water must be available to the animal at all times.<br />

B) Adequate shelter shall be a structure that is large enough for the animal, whether it<br />

be livestock or pet, to stand naturally, turn around and lie down inside <strong>of</strong> the<br />

structure without being exposed to the elements <strong>of</strong> weather. The ro<strong>of</strong> and walls <strong>of</strong><br />

the structure shall be water pro<strong>of</strong> and wind pro<strong>of</strong>. Bedding must be furnished and<br />

shall be kept clean and dry to preserve insulating properties. Insulation and an inner<br />

wall must be included in the structure for dogs with short fur to provide adequate<br />

protection from cold. During cold weather a moveable flap shall be placed over the<br />

entrance <strong>of</strong> the structure to preserve the dog’s body heat. Adequate shelter from the<br />

sun may be provided by a tarp placed in a manner to provide deep shade and allow<br />

air to pass through for ventilation.<br />

C) Whoever violates the provisions <strong>of</strong> this section shall, if it is the first <strong>of</strong>fense, be<br />

given a written warning, and if it is the second or subsequent <strong>of</strong>fense, shall be<br />

subject to a fine <strong>of</strong> fifty ($50.00) dollars.<br />

AMENDMENT: Delete “or farm animal” from section A) line one and delete “whether it be<br />

<strong>Town</strong> voted to amend Article 50.<br />

VOTED: By a declared majority vote, a quorum being present on Thursday, <strong>April</strong> 5, <strong>2007</strong> the<br />

<strong>Town</strong> voted to amend ch. 83 <strong>of</strong> the Code <strong>of</strong> <strong>Falmouth</strong>, animals, by adding a new section to be<br />

appropriately numbered by the <strong>Town</strong> Clerk, as follows:<br />

A) Any person owning, keeping or otherwise responsible for a companion animal who<br />

confines that animal to his property by tethering, fencing, or other means shall<br />

provide for that animal access to adequate shelter from the elements <strong>of</strong> weather such<br />

as precipitation, cold and heat and protection from entanglements or other inherently<br />

dangerous conditions including attack by predatory animals. Potable water must be<br />

available to the animal at all times.<br />
