 1,<br />

2011 until December 31, 2011.<br />

All present voted aye. Motion carried.<br />

The m<strong>at</strong>ter of P<strong>at</strong> Lafollette, ab<strong>at</strong>ement of<br />

taxes was tabled.<br />

It was moved by Rozenboom seconded<br />

by Gordy to approve the 28E agreement with<br />

Central Iowa Detention. All present voted aye.<br />

Motion carried.<br />

It was moved by Rozenboom seconded<br />

by Gordy to approve the following resolution<br />

#2011-03-03. All present voted aye. Motion<br />

carried.<br />

RESOLUTION NO. _2011-03-03<br />

WHEREAS, the Boards of Supervisors of<br />

Boone, Buena Vista, Calhoun, Franklin, Floyd,<br />

Greene, Hamilton, Hancock, Hardin, Humboldt,<br />

Iowa, Jasper, Kossuth, Mahaska, Marshall,<br />

Palo Alto, Poweshiek, Story, Tama, Webster,<br />

Winnebago and Wright Counties (collectively<br />

hereinafter the “Member Counties”) in the St<strong>at</strong>e<br />

of Iowa have authorized and executed a cer-<br />

tain agreement pursuant to Chapter 28E of the<br />

Code of Iowa (the “28E Agreement”); and<br />

WHEREAS, the terms of the 28E Agree-<br />

ment provide for the cre<strong>at</strong>ion of the Central<br />

Iowa Juvenile Detention Center (“C.I.J.D.C.”),<br />

which is governed by a Commission (the “Com-<br />

mission”) for the purpose of establishing and<br />

maintaining a juvenile detention facility and re-<br />

l<strong>at</strong>ed services on behalf of the Member Coun-<br />

ties; and<br />

WHEREAS, C.I.J.D.C. has previously is-<br />

sued its $2,500,000 Building Facility Revenue<br />

Note, Series 2008 (Detention Facility Project)<br />

(the “2008 Note”) a portion of which remains<br />

outstanding; and<br />

WHEREAS, C.I.J.D.C. has entered into<br />

certain revolving credit and short term opera-<br />

tions credit facilities with Green Belt Bank &<br />

Trust, Eldora, Iowa (the “Credit Facilities”); and<br />

WHEREAS, the Commission of C.I.J.D.C.,<br />

proposes to enter into a loan agreement (the<br />

“Loan Agreement”) and borrow money in a prin-<br />

cipal amount not to exceed $1,100,000 for the<br />

purpose of paying the cost, to th<strong>at</strong> extent, of<br />

refunding the outstanding balance of the 2008<br />

Note and the Credit Facilities; and payment of<br />

any other loans deemed necessary.<br />

WHEREAS, it is necessary for the Board<br />

of Supervisors of each of the Member Counties<br />

to authorize C.I.J.D.C. to enter into the Loan<br />

Agreement;<br />

NOW, THEREFORE, It Is Hereby Re-<br />

solved by the Board of Supervisors of Mahaska<br />

County (the “County”), as follows:<br />

Section 1. The County hereby<br />

approves and authorizes C.I.J.D.C., acting<br />

through the Commission, to approve the Loan<br />

Agreement and to borrow money in a principal<br />

amount not to exceed $1,100,000 for the pur-<br />

poses set forth in the preamble hereof.<br />

Section 2. All resolutions or parts<br />

thereof in conflict herewith are hereby repealed<br />

to the extent of such conflict.<br />

Michael Schrock, Jr., City Manager and<br />

David Dixon, City Attorney discussed the area<br />

northwest of Oskaloosa in the proposed an-<br />

nex<strong>at</strong>ion area. The supervisors have 30 days<br />

to approve this m<strong>at</strong>ter.<br />

It was moved by Gordy seconded by<br />

Rozenboom to approve the Cost Advisory<br />

Agreement to provide professional consulting<br />

services to Mahaska County for fiscal years<br />

2011, 2012 and 2013. All present voted aye.<br />

Motion carried.<br />

It was moved by Gordy seconded by<br />

Rozenboom to set the public hearing d<strong>at</strong>es of<br />

April 18, 2011, May 2, 2011 and May 16, 2011<br />

<strong>at</strong> 10:00 a.m. for the upd<strong>at</strong>e of the Flood Plain<br />

Ordinance. All present voted aye. Motion car-<br />

ried.<br />

The engineer discussed the bridge repairs<br />

on the following bridges Bridge #236730 Cor-<br />

dova Ave. between 280th and 285th ; Bridge<br />

#235760 Hickory Avenue @ Truax, and Bridge<br />

#237940 between Yale Avenue & Keokuk<br />

County Line.<br />

Under committee reports chairman Van-<br />

Weelden reported th<strong>at</strong> they are working on<br />

keeping our workforce office open in Oskaloo-<br />

sa.<br />

Member Rozenboom discussed the CAT<br />

Grant for the stadium project needs a county<br />

don<strong>at</strong>ion to help it along.<br />

Reconditioned<br />

I am a self-proclaimed turkey call guru. If you ask my wife how many<br />

calls I have, she will just roll her eyes. It’s not like I chase her around the<br />

house running three or four calls <strong>at</strong> a time hoping to get her <strong>at</strong>tention… Ok,<br />

maybe I do run calls in the house often, but only during this time of year.<br />

Actually, in anticip<strong>at</strong>ion of the upcoming season I like to pop in my favorite<br />

turk DVD and pretend I am calling in my first gobbler of the year! Again, my<br />

wife questions my sanity...<br />

I love turkey calls almost as much as I do hunting them. I have been collecting<br />

them for years and appreci<strong>at</strong>e how each and every call is different and<br />

takes the right maneuver to get the best sound out of it. Between wh<strong>at</strong> I have<br />

purchased and built myself, I have accumul<strong>at</strong>ed a little over 100 calls. With<br />

a pretty even mix of friction pots, box calls, and mouth calls, glass and sl<strong>at</strong>e<br />

friction calls are by far my favorite.<br />

Through the years of being a call junkie I have learned th<strong>at</strong> to maintain<br />

the sounds they are supposed to make requires a little maintenance. Its<br />

simple, but far too many hunters struggle with adequ<strong>at</strong>e calling and usually<br />

just give up and buy a new one. A piece of sand paper and a couple seconds<br />

will have your call running like new again.<br />

Box calls need chalk and a little brushing with sandpaper <strong>at</strong> times, but<br />

don’t over do it. When a box call begins to slide across the sidewalls without<br />

making much noise, or the sound is real scr<strong>at</strong>chy, chances are good you need<br />

to put a co<strong>at</strong> of chalk on it. About twice a season depending on how much I<br />

use it, or if the call gets wet, I will recondition the paddle and sidewalls with<br />

a piece of 120 grit sandpaper. I suggest sanding with the grain of the wood<br />

to produce the best results.<br />

A quarter turn either way on the screw th<strong>at</strong> holds the paddle to the box<br />

will help redial in the perfect sound. Th<strong>at</strong> screw rarely needs adjusted, but if<br />

you feel the sound has been lost, a quarter turn in will heighten the pitch, and<br />

a quarter turn out will lower it. Experiment with this until you have wh<strong>at</strong> you<br />

feel is right. Less is more.<br />

Friction calls typically need resurfacing once a day. You can use larger<br />

grit sandpaper for glass calls, but a “brillo” pad will totally suffice for sl<strong>at</strong>e.<br />

Run the sandpaper or pad across the call, back and forth in one direction, not<br />

in circles. Do this until the surface is consistent any smudges or marks are<br />

gone. I suggest leaving the remaining dust on the surface of the call, as it will<br />

give you more control with the striker when calling.<br />

The striker is the next thing th<strong>at</strong> needs reconditioned. Take the striker<br />

between your thumb and forefinger and spin it while brushing the tip of it<br />

with the sand paper in a downward motion <strong>at</strong> a 45-degree angle. Once the<br />

striker and pot are finished, give it a try and make sure you have <strong>at</strong>tained the<br />

desired sound.<br />

I prefer to resurface my pots <strong>at</strong> each hunt; it allows me to stay in control<br />

of the sound I am producing. Also avoid touching the friction areas on both<br />

box and sl<strong>at</strong>e calls with your fingers, as the oils in your skin will deaden the<br />

calls quicker than anything. Moisture is also horrible on calls th<strong>at</strong> are not<br />

w<strong>at</strong>erproof.<br />

A little tender loving care for your turkey calls will up your odds of fooling<br />

th<strong>at</strong> big ‘ol gobby into shotgun range! Plus it will make me feel better<br />

knowing there are far more quality sounding calls out there this spring.<br />

NATIONAL NIGHT OUT<br />

• Sheriff Shipley, Deputy Hinnah<br />

and Deputy Stein left the Keokuk<br />

County SO and proceeded to Krier’s<br />

residence loc<strong>at</strong>ed <strong>at</strong> 18327 249th St.<br />

in rural Sigourney.<br />

• Sheriff Shipley and Deputy<br />

Hinnah departed the SO in Sheriff<br />

Shipley’s white F-150. Deputy<br />

Hinnah was driving. Sgt. Stein<br />

followed in his Ford Explorer.<br />

• Sheriff Shipley continued<br />

<strong>at</strong>tempts to make contact with Krier<br />

on their way to Krier’s residence.<br />

Krier did not answer.<br />

• At approx. 11:32 a.m., Sheriff<br />

Shipley placed a call to Krier as<br />

they drove up the lane to the Krier<br />

residence.<br />

• Upon arrival <strong>at</strong> the Krier<br />

residence, Sheriff Shipley exited<br />

his vehicle and approached the<br />

residence.<br />

• Sheriff Shipley announced to<br />

Krier he was here and would like<br />

to speak with Krier. Krier did not<br />

reply. Sheriff Shipley <strong>at</strong>tempted this<br />

a few times and then returned to the<br />

pickup.<br />

• Sgt. Stein then got on the PA<br />

and requested Krier come out. Krier<br />

still did not respond.<br />

• Officers observed a blue vehicle<br />

with rusty cans in the back, which<br />

appeared to m<strong>at</strong>ch the incident<br />

from Sunday night <strong>at</strong> the Steinhart<br />

residence.<br />

• Officers discussed if anyone<br />

can see Krier. Sgt. Stein advised he<br />

saw Krier in the window. Seconds<br />

l<strong>at</strong>er, Sgt. Stein advised Krier had a<br />

gun.<br />

• Officers took cover in their<br />

vehicles, <strong>at</strong> which time Krier began<br />

to fire <strong>at</strong> the officers and disabled<br />

their vehicles.<br />

It was neighborly affection and<br />

civic duty which led Sheriff Shipley,<br />

Chief Deputy Hinnah and Sgt. Stein<br />

to the home of Krier on the morning<br />

of the fourth. The situ<strong>at</strong>ion quickly<br />

turned into a clear m<strong>at</strong>ter of integrity<br />

in a job well done as the three officers<br />

found themselves in the midst of<br />

dangerous gunfire. They relied upon<br />

Sgt. Stein’s tactical experience and<br />

leadership, according to Sheriff<br />

Shipley’s st<strong>at</strong>ement <strong>at</strong> Monday’s<br />

press conference, to reevalu<strong>at</strong>e the<br />

situ<strong>at</strong>ion.<br />

The day didn’t end well for the<br />

entire community of Keokuk County<br />

as a truly humble hero, Sgt. Eric Stein<br />

was lost during this stand-off with<br />

Krier. The Iowa St<strong>at</strong>e P<strong>at</strong>rol Tactical<br />

Teams also had to use deadly force<br />

to completely resolve the situ<strong>at</strong>ion<br />

and Krier died of injuries suffered<br />

during the gunfire.<br />

The integrity of the entire<br />

situ<strong>at</strong>ion required a certain level<br />

of objectivity, which Keokuk Co.<br />

Attorney John Schröeder felt some<br />

may view as a conflict of interest<br />

and he contacted the Iowa Attorney<br />

General’s Office to investig<strong>at</strong>e the<br />

use of deadly force.<br />

In a st<strong>at</strong>ement release <strong>at</strong><br />

Monday’s press conference, the<br />

Attorney General’s Office said:<br />

Schröeder, citing a potential conflict<br />

of interest, requested the Iowa<br />

Attorney General’s Office investig<strong>at</strong>e<br />

the Iowa St<strong>at</strong>e P<strong>at</strong>rol’s use of<br />

deadly force on April 4, 2011, when<br />

members of the tactical until shot<br />

and killed Jeffrey Krier near his<br />

residence in rural Keokuk County.<br />

According to the Deputy<br />

Attorney General Thomas H.<br />

Miller, from the press conference on<br />

Monday afternoon, the sole purpose<br />

of the review was to determine if the<br />

use of deadly force by the involved<br />

officers was legally justified. This<br />

decision was based upon the review<br />

of five separ<strong>at</strong>e variables:<br />

1. Relevant background inform<strong>at</strong>ion<br />

on Jeffrey Krier including<br />

his previous recent encounters with<br />

local law enforcement, his criminal<br />

and mental health histories.<br />

2. Inform<strong>at</strong>ion rel<strong>at</strong>ing to the season<br />

law enforcement contact Krier<br />

on Monday, April 4. This inform<strong>at</strong>ion<br />

indic<strong>at</strong>ed Krier was a suspect<br />

in several recent events, including<br />

a local shooting, a possible burglary<br />

and thre<strong>at</strong>s toward personnel <strong>at</strong> the<br />

local hospital.<br />

3. Inform<strong>at</strong>ion detailing the contact<br />

and Sgt. Eric Stein had with Krier on<br />

Monday <strong>at</strong> his residence loc<strong>at</strong>ed <strong>at</strong><br />

County.<br />

4. Inform<strong>at</strong>ion from the Iowa<br />

St<strong>at</strong>e P<strong>at</strong>rol tactical Unit detailing<br />

their involvement including the rules<br />

of engagement in use on Monday<br />

and the decision to use deadly force.<br />

5. A review of the entirety of the<br />

investig<strong>at</strong>ion conducted by the Iowa<br />

Division of Criminal Investig<strong>at</strong>ion<br />

into the shooting of Sgt. Eric Stein<br />

and Jeffrey Krier.<br />

Even after this horrific day and<br />

numb with pain - friends, family<br />

and complete strangers pulled<br />

together to pay respects and honor<br />

the life and lifestyle of Sgt. Eric<br />

Stein <strong>at</strong> his funeral last S<strong>at</strong>urday.<br />

“After S<strong>at</strong>urday, I am so proud to be<br />

associ<strong>at</strong>ed with these gentlemen,”<br />

Shipley said of his fellow officers<br />

from his own department, his county<br />

and across the st<strong>at</strong>e. “I’m also proud<br />

of my community, my county.”<br />

Stein’s friend and fellow officer,<br />

Chad Weber said it best when<br />

he spoke of how he could honor<br />

Stein’s memory by living life to<br />

the fullest and honorably the way<br />

Stein lived. The entire community<br />

of Keokuk County and its’ neighbors<br />

may also begin the healing process<br />

by embracing the qualities and characteristics<br />

of a small community:<br />

pride, neighborly affection, integrity<br />

and a job well done.<br />

The regular meeting of the Mahaska Masters 4-H club was held on march<br />

7 <strong>at</strong> the First Christian Church. There was no recre<strong>at</strong>ion. The meeting was<br />

called to order by President Megan Adams <strong>at</strong> 7:00. Pledge of allegiance was<br />

led by Julie Wanders. Roll call “Wh<strong>at</strong> is your favorite song or artist?” was<br />

answered by 28 members and 5 leaders. Minutes were read by vicar Alyssa<br />

Phillips. They were moved and seconded. There was no correspondence. Rachel<br />

Adams gave the treasurers report. There were no bills presented. Dana<br />

Van Renterhem talked about the YMCA preschool party which is March 11th<br />

from 1:30-3:00p.m. Logan Gross talked about the Socail Committee. Alyssa<br />

Phillips talked about the welding workshop which will be March 26th <strong>at</strong><br />

2:00 p.m.<br />

Garret Gilliland, Emily Van Donselaar and Rachel Adams talked about<br />

dog and c<strong>at</strong> tre<strong>at</strong>/ toys for animal shelter. Alyssa Phillips talked about teen<br />

council. There was no unfinished or new business. Megan Adams talked<br />

about the announcements. March 12th is a Horse Clinic <strong>at</strong> the Mahaska<br />

County Extension Office. March 19th is advanced c<strong>at</strong>tle feeder pen weighin.<br />

March 20th is a rabbit workshop <strong>at</strong> Grinnell. March 24th is a le<strong>at</strong>her<br />

workshop <strong>at</strong> the Mahaska County Extension office. April 2nd is the swine<br />

weigh-in. April 16th is the Iowa Bank Egg Hunt. April 30th is the intermedi<strong>at</strong>e<br />

trip to Chicago. The forms for the trip are due to the Mahaska County<br />

Extension office. Just a reminder to read the county newsletter. Penny Adams<br />

talked about the record book workshop which is April 11th <strong>at</strong> 6:00p.m. It<br />

was moved and seconded to adjourn the meeting. Reece Strausser led the<br />

4-H pledge.<br />

Emily Augustine of Rose Hill<br />

receives pharmacy scholarship<br />

Emily Augustine of Rose Hill, was recently named a recipient of a Walgreens<br />

Scholarship for $3000. Augustine is a fourth year student in Drake<br />

University’s professional pharmacy program.<br />

Drake is a priv<strong>at</strong>e, independent university in Des Moines, Iowa, with an<br />

enrollment of approxim<strong>at</strong>ely 3,300 full-time undergradu<strong>at</strong>e students from 45<br />

st<strong>at</strong>es and 50 countries. Drake University’s mission is to provide an exceptional<br />

learning environment th<strong>at</strong> prepares students for meaningful personal<br />

lives, professional accomplishments and responsible global citizenship. The<br />

Drake experience is distinguished by collabor<strong>at</strong>ive learning among students,<br />

Laugh Your Way to a Better Marriage<br />

Seminar Coming to the Area<br />

“Laugh Your Way to a Better Marriage” is a marriage seminar for those<br />

who h<strong>at</strong>e marriage seminars. It humorously reveals the different way men<br />

& women experience the marriage rel<strong>at</strong>ionship. Mark Gunger has a way of<br />

describing marriage th<strong>at</strong> will have the audience laughing again and again.<br />

This video series is a must see for any married couple, prospective married<br />

couple or person th<strong>at</strong> may marry in the future. In the humor he deals with the<br />

serious issues of marriage in a nonthre<strong>at</strong>ening way. Whether your marriage<br />

is ‘on the rocks’, healthy or you are not married there is plenty to glean from<br />

this seminar. This video starts 7PM this Thursday, April 14 <strong>at</strong> Hilltop Chapel<br />

in Wh<strong>at</strong> Cheer and will run each Thursday evening for 4 to 8 weeks, depending<br />

on how much we cover each night. Come try the 1st session. There is<br />

To Hold Spring Game<br />

The William Penn football team will hold its annual Spring Game next S<strong>at</strong>urday,<br />

April 16 <strong>at</strong> 10 a.m. on the Penn practice field on the southwest corner<br />

of campus. In case of poor we<strong>at</strong>her, the game will be moved to the PAC. No<br />

admission is required and the game is open to the public.<br />

School life has quickly entered fourth quarter<br />

– the last one of the 2010-2011 school year.<br />

It is th<strong>at</strong> time of year when teachers look <strong>at</strong> their<br />

plans and realize just how little time is left, and<br />

how much they still want to accomplish, with the<br />

youngsters who have been entrusted to them.<br />

It is also a time for little daydreamers who<br />

want to get outside and play in the spring we<strong>at</strong>her.<br />

Lightweight jackets and bikes have been pulled<br />

out of storage and ball practice has begun. Farm<br />

kids have to leave home each morning thinking<br />

about the fieldwork and newly born livestock they<br />

will miss out on th<strong>at</strong> day. The kids also sense th<strong>at</strong><br />

their school days are winding down and begin<br />

longing for all th<strong>at</strong> summer has to offer. Attentions<br />

can be harder to keep, but <strong>at</strong> the same time<br />

some children have just reached their peak in<br />

learning potential, becoming sponges, building on<br />

all they have gained since last fall.<br />

Meanwhile, the students keep busy with their<br />

day-to-day progress in reading, writing and arithmetic.<br />

They have currently been keeping a close<br />

w<strong>at</strong>ch on the Decorah Eagle Cam, as they w<strong>at</strong>ch<br />

the mama eagle and her new h<strong>at</strong>chlings via the<br />

Internet. <strong>Students</strong> have several field trips to look<br />

forward to before their year ends. On April 28,<br />

4th-6th graders will travel to <strong>Eddyville</strong>/<strong>Blakesburg</strong><br />

High School for an afternoon performance of<br />

the play, “The Wizard of Oz”, put on by the high<br />

school students. Scheduled for May 12, is an<br />

outdoor adventure for 2nd-3rd graders <strong>at</strong> Russell<br />

Wildlife. May 19 a Des Moines trip is planned<br />

Landform Unit Sparks Cre<strong>at</strong>ivity<br />

The library <strong>at</strong> Fremont School has many interesting projects on display.<br />

These come from the second grade classroom where they have been studying<br />

about landforms.<br />

As a class, they learned about the characteristics of the many different<br />

types of landforms th<strong>at</strong> cover the earth. Following is a list of landforms<br />

and well-known examples of them th<strong>at</strong> the children were given: Bay (San<br />

Francisco Bay), Canyon (The Grand Canyon), Cliff (Gray Cliff in Yosemite<br />

N<strong>at</strong>ional Park), Coast (The Ivory Coast), Desert (The Sahara Desert), Forest<br />

(Olympic N<strong>at</strong>ional Forest), Gulf (The Gulf of Mexico), Hill (The Black<br />

Hills), Island (The Hawaiian Islands), Lake (Lake Superior), Mountain (The<br />

Himalayan Mountains), Ocean (Atlantic Ocean), Plains (The Gre<strong>at</strong> Plains<br />

of the Central United St<strong>at</strong>es of America), Prairie (The Bad Lands of South<br />

Dakota), Reef (Gre<strong>at</strong> Barrier Reef<br />

near Australia), River (The Mississippi<br />

River), Swamp (The Florida<br />

for preschoolers-2nd grade as they visit the Blank<br />

Park Zoo, and another Des Moines excursion will<br />

take place on May 26 when 3rd-6th graders travel<br />

to Living History Farms.<br />

Kindergarteners have been anxiously awaiting<br />

the return of their teacher, Mrs. Glick, which is<br />

scheduled for this week. Mrs. Glick just became<br />

a mommy for the second time, as her little boy just<br />

became the proud big brother of a baby sister. She<br />

has been gone awhile, but will have many exciting<br />

things to share with her class of curious little<br />

people.<br />

First graders, and their teacher Mrs. McDanel,<br />

just got an up close look of the beauty of spring.<br />

Ephraim Van Zante had a gre<strong>at</strong> show ‘n tell when<br />

his mom brought baby chicks to the classroom. It<br />

seems the Van Zante family placed an order and<br />

then got a call from the post office. At the post<br />

office waiting for them, was a noisy box with air<br />

holes marked “FRAGILE”.<br />

Second graders are working on writing their<br />

own poetry. They have plans for a “Poetry Café”<br />

for May 6. Ms. Depenning, their teacher, looks<br />

forward to an entertaining event.<br />

Third graders just got an order in too. Mrs.<br />

Hammes just received her annual purchase of<br />

crayfish. They have a cre<strong>at</strong>ed a home for them,<br />

complete with little shelters for these shy, but<br />

fierce critters to hide in. As they study the life<br />

cycles of these crayfish for the remainder of the<br />

school year, third graders will hopefully get to see<br />

them molt, learn to label all their parts and be able<br />

to identify whether they are male or female. Each<br />

crayfish will also get a name.<br />

As students worked on their assignments<br />

they had to do research,<br />

as well as be cre<strong>at</strong>ive. After determining<br />

wh<strong>at</strong> type of landform they<br />

would study about, they had to find<br />

<strong>at</strong> least five interesting facts about<br />

them to report on. The second part<br />

of this project included a way to<br />

show wh<strong>at</strong> they had learned about –<br />

suggestions of ways to do this were<br />

making a model from clay, cre<strong>at</strong>ing<br />

a poster, game or brochure. Pictures<br />

of these projects were fe<strong>at</strong>ured in<br />

last week’s Village Vine -- imagin<strong>at</strong>ions<br />

were used as each child made<br />

the project their own. Their teacher<br />

is Ms. DePenning.<br />

Fremont Elementary Tidbits: Fourth Quarter Full of Adventures<br />

Fourth graders are working hard on fractions<br />

as their intensive year of m<strong>at</strong>h continues – much<br />

ground is gained in this subject area in fourth<br />

grade, and both student and teacher put in lots of<br />

hard work. Mrs. Goldman also reports th<strong>at</strong> they<br />

have begun reading the first book in the Series of<br />

Unfortun<strong>at</strong>e Events, “The Bad Beginning”; she<br />

says it seems th<strong>at</strong> Count Olaf has visited their<br />

room, as there are “eyes” placed everywhere,<br />

which seem to be w<strong>at</strong>ching them.<br />

Fifth graders are in the midst of their study of<br />

Iowa history – a favorite of many during their fifth<br />

grade year. In conjunction with this, Mr. Miller<br />

has students write tall tales which he has them tie<br />

into Iowa agriculture. From these tales, one or<br />

two will be selected for an upcoming puppet show<br />

production.<br />

Sixth grade students, of Mrs. Lane, have recently<br />

been selected to <strong>at</strong>tend the regional m<strong>at</strong>h<br />

bee – students <strong>at</strong>tending are Austin Kennedy,<br />

Brandon Dicks, Logan Pl<strong>at</strong>e and Ricardo Garcia.<br />

Sixth grade students are looking forward to their<br />

upcoming speaking parts in the play entitled “Music<br />

Class”, th<strong>at</strong> they will be performing during the<br />

May music concert. It is a play about new students<br />

who come to school and have never had music<br />

class before. Plan to <strong>at</strong>tend the spring concert<br />

on May 17 to w<strong>at</strong>ch these young actors/actresses.<br />

To help the school, remember to keep saving<br />

the Boxtops for Educ<strong>at</strong>ion, Labels for Educ<strong>at</strong>ion,<br />

pop tabs, and used-up computer ink cartridges.<br />

All of these items can be turned into the school<br />

for a good cause.<br />

Molly Walker developed a brightly colorful world with her diorama of a<br />

reef. The different dimensions really make it pop with life.<br />

This very unique landform project comes form Allison Blad. Using<br />

a large turtle shell, she has cre<strong>at</strong>ed a swamp which even includes a<br />

toothpick bridge. Alot of time and hard work went into this one.<br />

to IHCC Honor Roll<br />

Indian Hills Community College has released the names of the students<br />

who were on the college’s academic Honor Roll for the Winter Term of the<br />

2010-11 year. To be included on the Honor Roll, a student must be enrolled<br />

fulltime and have a grade point average from 3.5 to 4.0 for the term.<br />
