TO REPORT AND RECOMMENDATION<br />
Pursuant to Rule 72 <strong>of</strong> the Federal Rules <strong>of</strong> Civil Procedure and Rule 4(b) <strong>of</strong> the<br />
Magistrate Judge Rules, Defendants, GATO B. JACKSON (“Jackson”) and LOUVENIA<br />
HARRIS (“Harris”) (hereinafter collectively referred to as the “Defendants”), hereby file their<br />
objections to the Report and Recommendation <strong>of</strong> Magistrate Judge White (the “Report”), issued<br />
on June 2, 2011 [D.E. #59]. Specifically, Defendants object to the Report‟s recommendation<br />
that Defendants‟ Motion to Dismiss be denied in part because Plaintiff has purportedly stated a<br />
valid claim for retaliation against Jackson and Harris at this preliminary stage <strong>of</strong> the proceedings.<br />
MEMORANDUM OF LAW<br />
I. Defendants object to the Report’s recommendation that Plaintiff has stated a<br />
valid Section 1983 claim for retaliation against Jackson and Harris.<br />
As summarized in the Report, the Eleventh Circuit <strong>Court</strong> <strong>of</strong> Appeals found that Plaintiff<br />
should be permitted to amend his complaint in this case because “Stringer asserted that, after<br />
filing a grievance . . . defendants retaliated against him by „improperly transferring him to<br />
another „much harsher condition‟ jail, without due process, without any incident or disciplinary
