A. If it is the first offense a written warning shall be given.
B. If it is the second offense subject to this Article, a fine of fifty dollars ($50.)
shall be imposed and shall operate as a final disposition of the case.
C. If it is the third or subsequent offense subject to this Article, a fine of one
hundred dollars ($100.) shall be imposed and shall operate as a final disposition of
the case.
Or do or take any other action on the matter. On request of the Department of Natural
Resources/ Falmouth Animal Control.
VOTED: By a unanimous vote, a quorum being present on Wednesday, April 4, 2007 the Town
voted Article 53 as printed.
ARTICLE 54: To see if the Town will vote to authorize the Selectmen to acquire, by deed, at
no cost to the Town, all or a portion of the land, 12, 850 sq.ft. more or less, at 54 Gardiner Road
in Woods Hole (Assessors Parcel 49A 06 031B 001), and to acquire, at no cost to the Town,
permanent easements on said land and/or on portions of abutting parcels (Assessors Parcels 49A
06 032 001 and 49A 06 031C 002) for sea wall construction, maintenance and access purposes,
and to appropriate the sum of $90,000.00, to be combined with private contributions of monies
and/or services and materials, and expended as necessary by the Selectmen to match state and/or
federal funding for the design, permitting and repair, restoration and/or replacement of the
seawall damaged in December 2005 at said properties, so as to protect the public way, wetlands
and nearby properties.

MOTION: (Board of Selectmen) To see if the Town will vote to authorize the Board of
Selectmen to conduct a comprehensive review of the Town’s options to facilitate repairs to the
seawall at 54 Gardiner Road in Wood Hole, including determining whether to recommend
acquiring land or easements, identifying sources of funding to acquire the land or easements and
make the necessary repairs and to enter into such agreements as they deem appropriate for the
purposes of this article.
VOTED: By a declared failed majority, a quorum being present on Thursday, April 5, 2007 the
Town voted not to authorize the Board of Selectmen to conduct a comprehensive review of the
Town’s options to facilitate repairs to the seawall at 54 Gardiner Road in Wood Hole, including
determining whether to recommend acquiring land or easements, identifying sources of funding
to acquire the land or easements and make the necessary repairs and to enter into such
agreements as they deem appropriate for the purposes of this article.
ARTICLE 55: To see if the Town will vote to amend the official Historic District Zoning
Map and designation (Woods Hole) by removing the property at 13 Church Street, The Fisher
House, described at Barnstable County Registry of Deeds in Book 00975 Page 0264 Recorded
02/26/1963 and by the Falmouth Board of Assessors as Parcel 51 01 000 002.
