III. Conclusion
Based on the foregoing, it is recommended that the Complaint
be dismissed pursuant to 28 U.S.C. §1915(e)(2)(b)(ii), for failure
to state a claim upon which relief can be granted and the case be
closed.

within ten days of receipt of a copy of the report.
