Iowa Code Sections
In order to be justified, the force used by the Iowa State Patrol officers must
have been reasonable. Reasonable force is that force which a reasonable
person, in like circumstances, would judge to be necessary to prevent an
injury or loss and can include deadly force if 1) it is reasonable to believe
that such force is necessary to avoid injury or risk to one’s life or safety or
the life or safety of another; (2) it is reasonable to believe that such force is
necessary to resist a like force or threat; (3) if an available alternative course
of action entails a risk to life or safety or the life or safety of a third party; or
4) the alternative course of action requires one to retreat from one’s dwelling
or place of business. Iowa Code Sections 704.1, 704.2 and 704.3 and State
Joanne Roquet retired February 28th from her position of Rural Route
One carrier in Hedrick.
Joanne began with the postal service in 1982 as a substitute on the same
Shooting Ruled Justified as County Mourns Loss of Sergeant
The official facts and details
in the fatal stand-off on Monday,
April 4, between law enforcement
officials and suspect Jeffrey Krier,
which ended in the death of Sergeant
Eric Stein and Krier, were released
during a press conference held at
the Keokuk County Courthouse on
Monday, April 11.
These details have been
reviewed, torn a part and dissected by
most, if not all, of the media outlets
across Iowa since then, but what
some of these larger agencies miss
in their haste to get the ‘big story’
is the pride and neighborly affection
found in a small communities such
as Keokuk County.
This is a community grieving,
but it is also a community who
values its integrity and takes pride in
a job well done. The Iowa Attorney
General’s Office determined, based
upon the facts and their review of
the case with the DCI (Division
of Criminal Investigation) and the
circumstances surrounding the death
of Sgt. Eric Stein as well as the
actions of the Iowa State Patrol, the
officers engaging Jeffrey Krier were
fully justified under the laws of the
State of Iowa in using deadly force.
The death of Jeffrey Krier
is determined to be a justifiable
homicide and the Iowa Attorney
General’s Office considers this
matter closed.
“Each officer involved acted
professionally and did not deviate
from training or established
protocols,” stated the Attorney
General’s Office in a statement
released at the conference on
Monday. “The rules of engagement,
as established by command staff,
were strictly adhered to. The officers
on scene were confronted with deadly
force being used against them by
Krier. All had the information Krier
had killed an officer earlier in the
day. All were aware if Krier escaped
the immediate area surrounding the
residence other lives would be in
jeopardy.”
“Casey (Hinnah) and
Eric (Stein) were
nothing short of heroic
that day.”
These sentiments were echoed
in the emotional statement given by
Keokuk County Sheriff Jeff Shipley
at the beginning of Monday’s press
conference, “We, Chief Deputy
Casey Hinnah, Sergeant Eric Stein
and myself, collectively made the
decision to not let help (other law
enforcement officers and tactical
units) any closer because we feared
for their safety.” He added, “Casey
(Hinnah) and Eric (Stein) were
nothing short of heroic that day. They
knew the decision could cost them
everything or they could perish; but
that is the type of people we have in
law enforcement in Keokuk County.
They think more of others than they
do of themselves.
Sgt. Eric Stein
• Proudly Serving the Keokuk
County Sheriff’s Office since
2000.
• Promoted to Sgt. in 2005
Shipley spoke of how
neighboring counties dropped
what they were doing and brought
everything they had to come to
the aid of a fellow officer, “I am
extremely proud to be associated
with each and every one of these
gentlemen. We suffered a tragic,
tragic loss with the loss of Sergeant
Eric Stein. He was my friend. We
are all friends.” Shipley also offered
support and encouragement to each
of the responding officers by telling
them, “We had so much help and
support out there.” He wanted them
to know they did all they could and
everything was done right.
It was this pride, sense of duty
and integrity which caused Sheriff
Shipley and Keokuk County
Attorney John Schröeder to share
the details leading up to the fateful
day of Monday, April 4 with the
media. The Attorney General’s
Office stated, “The action of each
officer was objectively reasonable
under the circumstances.”
The following is the detail
account of communication attempts
between the Keokuk County
Sheriff’s Department and Jeffrey
Krier until the first shot was fired on
related to the incident, were found in
the yard.
•Deputy Runnells also
discovered blue paint transfer on the
damaged garage door.
•The Krier residence is
• Sheriff Shipley, Chief Deputy
Hinnah and Sgt. Eric Stein discussed
the events of the weekend and were
Tales of the Ancient Sportsman
What a devastating and sad week. The senseless
killing of deputy Eric Stein has covered the area with
a heavy gloom. Once again we are made aware that the
handling of the mentally ill falls far short of good sense.
The idea of not doing anything until they do something
bizarre is totally wrong.
I was in Kansas City Monday, Tuesday and Wednesday
for the Missouri Travel Exchange and arrived home
to hear of this terrible tragedy. I just feel and ache for the
members of both families.
The meeting in KC was a good one and it was held
in the Holiday Inn across from the sports complex. From
my sixth floor room I could look into Kaufman Stadium.
The Royals were playing the White Sox and the stadium
appeared to be nearly empty. The Royals are definitely
a small market team and I do not see that changing. The
days of George Brett are far in the rear view mirror.
My Cardinals have started with a thud. Right now
they are terrible and if this continues, it is going to be a
very long summer. To show how bad we are, we are even
behind the Flubs.
The time in KC was well spent as we were given a
tour of the city and taken to some of the finer places. Of
course, you can’t be in KC and not be fed a KC Strip
steak. Most of the other food was Italian, which is not
my favorite food. We were limited in what we could see
in a morning tour, but we did visit the sunken steamboat
Arabia, the WWI museum and Crown Center. I would
have liked to visit the Negro Baseball Hall of Fame, but
it was not on the itinerary.
I was able to meet with several new Missouri attractions
and discovered some interesting things. It was also
a good time of visiting and sharing ideas with old friends
and others in the travel business.
Wednesday was a big day for the Ancient-ess. She
had one of those big birthdays with an ugly zero at the
end. I got back from KC in time to console her with supper
at Taso’s. She found what she wanted for her birthday
at the Thomas Kincade store in Savannah. It is a
beautiful painting of a castle that she wants to put in
her redecorated bedroom. The $1800 price tag led me
to believe that the bedroom has been decorated enough
already.
Thursday and Friday were spent trying to get our income
tax finished. What a farce! Each year I vow to get
things in order early and each year we are still pushing
the deadline. A flat tax would be so much more efficient
and profitable for all.
Saturday we made a trip to Cedar Falls to visit family.
The Ancient-ess has a cousin who was back from California,
another cousin that lives in Cedar Falls and an
aunt who is in a
We all gathered
for lunch at
the Village Inn
and while there,
I was surprised
to see Don Lee
walk in the door with his son A. J., who is a student at
UNI. Don is a graduate of Osky High and has served
as a missionary all over the world. He and his family
have served in the Philippines, Russia and most recently,
India. Don’s support level has dropped to the point that
they will not be able to go back to India. They will be
starting a new ministry in Memphis, TN.
On the way home I decided to do a little trip scouting
and took the blacktop west of Hudson to the Hansen
Dairy. This is a unique dairy farm and they process their
own milk and cream products as well as cheese, butter
and ice cream. After the tour by Mrs. Hansen we were
able to make our own butter and sample the ice cream.
I must say that their hard freeze raspberry is right there
with the Frosty Udder soft freeze. It was mighty good.
There was a couple from Cedar Falls along with their
three boys and a set of grandparents that joined us for the
tour. I would guess the boys to be ages seven, five and
three. They were wide eyed during the milking and then
Mrs. Hansen gave them each a large bottle of milk to
bottle feed the calves. That really turned them on.
The Hansen’s have a retail store in Waterloo called
the Moo-Roo Dairy. The name stems from the five kangaroos
that live at the farm. There are three adults and
two babies. The babies were very comfortable in their
mother’s pouch and would peek out to see what was going
on. If a noise distracted them, they quickly ducked
back inside and you would not see them for a while.
I had hoped to get some sports coverage in, but it
will not happen for a while. I will spend the most of this
week at Mercy Hospital in Des Moines. I have to take a
high powered medication Monday morning and then be
observed for three and one half days, before a defibulator
is installed on Thursday. Hopefully that will get me
going at full speed again.
I did notice that the North Mahaska girls track team
won the PCM meet and that Eddyville-Blakesburg’s
Sam Taylor has turned in an outstanding time in the high
hurdles.
Let’s see what happened in our yesterdays.
Blast from the Past
A Snapshot from Fremont’s History
by Keith Dinsmore
The four sons of the late Howard and Ruth Cummings of Cedar are pictured in 1954 in their baseball
uniforms on the Cummings farm where they were raised just north of Cedar. Bill stands behind Dick while
Chuck is on the left and Don is on the right. They recently published a book about their formative years
entitled “The Cummings Boys of Cedar, Iowa.”
The Cummings Boys of Cedar, Iowa
Growing up in the Cedar community in the 1950’s
is the theme of a 134-page book of memoirs by the four
sons of the late Howard and Ruth Cummings, who lived
in the first house north of the old Cedar Elevator. They
describe how the community was self-sufficient with a
post office, school, grocery store, lumber yard, grain elevator,
café, auto repair shop, and two gas stations along
with two churches.
“The character of a community is determined by its
citizens,” they write, and “Cedar had many prominent
families with long-time ties to the area. The McBurneys,
the Randells, the Moores, the Wards, the Beavers, the
Fergusons, the Barnards, the Browns, the Hardgroves,
the Krusemark and the Veldhuizens are but a few of the
names that shaped the quality of life in Cedar.”
They point out that, without any formal local government
as an unincorporated village, “These citizens
helped make the community what it was – a place where
crime, unemployment, welfare, homelessness and poverty
did not exist.” The authors emphasized that people
looked out for each other in the community. “If someone
had health issues, the work was covered by neighbors
until they were back on their feet. You just couldn’t hide
from reality and responsibility in a community the size
of Cedar.”
The character of the Cedar community shines
through in the chapter of the book that describes the “car
wreck that changed everything” on Mar. 15, 1955. Their
dad was driving their mother to a doctor’s appointment
in Fremont that morning when a collision occurred on
Highway 63 three miles east of Cedar that injured their
father and killed their mother. At the time, the Cummings
boys ranged in age from 15 to 7 years.
“If ever it took a village to raise a child, we were
that example times four,” they write in their book. As
deeply distressed young boys without a mom, confused
and wary of the future, they returned to school after two
weeks. “Relatives and neighbors took turns looking after
us,” they write. “The support and help was unbelievable.”
Deadline for all ads and
submissions to the VV is
Friday at 2:00 pm. Please
have everything there before
2:00 pm.
Since their dad was still recovering from the accident,
they describe how neighboring farmers scheduled
a day that spring when 50 tractors showed up to plow the
fields, clean the farm buildings and fix the fences – all
in one day. Meanwhile, their wives spent the day in the
Cummings house cleaning everything and cooking up a
storm. “We had a freezer and refrigerator full of pies and
cakes and food enough to eat for weeks (or months),”
they write. “It was an expression of love and support
unlike anything we have ever since witnessed.” They
also pay tribute to the loving care given by their Grandmother
Masterson and two aunts, Vera and June, who
often scheduled their days to assure that the Cummings
boys were well cared for.
Chapters on farm life, the Cedar school, pets and hobbies,
the two churches (“the Methodist and the Dutch”),
and their evolution “from singers to athletes” complete
the narrative of their coming of age in the 1950s. While
noting the changes over the past 50 years with the decline
of smaller communities, they write: “We are so
happy that we had the opportunity to grow up during a
time and in a place where people looked after people and
everyone was expected to succeed. It was a wonderful
experience that we will never forget.”
Appendices to the book include biographical material
about both Howard and Ruth Cummings, genealogical
data and information about Don’s service in Vietnam.
In the preface, Dick Cummings expresses the hope that
this collaborative effort will inspire others to record their
memoirs for the enjoyment of family members and others.
Their book is a loving tribute to their parents and to
the big-hearted community that helped to raise the Cummings
boys of Cedar, Iowa.
Plans are being made for a run
of garage sales reaching along High-
way 78 from the Hedrick Pioneer
Plant to the City of Brighton the first
weekend of June. Just think how
many shoppers there are when we
pull together on the same day!
A key person in each town is
signing up those who want their lo-
cation on a map to guide the buyers
in each area. The ad for this garage
sale will go to 2000 recipients of the
Town Crier at no cost to the sellers.
This beats happenstance efforts and
personal ads attracting a few shop-
pers.
Almost anything goes: fresh
veggies, crafts, plants, baked goods,
maybe even pop or water. Now is the
time to be boxing up the items you
want to sell, price them and be ready
for the big event June 3 and 4.
Details are finalized soon! Key
people are needed in each area.
Reconditioned
I am a self-proclaimed turkey call guru. If you ask my wife how many
calls I have, she will just roll her eyes. It’s not like I chase her around the
house running three or four calls at a time hoping to get her attention… Ok,
maybe I do run calls in the house often, but only during this time of year.
Actually, in anticipation of the upcoming season I like to pop in my favorite
turk DVD and pretend I am calling in my first gobbler of the year! Again, my
wife questions my sanity...
I love turkey calls almost as much as I do hunting them. I have been collecting
them for years and appreciate how each and every call is different and
takes the right maneuver to get the best sound out of it. Between what I have
purchased and built myself, I have accumulated a little over 100 calls. With
a pretty even mix of friction pots, box calls, and mouth calls, glass and slate
friction calls are by far my favorite.
Through the years of being a call junkie I have learned that to maintain
the sounds they are supposed to make requires a little maintenance. Its
simple, but far too many hunters struggle with adequate calling and usually
just give up and buy a new one. A piece of sand paper and a couple seconds
will have your call running like new again.
Box calls need chalk and a little brushing with sandpaper at times, but
don’t over do it. When a box call begins to slide across the sidewalls without
making much noise, or the sound is real scratchy, chances are good you need
to put a coat of chalk on it. About twice a season depending on how much I
use it, or if the call gets wet, I will recondition the paddle and sidewalls with
a piece of 120 grit sandpaper. I suggest sanding with the grain of the wood
to produce the best results.
A quarter turn either way on the screw that holds the paddle to the box
will help redial in the perfect sound. That screw rarely needs adjusted, but if
you feel the sound has been lost, a quarter turn in will heighten the pitch, and
a quarter turn out will lower it. Experiment with this until you have what you
feel is right. Less is more.
Friction calls typically need resurfacing once a day. You can use larger
grit sandpaper for glass calls, but a “brillo” pad will totally suffice for slate.
Run the sandpaper or pad across the call, back and forth in one direction, not
in circles. Do this until the surface is consistent any smudges or marks are
gone. I suggest leaving the remaining dust on the surface of the call, as it will
give you more control with the striker when calling.
The striker is the next thing that needs reconditioned. Take the striker
between your thumb and forefinger and spin it while brushing the tip of it
with the sand paper in a downward motion at a 45-degree angle. Once the
striker and pot are finished, give it a try and make sure you have attained the
desired sound.
I prefer to resurface my pots at each hunt; it allows me to stay in control
of the sound I am producing. Also avoid touching the friction areas on both
box and slate calls with your fingers, as the oils in your skin will deaden the
calls quicker than anything. Moisture is also horrible on calls that are not
waterproof.
A little tender loving care for your turkey calls will up your odds of fooling
that big ‘ol gobby into shotgun range! Plus it will make me feel better
knowing there are far more quality sounding calls out there this spring.
Good luck and don’t hesitate to contact me with any questions!
Krier did not answer.
• At approx. 11:32 a.m., Sheriff
Shipley placed a call to Krier as
they drove up the lane to the Krier
• Upon arrival at the Krier
residence, Sheriff Shipley exited
his vehicle and approached the
• Sheriff Shipley announced to
Krier he was here and would like
to speak with Krier. Krier did not
reply. Sheriff Shipley attempted this
a few times and then returned to the
• Officers observed a blue vehicle
with rusty cans in the back, which
appeared to match the incident
from Sunday night at the Steinhart
residence.
• Officers discussed if anyone
can see Krier. Sgt. Stein advised he
saw Krier in the window. Seconds
later, Sgt. Stein advised Krier had a
gun.
• Officers took cover in their
vehicles, at which time Krier began
to fire at the officers and disabled
their vehicles.
It was neighborly affection and
civic duty which led Sheriff Shipley,
Chief Deputy Hinnah and Sgt. Stein
to the home of Krier on the morning
of the fourth. The situation quickly
turned into a clear matter of integrity
in a job well done as the three officers
found themselves in the midst of
dangerous gunfire. They relied upon
Sgt. Stein’s tactical experience and
leadership, according to Sheriff
Shipley’s statement at Monday’s
press conference, to reevaluate the
situation.
The day didn’t end well for the
entire community of Keokuk County
as a truly humble hero, Sgt. Eric Stein
was lost during this stand-off with
Krier. The Iowa State Patrol Tactical
Teams also had to use deadly force
to completely resolve the situation
and Krier died of injuries suffered
during the gunfire.
The integrity of the entire
situation required a certain level
of objectivity, which Keokuk Co.
Attorney John Schröeder felt some
may view as a conflict of interest
and he contacted the Iowa Attorney
General’s Office to investigate the
use of deadly force.
In a statement release at
Monday’s press conference, the
Attorney General’s Office said:
Keokuk Co. Attorney, John
Schröeder, citing a potential conflict
of interest, requested the Iowa
Attorney General’s Office investigate
the Iowa State Patrol’s use of
deadly force on April 4, 2011, when
members of the tactical until shot
and killed Jeffrey Krier near his
residence in rural Keokuk County.
According to the Deputy
Attorney General Thomas H.
Miller, from the press conference on
Monday afternoon, the sole purpose
of the review was to determine if the
use of deadly force by the involved
officers was legally justified. This
decision was based upon the review
of five separate variables:
1. Relevant background information
on Jeffrey Krier including
his previous recent encounters with
local law enforcement, his criminal
and mental health histories.
2. Information relating to the season
law enforcement contact Krier
on Monday, April 4. This information
indicated Krier was a suspect
in several recent events, including
a local shooting, a possible burglary
and threats toward personnel at the
local hospital.
3. Information detailing the contact
Keokuk County Sheriff Jeff
Shipley, Chief Deputy Casey Hinnah
and Sgt. Eric Stein had with Krier on
Monday at his residence located at
18327 249th Street in rural Keokuk
County.
4. Information from the Iowa
State Patrol tactical Unit detailing
their involvement including the rules
of engagement in use on Monday
and the decision to use deadly force.
5. A review of the entirety of the
investigation conducted by the Iowa
Division of Criminal Investigation
into the shooting of Sgt. Eric Stein
and Jeffrey Krier.
Even after this horrific day and
numb with pain - friends, family
and complete strangers pulled
together to pay respects and honor
the life and lifestyle of Sgt. Eric
Stein at his funeral last Saturday.
“After Saturday, I am so proud to be
associated with these gentlemen,”
Shipley said of his fellow officers
from his own department, his county
and across the state. “I’m also proud
of my community, my county.”
Stein’s friend and fellow officer,
Chad Weber said it best when
he spoke of how he could honor
Stein’s memory by living life to
the fullest and honorably the way
Stein lived. The entire community
of Keokuk County and its’ neighbors
may also begin the healing process
by embracing the qualities and characteristics
of a small community:
pride, neighborly affection, integrity
and a job well done.
By Kathy Street, Fremont School Correspondent
School life has quickly entered fourth quarter
– the last one of the 2010-2011 school year.
It is that time of year when teachers look at their
plans and realize just how little time is left, and
how much they still want to accomplish, with the
youngsters who have been entrusted to them.
It is also a time for little daydreamers who
want to get outside and play in the spring weather.
Lightweight jackets and bikes have been pulled
out of storage and ball practice has begun. Farm
kids have to leave home each morning thinking
about the fieldwork and newly born livestock they
will miss out on that day. The kids also sense that
their school days are winding down and begin
longing for all that summer has to offer. Attentions
can be harder to keep, but at the same time
some children have just reached their peak in
learning potential, becoming sponges, building on
all they have gained since last fall.
Meanwhile, the students keep busy with their
day-to-day progress in reading, writing and arithmetic.
They have currently been keeping a close
watch on the Decorah Eagle Cam, as they watch
the mama eagle and her new hatchlings via the
Internet. Students have several field trips to look
forward to before their year ends. On April 28,
4th-6th graders will travel to Eddyville/Blakesburg
High School for an afternoon performance of
the play, “The Wizard of Oz”, put on by the high
school students. Scheduled for May 12, is an
outdoor adventure for 2nd-3rd graders at Russell
Wildlife. May 19 a Des Moines trip is planned
Landform Unit Sparks Creativity
The library at Fremont School has many interesting projects on display.
These come from the second grade classroom where they have been studying
about landforms.
As a class, they learned about the characteristics of the many different
types of landforms that cover the earth. Following is a list of landforms
and well-known examples of them that the children were given: Bay (San
Francisco Bay), Canyon (The Grand Canyon), Cliff (Gray Cliff in Yosemite
National Park), Coast (The Ivory Coast), Desert (The Sahara Desert), Forest
(Olympic National Forest), Gulf (The Gulf of Mexico), Hill (The Black
Hills), Island (The Hawaiian Islands), Lake (Lake Superior), Mountain (The
Himalayan Mountains), Ocean (Atlantic Ocean), Plains (The Great Plains
of the Central United States of America), Prairie (The Bad Lands of South
Dakota), Reef (Great Barrier Reef
near Australia), River (The Mississippi
River), Swamp (The Florida
for preschoolers-2nd grade as they visit the Blank
Park Zoo, and another Des Moines excursion will
take place on May 26 when 3rd-6th graders travel
to Living History Farms.
Kindergarteners have been anxiously awaiting
the return of their teacher, Mrs. Glick, which is
scheduled for this week. Mrs. Glick just became
a mommy for the second time, as her little boy just
became the proud big brother of a baby sister. She
has been gone awhile, but will have many exciting
things to share with her class of curious little
people.
First graders, and their teacher Mrs. McDanel,
just got an up close look of the beauty of spring.
Ephraim Van Zante had a great show ‘n tell when
his mom brought baby chicks to the classroom. It
seems the Van Zante family placed an order and
then got a call from the post office. At the post
office waiting for them, was a noisy box with air
holes marked “FRAGILE”.
Second graders are working on writing their
own poetry. They have plans for a “Poetry Café”
for May 6. Ms. Depenning, their teacher, looks
forward to an entertaining event.
Third graders just got an order in too. Mrs.
Hammes just received her annual purchase of
crayfish. They have a created a home for them,
complete with little shelters for these shy, but
fierce critters to hide in. As they study the life
cycles of these crayfish for the remainder of the
school year, third graders will hopefully get to see
them molt, learn to label all their parts and be able
to identify whether they are male or female. Each
crayfish will also get a name.
Everglades), Valley (Death Valley),
Volcano (Mt. St. Helen in Washington),
and Waterfall (Niagara Falls).
As students worked on their assignments
they had to do research,
as well as be creative. After determining
what type of landform they
would study about, they had to find
at least five interesting facts about
them to report on. The second part
of this project included a way to
show what they had learned about –
suggestions of ways to do this were
making a model from clay, creating
a poster, game or brochure. Pictures
of these projects were featured in
last week’s Village Vine -- imaginations
were used as each child made
the project their own. Their teacher
is Ms. DePenning.
Fremont Elementary Tidbits: Fourth Quarter Full of Adventures
Fourth graders are working hard on fractions
as their intensive year of math continues – much
ground is gained in this subject area in fourth
grade, and both student and teacher put in lots of
hard work. Mrs. Goldman also reports that they
have begun reading the first book in the Series of
Unfortunate Events, “The Bad Beginning”; she
says it seems that Count Olaf has visited their
room, as there are “eyes” placed everywhere,
which seem to be watching them.
Fifth graders are in the midst of their study of
Iowa history – a favorite of many during their fifth
grade year. In conjunction with this, Mr. Miller
has students write tall tales which he has them tie
into Iowa agriculture. From these tales, one or
two will be selected for an upcoming puppet show
production.
Sixth grade students, of Mrs. Lane, have recently
been selected to attend the regional math
bee – students attending are Austin Kennedy,
Brandon Dicks, Logan Plate and Ricardo Garcia.
Sixth grade students are looking forward to their
upcoming speaking parts in the play entitled “Music
Class”, that they will be performing during the
May music concert. It is a play about new students
who come to school and have never had music
class before. Plan to attend the spring concert
on May 17 to watch these young actors/actresses.
To help the school, remember to keep saving
the Boxtops for Education, Labels for Education,
pop tabs, and used-up computer ink cartridges.
All of these items can be turned into the school
for a good cause.
Molly Walker developed a brightly colorful world with her diorama of a
reef. The different dimensions really make it pop with life.
This very unique landform project comes form Allison Blad. Using
a large turtle shell, she has created a swamp which even includes a
toothpick bridge. Alot of time and hard work went into this one.
