ARTICLE 13 – FEE-IN-LIEU OF SITE RUNOFF<br />
STORAGE AND WETLAND MITIGATION<br />
§ T1300 Fee-in-Lieu of Site Storage Runoff<br />
The Director or Administrator may in some limited circumstances pay a fee-in-lieu of<br />
site runoff storage to fulfill part or all of the site runoff storage requirement. The fee<br />
will be determined to be the lesser of<br />
a fee per acre foot or part thereof computed from a schedule adopted by the<br />
permitting authority.<br />
OR<br />
the verifiable cost of providing the required storage<br />
§ T1301 Procedures; Use of Funds<br />
The Administrator shall grant or deny the fee-in-lieu request within 45 days of written<br />
request. The funds shall be collected and used in the same watershed for which<br />
they were paid. The fees may be used to plan, design, construct or improve<br />
<strong>stormwater</strong> management facilities in the watershed for which they were collected.<br />
§ T1302 Fee-in-Lieu of Wetland Mitigation<br />
If a wetland mitigation is required under this ordinance, the applicant may choose to<br />
satisfy the mitigation requirement by paying a fee-in-lieu of mitigation. To satisfy the<br />
requirements of § 1302 the applicant shall:<br />
Prepare a statement of the estimated probable cost to acquire the land, install,<br />
monitor and maintain a wetland mitigation facility for five years as if the applicant<br />
had chosen to satisfy the mitigation requirement by mitigating within a wetland<br />
mitigation facility;<br />
and<br />
If mitigation credits are available from any wetland mitigation bank, the applicant<br />
shall also prepare a statement of the estimated probable cost of satisfying the<br />
mitigation requirement through the purchase of credits from a wetland mitigation<br />
bank as if the applicant had chosen to satisfy the mitigation requirement in such<br />
manner. Each estimate shall require the approval of the Director and the fee-in-lieu<br />
of wetland mitigation shall be the lesser of the two estimates.<br />
