from afforestation, reforestation, <strong>and</strong> forest conservation projects conducted on their l<strong>and</strong>. This<br />

analysis examined the Brazilian Indians’ constitutional rights12 <strong>and</strong> relevant infra-constitutional<br />

legislation on Brazilian Indians13 <strong>and</strong> environmental protection14 as well as the emerging rules <strong>and</strong><br />

principles on legal title over carbon credit projects in Brazil. Our legal analysis then focused on<br />

the particular aspects of the projects proposed by the Surui in their demarcated l<strong>and</strong>, including<br />

their overall compliance with the legal regime mentioned above, <strong>and</strong> some requirements to be<br />

followed in connection with the proposed project design, implementation <strong>and</strong> governance,<br />

<strong>and</strong> certain aspects of its commercialization phase. Further analysis was conducted specifically<br />

with respect to the <strong>REDD</strong>15 component of the project, including testing our major conclusions<br />

on the Surui’s ownership rights over the carbon credits resulting from the project against some<br />

hypothesis regarding a future Brazilian National Policy on <strong>REDD</strong>.<br />

In order to focus our analysis on the central issue of the Surui’s rights on their demarcated<br />

l<strong>and</strong>s, we assumed that:<br />

(i) The l<strong>and</strong>s that will be included in the proposed project area are within demarcated<br />

Indian l<strong>and</strong>s that belong to the Surui, the boundaries of which are not subject to<br />

dispute;<br />

(ii) Surui l<strong>and</strong>s are not partial or integrally located in Conservation Units;<br />

placed on the agenda of the Subsidiary Body for Scientific <strong>and</strong> Technological Advice (SBSTA) established under<br />

the United Nations Framework Convention on Climate Change (UNFCCC) in 2005 by Papua New Guinea (with<br />

expressions of support by Bolivia, the Central African Republic, Chile, Congo, Costa Rica, the Democratic Republic<br />

of Congo, the Dominican Republic <strong>and</strong> Nicaragua). It comprises a set of actions aimed at enhancing carbon stocks<br />

due through the sustainable management of forests, as referred to by Decision 2/CP.13 of the UNFCCC – United<br />

Nations Framework Convention on Climate Change (Decision 2/CP.13, FCCC/CP/2007/Add.1*, 8th Plenary Meeting,<br />

14-15 December, 2007) <strong>and</strong> further developments under the UNFCC <strong>and</strong> the Kyoto Protocol.<br />
