A. If it is the first <strong>of</strong>fense a written warning shall be given.<br />
B. If it is the second <strong>of</strong>fense subject to this Article, a fine <strong>of</strong> fifty dollars ($50.)<br />
shall be imposed and shall operate as a final disposition <strong>of</strong> the case.<br />
C. If it is the third or subsequent <strong>of</strong>fense subject to this Article, a fine <strong>of</strong> one<br />
hundred dollars ($100.) shall be imposed and shall operate as a final disposition <strong>of</strong><br />
the case.<br />

VOTED: By a unanimous vote, a quorum being present on Wednesday, <strong>April</strong> 4, <strong>2007</strong> the <strong>Town</strong><br />
voted Article 53 as printed.<br />
ARTICLE 54: To see if the <strong>Town</strong> will vote to authorize the Selectmen to acquire, by deed, at<br />
no cost to the <strong>Town</strong>, all or a portion <strong>of</strong> the land, 12, 850 sq.ft. more or less, at 54 Gardiner Road<br />
in Woods Hole (Assessors Parcel 49A 06 031B 001), and to acquire, at no cost to the <strong>Town</strong>,<br />
permanent easements on said land and/or on portions <strong>of</strong> abutting parcels (Assessors Parcels 49A<br />
06 032 001 and 49A 06 031C 002) for sea wall construction, maintenance and access purposes,<br />
and to appropriate the sum <strong>of</strong> $90,000.00, to be combined with private contributions <strong>of</strong> monies<br />
and/or services and materials, and expended as necessary by the Selectmen to match state and/or<br />
federal funding for the design, permitting and repair, restoration and/or replacement <strong>of</strong> the<br />
seawall damaged in December 2005 at said properties, so as to protect the public way, wetlands<br />
and nearby properties.<br />

MOTION: (Board <strong>of</strong> Selectmen) To see if the <strong>Town</strong> will vote to authorize the Board <strong>of</strong><br />
Selectmen to conduct a comprehensive review <strong>of</strong> the <strong>Town</strong>’s options to facilitate repairs to the<br />
seawall at 54 Gardiner Road in Wood Hole, including determining whether to recommend<br />
acquiring land or easements, identifying sources <strong>of</strong> funding to acquire the land or easements and<br />
make the necessary repairs and to enter into such agreements as they deem appropriate for the<br />
purposes <strong>of</strong> this article.<br />
VOTED: By a declared failed majority, a quorum being present on Thursday, <strong>April</strong> 5, <strong>2007</strong> the<br />
<strong>Town</strong> voted not to authorize the Board <strong>of</strong> Selectmen to conduct a comprehensive review <strong>of</strong> the<br />
<strong>Town</strong>’s options to facilitate repairs to the seawall at 54 Gardiner Road in Wood Hole, including<br />
determining whether to recommend acquiring land or easements, identifying sources <strong>of</strong> funding<br />
to acquire the land or easements and make the necessary repairs and to enter into such<br />
agreements as they deem appropriate for the purposes <strong>of</strong> this article.<br />
ARTICLE 55: To see if the <strong>Town</strong> will vote to amend the <strong>of</strong>ficial Historic District Zoning<br />
Map and designation (Woods Hole) by removing the property at 13 Church Street, The Fisher<br />
House, described at Barnstable County Registry <strong>of</strong> Deeds in Book 00975 Page 0264 Recorded<br />
02/26/1963 and by the <strong>Falmouth</strong> Board <strong>of</strong> Assessors as Parcel 51 01 000 002.<br />
