answer from <strong>air</strong>l<strong>in</strong>es concern<strong>in</strong>g <strong>the</strong>ir claim. The<br />

DGAC, as <strong>ADR</strong>, does not propose dispute solutions<br />

or confirm <strong>the</strong> proper application of <strong>the</strong> Regulation.<br />

For consumers, <strong>the</strong> dist<strong>in</strong>ction between <strong>the</strong><br />

different roles of <strong>the</strong> DGAC is not always clear: when<br />

contact<strong>in</strong>g <strong>the</strong> DGAC, consumers always hope to<br />

get an <strong>in</strong>dividual enforcement of <strong>the</strong>ir claim and do<br />

not understand <strong>the</strong> answers <strong>the</strong>y receive, which are<br />

based on an amicable <strong>in</strong>tervention.<br />

F<strong>in</strong>land is quite an exception <strong>in</strong> <strong>the</strong> <strong>ADR</strong> landscape.<br />

It is <strong>the</strong> only country <strong>in</strong> which <strong>the</strong>re is a general <strong>ADR</strong><br />

competent for APR but which is also designated as<br />

a NEB.<br />

The tasks of <strong>the</strong> NEB <strong>in</strong> F<strong>in</strong>land are divided between<br />

3 stakeholders:<br />

• Consumer Agency<br />

The Consumer Agency supervises compliance<br />

with consumer protection legislation and<br />

consumer <strong>rights</strong> <strong>in</strong> general. The Consumer<br />

Agency supervises, among o<strong>the</strong>r th<strong>in</strong>gs,<br />

<strong>the</strong> market<strong>in</strong>g and contract terms of <strong>air</strong>l<strong>in</strong>es<br />

operat<strong>in</strong>g <strong>in</strong> F<strong>in</strong>land. The Agency does not<br />

process <strong>in</strong>dividual disputes.<br />

• Consumer Disputes Board<br />

The Board issues recommendations concern<strong>in</strong>g<br />

<strong>in</strong>dividual disputes <strong>in</strong> F<strong>in</strong>land. But <strong>the</strong> <strong>ADR</strong> does<br />

not have <strong>the</strong> possibility to sanction <strong>air</strong>l<strong>in</strong>es - that<br />

is <strong>in</strong> <strong>the</strong> hands of <strong>the</strong> Consumer Agency only<br />

and for <strong>the</strong> purposes of collective consumer<br />

protection.<br />

• F<strong>in</strong>nish Transport Safety Agency (Trafi)<br />

Trafi is responsible for supervis<strong>in</strong>g safety <strong>in</strong> <strong>air</strong><br />

transport.<br />

1.6. Traders participation <strong>in</strong> <strong>the</strong> <strong>ADR</strong><br />

procedure<br />

Participation of Traders <strong>in</strong> <strong>the</strong> <strong>ADR</strong> procedure:<br />

One of <strong>the</strong> basic pr<strong>in</strong>ciples of <strong>ADR</strong> comprises that<br />

it is based on <strong>the</strong> good will of both parties - consumers<br />

and traders - to cooperate <strong>in</strong> f<strong>in</strong>d<strong>in</strong>g an amicable<br />

solution to a dispute. The recourse to <strong>ADR</strong> is,<br />

<strong>in</strong> pr<strong>in</strong>ciple, not mandatory.<br />

In some <strong>ADR</strong> entities, however, <strong>the</strong> traders have<br />

freely submitted <strong>the</strong>mselves to <strong>the</strong> possibility of an<br />

<strong>ADR</strong> and have agreed to participate <strong>in</strong> any <strong>ADR</strong> procedure<br />

<strong>in</strong>itiated by a consumer.<br />

In six countries, respectively Denmark (Consumers<br />

Compla<strong>in</strong>ts Board), F<strong>in</strong>land, Latvia, Lithuania,<br />

Norway and Sweden, <strong>the</strong> <strong>ADR</strong>s competence to rule<br />

is not dependent on <strong>the</strong> trader’s acceptance to submit<br />

to an <strong>ADR</strong> procedure.<br />

The participation of <strong>the</strong> traders <strong>in</strong> <strong>the</strong> <strong>ADR</strong> entities<br />

seems to be closely l<strong>in</strong>ked to <strong>the</strong> orig<strong>in</strong> of<br />

<strong>the</strong> scheme, but also to its f<strong>in</strong>anc<strong>in</strong>g (see 1.3). For<br />

example, <strong>in</strong> Belgium, Iceland and Luxemburg, <strong>the</strong><br />

<strong>ADR</strong> entities were first <strong>in</strong>itiated by a private <strong>in</strong>itiative<br />

of travel agencies, not <strong>the</strong> national <strong>air</strong>l<strong>in</strong>es. Therefore,<br />

only <strong>the</strong> travel agencies or tour operators<br />

have agreed to participate <strong>in</strong> <strong>the</strong>se schemes, which<br />

are also partially f<strong>in</strong>anced by <strong>the</strong>se traders.<br />

In <strong>the</strong> case of Alitalia’s Conciliation Board as <strong>the</strong><br />

<strong>ADR</strong> was set up directly by <strong>the</strong> <strong>air</strong>l<strong>in</strong>e, <strong>the</strong> company<br />

has evidently submitted to it and <strong>the</strong> competence<br />

of <strong>the</strong> <strong>ADR</strong> is exclusively limited to cases <strong>in</strong>volv<strong>in</strong>g<br />

Alitalia (or an <strong>air</strong>l<strong>in</strong>e of <strong>the</strong> group).<br />

The French MTV was also created by a private <strong>in</strong>itiative<br />

of travel agencies and tour operator federations<br />

but also by <strong>the</strong> association of French <strong>air</strong> carriers.<br />

Thus, nearly <strong>the</strong> whole travel <strong>sector</strong> participates <strong>in</strong><br />

this <strong>ADR</strong> entity and process.<br />

The German SöP normally can only handle compla<strong>in</strong>ts<br />

aga<strong>in</strong>st its members but it could successfully<br />

conciliate a number of cases with o<strong>the</strong>r <strong>air</strong>l<strong>in</strong>es as<br />

well. A current legislative proposal aims to render<br />

participation <strong>in</strong> <strong>the</strong> conciliation procedure mandatory<br />

for all German <strong>air</strong>l<strong>in</strong>es.<br />

In most countries <strong>the</strong> <strong>ADR</strong>s deal with national companies.<br />

In Denmark for example <strong>the</strong> <strong>ADR</strong> (Consumer<br />

Compla<strong>in</strong>ts Board) can even handle compla<strong>in</strong>ts<br />

aga<strong>in</strong>st foreign <strong>air</strong>l<strong>in</strong>es.
