• Such a system would also allow <strong>ADR</strong>s, and thus<br />

consumers, to have access to specific technical<br />

<strong>in</strong>formation needed for <strong>the</strong> assessment of a<br />

case. <strong>ADR</strong>s as well as NEBs have very different levels<br />

of competence regard<strong>in</strong>g technical matters<br />

related to <strong>air</strong>planes or <strong>air</strong>ports. Close cooperation<br />

would allow access to <strong>the</strong> necessary expertise,<br />

to assess extraord<strong>in</strong>ary circumstances etc.<br />

• A close cooperation between ECCs, <strong>ADR</strong>s and<br />

NEBs should also help to clarify <strong>the</strong> compla<strong>in</strong>t<br />

system <strong>in</strong> which <strong>the</strong> consumer will have to submit<br />

his claim. Indeed, geographical competence<br />

is not <strong>the</strong> same, depend<strong>in</strong>g on <strong>the</strong> stakeholder<br />

<strong>the</strong> consumer will turn to:<br />

• Whereas <strong>the</strong> competent ECC to receive <strong>the</strong><br />

consumer’s compla<strong>in</strong>t will be <strong>the</strong> ECC of his/<br />

her country of residence, <strong>the</strong> competence of<br />

<strong>the</strong> NEB is <strong>in</strong>cident-based (country <strong>in</strong> which <strong>the</strong><br />

cancellation or delay occurred). An <strong>ADR</strong> <strong>in</strong> most<br />

cases is competent for <strong>the</strong> traders registered <strong>in</strong><br />

its country, disregard<strong>in</strong>g <strong>the</strong> nationality of <strong>the</strong><br />

consumer. Good practices<br />

It seems necessary that <strong>the</strong> <strong>ADR</strong> entities <strong>in</strong>volved<br />

<strong>in</strong> APR have a proper knowledge of APR issues <strong>in</strong><br />

order to understand <strong>the</strong> problems l<strong>in</strong>ked to <strong>the</strong> implementation<br />

of <strong>the</strong> EU regulation or <strong>the</strong> Montreal<br />

Convention, even if <strong>the</strong> <strong>ADR</strong> is already notified with<br />

<strong>the</strong> <strong>European</strong> <strong>Commission</strong> for its general competence.<br />

A good example is <strong>the</strong> Swedish Konsument Ombudsman<br />

(KO), whose core function is to represent<br />

consumers’<strong>in</strong>terests <strong>in</strong> relation with bus<strong>in</strong>esses and<br />

represent consumers <strong>in</strong> <strong>in</strong>dividual cases and market<strong>in</strong>g<br />

issues. The KO has represented consumers <strong>in</strong><br />

court cases concern<strong>in</strong>g APR and is <strong>the</strong>refore familiar<br />

with <strong>the</strong> particularity of this subject.<br />
