SECTION A UNITED KINGDOM NATIONAL LISTS OF VARIETIES OF AGRICULTURAL PLANT SPECIES OFFICIAL NOTICE BY THE NATIONAL AUTHORITIES IN THE UNITED KINGDOM 1. The United Kingdom National Lists were last published in the February 2011 Special Edition of the Plant Varieties and Seeds Gazette and amendments to these lists have been published in the subsequent monthly editions. 2. The National Authorities have now reprinted the National Lists containing the amendments which have been made up to and including those made on 30 June 2011. You will note that we have used the same procedure as last year and only show the Maintainer and UK Agent’s code against each variety. The name and address for each code are given in the address list at the back of the publication. In showing the UK Agent the National Authorities refer only to the Agent as shown in the application and have no knowledge of the commercial activities of such persons. For ease of reference the species prescribed in the Schedule to the Seeds (National Lists of Varieties) Regulations 2001 (as amended) are listed in the order in which they appear in the Common Catalogue and are numbered accordingly. MARKETING 3. Attention is again drawn to the fact that it is an offence, subject to certain exceptions, to sell, hold with a view to sale or offer for sale or any disposal, supply or transfer of seed to a third party seed of a plant variety (a) unless and until the name of the variety is included in the appropriate United Kingdom National List or the EC Common Catalogue of varieties of agricultural plant species or (b) under a name other than that which is given in a National List or the Common Catalogue for that variety. The principal exceptions are sales etc, in connection with exports of seeds to countries outside the EU area and contractual arrangements for multiplication and tests and trials. Other exceptions are where authorisations have been granted under the seed marketing regulations to market appropriate quantities of unlisted agricultural varieties for tests and trials, to market uncertified seed of unlisted vegetable varieties for the purpose of gaining knowledge from practical experience during cultivation or to market small quantities of uncertified seed either listed or unlisted of agricultural or vegetable varieties. It should be noted, however, that the relevant marketing regulations concerning seeds of fodder plants prescribe the species to which the “commercial seed” category applies and in which it is therefore permissible to sell by species name only and without reference to variety. However, once a variety name is mentioned in connection with the commercial seed category, whether by supplier’s label or otherwise, the provisions of the National Lists Regulations regarding the use of that name appropriate to the variety will apply. The kinds of seed to which the commercial seed category applies are as follows:- Grasses Legumes Oil & Fibre Plants Annual Meadowgrass Hungarian Vetch Sainfoin 1 Black Mustard 4. Any variety which has been deleted from the Lists but for which the National Authorities have allowed a period for the disposal of seed stocks which have been produced or were in the course of production when the variety was deleted from the List are indicated below the appropriate List. In each case the date of the expiry of the period permitted by the National Authorities is included. It would be an offence to market the seed after those dates. DATE OF ENTRY TO THE NATIONAL LISTS 5. In the case of varieties added to the National Lists since 1 July 1973 the dates of entry have been indicated. Against certain dates the symbol * appears. This indicates that the variety was entered on the original National Lists with the dagger symbol and that this symbol was removed on the date quoted. Where no dates are given, the date of entry is assumed to be 1 July 1973.
MAINTENANCE OF VARIETIES ON THE NATIONAL LISTS 6. The maintainers of varieties entered on the National Lists are reminded of their responsibilities under the provisions of Regulation 7 of the Seeds (National Lists of Varieties) Regulations 2001(as amended). They are asked to check the information provided in this Gazette and inform the Food and Environment Research Agency (Fera), Whitehouse Lane, Huntingdon Road, Cambridge CB3 OLF, of any amendments which should be made to the National Lists and, where applicable, to the Common Catalogue. The maintainers are also requested to notify Fera of any varieties which are no longer being maintained. COMMON CATALOGUE 7. The last Complete edition of the EC Common Catalogue of varieties of agricultural plant species was published on 14 December 2010 (29th edition) taking into account all amendments up to 13 November 2010. NATIONAL LISTS OF FODDER PLANT SPECIES 8. Ploidy is indicated in the column headed classification by the letter “D” (Diploid) or “T” (Tetraploid). ENQUIRIES 9.
