NOTICE OF PUBLIC HEARING<br />
The Board of Commissioners of <strong>Flathead</strong> <strong>County</strong>, <strong>Montana</strong>, hereby gives notice, pursuant to Section 76-2-205(1),<br />
M.C.A., that it will hold a public hearing to consider a change to the text of the <strong>Flathead</strong> <strong>County</strong> Zoning Regulations<br />
proposed by <strong>Flathead</strong> <strong>County</strong> and the <strong>Flathead</strong> <strong>County</strong> Planning and Zoning Office.<br />
The proposed amendments would add cross-references to recently created classifications, clarify which<br />
regulations will apply to a zone-change application, define “police” and “fire” stations and add them to the list of public<br />
buildings, update cross references generally, remove “primary” use and replace with “principal” use, authorize the Board<br />
of Adjustment to revoke conditional use permits under certain circumstances, clarify setback definitions, defining Taverns<br />
to include casinos, and amend the regulations to comply with statutory changes including posting of notices for 45 days,<br />
adopting the new statutory criteria for evaluating zoning proposals, and requiring attempts at voluntary compliance prior<br />
to filing complaints for zoning violations.<br />
The <strong>Flathead</strong> <strong>County</strong> Zoning Regulations apply in all <strong>County</strong> zoning districts created under Section 7-2-205,<br />
M.C.A., and are on file for public inspection at the Office of the Clerk and Recorder, 800 South Main, Kalispell, <strong>Montana</strong>,<br />
and the <strong>Flathead</strong> <strong>County</strong> Planning and Zoning Office, 1035 1st Avenue West, Kalispell, <strong>Montana</strong>, and on the <strong>Flathead</strong><br />
<strong>County</strong> Planning and Zoning Office’s website, at: http://flathead.mt.gov/planning_zoning/downloads.php Documents<br />
related to the proposed amendments to those regulations are on file for public inspection at the Office of the <strong>County</strong> Clerk<br />
and Recorder, and the <strong>Flathead</strong> <strong>County</strong> Planning and Zoning Office.<br />
The public hearing will be held on the 19 th day of November, <strong>2009</strong> at 9:30 o'clock a.m., in the Office of the<br />
Board of Commissioners of <strong>Flathead</strong> <strong>County</strong>, Courthouse, West Annex, Kalispell, <strong>Montana</strong>. At the public hearing, the<br />
Board of Commissioners will give the public an opportunity to be heard regarding the proposed change to the text of the<br />
<strong>Flathead</strong> <strong>County</strong> Zoning Regulations.<br />
Written comments are encouraged and will be reviewed by the Commissioners prior to the hearing if received by<br />
the <strong>Flathead</strong> <strong>County</strong> Commissioners’ Office at least three business days prior to the hearing.<br />

Prunty reported the contract is to have an engineer determine if the peers in the middle of the river and the truss structure for<br />
the Red Bridge is worth saving and rehabilitating.<br />
Commissioner Dupont made a motion to approve the HDR Engineering contract and authorized the chairman to sign.<br />
Commissioner Brenneman seconded the motion. Aye - Lauman, Brenneman and Dupont. Motion carried unanimously.<br />

Assistant Mike Pence, Public Works Director Dave Prunty, Operations Manager Solid Waste Jim Chilton, Clerk Kile<br />
Prunty reported the Solid Waste Board denied a request from the West Valley Fire Department to waive disposal fees for<br />
construction of a new fire hall. Prunty then spoke about a problem with the purchase of the Somers container site in regards to<br />
the state requiring an 80 foot right-of-way now and the total acreage being reduced to 2.98 acres instead of 3.21 acres, which<br />
will also require moving the southern boundary fence. The container site consolidation project for the Nyack Flats, Denny’s<br />
and Essex area was then discussed and Prunty reported letters have been received from several agencies that are concerned<br />
about grizzly bears. He then explained the Solid Waste Board discussed the possibility of funding from GNESA (Great<br />
Northern Environmental Stewardship Area) to keep the site open and was directed by the board to write a letter to them in that<br />
there may be a potential they may help fund the site. He then reviewed different options for disposal fees for mobile homes<br />
and reported a proposal will be brought before the commission when a decision is made by the Solid Waste Board in regards<br />
to the new fees.
