Further <strong>in</strong> 2001 resolution there is a provision that the rights of the committees over<br />

MFPs shall be <strong>in</strong> accordance with the decisions of the State Government under<br />

Provisions of Panchayats (Extension to Scheduled Areas) Act 1996. The said legislation<br />

applies only to scheduled areas, it provides for ownership of MFPs to vest <strong>in</strong> any tier of<br />

the Panchayat and the Gram Sabha. However the State Government has not yet made any<br />

provision <strong>in</strong> its panchayat law <strong>in</strong> this respect. Thus the State needs to clarify its stand <strong>in</strong><br />

this regard, further whether the said decisions on MFP’s will apply to Scheduled areas<br />

only or to non-scheduled areas also is unclear. It is pert<strong>in</strong>ent to mention that our study<br />

area has no scheduled area and thus is not with<strong>in</strong> the purview of the legislation on PESA.<br />

vi) Role of <strong>Forest</strong> Department:<br />

S<strong>in</strong>ce JFM is carried out jo<strong>in</strong>tly by the forest department as well as the village<br />

community it is pert<strong>in</strong>ent to look at the role of the forest department more closely. The<br />

1991 resolution gave central place to the forest department, while that of the village<br />

community was peripheral. It were the forest officials who selected the area to be covered<br />

under JFM, mooted the idea of JFM <strong>in</strong> village people's meet<strong>in</strong>g, formulated micro-plan,<br />

certified whether or not the committees have been perform<strong>in</strong>g satisfactorily and thus<br />

grant<strong>in</strong>g them various benefits enumerated under the resolution. Even after three<br />

amendments the role of forest department is more or less the same. For <strong>in</strong>stance 2001<br />

resolution provides for formulation of micro-plan jo<strong>in</strong>tly with village community and<br />

other developmental departments.<br />

Most controversial among these powers is the power of the DFO to disband a committee<br />

or to term<strong>in</strong>ate the member ship of any <strong>in</strong>dividual <strong>in</strong> the committee. While the <strong>Forest</strong><br />

department can dissolve any particular JFMC anytime, there is no space for voluntary and<br />

collective decision of the village community to term<strong>in</strong>ate the programme. Similarly<br />

entitlement of benefits to people has aga<strong>in</strong> been made subject to the satisfaction of the<br />

DFO.<br />

There is a view that the forest department should play the role of a facilitator like<br />

provid<strong>in</strong>g f<strong>in</strong>ancial as well as technical assistance. Though such provisions have been<br />

provided, it is important to restrict some of the unchecked powers of the forest<br />

department as discussed above to make JFM more participatory, just and equitable.<br />

5.3 Legal Issues <strong>in</strong> Jo<strong>in</strong>t <strong>Forest</strong> Management:<br />

In this section we would discuss certa<strong>in</strong> legal issues related with Jo<strong>in</strong>t <strong>Forest</strong><br />

Management. There are certa<strong>in</strong> grey areas when it comes to the legal basis of JFM, its<br />

<strong>in</strong>terl<strong>in</strong>kages with other legislations etc. These issues are discussed here<strong>in</strong> below:<br />

(i) Legal basis of JFM:<br />

Most significant issue relates to the legal status of the JFM circular itself. It has to be<br />

borne <strong>in</strong> m<strong>in</strong>d that it has no force of law and thus JFM circular premise is on weaker<br />
