WEDNESDAY, SEPTEMBER 30, 2009 (Continued) NOTICE OF PUBLIC HEARING The Board of Commissioners of Flathead County, Montana, hereby gives notice, pursuant to Section 76-2-205(1), M.C.A., that it will hold a public hearing to consider a change to the text of the Flathead County Zoning Regulations proposed by Flathead County and the Flathead County Planning and Zoning Office. The proposed amendments would add cross-references to recently created classifications, clarify which regulations will apply to a zone-change application, define “police” and “fire” stations and add them to the list of public buildings, update cross references generally, remove “primary” use and replace with “principal” use, authorize the Board of Adjustment to revoke conditional use permits under certain circumstances, clarify setback definitions, defining Taverns to include casinos, and amend the regulations to comply with statutory changes including posting of notices for 45 days, adopting the new statutory criteria for evaluating zoning proposals, and requiring attempts at voluntary compliance prior to filing complaints for zoning violations. The Flathead County Zoning Regulations apply in all County zoning districts created under Section 7-2-205, M.C.A., and are on file for public inspection at the Office of the Clerk and Recorder, 800 South Main, Kalispell, Montana, and the Flathead County Planning and Zoning Office, 1035 1st Avenue West, Kalispell, Montana, and on the Flathead County Planning and Zoning Office’s website, at: http://flathead.mt.gov/planning_zoning/downloads.php Documents related to the proposed amendments to those regulations are on file for public inspection at the Office of the County Clerk and Recorder, and the Flathead County Planning and Zoning Office. The public hearing will be held on the 19 th day of November, 2009 at 9:30 o'clock a.m., in the Office of the Board of Commissioners of Flathead County, Courthouse, West Annex, Kalispell, Montana. At the public hearing, the Board of Commissioners will give the public an opportunity to be heard regarding the proposed change to the text of the Flathead County Zoning Regulations. Written comments are encouraged and will be reviewed by the Commissioners prior to the hearing if received by the Flathead County Commissioners’ Office at least three business days prior to the hearing. Commissioner Dupont made a motion to approve the HDR Engineering contract and authorized the chairman to sign. Commissioner Brenneman seconded the motion. Aye - Lauman, Brenneman and Dupont. Motion carried unanimously. MONTHLY MEETING W/ DAVE PRUNTY, SOLID WASTE DISTRICT 9:30:24 AM Members present: Chairman Dale W. Lauman Commissioner Joseph D. Brenneman Commissioner James R. Dupont Others present: Assistant Mike Pence, Public Works Director Dave Prunty, Operations Manager Solid Waste Jim Chilton, Clerk Kile Prunty reported the Solid Waste Board denied a request from the West Valley Fire Department to waive disposal fees for construction of a new fire hall. Prunty then spoke about a problem with the purchase of the Somers container site in regards to the state requiring an 80 foot right-of-way now and the total acreage being reduced to 2.98 acres instead of 3.21 acres, which will also require moving the southern boundary fence. The container site consolidation project for the Nyack Flats, Denny’s and Essex area was then discussed and Prunty reported letters have been received from several agencies that are concerned about grizzly bears. He then explained the Solid Waste Board discussed the possibility of funding from GNESA (Great Northern Environmental Stewardship Area) to keep the site open and was directed by the board to write a letter to them in that there may be a potential they may help fund the site. He then reviewed different options for disposal fees for mobile homes and reported a proposal will be brought before the commission when a decision is made by the Solid Waste Board in regards to the new fees.
WEDNESDAY, SEPTEMBER 30, 2009 (Continued) Chilton then reviewed the construction schedule for the Ashley Lake West Corridor Container Site which should be completed by the 22 nd of October. He reported an easement revision will be made with DNRC for changes made to the road design. Prunty reported they are also working with Rails to Trails on rehabilitating the current Kila site to put in a parking lot and clean up the site. The tonnage report was then discussed with the month of August down 4 percent compared to August 2008. DOCUMENT FOR SIGNATURE: MDOT FUNDING AGREEMENT/ WATER TRUCK 10:00:31 AM Members present: Chairman Dale W. Lauman Commissioner Joseph D. Brenneman Commissioner James R. Dupont Others present: Assistant Mike Pence, Public Works Director Dave Prunty, Operations Manager Solid Waste Jim Chilton, Clerk Kile Prunty explained through MDOT’s air quality program a 4,000 gallon water truck will be received by the county for $17,200.00. MDOT will pay 86 percent of the purchase price and the county will pay 14 percent. Commissioner Dupont made a motion to approve the document for signature with MDOT. Commissioner Brenneman seconded the motion. Aye - Lauman, Brenneman and Dupont. Motion carried unanimously. Dupont Others present: Assistant Mike Pence, Public Works Director Dave Prunty, Operations Manager Solid Waste Jim Chilton, Clerk Kile Discussion was held relative to waiving the road closure fee to repair the railroad crossing by Plum Creek. Commissioner Dupont made a motion to waive the road closure fee. Commissioner Brenneman seconded the motion. Aye - Lauman, Brenneman and Dupont. Motion carried unanimously. MEETING W/ VIRGINIA SLOAN (SENATOR TESTER’S OFFICE) AND KIRBY CAMPBELL-RYERSON (SENATOR BAUCUS’ OFFICE) RE: UPDATE 10:05:49 AM Members present: Chairman Dale W. Lauman Commissioner Joseph D. Brenneman Commissioner James R. Dupont Others present: Assistant Mike Pence, Virginia Sloan, Kirby Campbell-Ryerson, Clerk Kile Virginia Sloan reported they have received a significant amount of calls in regards to the proposed closure of the Essex, Nyack and Denny’s container sites and closure of the Kila and Marion sites. Chairman Lauman said they are trying to streamline the system and still provide services. He then explained the problems with the Kila and Marion sites and stated they tried to develop something in between the two small communities. Commissioner Dupont said the proposed closures are due to cost factors. He then stated he could certainly understand getting rid of two of the sites but his personal opinion is to leave the site at Essex open. Discussion was then held relative to the U.S. 93 bypass, Senator Tester’s Wilderness Bill (Forest Job Bill), radio sites and appropriations. MEETING W/ GEORGE SMITH/ PLANNING & ZONING OFICE RE: LAKESHORE PERMIT/ BARRY 10:33:03 AM Members present: Chairman Dale W. Lauman Commissioner Joseph D. Brenneman Commissioner James R. Dupont Others present: Planning & Zoning Director Jeff Harris, Planner George Smith, Olaf Ervine, Clerk Kile Smith explained he is looking for guidance and direction with a lakeshore permit application that is in a catch 22 situation. He then reviewed the lakeshore regulations that pertain to the application. The applicant proposes to build a non-intrusive boat storage into the bank of his property. Discussion was held relative to the need to revise the lakeshore regulations.
