UNITED KINGDOM NATIONAL LISTS OF VARIETIES OF AGRICULTURAL PLANT SPECIES<br />

OFFICIAL NOTICE BY THE NATIONAL AUTHORITIES IN THE UNITED KINGDOM<br />

1. <strong>The</strong> United Kingdom National Lists were last published in the February 2011 Special Edition of the <strong>Plant</strong><br />

<strong>Varieties</strong> <strong>and</strong> <strong>Seeds</strong> <strong>Gazette</strong> <strong>and</strong> amendments to these lists have been published in the subsequent<br />

monthly editions.<br />

2. <strong>The</strong> National Authorities have now reprinted the National Lists containing the amendments which have<br />

been made up to <strong>and</strong> including those made on 30 June 2011. You will note that we have used the same<br />

procedure as last year <strong>and</strong> only show the Maintainer <strong>and</strong> UK Agent’s code against each variety. <strong>The</strong> name<br />

<strong>and</strong> address for each code are given in the address list at the back of the publication. In showing the UK<br />

Agent the National Authorities refer only to the Agent as shown in the application <strong>and</strong> have no knowledge<br />

of the commercial activities of such persons. For ease of reference the species prescribed in the Schedule<br />

to the <strong>Seeds</strong> (National Lists of <strong>Varieties</strong>) Regulations 2001 (as amended) are listed in the order in which<br />

they appear in the Common Catalogue <strong>and</strong> are numbered accordingly.<br />

MARKETING<br />

3. Attention is again drawn to the fact that it is an offence, subject to certain exceptions, to sell, hold with a<br />

view to sale or offer for sale or any disposal, supply or transfer of seed to a third party seed of a plant<br />

variety (a) unless <strong>and</strong> until the name of the variety is included in the appropriate United Kingdom National<br />

List or the EC Common Catalogue of varieties of agricultural plant species or (b) under a name other than<br />

that which is given in a National List or the Common Catalogue for that variety. <strong>The</strong> principal exceptions<br />

are sales etc, in connection with exports of seeds to countries outside the EU area <strong>and</strong> contractual<br />

arrangements for multiplication <strong>and</strong> tests <strong>and</strong> trials. Other exceptions are where authorisations have been<br />

granted under the seed marketing regulations to market appropriate quantities of unlisted agricultural<br />

varieties for tests <strong>and</strong> trials, to market uncertified seed of unlisted vegetable varieties for the purpose of<br />

gaining knowledge from practical experience during cultivation or to market small quantities of uncertified<br />

seed either listed or unlisted of agricultural or vegetable varieties. It should be noted, however, that the<br />

relevant marketing regulations concerning seeds of fodder plants prescribe the species to which the<br />

“commercial seed” category applies <strong>and</strong> in which it is therefore permissible to sell by species name only<br />

<strong>and</strong> without reference to variety. However, once a variety name is mentioned in connection with the<br />

commercial seed category, whether by supplier’s label or otherwise, the provisions of the National Lists<br />

Regulations regarding the use of that name appropriate to the variety will apply. <strong>The</strong> kinds of seed to<br />

which the commercial seed category applies are as follows:-<br />

Grasses Legumes Oil & Fibre <strong>Plant</strong>s<br />

Annual Meadowgrass Hungarian Vetch<br />

Sainfoin<br />

4. Any variety which has been deleted from the Lists but for which the National Authorities have allowed a<br />

period for the disposal of seed stocks which have been produced or were in the course of production when<br />

the variety was deleted from the List are indicated below the appropriate List. In each case the date of the<br />

expiry of the period permitted by the National Authorities is included. It would be an offence to market the<br />

seed after those dates.<br />

DATE OF ENTRY TO THE NATIONAL LISTS<br />

5. In the case of varieties added to the National Lists since 1 July 1973 the dates of entry have been<br />

indicated. Against certain dates the symbol * appears. This indicates that the variety was entered on the<br />

original National Lists with the dagger symbol <strong>and</strong> that this symbol was removed on the date quoted.<br />

Where no dates are given, the date of entry is assumed to be 1 July 1973.
