CHAPTER I General Provisions<br />

Section 1 Definition of Words Used and<br />

Methods of Calculation<br />

(Definition of Words Used)<br />

Article 1. In this Cabinet Order, the definition of<br />

the words used in the following items shall b3 as<br />

termed in each item concerned :<br />

(1) Building site: means a parcel of land where<br />

one or more than two buildings occupy which<br />

cannot be separated on account of the use;<br />

(2) Basement: means a story with its floor lower<br />

than ground level but the height from its floor<br />

to ground level is higher than 1/3 of the ceiling<br />

height of that story;<br />

(3) Principal structural parts: mean walls,<br />

columns, trusses, sills, bracings, (angle braces,<br />

materials for horizontal bracings or the like),<br />

or horizontal members of a building, (beams,<br />

girders, or the like) that sustain dead and live<br />

loads, snow load, wind load, earth pressure or<br />

water pressure or impact due to earthquake<br />

and other tremors and vibrations;<br />

(4) Waterproofed materials: mean the building<br />

materials with waterproofing quality such as<br />

brick, stone, artificial stone, concrete, asphalt<br />

chinaware, glass and other similar materials.


(Methods of Calculation of Area, Height, etc.) |<br />

Article 2. The methods of calculation of area,<br />

height and number of story mentioned in the<br />

following items shall be as determined in each<br />

item concerned :<br />

(1) Area of building site: to take the area of<br />

horizontal projection. However, the site in part<br />

between the line considered as the boundary line<br />

of the road and the road as provided for in the<br />

provisions of Article 42 paragraph 2 of the<br />

Building Standard Law (hereinafter referred to<br />

as "Law") shall not be included in the area of<br />

the site;<br />

(2) Building area: to be the area of horizontal<br />

projection of part surrounded by the center<br />

line (in caseN there is a projection exceeding<br />

one meter from the center line concerned as of<br />

eave, pent-roof, balcony, and other similar ones,<br />

the line measured back horizontally from the<br />

edge of the same, 1 meter of exterior walls or<br />

the columns taking place of these in a building<br />

(excluding a part of basement below imaginary<br />

line drawn 1 meter above the ground level) ;<br />

(3) Floor area: to be the area of horizontal<br />

projection of a part surrounded by center line<br />

of walls and other partitions in each floor or its<br />

part of a building;<br />

(4) Total floor area: to be the total of floorarea<br />

of each story of a building except that, in the<br />

case coming under Article 56 paragraph 3 of<br />

the Law, no floor area of basement shall be<br />

included ;<br />

(5) Height of building: to be the height above<br />

the ground level; however, in the case coming<br />

under any one of the following items, it shall<br />

be as provided for in each item concerned;<br />

(a) For calculation of height according to the<br />

provisions of Article 57 or Article 58 of the<br />

Law, it shall be measured from the road<br />

surface at center of the road in front;<br />

(b) In case the total area of horizontal projection<br />

of staircase, elevator towers, decorative<br />

towers, •Ewatch towers, dormer windows and<br />

other similar part above roof of a building is<br />

less than 1/8 of the building area, the height<br />

of that part shall not be counted in determining<br />

the height of building concerned up<br />

to 12 meters;<br />

(c) A part of crest, fire wall projecting above<br />

roof and other similar projections above roof<br />

shall not be counted in determining the height<br />

of the building concerned.<br />

(6) Height of eave: to be the height measured<br />

from ground level to the top of wall supporting<br />

roof truss or horizontal member taking its place;<br />

wall plate or columns;<br />

(7) Number of story: no elevator towers, decorative<br />

towers, watch towers (or a part above roof<br />

of other similar building or storerooms, machine<br />

room of basement and part of other similar<br />

building of which each total horizontal projected<br />

area is less than 1/8 of building area concerned)<br />

shall be counted in number of story, or in case<br />

a part of a building has open inner court, or in<br />

case building site is sloped or stepped and when<br />

number of story differs by parts of these stories,<br />

the longest one shall be taken.<br />

2 Ground level mentioned in preceding item (2),<br />

(5) or (6) means the horizontal face imagined to<br />

exist at the average height where the perimeter<br />

of the building comes in contact with the ground<br />

surface, while in case the location of contact has<br />

the difference of elevation more than 3 meters, it<br />

shall be the horizontal face in average height at<br />

all points where the difference of elevation is<br />

kept within 3 meters.<br />

3 The method of calculation of horizontal projection<br />

for the case coming under paragraph 1 item<br />

(5) (b) or item (7) shall follow the method of ^<br />

calculation of building area of item (2) of the<br />

same paragraph.<br />

Section 2 Examination of Qualification of<br />

Building Official<br />

(Standard for Examination of Qualification)<br />

Article 3. Examinations of qualification of building<br />

official (hereinafter referred to as "examination<br />

of qualification") prescribed in the provisions of<br />

Article 5 of the Law shall be conducted to test<br />

the knowledge and experience on technical matters<br />

of building and regarding laws and ordinance<br />

required for confirmation provided for in the<br />

provisions of Article 6 paragraph 1 of the Law<br />

with respect to all buildings.<br />

(Methods of Examining Qualification)<br />

Article 4. Examination of qualification shall be<br />

conducted based on deliberation of past records<br />

and test.<br />

2 The deliberation of past records mentioned in<br />

the preceding paragraph shall be conducted on<br />

the records of actual performance concerning the<br />

building administration or building construction<br />

work.<br />

3 The test mentioned in paragraph 1 shall be<br />

conducted on the subject matters given in the<br />

following items. However, for person qualified<br />

as first class architect, the test on subject given<br />

in the items (1) to (5) inclusive shall be exempted:<br />

(1) Designing of building;<br />

(2) Planning of building;<br />

(3) Structure of building;<br />

(4) Building materials;<br />

(5) Execution of building construction;<br />

(6) Building Standard Law and Orders based on<br />

Building Standard Law ; ^<br />

(7) Laws and Regulations relating to City Planning<br />

(Law No. 36 of 1919)and Fire Defence Law


(Law No. 186 of 1948) and outline of Orders<br />

based thereon ;<br />

(8) Necessary Knowledge on building administration<br />

other than that mentioned in the preceding<br />

two items.<br />

(Execution of Examination of Qualification)<br />

Article 5. Examination of qualification shall be<br />

executed more thah once every year.<br />

2 The date and time as well as place for taking<br />

examination of qualification shall be announced to<br />

the public by the Minister of Construction through<br />

the Official Gazette beforehand.<br />

(Granting of Certificate of Passing Examination)<br />

Article 6. Minister of Construction shall grant the<br />

certificate of passing the examination of qualification<br />

for building officials to those persons who<br />

have passed the examination of qualification.<br />

(Fixed Number of Members of Committee for<br />

Examination" of Qualification)<br />

Article 7. Number of members of the Committee<br />

for Examination of Qualification for building<br />

officials shall be not more than 10.<br />

(Duty and Service of Members of Committee for<br />

Examination of Qualification)<br />

Article 8. The members of Committee of Examination<br />

of Qualification shall be of part-time service.<br />

(Entrusting to Ministerial Ordinance) •E<br />

Article 9. The procedures regarding the application<br />

for examination of qualification shall be<br />

determined by Ministry of Construction Ordinance.<br />

Section 3 Fees for Application for Confirmation<br />

(Fees for Application for Confirmation regarding<br />

Buildings)<br />

Article 10. The amount of fees for application for<br />

confirmation provided for in the provisions of<br />

Article 6 paragraph 5 of the Law (including the<br />

case where this applies mutatis mutandis in<br />

Article 87 paragraph 1 of the Law) shall be as<br />

shown in the following table for each separate<br />

case of application for confirmation :<br />

2 The total floor area mentioned in the Table of<br />

the preceding paragraph shall, in case of building<br />

a building, be calculated on the total floor area<br />

of the parts of building concerned, and in case<br />

of large scale repairing or remodelling or change<br />

of use of a building, it shall be calculated as 1/2<br />

of the total floor area of the part pertaining to<br />

repairing, remodelling or change of use concerned.<br />

(Fees for Application for Confirmation regarding<br />

Structures)<br />

Article ll. The amount of fee for application for<br />

confirmation of structure in accordance with the<br />

provisions of Article 138 shall be ¥500 for each<br />

case of application for confirmation of structure.<br />

(Fee for Confirmation in Case of Combined<br />

Application for Confirmation of Building and<br />

Structure)<br />

Article 12. The amount of fee for application for<br />

confirmation in case of the applications for confirmation<br />

for building and structure in one application<br />

for confirmation shall be determined in<br />

accordance with the amount of fee for application<br />

for confirmation as in the provisions of Article 10<br />

for building concerned,* however, in case its<br />

amount is less than ¥500, it shall be at ¥500.<br />

(Reduction of Fee for Application of Confirmation)<br />

Article 13. In case the administrative agency concerned<br />

deems it necessary for the sake of public<br />

interest due to disasters and other special reasons<br />

may, irrespective of the provisions of the preceding<br />

three Articles reduce the fee for application<br />

for confirmation as provided for by the regulations<br />

of the local public entity concerned.<br />

(Ways of Paying Fee for Application for Confirmation)<br />

Article 14. The ways of paying fee or application<br />

for Confirmation shall be determined by the<br />

regulation of the local public entity concerned.<br />

Section 4 Amount of Compensation<br />

(Application for Decision of Expropriation<br />

Council)<br />

Article 15. Person (hereinafter referred to as<br />

"applicant") who intends to request the decision<br />

of Expropriation Council in accordance with the<br />

provisions of Article ll paragraph 3 of the Law<br />

(including the case where this applies mutatis<br />

mutandis in Article 88 of the Law) shall submit<br />

to the Expropriation Council on application inscribed<br />

with the matters enumerated below through<br />

the hand of the governor of To, Do, Fu or prefecture<br />

where the building concerned is located :<br />

(1) Name and address of the applicant;<br />

(2) Place where the building is located;<br />

(3) Rights possessed by the applicant regarding<br />

the building concerned ;<br />

(4) Use and brief description of structure of the


uilding, plot plan, block plan and floor plan of<br />

each story; however, the items not concerned<br />

with the disposal ordered may be omitted ;<br />

(5) Disposal ordered by the Special Administrative<br />

Agency in accordance with the provision<br />

of Article ll paragraph 1 of the Law;<br />

(6) Notified amount of compensation and the<br />

date when the notice was received;<br />

(7) The objectionable reasons against the amount<br />

of the notified compensation and the amount<br />

that applicant requests and particulars thereof ;<br />

(8) Excluding the matters that the applicant<br />

deems necessary in addition to those enumerated<br />

in the preceding items.<br />

2 In case the applicant submits an application in<br />

accordance with the provisions of the preceding<br />

paragraph, one copy of the application mentioned<br />

in the said paragraph shall be submitted to the<br />

governor of To, Do, Fu or prefecture mentioned<br />

in the preceding paragraph.<br />

(Written Opinion Submitted)<br />

Article 16. When the governor of To, Do, Fu or<br />

prefecture receives the application in accordance<br />

with the provision of paragraph 2 of the preceding<br />

Article one of the copies shall be sent without<br />

delay to the head of city, town or village where<br />

the building concerned is located.<br />

The head of city, town or village who receives<br />

a copy of application prescribed in the provision<br />

of the nrecedine paragraph shall, within 10 days<br />

from the date of receipt of the same, prepare his<br />

written opinion for the application concerned<br />

which shall be submitted to the Expropriation<br />

Council.<br />

(Expropriation Council in Session)<br />

Article 17. The governor of To, Do, Fu or prefecture<br />

shall, within the period of time reckoning<br />

two weeks after submitting of the application in<br />

accordance with the provision of Article 15 but<br />

not exceeding one month, call the meeting of<br />

Expropriation Council.<br />

(Sending of Attested Copy of Written Decision)<br />

Article 18. In case the governor of To, Do, Fu or<br />

prefecture receives the report of the decision<br />

from the Expropriation Council, the attested<br />

copies of the written decision shall be delivered<br />

to the applicant and the head of city, town or<br />

village where the building concerned is located.<br />

CHAPTER<br />

II<br />

Structure in General<br />

Section 1 Openings Required for Taking in<br />

Light<br />

(Taking in Light to Living Rooms of School,<br />

Hospital, Dormitory, etc.)<br />

Article 19. The ratio of area of part effective for<br />

taking in light by means of windows and other<br />

openings in living room of school, hospital,<br />

medical office, dormitory or lodging house, etc.<br />

prescribed by the provisions of Article 28 paragraph<br />

1 of the Law to the area of that floor shall<br />

be larger than that as specified by the following<br />

table for each case:<br />

<br />

(Method of Calculating Effective Area)<br />

Article 20. The effective area for lighting by means<br />

of windows and other openings (hereinafter referred<br />

to as "opening" in this Article) of living<br />

room prescribed in the provisions of Article 28<br />

paragraph 1 of the Law shall be calculated at the<br />

part of opening falling under each of the following<br />

items:<br />

(1) In respect to the part of "opening" facing<br />

the boundary line of adjacent lot or other<br />

building or other part of the building concerned<br />

within the same lot, the distance from each<br />

part directly above the opening in question of<br />

the building (if there is recession from perpendicular<br />

face directly above the opening, or<br />

projecting part to include such part, and if<br />

there is semi-transparent pent roof or other<br />

pent roof not obstructing for taking in light,<br />

such shall be excluded) measured horizontally<br />

to the boundary line of adjacent lot or to<br />

opposite part of the building or other part of<br />

building concerned in the same lot, and the<br />

ratio of the measured distance to the vertical<br />

distance from the part in question to the opening<br />

in question to be larger than that given in<br />

the following table :<br />

(2) In respect to the opening facing the boundary<br />

line of adjacent lot in a zone or district given<br />

in item (2) or item (3) of the table of the<br />

preceding item or other building or other part<br />

of building concerned in the same lot that the<br />

horizontal distance prescribed in said item to<br />

be more than 5 meters;<br />

(3) Part of opening facing the road, (in cityplanning<br />

district, road under the provision of<br />

Article 42 of the Law; hereinafter the same)<br />

park, open space, river, or vacant lot or surface<br />

of water.<br />

2 Part of area of sky-light effective for light shall,<br />

in regard to the application of the provisions of<br />

Article 28 paragraph 1 of the Law, b3 taken as 3<br />

times the area of that part.<br />

3 In case there is on.the outside of an opening a<br />

verandah wider than 90 cm., or other of the<br />

similar construction (excluding open verandah or<br />

the like), the application of the provisions of<br />

Article 28 paragraph 1 of the Law regarding the<br />

effective area of lighting of that part shall be<br />

considered as 7/10 of area of that part.<br />

Section 2 Ceiling Height, Height of Floor<br />

and the Method of Damp-proofing<br />

thereof<br />

(Ceiling Height of Living Room)<br />

Article 21. Ceiling height of a living room shall<br />

be more than 2.1m.<br />

2 Class room of a school (excluding various schools<br />

and kinder gartens) which floor area exceeds.<br />

50 sq.m. the height of ceiling shall be 3m. or<br />

over irrespective of the provisions of the preceding<br />

paragraph.<br />

3 Where the floor area for seating space for<br />

theater, cinema, show-house, place of review,<br />

auditorium or meeting place exceeds 200 sq. m.<br />

the ceiling height shall be more than 4m. irrespective<br />

of the provision of paragraph 1, except<br />

in case there is mechanical ventilating devise<br />

installed.<br />

4 Ceiling height of each preceding paragraph shall<br />

be measured from the level of the room. Where<br />

there are several ceiling heights in the same<br />

room, average height shall be taken as its ceiling<br />

height.<br />

(Height of Floor of Living Room and"the Method<br />

of Damp-proofing)<br />

Article 22. Height of floor and the damp-proofing<br />

methods for the case where the floor of living<br />

room in the lowest story is built of wood, it<br />

shall be done according to the provisions of the<br />

following items, except in cases where plain<br />

concrete or Tataki or other means corresponding<br />

thereto of disposal effective for damp-proofing are<br />

placed below floor :<br />

(1) The height floor shall be more than 45cm.<br />

measured from ground level directly below and<br />

to the top of floor level;<br />

(2) In exterior walls below floor level, holes with<br />

area of 300sq. cm. or over for the purpose of<br />

ventilation shall be provided at every or less<br />

than 5m. measured along the length of wall,<br />

and they shall be provided with means to<br />

prevent rats from going there.<br />

Section 3 Stairways<br />

(Width of Stairways and of its Landing, as well<br />

as Dimension of Rise and Tread thereof)<br />

Article 23. The width of stairways and its landing,<br />

as well as the dimensions of rise and tread thereof<br />

shall be as shown in the following table.<br />

However, the width of exterior stairways shall be<br />

60 cm. or over, and stairways (excluding stairs in<br />

apartment for common use) for use of residence<br />

may have its rise 23cm.or less and tread 15cm.<br />

2 The dimension of tread of part forming circular<br />

stairs shall be measured at point 30 cm. from the<br />

end with the least width of tread.<br />

(Location and Tread-length of Landing)<br />

Article 24. Stairways coming under item 1) or<br />

item 2) of the table given in paragraph1 of the<br />

preceding Article, and having their height more<br />

than 3 meters shall be provided with landings so<br />

arranged to come at point less than 3 meters;<br />

other kind of stairs having height exceeding 4<br />

meters shall be provided with landings so arranged<br />

to come at point less than 4 meters.<br />

2 Tread-length of landing mentioned in the preceding<br />

paragraph for straight stairs in accordance<br />

with the preceding provision shall be 1.2 meters<br />

or over.<br />

(Railings for Stairways and Landings)<br />

Article 25. In case both sides of stairs and landings<br />

are not provided with side walls or with<br />

other means to take place thereof, they shall be<br />

provided with hand railings.<br />

2 For stairways with width exceeding 3 meters<br />

railing shall be provided running through preferably<br />

at middle except for stairs with rise less^<br />

than 15 cm. and tread more than 30cm.<br />

3 The provisions of the preceding two paragraphs<br />

shall not apply for a part of stairways of height<br />

less than 1 meter.<br />

(Ramp in Place of Stairs)<br />

Article 26. The ramp taking place of stairs shall<br />

satisfy the following requirements in each item:<br />

(1) Gradient.not to exceed 1 in 8;<br />

(2) Surface shall either be roughened or shall be<br />

finished with other materials not slippery.<br />

2 The provisions of the preceding 3 Articles (excluding<br />

part concerned with rise and tread) shall<br />

apply mutatis mutandis to the ramp mentioned<br />

in the preceding paragraph.<br />

(Stairways Solely for Special Use)<br />

Article 27. The provisions of Article 23 to Article<br />

25 inclusive shall not apply to the stairs for<br />

elevator machinery room, watch tower, and for<br />

others solely used for special purposes.<br />

Section 4 Latrines and Sewers<br />

(Light and Ventilation of Latrine)<br />

Article 28. Latrine shall have window opened<br />

directly to outside air for light and ventilation<br />

except for water closet which has means to take<br />

the place of window.<br />

(Construction of Bail-out Latrines)<br />

Article 29. Construction of bail-out latrines shall<br />

be as specified by the following items:<br />

(1) Soil pipe from urinal, tank for soil water<br />

and the periphery of upper mouth shall be<br />

constructed of waterproof materials, and in case<br />

it is to be constructed of waterproof materials<br />

of osmotic quality, the means to prevent water<br />

leaking shall be made the applying waterproof<br />

cement mortar or similar effective waterproof<br />

construction ;<br />

(2) Space below latrine shall be separated from<br />

other parts by finishing with waterproof materials;<br />

(3) Opening for bailing out shall not face directly<br />

a road with its lower part fixed at 10cm. of<br />

over above ground level, and it shall be provided<br />

with tight fitted door;<br />

(4) The space 30cm. to front and right and left<br />

sides of bail-out opening, the ground shall be<br />

covered with plain concrete, Tataki or other<br />

similar materials.<br />

(Structure of Privy Closet in Special Building and<br />

District)<br />

Article 30. In city planning section, the latrines<br />

for school, hospital, theater, cinema, showhouse,<br />

place for review, auditorium, meeting house,<br />

department store, hotel, Japanese hotel, dormitory,<br />

railroad station, and buildings for use specified<br />

by the local public entity by its regulations and<br />

public latrines shall be constructed as prescribed<br />

in the following items :<br />

(1) To provide with non-water-penetrating stand<br />

and urinals;<br />

(2) Urinal shall be connected with soil pipe of<br />

non-water-penetrating quality to the soil tank ;<br />

(3) Window and other ventilating opening in<br />

latrine (in case there is no tight closing door<br />

in, latrine, a privy-closet) shall have insect<br />

metallic wire net to keep out flies.<br />

2 In case the local public entity deems that bailout<br />

latrines for building for use given in the<br />

preceding paragraph or buildings in the district<br />

designated by by-law should be replaced by the<br />

improved cess-pool, "Kairyobenso" mentioned in<br />

Article 31 from standpoint of sanitation, and that<br />

it can be maintained effectively, it may require<br />

to install Kairyobenso instead by the same bylaw.<br />

(Construction of "Kairyobenso")<br />

Article 31. "Kairyobenso" shall be according to<br />

the requirements given in the following items,<br />

excepting those having special structural quality<br />

which the administrative agency concerned recognizes<br />

as having equivalent or superior effect<br />

from stand point of sanitation :<br />

(1) Soil tank will be tank composed of retaining<br />

chamber and bail-out chamber in combination;<br />

(2) Ceiling, bottom, side walls and partition<br />

walls of soil tank shall be constructed of water-<br />

•E proof materials and shall be finished with<br />

waterproof mortar or by similar equally effective<br />

waterproofing methods to prevent any<br />

water leakage ;<br />

(3) Retaining chambers shall be composed of<br />

two or more chambers with part to keep soil<br />

water at depth of 80cm. or more at the same<br />

time its volume to be more than 0.75 cu,m.,<br />

and so arranged that soil water may be retained<br />

over 100 days;<br />

(4) There shall be provided proper sized opening<br />

in the retaining chamber for purposes^of cleaning<br />

thereof, and it shall be installed as tight<br />

fit;<br />

(5) The end of soil pipe from urinal shall enter<br />

retaining chamber at a point 40cm. or more<br />

below the surface of retaining soil water.<br />

(Soil Disposal Tank for Water-closet)<br />

Article 32. Soil disposal tank under the provisions<br />

of Article 31 paragraph 2 of the Law shall be so<br />

constructed as required by each item given below<br />

which permits decomposition of the liquefied soil<br />

matters to the extent that it shall not be objectionable<br />

from stand point of sanitation, excepting<br />

those of special construction which the administrative<br />

agency concerned recognizes as having<br />

equivalent or superior clarifying effect as compared<br />

with other accepted ones : •E<br />

(1) Soil disposal tank shall be constructed by<br />

combining the orders of treatment by decomposing<br />

chamber, oxidizing chamber, and<br />

chlorination chamber ;<br />

(2) Ceiling, bottom, side walls, partition walls<br />

shall be constructed of waterproof materials,<br />

and shall be finished by waterproof mortar or<br />

by other equally effective waterproof finishing<br />

safe against any. water leaking ;<br />

(3) Manhole of size with inside diameter 45cm.<br />

or over shall be provided over decomposing<br />

chamber, oxidizing chamber and disinfecting<br />

chamber ;<br />

(4) Decomposing chamber shall be constructed<br />

composed of setting and separating chambers<br />

and primary filtration chamber ;<br />

(5) The depth of part of decomposing chamber<br />

where soil water is retained shall be 1.2 meters<br />

or over, its volume shall be0.75 cu. m., or over<br />

up to the capacity for 15 persons using the<br />

watercloset concerned, and the size to be<br />

enlarged to meet the increase in persons using<br />

proportionately ;<br />

(6) Oxidizing chamber shall be of distributing<br />

filtration type and shall be 'provided with<br />

ventilating equipment such as air drawing pipe<br />

and air supply pipe;<br />

(7) The distance from the bottom of water<br />

sprinkling trough of oxidization chamber to<br />

the top of crushed stone layer shall be more<br />

than 10 cm. the thickness of crushed stone<br />

layer shall be 90cm. or over: the volume of<br />

crushed stone layer shall be more than 1/2 the<br />

volume of part of decomposing chamber where<br />

soil water is retained: the distance from the<br />

bottom of the supporter of crushed stones and<br />

the bottom of the tank shall be 10cm. or over.<br />

(Test for Water Leakage)<br />

Article 33. Tank for Kairyobenso of Article 31 and<br />

soil disposal tank mentioned in the preceding<br />

Article shall be tested for leakage by filling the<br />

tank with water for more than 24 hours.<br />

(Distance from Closet to Well)<br />

Article 34. Tank for bail-out-latrine shall not be<br />

located at distance less than 5 meters from a<br />

well. However, in enclosed type well which is<br />

covered with fill of 3m. or over below ground<br />

level with water drawing pipe made of water<br />

tight material, or in case of using outside casing<br />

of water tight pipe with inside diameter 25 cm.<br />

or less while water drawing pipe inside thereof<br />

is also made of water tight material, the distance<br />

may be 1.8m. or over.<br />

(Materials for Sewage Pipe, etc.)<br />

Article 35, Sewage pipe, sewage channel or catch<br />

basin and other similar facility prescribed by the<br />

provisions of Article 19 paragraph 3 of the Law<br />

shall be constructed of waterproof materials or<br />

cast iron.<br />

CHAPTER 111 Structural Calculation<br />

Section 1 General Provisions<br />

(Fundamental Principle of "Structural Designing)<br />

Article 36. In making structural designing for a<br />

building, columns, beams, floors, walls, etc. shall<br />

be arranged effectively and safe against dead load, •E<br />

live load, snow load, wind pressure, eartE pressure<br />

and water-pressure and impact of earthquake<br />

and vibrations of earthquake & others<br />

acting on a building according to the kind of its<br />

•Estructural composition.<br />

2 In case a wall as a principal structural part of<br />

a building is considered to resist against the<br />

horizontal force acting on building, such wall<br />

shall be arranged well balanced, so far as it<br />

serves the purpose of use.<br />

3 Principal structural parts of a building shall be<br />

designed as ridged to cause no distortion objectionable<br />

to purpose of use.<br />

4 Footing of a building shall be designed structurally<br />

against unbalanced settlement and freezing.<br />

Section 2 Structural Materials<br />

(Lasting Quality of Structural Materials)<br />

Article 37. A part of timber used in principal<br />

parts from standpoint of lasting quality of structure<br />

that comes in contact with bricks, concrete,<br />

earth or other similar materials of water absorbent<br />

quality (excluding part that comes in<br />

contact with Shinkabe or walls of Dozo construction)<br />

shall be coated with decay protective paint<br />

or make disposal for preventing rotting by effective<br />

means equal to or superior thereof.<br />

2 Part of wall of a building that comes in contact<br />

with earth directiy> excluding such cases as of<br />

gate, fence, storage house, shed or other similar<br />

classes of building shall be constructed of water<br />

proof materials.<br />

3 In case wood piles are used as foundation of a<br />

building, excluding those used for one story<br />

wooden building, they shall be driven down below<br />

the surface of normal level of the standing<br />

water.


(Prevention of Wearing out)<br />

Article 38. In structural part of a building, liable<br />

to get easily worn out, material that resists wear<br />

shall be used or that part shall be covered with<br />

wear resisting materials to prevent any objectionable<br />

trouble.<br />

(Keeping Curtain Wall and Roof Tiles in Place)<br />

Article 39. Curtain wall shall be fixed to the building<br />

frames.<br />

2 Roof tiles shall be so placed that each tile in<br />

two rows along eave and sides and one in every<br />

5 tiles in other parts are fixed to the groundstrips<br />

with copper wire, iron wire or nails, or by<br />

other ways equally effective or better for keeping<br />

them from falling down.<br />

3 Decorative stones, terra cotta and the like shall<br />

be fixed to frames or to walls with bolts, spikes<br />

and other iron wares.<br />

Section 3 Wooden Construction<br />

(Scope of Application)<br />

Article 40. The provisions of this Section shall<br />

apply to part of wooden construction in a wooden<br />

building or building constructed of wooden construction<br />

combined with masonry or other construction<br />

and others, excepting those buildings<br />

such as Chashitsu, Azumaya or the similar buildings,<br />

or storage, shed or the like with total<br />

floor area less than 10 sq.m.<br />

(Timbers or Lumber)<br />

Article 41. Quality of lumber to be used in principal<br />

structural parts shall be free from defects<br />

such as knot, rot, slope of grain, rounded corners,<br />

etc. affecting structural strength.<br />

(Sills)<br />

Article 42. For principal structural column used<br />

in lowest §tory, its base shall be placed on asill,<br />

except in the case where column is firmly tiedto<br />

footing or foot of column or in the case where<br />

one story house is fixed on a base.<br />

2 Sill shall be firmly tied to footing except forone<br />

story building with the total floor area less than<br />

50 sq.m.<br />

(Least Diameter of Column)<br />

Article 43. Least diameter of principal structural<br />

column shall be not less than the ratio shown in<br />

the following table against the perpendicular distance<br />

between each horizontal member of principal<br />

structural part such as sill, base, girt, beam,<br />

girder and other horizontal structural members<br />

that are connected thereto :<br />

2 In cases where, by regulation and in accordaic.3<br />

with the provisions of Article 41 of the Law,<br />

whole or part of the provision of Article 21 paragraph<br />

1 of the Law is not applicable or in cases<br />

where, the restrictions of the provision of the<br />

same paragraph are to be alleviated by the same<br />

regulation and by supplementing the provisions<br />

of the preceding paragraph, the ratio between<br />

the least diameter of column and the perpendicular<br />

distance of horizontal members shall be<br />

determined.<br />

3 In case more than 1/3 of required cross section<br />

of column calculated on the basis of least diameter<br />

mentioned in the provisions of the preceding<br />

two paragraphs is to be cut out, that part<br />

shall have to be properly rain forced.<br />

4 Corner columns of 2 story building or higher or<br />

columns acting as such shall be one continuous<br />

through-column unless they are properly reinforced<br />

at the joint to give the same or higher<br />

strength than one continuous through-columns.<br />

(Horizontal Members such as Beam, etc.)<br />

Article 44. No objectionable cut on tension side<br />

about the middle of beam, girder or in other<br />

horizontal members shall be allowed.<br />

(Bracing and Joints)<br />

Article 45. Bracing acting as tension member shall<br />

be wood of size larger than 1/5 of column with<br />

which it is in contact or steel far larger than<br />

9 mm. in diameter, or other steel members having<br />

equivalent strength.<br />

2 Bracing acting as compression member shall be<br />

wood of size larger than 1/3 of column with<br />

which it is in contact.<br />

3 Ends of bracing mentioned in the preceding two<br />

paragraphs shall be firmly connected near at the<br />

joints in column, beam or other horizontal member<br />

by means of holt, spike, nails or other irons.<br />

4 Bracing members shall not be cut out.<br />

(Framing Necessary for Strength)<br />

Article 46. In wooden buildings, walls, columns<br />

and horizontal members of principal parts necessary<br />

for structural strength in direction of spacing<br />

of beams and in direction of wall girders of<br />

each story, framings with wall or bracings shall<br />

be arranged well balanced to be safe against<br />

horizontal forces acting in all directions, except in<br />

the case where brackets, column buttress, wall<br />

buttress are provided propejly to stand against<br />

acting forces.<br />

2 In corners of floor frame and roof truss systems<br />

shall use horizontal bracing members and roof<br />

trusses shall be provided with vertical bracings.<br />

3 In wooden buildings of 2 or more stories or<br />

with total floor area exceeding 50 sq.m. the<br />

required length of framing with wall or bracings<br />

laid out in direction of span of beam as well as<br />

direction of side wall girders in each story according<br />

to the provisions of paragraph 1 shall be<br />

not less than the respective value per 1 sq.m.<br />

of floor area of that story shown in the following<br />

table: However, in the case within the district<br />

where the special administrative agency<br />

designates the seismic constant for horizontal<br />

force at 0.3 or higher in accordance with the<br />

(Wooden School Building for Elementary or Middle<br />

School)<br />

Article 48. Walls, columns and horizontal members<br />

of wooden school building for elementary or<br />

lower secondary school shall be as prescribed in<br />

the following items except in the case where<br />

they accord with Article 12 of Japanese Building<br />

Specifications "Wooden elementary school (Building<br />

1302)" or with Article 13 of "Wooden lower<br />

secondary school (Building 1303)" as provided for by<br />

the competent Minister. However, school or class<br />

room built by special structural method or other<br />

schools of smaller type that the special administrative<br />

agency recognizes as having equal or<br />

higher strength as compared with those under<br />

these specifications or under the provisions in<br />

each item:<br />

(1) Bracings mentioned in Article 46 paragraph<br />

5 table item (3) shall be used in exterior walls;<br />

(2) In case the distance in direction of side wall<br />

girder is over 12 m. in direction of side wall<br />

girder at interval of 12 m. or less shall have<br />

through partition wall of property spaced bracings<br />

mentioned in Article 46 paragraph 5 table<br />

item (3) unless buttress-columns or buttresswalls<br />

of equal or higher strength are provided<br />

at<br />

Columns beams and trusses shall ba arranged<br />

to be located at distance not exceeding 2 m. in<br />

direction of side wall girder (4 m. in indoor<br />

(4) Column as principal structural part shall be<br />

15 cm. sq. or more or having equivalen<br />

(Disposal for Prevention of Rot in Interior of<br />

Article 49. In case whole or part of the exterior<br />

walls of wooden frame is to be finished with cement<br />

mortar on metal lath or ashlared stone<br />

facing and other construction that frames are<br />

easily eaten by rot, water-proofing paper shall be<br />

placed as ground for that part in addition to ap"<br />

plying creosote or other chemical to columns up<br />

1 m. from ground level, bracings and sills in<br />

that part; provided that the interior of wall in<br />

that part is so constructed as to permit of air<br />

circulation.<br />

(Ashlaring)<br />

Article 50. In building construction with wooden<br />

frames to be faced with stones (including tile<br />

facing and the like, hereinafter the same in this<br />

Article), the thickness* of facing tiles shall be<br />

less than 5 cm. excepting the part up to 1 m.<br />

from the ground level.<br />

2 Facing stones of building mentioned in the preceding<br />

paragraph exceeding 1,5 cm. in thickness<br />

shall be tied to the framesby means of spikes,<br />

copper wire other similar non-corrosive metals to<br />

prevent them from falling off.<br />

Section 4 Masonry Construction<br />

(Scope of Application)<br />

Article 51. The provisions of this Section shall<br />

apply to part of masonry construction in masonry<br />

building such as brick construction, stone construction,<br />

concrete block construction and other<br />

masonry constructions, or part in building constructed<br />

of masonry construction combined with<br />

wooden construction or other. However, the<br />

provisions of this Section shall not apply to part<br />

reinforced by ferro-concrete or by steel shapes<br />

which proved to have equal or higher strength<br />

as compared with those satisfying the provisions<br />

of this Section by structural calculation or by<br />

experiment.<br />

2 The provisions of Article 55 paragraph 2 and<br />

Article 56 of this Section shall not apply to buildings<br />

lower than 4m and at the same time with<br />

its total floor area not over 20 sq.m.<br />

3 To structurally unimportant partition wall of<br />

less than 2 m. high, the provisions of this Section<br />

only from this Article to Article 53 inclusive,<br />

Article 55 paragraph 6 and Article 62 shall apply.<br />

(Execution of Masonry Constructions)<br />

Article 52. Brick, stones and concrete blocks and<br />

other masonry materials to be used in masonry<br />

construction shall be washed well before planning<br />

them.<br />

2 Masonry materials shall be placed so that cement<br />

mortar shall spread evenly over entire face<br />

of its joint.<br />

3 Mortar mentioned in the preceding paragraph<br />

shall be cement mortar, the mixture of cement<br />

and sandbyvolume shall be 1:3 or having<br />

strength equal or superior to this, and cement<br />

mortar with lime shall be in mixture of cement,<br />

lime and sand by volume in the proportion of<br />

1:2:5 or having strength equal or superior to<br />

this.<br />

4 Masonry construction shall be constructed to<br />

prevent straight joint.


(Foot i ng)<br />

Article 53. Footing to receive masonry wall shall<br />

be constructed of mass of plain concrete or reinforced<br />

concrete.<br />

(Length of Wall)<br />

Article 54. No masonry wall shall have its length<br />

over 10 m.<br />

2 Length of wall mentioned in this Section means<br />

the distance center to center of adjacent two<br />

walls measured at parts connected to that wall<br />

(including buttress whose length at part connected<br />

to footing is less than 1/3 of length of wallto<br />

which the buttresses are fixed. Hereinafter referred<br />

to in this Section, as "adjacent opposing<br />

walls").<br />

(Thickness of Wall)<br />

Article 55. Thickness of wall for masonry construction<br />

(not including the thickness of finishing<br />

materials ; hereinafter the same in this Section)<br />

shall bs not less than the value given in the following<br />

table in accordance with the number of<br />

story and the length of that wall (meaning the<br />

length of wall mentioned in paragraph 2 of the<br />

preceding Article) of that building respectively :<br />

two paragraphs, provided that the thickness of<br />

its wall is more than 20 cm.<br />

4 The thickness of wall constructed in combination<br />

of stones or stones and other masonry materials<br />

shall be not less than the value of the thickness<br />

of wall prescribed by the provisions of the preceding<br />

3 paragraphs increased by 2/10 of the<br />

thickness of that wall, excepting the steel framing<br />

stone construction.<br />

5 Regarding double-wall masonry building the provisions<br />

of the preceding 4 paragraphs shall apply<br />

to either one wall of that double-wall.<br />

6 Thickness of wall in each story of masonry<br />

building shall be not less than the thickness of<br />

respective upper walls bearing thereon.<br />

7 Regarding the thickness of curtain walls constructed<br />

of masonry in steel frame building, reinforced<br />

concrete construction or steel skeleton<br />

reinforced concrete construction, it shall be considered<br />

as partition upon application of the provision<br />

of this Article.<br />

(Wall Girder)<br />

Article 56. In the wall of masonry building, at the<br />

top of walls in each story (in cases where gable<br />

wall exists, top of wall of said gable) shall be<br />

placed the wall girder constructed of steel frame<br />

structure or reinforced concrete, except in cases<br />

where the reinforced concrete roof or slab etc.<br />

are placed over, or thickness of wall of one story<br />

building is more than 1/10 of height of wall, or<br />

where the length of wall is less than 5 m.<br />

(Openings)<br />

Article 57. Opening in walls of masonry building<br />

such as windows, exits, and others shall be as<br />

provided for in following items :<br />

(1) Total width of openings of each wall in<br />

section formed by adjacent-opposing-walls of<br />

each story shall be not more than 1/2 of the<br />

length of that wall;<br />

(2) Total width of openings in each story shall<br />

be not more than 1/3 of the total length of<br />

walls in that story;<br />

(3) Vertical distance from an opening to an,<br />

opening directly above shall be not less than<br />

60cm.<br />

2 Distance between openings in wall of each story<br />

in masonry building, or horizontal distance between<br />

opening and center line of adjacent-opposing-walls<br />

shall be more than twice the thickness<br />

of that wall,<br />

5 Masonry construction inside of wall fire-place<br />

shall have substantial footing to sustain the weight<br />

of fire-place and the chimney and its upper part<br />

shall not be stepped out. In case of wooden<br />

building it shall be reinforced by steel materials<br />

in addition.<br />

(Channel Cut in Walls)<br />

Article 58. In walls of masonry building, when<br />

vertical channel for continuous distance more<br />

than 3/4 of height of wall of that story is to be<br />

made, depth shall be less than 1/3 of the thick-


ness of the wall, and when horizontal channel is<br />

to be made, its depth shall bs less than 1/3 of<br />

the thickness of wall while the length shall not<br />

exceed 3 meters.<br />

(Wall of Wooden Frame Masonry Construction or<br />

Steel Frame Masonry Construction)<br />

Article 59. Part of masonry construction in the j<br />

wall of wooden frame or steel frame masonry<br />

construction shall be tied firmly into wooden<br />

frame or steel frame with bolts, spikes and other<br />

iron wares.<br />

(Hand Railing and Railing Wall)<br />

Article 60. Hand railing or railing wall shall no*t<br />

be constructed ©f masonry unless its top is tied<br />

by reinforced concrete wall girder.<br />

(Masonry Fence)<br />

Article 61. Masonry fence shall satisfy the following<br />

requirements :<br />

(1) Height shall not exceed 3 m.;<br />

(2) Thickness at any part of wall shall be more<br />

than 1/10 of the height, measured from that<br />

part to the top of that wall;<br />

(3) At every 4 m. or less of the length of wall,<br />

there shall be buttress walls (excluding wooden<br />

construction) projecting out of the face of wall<br />

more than 1.5 times its thickness, of that point<br />

unless the thickness of wall in that part is<br />

more than 1.5 of the wall thickness specified in<br />

the provisions of the preceding item.<br />

(Supports, etc. of Principal Structural Part for<br />

Structural Strength)<br />

Article 62. Principal masonry part shall not be<br />

supported by any part of wooden structure.<br />

Section 5 Steel Frame Construction<br />

(Scope of Application)<br />

Article 63. The provisions of this Section shall apply<br />

to part of steel construction in steel frame<br />

building, steel skeleton reinforced concrete building<br />

or building constructed of steel frame combined<br />

with other construction such as masonry,<br />

etc.<br />

(Materials)<br />

Article 64. No cast iron shall be used in part receiving<br />

stresses other than compression or stress<br />

caused by contact.<br />

(Effective Slenderness Ratio of Compression Member)<br />

Article 65. Effective slenderness ratio (ratio of<br />

buckling,length to the radius of gyration; hereinafter<br />

the same) of steel compression member<br />

(meaning material to take compressive stress;<br />

hereinafter the same) as principal part for structural<br />

strength shall not exceed 200 for column,<br />

250 for members other than column.<br />

(Foot of Column)<br />

Article 66. Foot of column as principal structural<br />

part shall be fixed to footing by anchor bolts<br />

constructions or designed as pin support.<br />

(Joints)<br />

Article 67. Joints of steel shapes as principal<br />

structural part shall either be riveted or welded<br />

joint, except where bolts are permitted to be<br />

used as in the cases given in any of the follow-<br />

(1) In the case where total weight of steel<br />

shapes used in structural part of a building is<br />

less than 10 tons, and bolted part is embedded<br />

in concrete, or nuts are fixed by welding, or<br />

lock nuts are used so that bolts will not be<br />

loosened ;<br />

(2) In the case where the joint is extremely<br />

difficult for riveting or welding.<br />

2 Joints and connections as the principal structural<br />

part shall, by means of splice piece riveted<br />

or welding, be so constructed that entire stress<br />

existing at that point may be transmitted. In<br />

this case, the end of column shall be perfectly<br />

Article 68. Spacing of rivet or bolt shallbe greater<br />

3 No holes for bolts shall be made larger than0.5<br />

mm.in diameter of bolt used.<br />

(Arrangement of Bracings, Walls, etc.)<br />

Article 69. Excluding the case where structures of<br />

upright framings, floor system and roof trusses are<br />

proved to be structurally safe through structural<br />

calculation, steel shape or bar bracings, or rein-<br />

forced concrete walls, roofslabor floor slabs shall<br />

be arranged to suit.<br />

(Prevention of Corrosion in Structural Materials)<br />

Article 70. Steel shapes used in principal structural<br />

"part shall be protected by non-corrosive<br />

paints or shall be embedded in concrete or in<br />

light protective concrete with no rust forming<br />

quality for steel.<br />

Section 6 Reinforced Concrete Construction<br />

(Scope of Application)<br />

Article 71. The provisions of this Section shall<br />

apply to part of reinforced concrete in reinforced<br />

concrete building, steel skeleton reinforced concrete<br />

building constructed of reinforced concrete<br />

combined with other construction such as mason"<br />

ry, etc.<br />

2 The provisions of Article 72, Article 75 and<br />

Article 79 of this Section only shall apply to


uildings of height less than 4 meters and with<br />

total floor area less than 30 sq.m., or to fence<br />

with height not over 3 meters.<br />

(Materials for Concrete)<br />

Article 72. Materials to be used for concrete in<br />

reinforced concrete buildings shall satisfy the<br />

requirements in the following items :<br />

(1) Sand, gravel, crushed stones and water shall<br />

be free from acids, salts, organic matters or<br />

particles of mud liable to cause rusting of steel<br />

or injurious to obstruct normal process of setting<br />

of concrete;<br />

(2) Gravel or crushed stones shall be hard and<br />

of size to go through easily between spaces in<br />

reinforcing bars and space between reinforcing<br />

bar and form.<br />

(Joints and Fixing of Reinforcing Bars)<br />

Article 73. Ends of reinforcing bars shall be hooked<br />

to prevent from slipping.<br />

2 Joint of main bar shall be at a partwhere<br />

tension stress acts least excepting the case of<br />

welding, the length of lap shall be more than 25<br />

times its diameter (in the case of making joints<br />

of main bars of different diameters, the smaller<br />

diameter; hereinafter the same in this Article).<br />

However, in case the joint may not be made at<br />

a point where tension is not working at full<br />

stress, then, the lap shall be more than 40 times<br />

the diameter or bars.<br />

3 Of the tension steel bars in beam framed with<br />

column, excepting the case of welding with main<br />

bars in column, the length of anchor shall benot<br />

less than 40 times its diameter.<br />

(Proportion of Concrete Mix)<br />

Article 74. Concrete to be used in reinforced concrete<br />

construction shall show compressive•E<br />

strength of more than 90 kg/cm2 at age of 28<br />

days.<br />

2 Water-Cement ratio of concrete shall be kept<br />

down from the value obtained by the following<br />

formula according to the required strength for<br />

structural purpose, except in cases where it is<br />

3 Mixture of Concrete shall be determined so that<br />

the product shall be uniform, and compact.<br />

(Curing of Concrete)<br />

Article 75. Curing of concrete shall be done so as<br />

to keep the temperature of concrete above 2°C,<br />

while pouring and during the period of 5 days<br />

after concrete is poured and care shall be taken<br />

to prevent it from setting and hardening by dryout<br />

or vibration.<br />

(Removing of Supports of Forms)<br />

Article 76. Supports for forms for beams and slabs<br />

as principal structural part shall not be removed<br />

before 6 weeks (4 weeks in case of roof floor or<br />

in case of no floor bsing directly above).<br />

2 The provisions of the preceding paragraph shall<br />

not apply in case high early-strength Portland<br />

cement is used or other cement is used and in<br />

case } of the period of time or more mentioned<br />

in said paragraph has elapsed and only in case<br />

building official approves that he has no objection<br />

thereto from standpoint of structural strength<br />

due to favorable condition in respect to temperature,<br />

humidity and others.<br />

(Construction of Columns)<br />

Article 77. Construction of columns as principal<br />

structural part shall satisfy the structural requirements<br />

as provided for in the following items :<br />

(1) Main bars shall consist of more than 4 reinforcing<br />

bars with properly spaced ties ;<br />

(2) Spacing of ties shall be less than 30 cm.,<br />

and at the same time not over 15 times the<br />

diameter of smallest bars used ;<br />

(3) Least diameter of column shall be more<br />

than 1/15 of the distance between the main<br />

supports unless it is checked as safe in consideration<br />

of its slenderness ratio in structural<br />

calculation.<br />

(4) Sum of area of main bars shall be not less<br />

than 0.8% of the area of cross-section of concrete<br />

(if area of bar exceeds the area under<br />

the provision of the preceding paragraph or<br />

under the result of structural calculation, that<br />

required area,,<br />

(Construction of Beams)<br />

Article 78. Beam as principal part for structural<br />

strength shall be reinforced double, and shall<br />

have stirrups at space not exceeding 3/4 of the<br />

depth of a beam.<br />

(Thickness of Protection for Embedded Bars)<br />

Article 79. Thickness of concrete covering of the<br />

embedded bars shall be more than 2 cm. for<br />

walls not bearing wall, and slab, more than 3cm.<br />

for bearing walls, columns or beams (more than<br />

2 cm. for a part facing interior with effective<br />

finishing for protection of steel bars such as<br />

mortar, plaster, tiles or others) more than 4 cm.<br />

for walls, columns, slabs or beams which come<br />

in contact with earth directly, more than 6 cm.<br />

for footing not including the levelling concrete.<br />

Section 7 Plain Concrete Construction<br />

(Provisions of Section 4 and Section 6 which applies<br />

mutatis mutandis to Concrete Construction)<br />

Article 80. Regarding the structural part of plain<br />

concrete in plain concrete building or building<br />

constructed of plain concrete construction combined<br />

with other construction the provisions of<br />

Section 4 (excluding Article 52), and Article 71<br />

(except that part pertaining to Article 79), the<br />

provisions of Article 72 and Article 74 to Article<br />

76 inclusive in this Chapter shall apply mutatis<br />

mutandis.<br />

Section 8 Structural Calculation<br />

Clause 1 General Provisions<br />

(Application)<br />

Article 81. Structural calculation of buildings<br />

mentioned in the provisions of Article 20 paragraph<br />

2 of the Law shall be conducted according<br />

to the provisions of this Section excluding the<br />

case under the provision of Section 9, excepting<br />

the case where structural calculation is carried<br />

out by the accurate method of structural calculation<br />

recognized as equal or superior to that prescribed<br />

in the provisions of this Section by the<br />

Minister of Construction.<br />

(Principle of Structural Calculation)<br />

Article 82. Structural calculation under the preceding<br />

Article shall comply with the requirements<br />

of the following items:<br />

(1) Calculate the stress developed in principal<br />

part for structural strength of building caused<br />

by loads and external forces specified by the<br />

provisions of Clause 2;<br />

(2) Permanent and temporary stresses at principal<br />

part of structural strength mentioned in<br />

and summing up stresses by using the<br />

than 3 kg. in heavy snow district and in other<br />

snow fall records, and the heavy snow district<br />

specified in the preceding paragraph shall be<br />

determined based on the standard arranged by<br />

4 Snow load on roof may, according to its slope,<br />

take the value obtained by multiplying the following<br />

value to the snow load in paragraph 1. However,<br />

if slope is steeper than 60 deg., it may be<br />

neglected. However, where there are strips to<br />

prevent snow from sliding down from roof, it<br />

(Wind Load)<br />

Article 87. Wind pressure shall be calculated by<br />

multiplying the coefficient of wind force to velocity<br />

pressure.<br />

2 Speed pressure of the preceding paragraph shall<br />

be calculated by the following formula ; however,<br />

the special administrative agency may designate<br />

the district by the regulation and may, on the<br />

respect to height of high building or chimney and<br />

other structures, or buildings and structures built<br />

(Allowable Unit Stress)<br />

Article 98. Allowable unit stress for structural<br />

materials used in buildings shall be in accordance<br />

with the values given in the following table.<br />

However, the unit stress for rolled steel with<br />

yielding point at 3500 kg/cm2 or more, or rivet<br />

steel with tensile strength at 5000 kg/cm2 or<br />

more may not be in accordance with this table:


3 Compression stress for concrete at age of 28<br />

(Methods of Estimating Spans for Beams for<br />

Calculation of Reinforced Concrete Construction)<br />

Article 99. Span for beams or slab in reinforced<br />

concrete construction shall be measured from<br />

center to center of its supports. However, the<br />

span may be replaced by the distance between<br />

the inside face of supports plus the depth of<br />

beam or the thickness of slab.<br />

2 Span for beam or slab with haunches at its ends<br />

may be taken at distance between the points in<br />

the haunches equal to 0.5 of the depth of beam<br />

or the thickness of slab measured up from the<br />

bottom of haunches.<br />

(Reinforced Concrete T-beam)<br />

Article 100. In case beams and slabs are built as<br />

monolithic, the construction may be considered as<br />

T-beam. In this case, calculation shall be made,<br />

taking the width of its flange less than 1/4 of its<br />

span and at the same time not more than 12<br />

times the thickness of the beam or slab.<br />

(Loads on Reinforced Concrete Slab in Roof and<br />

Floors)<br />

Article 101. In reinforced concrete construction<br />

where reinforcement bars in rectangular<br />

on bothways, the share of distributed load by<br />

both spans may be estimated within the limit<br />

not less than the values obtained by calculation<br />

concrete at age of 28 days, and at the same<br />

time, it shall be less than 18 kg. per sq. cm.:<br />

the following items. However, where main bars<br />

are bent up, that part may be considered as<br />

provided with sMrrups or hoops :<br />

(1) Stirrups and hoopings shall be arranged<br />

properly to take care of shearing stress distribution,<br />

and the spacing shall be less than 2/3<br />

of depth of column, beam or roof slab or floor<br />

slab;<br />

(2) Stirrups shall go around outside of tension<br />

bars and shall be carried into near the edge of<br />

compression side and also, they shall be<br />

anchored appropriately.<br />

CHAPTER IV Fireproof Construction, Fireresisting<br />

Construction, Firezone,<br />

etc.<br />

(Fireproof Construction)<br />

Article 107. By fireproof constructions prescribed<br />

in the provisions Article 2 item (7) of the law<br />

means as described by the following terms, excluding<br />

those that the grounds for finishing or<br />

covering part of steel skeleton with metal lath<br />

concrete, metal lath mortar, concrete mortar or<br />

plaster given in (c) of items (1) to (4) inclusive<br />

are those columns and beams given in item (2)<br />

(a) or (b) with least diameter or width less than<br />

25 cm. However, covering or thickness mentioned<br />

in item (1) (c) or item (2) (c) includes<br />

respectively the thickness of finish such as<br />

mortar plaster and the like.<br />

(1) Pertaining to walls that come under one of<br />

the following items :


(a) Reinforced concrete construction or steel<br />

frame reinforced concrete construction ;<br />

(b) In steel frame concrete construction, the<br />

thickness of concrete protective covering being<br />

3 cm. or more;<br />

(c) Steel frame construction with steel<br />

skeletons both sides of witch are covered<br />

with protective coat of reinforced concrete<br />

or mortar or metal lath of thickness 3 cm.<br />

or over or covered with bricks, stones or<br />

concrete blocks ;<br />

(d) In brick, stone or concrete block constructions<br />

reinforced by steel members, the<br />

thickness of brick, stone or concrete protective<br />

finish or covering being 4 cm. or more.<br />

(2) Pertaining to columns that come under one<br />

of the following items:<br />

(a) Reinforced concrete construction or steel<br />

reinforced concrete construction ;<br />

(b) In steel frame concrete construction, the<br />

thickness of protective covering of concrete<br />

being 5 cm. ormore;<br />

(c) Steel skeleton protected by bricks, stones<br />

or concrete blocks of thickness not less than<br />

7cm.;<br />

(d) Plain concrete, brick, stone or concrete<br />

block construction ;<br />

(e) In brick, stone or concrete block construction<br />

reinforced by steel members, the<br />

thickness of brick, stone or concrete block<br />

protective finish or covering being 7 cm. or<br />

more.<br />

(3) Pertaining to floors that come under one of<br />

the following items :<br />

(a) Reinforced concrete construction, or steel<br />

frame reinforced concrete construction ;<br />

(b) Plain concrete, brick, stone or concrete<br />

block construction of thickness being 3 cm.<br />

or more;<br />

(c) In brick, stone or concrete block construction<br />

of thickness 3 cm. or more reinforced<br />

by steel members, the thickness of<br />

brick, stone, or concrete block finish or<br />

covering being 4 cm. or more, or those steel<br />

materials being covered by mortar on metal<br />

lath or plaster of thickness 3 cm. or more.<br />

(4) Pertaining to beams that come under one<br />

of the following items :<br />

(a) Reinforced concrete construction or steel<br />

frame reinforced concrete construction ;<br />

(b) In steel frame concrete construction the<br />

covering of concrete for steel skeleton being<br />

5 cm. or more;<br />

(c) Steel truss without ceiling directly below<br />

or, in case there is ceiling directly, below,<br />

that ceiling is to be built of mortar on metaj<br />

lath not less than 2cm., or plaster, or wired<br />

(5) Pertaining to roofs that come under the<br />

following items :<br />

(a) Reinforced concrete construction or steel<br />

frame-reinforced concrete construction ;<br />

(b) Plain concrete, brick, stone or concrete<br />

block construction ;<br />

(c) Brick, or concrete block construction reinforced<br />

with steel members;<br />

(d) Metal lath concrete or mortar on metal<br />

lath with the thickness of covering 3 cm. or<br />

more or covered with wired glass.<br />

(6) Pertaining to stairs that come under one of<br />

the following items :<br />

(a) Reinforced concrete construction or steel<br />

frame reinforced concrete construction ;<br />

(b) Plain concrete, brick, stone^or concrete<br />

block construction ;<br />

(c) Brick, stone or concrete block construction<br />

reinforced with steel members ;<br />

(d) Steel construction.<br />

(7) In addition to those given in the preceding<br />

items, that designated by the Minister of Construction<br />

upon hearing the opinion of Director<br />

of National Fire Defence Agency as having<br />

fireproof quality equal to or better than above<br />

mentioned.<br />

2 In beams and columns in 2 topmost floors of a<br />

building or in a building less than 4 stories<br />

where steel frame construction is used, if the<br />

steel skeleton has non-combustible ground, and<br />

finished with protective covering of concrete or<br />

mortar on metal lath of thickness 5 cm. or more<br />

shall be treated as fireproof construction.<br />

(Fire-resisting Construction)<br />

Article 108. Meaning of fire-resisting construction<br />

mentioned in the provisions of Article 2 item (8)<br />

of the Law shall be as described in either one of<br />

the following items :<br />

(1) Mortar finish on metal lath or plaster finish<br />

on wood lath of thickness 2 cm. or more;<br />

(2) Mortar or plaster finish over wood-fibrecement<br />

sheet of total thickness 2.5 cm. or<br />

more;<br />

(3) Cement mortar coating with tile finish of<br />

total thickness 2.5 cm. or more;<br />

(4) Cement mortar finish over cement sheet,<br />

magnesia-cement sheet or common tiles of<br />

total thickness 2.5 cm. or more;<br />

(5) Dozo construction (Japanese earth-vault construction)<br />

;<br />

(6) Earth-plaster wall (shinkabe) construction<br />

with back coating ;<br />

(7) In addition to those mentioned in above<br />

items, that designated by the Minister of Construction<br />

upon hearing the opinion of Director<br />

of National Fire Defence Agency as having<br />

fire-resisting quality equal to or better than<br />

above mentioned.<br />

2 Exterior walls in one story building with framing<br />

constructed of non-combustible materials<br />

surface of which is applied with wood-fibercement<br />

sheet of thickness 1.5 cm. or more, or<br />

fire-protecting timber of thickness 0.9 cm. or<br />

more to receive the finishing of sheet metal shall<br />

be treated as fire-resisting construction.<br />

(Fire-door and Other Fire Protective Facilities)<br />

Article 109. By fire-door and other fire protective<br />

facilities mentioned in the provisions of Article<br />

64 of the Law shall mean any one of the items<br />

as described below :<br />

(1) Fire door A;<br />

(2) Fire door B;<br />

(3) Drencher installed in opening which has<br />

passed the inspection to be conducted by the<br />

National Fire Defence Agency.<br />

2 Fireproof- or fire-resisting exterior wall, wing wall<br />

and other similar construction that built cutting<br />

across an opening in a building or buildings and<br />

all parts of boundary line, center line of road<br />

and center line of exterior wall of each building<br />

constituting more than 2 houses within the same lot<br />

(building with total floor area less than 500 sq. m.<br />

considered as one house) located or separated at<br />

the distance 3 m. or less from the opening concerned<br />

in case of one story and 5 m., or less in<br />

2nd floor or above to the above mentioned center<br />

lines, shall be considered as the fire-facilities<br />

mentioned in the preceding paragraph.<br />

3 In ventilation opening of area 100 sq. cm. or<br />

less, the fire-resisting protection made of iron<br />

plate, mortar slab and other similar materials<br />

(including vent located in part 1 m. less from<br />

ground level protected by metal wire net of<br />

2 mm. mesh.) shall be considered as the firefacilities<br />

mentioned in paragraph 1.<br />

(Construction of Fire-door)<br />

Article 110. Fire door A mentioned in the preceding<br />

Article paragraph 1 item (1) shall mean one<br />

of the constructions describad in one.of the<br />

following items :<br />

(1) Frame shall be steel with steel plate of<br />

thickness 0.5 mm. or more applied on all faces;<br />

(2) Made of steel, with steel plate of thickness<br />

1.5 mm.or more;<br />

(3) Made of steel frame concrete or of reinforced<br />

concrete of thickness 3.5 cm. or more;<br />

(4) Door of dozo-construction *of thickness 15<br />

cm. or more;<br />

(5) That specified as having equal or superior<br />

fire-resisting quality by the Minister of Construction<br />

upon hearing the opinion of the<br />

Director of National Fire Defence Agency in<br />

addition to those given in the foregoing items.<br />

2 Fire-door B mentioned in the preceding Article<br />

paragraph 1 item (2) shall satisfy one of the<br />

following requirements in its construction :<br />

(1) Made of steel plate of thickness less than<br />

1.5 mm.;<br />

(2) Made of steel frame concrete or reinforced<br />

concrete of thickness less than 3.5cm. ;<br />

(3) Door of dozo-construction of thickness less<br />

than 15 cm.;<br />

(4) Steel construction with wired glass inserted;<br />

(5) Fire-protecting timber frame with galvanized<br />

sheet iron applied on all faces;<br />

(6) Fire-protecting timber frame with interior<br />

faces applied with fire-protecting timber board<br />

of thickness 0.9 cm. or more, and its exterior<br />

face protected by application of galvanized<br />

iron sheet ;<br />

(7) That recognized as having equal or superior<br />

fire-resisting quality by the Minister of Construction<br />

upon hearing the opinion of the<br />

Director of National Fire Defence Agency and,<br />

in addition to those given in the foregoing<br />

items.<br />

3 Door for opening of 500sq.cm. or less in area<br />

made of fire-protecting timber frame insertion of<br />

wired-glass shall be considered as fire-door B in<br />

the preceding paragraph.<br />

4 The part of fire door coming in contact with<br />

frame or other fire door shall be of tongue and<br />

groove fit, or of, "jogibuchi" or door stop, so it<br />

shall be intact in place in case of fire, and shall<br />

be so installed that the hardware building fire<br />

door will not show where closed.<br />

5 Fire door mentioned in paragraph 1 item (1) or<br />

item (2), or paragraph 2 item (1) or item (4)<br />

shall be installed in opening where surrounding<br />

of opening (in case fixture is to be installed<br />

within 15cm. inside of fire door, that fixture<br />

shall be included) is constructed of non-combustible<br />

materials or fire-protecting timber.<br />

(Principal Important Materials for Fire Prevention)<br />

Article 111. Cement,metal lath, wire lath, wood-firecement<br />

sheet, fire-protecting timber, fire-protecting<br />

point, or other principal fire-resisting materials<br />

similar to them to be used in structural parts in<br />

addition to the principal parts of construction on<br />

the structural parts of fire-proof construction and<br />

fire-resisting construction or fire doors.<br />

(Fire-preventing Section)<br />

Article 112. Building that its principal part of<br />

construction is constructed of fireproof or noncombustible<br />

materials, and its floor area exceeding<br />

1500 sq. m. there shall be provided with fire<br />

fighting section at convenient part so that total<br />

floor area of part included in that section shall<br />

not exceed 1500 sq. m., and constituting either<br />

floor or wall of fireproof construction, or with<br />

fire door A. However, in the case of a part of<br />

building provided with sprinkler or in the indispensable<br />

case due to its use, such as seating<br />

room, theater, cinema, show house, place of review,<br />

auditorium or assembly hall, indoor sport


oom, factory or others of the similar cases shall<br />

be expected.<br />

2 In case apart of building coming under one of the<br />

items of Article 24 paragraph 1 of the Law that<br />

part and other parts shall be separated by wall<br />

made of fireproof construction or by wall with<br />

both faces made as fire-resisting construction, or<br />

provided with fire door A or fire door B (excluding<br />

the type mentioned in Article 110 paragraph<br />

2 item (3) and item (6). ><br />

3 In case a part of building coming under one of<br />

the items of Article 27 of the Law that part and<br />

other parts shall be separated by floor or wall<br />

made of fireproof construction and fire door A.<br />

(Fire Wall in Wooden Buildings, etc.)<br />

Article 113. Fire wall shall be constructed as required<br />

by the following items :<br />

(1) Self supporting structure of fireproof construction<br />

;<br />

(2) In wooden building, neither concrete construction<br />

nor masonry construction shall be<br />

allowed ;<br />

(3) Both ends and top of fire wall shall project<br />

out from exterior walls and roof not less than<br />

50cm. (in case exterior wall of a building<br />

located on both sides of fire wall and underneath<br />

of eave or ground for roof for distance<br />

of 1.8 m. or less are of fire-resisting construction,<br />

and at the same time there is no opening<br />

in the parts mentioned herein, that projecting<br />

part may be 10cm.). However, in case fireproof<br />

exterior wall or roof is of fire-resisting<br />

construction located at section of width 3.6 m.<br />

or more including fire wall, and at the same<br />

time there is no opening or the opening in that<br />

part is provided with fire door or sash window<br />

made of fire protecting timber with insertion<br />

of wired-glass is installed, that part shall be<br />

excepted ;<br />

(4) Opening in fire wall shall be less than 2.5<br />

m.sq. and it shall be provided with fire door A;<br />

(5) Space between fire wall and passing water<br />

pipe, electric wire conduct and other pipes shall<br />

be filled with mortar,<br />

(Principal Partition Wall, etc. for Building)<br />

Article 114. Partition wall between each unit of<br />

multifamily tenant housing or apartment house<br />

shall be built as fireproof or fire-resisting construction,<br />

and it shall be carried up to roof truss<br />

or ceiling space.<br />

2 Principal partitionwall in the part of a building<br />

used as school, hospital, medical office, (excluding<br />

those having no facilities for accommodation<br />

of patients), hotel, Japanese hotel, lodging house,<br />

dormitory or market as concerned in the matter,<br />

shall be built as fireproof or fire resisting con-<br />

struction, and shall be carried up to roof truss or<br />

ceiling space.<br />

B When roof trusses of a building exceeding 300<br />

sq.m. in its building area are constructed of<br />

wood, a partition wall with its both sides built<br />

of fire-resisting construction shall be provided in<br />

roof truss space at points not exceeding 12 m.<br />

measured along the side wall girder.<br />

4 Passageway connecting two buildings of total<br />

floor area exceeding 200 sq. m., and of length 4m.<br />

or more with wooden trusses shall be provided<br />

with partition in roof truss space built of fireproof<br />

construction or fire-resisting construction<br />

on both faces.<br />

(Chimney built within Building)<br />

Article 115. Chimney built within building shall<br />

satisfy the structural requirements as described<br />

in the following items :<br />

(1) Vertical distance of projection of chimney<br />

built within a building to the face of roof shall<br />

not be less than 60cm.; however, in case of<br />

brick, stone or concrete block construction built<br />

without reinforcing steel members, the part<br />

projected up shall be not less than 90 cm;<br />

(2) In case there is a building at horizontal<br />

distance less than 1 meter from the top of a<br />

chimney, the chimney shall be carried up 60cm.<br />

or more above the eave of a building concerned;<br />

(3) Part of chimney built of metal or asbestos,<br />

going through roof truss space, ceiling space,<br />

floor space, etc., shall be covered with incombustible<br />

materials other than metal ;<br />

(4) Metal or asbestos chimney shall be built at<br />

least 15 cm. away from wooden or other combustible<br />

material, excepting that part covered<br />

with incombustible materials other than metals<br />

of thickness 10 cm. or more;<br />

(5) Part of chimney of fireplace built in with<br />

wall in a building that is in interior of house<br />

shall be constructed of reinforced concrete of<br />

thickness 15cm. or more, or plain concrete<br />

brick, stone or concrete block construction of<br />

thickness 25cm. or more, and in brick, stone<br />

or concrete block chimney shall be lined with<br />

earthenware pipes or with finish of cement<br />

mortar ;<br />

(6) In the case of fireplace built in with wall<br />

where bend is less than 120°, there shall be an<br />

opening at the bend ifor cleaning.<br />

(Quantity of Dangerous Materials)<br />

Article 116. Quantity of dangerous materials mentioned<br />

in Article 27 item (6) of the Law is as<br />

listed below :

2 In case of temporary uses for engineering works<br />

and other enterprises, the limit of the quantity<br />

of dangerous materials permitted to.b#e stored<br />

for the purpose of carrying out the work, andthe<br />

limit of quantity of compressed gas or liquified<br />

gas of combustion-resisting or incombustible<br />

quality shall be unrestricted.<br />

3 In case more than two kinds of the dangerous<br />

materials given in the table of paragraph 1 are<br />

to be stored in the one building, the limit of the<br />

dangerous materials prescribed by paragraph 1<br />

shall be obtained by dividing the volume of<br />

quantity of dangerous material intended to be<br />

stored by the built of the value of the quantity<br />

of dangerous material in the column concerned,<br />

and the case the value of sum respective quotients<br />

istobe 1.<br />

CHAPTER V Facilities for Escape<br />

Section 1 Corridor, Escape Stairways and<br />

Exits<br />

(Scope of Application)<br />

Article 117. The provisions of this Section shall<br />

apply to special buildings mentioned in Article 35<br />

of the Law or to a building with total floor area<br />

of living rooms exceeding 1,000 sq. m. However,<br />

as to part partitioned fire-proof walls without any<br />

opening for living room with total area less than<br />

1,000 sq.m. which shall not be used as special<br />

building enumerated in said Article, they shall<br />

not apply.<br />

(Door in Exits to Audierxa Hall)<br />

Article 118. Doors installed in exits of audience<br />

Article 119. Width of corridor or passageways<br />

shall be wider than the figures given in the<br />

following table :

Article 120. In floors other than escape-floor (floor<br />

with exits directly leading to ground, hereinafter<br />

, the same) of a building, a distance by walk from<br />

each part of living room to one of through stair<br />

ways leading directly to escape floor (including<br />

ramp; hereinafter the same) shall not exceed<br />

the values given in the following table :<br />

(Providing Through Stairways and its Structure)<br />

Article 121. In case floors other than escape-floor<br />

of a building come under one of the following<br />

items, more than two through stairways beading<br />

from that story to escape-floor shall be provided.<br />

However, of those mentioned in from item (2) to<br />

item(4) inclusive, if its principal structural parts<br />

are constructed as fire-proof structure or constructed<br />

of incombustible materials, the provision<br />

of item 5 shall govern:<br />

(1) Use for theater, cinema, show house, place<br />

of viewing, auditorium, or department store or<br />

meeting place ;<br />

(2) Of floors for use as hospital or medical office,<br />

the floor in which the total floor area for<br />

patients use exceeds more than 50 sq.m.;<br />

(3) Of floors for use as hotel, Japanese hotel or<br />

lodging house, the floor in which the total floor<br />

area of bed room for guest is 100sq.m.; or of<br />

floors for use as apartment houss, the floor in<br />

which the total floor area of living room exceed<br />

100sq.m.; or of floors for use as dormitory,<br />

the floor in which the total floor area for sleeping<br />

rooms exceeds 100 sq.rn. or more;<br />

(4) Of floors other than those mentioned in<br />

preceding two items, floor in which the total<br />

floor area of living rooms directly above or<br />

directly below escape-floor exceeds 200 sq. m.<br />

and of other floors, the floor in which total area<br />

floor exceed 100 sq. ;<br />

(5) Of floors of a building with its principal<br />

structural parts built as fireproof construction<br />

or with incombustible materials, the floor in<br />

which the total floor area of living rooms<br />

exceeds 400 sq. m.<br />

2 In case a building is divided into sections by<br />

means of fireproof partitions without any opening<br />

the provisions of preceding paragraphs shall apply<br />

to the respective sections.<br />

3 Through stairways under the provisions of paragraph<br />

1 that are provided outside, shall not be of<br />

wooden construction.<br />

(Providing Escape Stairways)<br />

Article 122. Through stairways leading to 5th floor<br />

or above in a building of 5 floors or more above<br />

ground level shall be escape stairways or special<br />

escape stairways in accordance with the provision<br />

of Article 123.<br />

2 In a building for use asdepartment store coming<br />

under the provisions of Article 27 item (4) of the<br />

Law, two or more through stairways shall ba<br />

provided leading to and from sales rooms of each


floor and open space in roof and they snail become<br />

escape-stairways or special escape stairways<br />

prescribed in Article 123.<br />

3 One of through stairways mentioned in the<br />

preceding paragraph that lead to or from sales<br />

room of 5th floor and above shall be special<br />

escape stairs prescribed in Article 123 paragraph<br />

3.<br />

4 In a part of a building above 5th floor used as<br />

department store with total floor area exceeding<br />

3,000sq.m. special escape stairs prescribed in<br />

Article 123 paragraph 3 one for every 3,000sq.m.<br />

of floor area shall be provided which will not<br />

serv6 for 4th floor and floors below 4th.<br />

(Structure of Escape and Special Escape Stairways)<br />

Article 123. Escape stairways to be installed inside<br />

a building shall be built in accordance with<br />

the construction described in the following items.<br />

However, for top floor, the provisions of item(l),<br />

item (3) or item (4) may not apply:<br />

(1) Stair-case shall be surrounded with fireproof<br />

walls excepting the part in direct contact with<br />

outside air part of the windows of item (3) or<br />

the exits of item (4) ;<br />

(2) Windows and other effective opening for<br />

taking in light or the illumination equipment<br />

with supplementary electric supply shall be<br />

* provided in staircase;<br />

(3) In case windows are to be provided inwalls<br />

of staircase facing inside house, area of each<br />

windows shall be less than 1 sq. m., and fixed<br />

steel sash window with wired glass shall be<br />

installed therein ;<br />

(4) Exits to stairways from inside of house shall<br />

be provided with automatic closing fire door A<br />

or steel door with wired glass which may be<br />

opened in case of necessity;<br />

(5) Door or its auxiliary exit door mentioned in<br />

the preceding item shall be installed to open<br />

toward direction of escaping;<br />

(6) Stairways shall be of fireproof construction,<br />

and it shall lead directly to escape-floor.<br />

2 Escape stairways to be provided outside of a<br />

house shall be constructed as required by the<br />

following items; however, as for top, provisions<br />

of item (1) or item (2) may not apply:<br />

(1) Stairways shall be provided at distance 2 m.<br />

or more away from the opening (excluding an<br />

opening 1 sq.m. or less in area with fixed steel<br />

sash window with wired glass in) other than<br />

the exit leading to those stairways from inside<br />

of house;<br />

(2) Exits for stairways connecting to or from<br />

inside of house shall be provided with automatic<br />

fire-door A or steel sash door with wired glass<br />

which may be operated at any time;<br />

(3) Door or auxiliary exit door in it mentioned<br />

in the preceding item shall be installed to open<br />

to direction of escaping ;<br />

(4) Stairways shall be of fireproof construction<br />

which shall lead directly to ground level.<br />

3 Special escape stairways shall be constructed in<br />

accordance with the requirements of the following<br />

items; however, as for top, provisions of item<br />

(1) item (2), item (4) or item (5) may not<br />

apply:<br />

(1) Either balcony or attached room with<br />

window open to outside air shall be provided,<br />

between inside of the house and stair-casa;<br />

(2) Excluding part of opening directly in contact<br />

with outside air or part of window of item (5),<br />

part in exits of item (7) or item (8), stair-case<br />

and attached room shall be surrounded by fireproof<br />

wall ;<br />

(3) Stair-case shall be provided with window<br />

facing attached room and other effective opening<br />

for taking in light or shall be installed illuminating<br />

equipment with extra source of<br />

electricity ;<br />

(4) Stair-case shall not be provided with opening<br />

*facing inside house except at parts facing<br />

balcony and attached room ;<br />

(5) In case window is provided in apart facing<br />

balcony or attached room of stair-case, sash<br />

window shall be fixed;<br />

(6) In balcony and attached room, no opening<br />

except exit in walls facing inside of the houss<br />

outside of stair-case shall be provided;<br />

(7) Exit leading from inside house to balcony<br />

or attached room shall be installed with automatic<br />

fire door A tjaat may be operated at any<br />

time;<br />

(8) Exit leading from balcony or attached room<br />

to staircase shall be provided with automatic<br />

door that may be operated at any time;<br />

(9) Door or its auxiliary door mentioned inthe<br />

preceding two items shall be so installed as to<br />

open to direction of escaping;<br />

(10) Stairways shall be constructed as fireproof<br />

and shall lead directly to escape floor.<br />

(Width of Escape Stairways, etc. in Department<br />

Store)<br />

Article 124. With respect to the escape stairs,<br />

special escape stairs and width of exits leading<br />

to these in a building used as department store,<br />

the requirements of the following items shall be<br />

observed :<br />

(1) Total of the widths of escape stairways and<br />

special escape stairways in each floor shall be<br />

not less than the values obtained by calculating<br />

by the following proportion in floors above<br />

ground level 6cm. per 100sq. m. of total floor<br />

area (part of floor used for department store,<br />

hereinafter the same in this Article and Article<br />

125) of each floor directly above that floor from<br />

which one is to take refuge by means of that<br />

escape stairways and special escape stairways


and at the same time more than 30cm. per<br />

100 sq. m. of floor area of that floor;<br />

(2) Total of widths of exits leading to or from<br />

escape stairs and special escape stairs in each<br />

floor shall be more than the values obtained by<br />

calculating by the following proportions per 100<br />

sq.m. of that floor in each floor: more than<br />

27 cm. in floors above ground level, more than<br />

36 cm. in ground floor.<br />

2 Regarding calculation of the required widths<br />

mentioned in the provisions of the preceding<br />

items, escape stairs and special escape stairways<br />

chiefly leading to escape-floor from one floor or<br />

two floors above ground level may be considered<br />

as those having the width of 1.5 times.<br />

3 In applying the provisions of tha preceding two<br />

paragraphs, open space in roof shall be considered<br />

same as other floors.<br />

(Exits to Outside of Building)<br />

Article 125. In escape-floor the walking distance<br />

leading from stairways to one of the exits to<br />

outside of a building shall be less than the value<br />

given in the provisions of Article 120.<br />

2 Doors in exits leading to outside of a building<br />

for use of audiences in theater, cinema, showhouse,<br />

place of viewing, or auditorium, or meeting<br />

place shall not be installed to open in.<br />

3 Total of widths of exits in escape-floor of department<br />

store leading to outside shall be more than<br />

the values obtained by calculation under the<br />

following proportion; 6 cm. per 100 sq. m. or<br />

total floor area of each floor, and at the same<br />

time more than 40cm. per 100 sq.m. in floor<br />

area of largest floor.<br />

4 The provisions of paragraph 3 of the preceding<br />

Article shall apply to the preceding paragraph<br />

mutatis<br />

mutandis.<br />

(Open Space in Roof)<br />

Article 126. Open space in roof shall be surrounded<br />

by parapet wall or wire fence of height 1.1 meters<br />

or more necessary for safety.<br />

2 In case the floors above 5th floor of a building<br />

are to be used as sales rooms of department<br />

store, an open space in roof available for refuge<br />

shall be provided.<br />

Section 2 Passages within Building Site<br />

Necessary for Escape and Defence<br />

against Fire<br />

(Scope of Application)<br />

Article 127. The provisions of this section shall<br />

aor-ly to the buildings mentioned in Article 35 of<br />

the Law.<br />

(Passageways within Building Site)<br />

Article 128. Building site shall be provided with<br />

passageways 1.5m. or more in width leading from<br />

outside escape stairways mentioned in Article 123<br />

paragraph 2, and with exits mentioned in Article<br />

125 paragraph 1 to road, park, open space and<br />

other large vacant spaces.<br />

(Passageway in Site for large Scale Wooden<br />

Building) *-<br />

Article 129. If-a building with whole of its principal<br />

structural parts is constructed of wood and<br />

exceeding 1,000sq.m. in total floor* area or a<br />

part of principal structural part is wood construction<br />

when its total floor area (excluding<br />

floor area of the part, for which principal structural<br />

parts are fireproof and separated from other<br />

parts by means of fireproof walls and fire doors<br />

A if any; hereinafter the same in this Article)<br />

exceed 1,000 sq. m., it shall be surrounded by<br />

passage 3 m. wide or more (except the part<br />

bounded by a road). However, in- case the total<br />

floor area is less than 3,000 sq. m., the width of<br />

passageway along the boundary line of adjacent<br />

lot may be 1.5m. or more.<br />

2 In case there is a building composed of more<br />

than 2 houses or more in the same building site<br />

(excluding a building with its principal structural<br />

parts are either built or are of fireproof construction<br />

or with incombustible materials, and those<br />

with floor area exceeding 1,000 sq.m.), if its<br />

sum of total floor area exceeds 1,000 sq. m., the<br />

part constituting the total of total floor area over<br />

in 1,000 sq.m. shall be divided into section of<br />

building with total floor area kept within 1,000<br />

sq. m. and shall be surrounded by passageways 3<br />

m.or more in width (excluding parts bounded by<br />

road or boundary lines of adjacent lots.)<br />

B The exterior wall (if there are eaves, including<br />

underneath thereof) of fireproof construction and<br />

having fire floor at an opening liable to fire<br />

spread, if it is cut away effectively against fire<br />

door by means of buildings with total floor area<br />

kept within 1,000 sq. m. the provision of the<br />

preceding paragraph shall not apply to these<br />

buildings. However, in case the total of total<br />

floor of the building exceeds 3,000sq. m., the part<br />

constituting the total of that total floor area not<br />

exceeding 3,000 sq. m. shall be surrounded by<br />

passage (excluding the parts bounded by roads or<br />

boundary lines of adjacent lots) 3m. or more in<br />

width.<br />

4 Irrespective of the provisions of the preceding<br />

items, passageway may go through the corridor<br />

coming under the provisions of the following<br />

items. However, the passageway out through<br />

the corridor shall be more than 2.5m. in width<br />

and height :<br />

(1) Width not over 3 meters;<br />

(2) Not to be used except for passage or light<br />

transport.<br />

5 Passageways mentioned in each preceding paragraph<br />

shall lead and reach to the roads on which<br />

abuts the building site,


CHAPTER VI Use Zone<br />

(Moderation of Restrictions for Existing Buildings)<br />

Article 130. Permissible scope of enlargement, remodelling<br />

or change of usa of existing buildings<br />

not complying with provisions of Article 49 of the<br />

Law or Article 50 paragraph 2 or paragraph 4 of<br />

the Law shall be as provided for in. the following<br />

items with the standard at the time when the<br />

building concerned has come not to comply with<br />

these provisions (hereinafter referred to as<br />

"standardized time" in this Article) :<br />

(1) The enlargement or remodelling is to be<br />

done in the site at standardized time, and the<br />

area or total area of building for enlargement<br />

or remodelling is not to exceed the percentage<br />

against area of site at standardized time prescribed<br />

in the provisions respectively in Article<br />

55 of the Law or Article 56 of the Law;<br />

(2) After standardized time total floor area to<br />

be increased by extension (in case extension<br />

involves more than two houses or enlargement<br />

undergoes by several extension works, total of<br />

floor areas increased by these enlargement works)<br />

shall not exceed 1/2 of total floor at standardized<br />

time (in case there is a building constituting<br />

more than two houses in the same site, tota1<br />

floor area thereof) ;<br />

(3) Total floor area of part of a building (total<br />

of floor areas increased by these enlargement<br />

of change of use when several extensions or<br />

change of use take place) not appropriate for<br />

uses mentioned in the provisions of Article 49<br />

of the Law or Article 50 paragraph 2 or paragraph<br />

4 of the Law concerned with the increase<br />

through enlargement or change of use after<br />

standardized time shall not exceed 1/2 of the<br />

total of that floor area at standardized time;<br />

(4) In the case where the cause not complying<br />

with the provisions of Article 49 of the Law is<br />

due to horse power of motors or number of<br />

machineries, the total of horse power of motors<br />

or number of machineries increased by enlargement<br />

of building or change thereof after standardized<br />

time (in case enlargements take place<br />

at several occasions, the total of these enlargements)<br />

shall not exceed 1/2 of total of horse<br />

power or number of machineries at standardized<br />

time.<br />

CHAPTER VII Height of Building<br />

(Disposal about Moderation in Height)<br />

Article 131. Disposal about moderation of application<br />

of the provisions of Article 58 paragraph 1<br />

or paragraph 2 of the Law under the provisions<br />

of paragraph 3 of the same Article shall be as<br />

prescribed in this Chapter.<br />

2 In the case of area where land replotting has<br />

been executed as well as other areas where<br />

street blocks have been readjusted In like manner,<br />

the road on which abut the street blocks, subject<br />

to the designation of administrative agency concerned<br />

shall be treated as the front road.<br />

(In case of having more than two Front Roads)<br />

Article 132. In case more than two front roads to<br />

a building exist, regarding the area with horizontal<br />

distance from the boundary line of front road<br />

which is largest within the limit of twice the<br />

width of that road, or at the same time with the<br />

-distance within the limit of 35 and regarding the<br />

area with the horizontal distances from center<br />

line of other front roads exceeding 10m., the<br />

width of all front roads shall be treated as having<br />

the same width as the widest front road.<br />

2 With regard, out of the areas other than that<br />

mentioned in the preceding paragraph, to the<br />

area with horizontal distance from the boundary<br />

line of one front road within the limit of twice<br />

the width of that road and at the same time<br />

with the distance within the limit of 35m., the<br />

front road thereof only may be considered as the<br />

front road.<br />

3 With regard, out of the areas other than that<br />

mentioned in paragraph 1, to the area with<br />

horizontal distance from the boundary line of<br />

more than two roads within the limit of twice<br />

the widthof each road and at the same time<br />

with the distance within the limit of 35m., the<br />

narrowest road of the front roads thereof shall<br />

be considered as having the same width of the<br />

wider road.<br />

(When Site abuts on Park, Open Space, Body of<br />

Water, etc.)<br />

Article 133. In case a site of a building abuts on<br />

park, open space, body of water, or others of the<br />

similar nature, the height of each and all part of<br />

said building may be taken 1.5 times or less<br />

(1.25 times in residential zone) of the horizontal<br />

distance measured from the boundary line of the<br />

opposite side of the front road, and at the same<br />

time, it shall not exceed twice the width of front<br />

road (1.75 times in residential zone) increased<br />

by 8m., and it shall not exceed the width of said<br />

park, open space, body of water, or others of the<br />

same or similar nature.<br />

(In case Park, Open Space, Body of Water or the<br />

Like exists on the Opposite Side of Front Road)<br />

Article 134. In case park, open space, body of<br />

water or the like exists on the opposite side of<br />

front road, the height at any and all parts of said<br />

building shall be less than 1.5 times of the<br />

horizontal distance from that part or parts of<br />

building to the boundary line on opposite side of<br />

said park, open space, body of water or the like<br />

(1.25 times in residential zone), and at the same<br />

time, it does not exceed twice the width of front<br />

road (1.75 times in residential zone) plus 8 m.<br />

Article 135. In case there is wall-surface line<br />

receded front road boundary line is opposite front<br />

road, the height of each part of that building<br />

shall be 1.5 times (in residential zone 1.25 times)<br />

the distance measured horizontally from that<br />

part to that wall line, or less, and at the same<br />

time it shall not exceed the width equal to or<br />

less than 1.5 times the width of front road (1.25<br />

times in residential zone) plus 8 m.<br />

(In Case Level of Road and Building Site not at<br />

Same Height)<br />

Article 136. In case the level of building site is<br />

higher than front road by 1 m. or more, the front<br />

road shall be considered to exist at tbe level<br />

equal to 1/2 or the difference of levels or the<br />

ground and building sites and the front road<br />

minus one meter.<br />

2 In case the administrative agency concerned<br />

deems it extremely improper to apply the pro*<br />

cedures as prescribed in the provisions of the<br />

preceding paragraph by reason of the special<br />

character of feature of land, irrespective of the<br />

provisions of said paragraph, the height of the<br />

position of that road may, by regulation, be<br />

determined as deemed proper so long as the<br />

height is kept within the level of ground at the<br />

position and site prescribed by the provisions of<br />

the same paragraph.<br />

CHAPTER VIII Miscellaneous Provisions<br />

!<br />

(Similarity of Uses)<br />

Article 137. The mutual relation of similar uses<br />

as provided for in the proviso to Article 87 paragraph<br />

2 of the Law shall, in case of existing<br />

building, mean the mutuality of uses belonging to<br />

the same item in the following items:<br />

(1) Theater, cinema, show house, auditorium,<br />

meating place ;<br />

(2) Department store, market;<br />

(3) Hotel, Ryokan (Japanese hotel) ;<br />

(4) Apartment house, dormitory, lodging house,<br />

hospital, medical office (excepting that which<br />

has no accommodating facilities for patients).<br />

Regarding the application of the provisions of<br />

Article 49 of the Law or Article 50 paragraph 2<br />

or paragraph 4^ of the Law, irrespective of the<br />

preceding paragraph, and in the case of existing<br />

building, mean the mutual uses of the same item<br />

of each item (if there is any item separated by<br />

parenthesis within the item, meant by that item ;<br />

in paragraph (c) item 1 item (1), item (2), item<br />

(3), item (4) and item (12) where it says "manufacture"<br />

shall also include disposal as well as of<br />

annexed Table No. 1 of the Law (excluding parts<br />

concerning articles or things of paragraph (A)<br />

item 1 paragraph (B) item (1) and paragraph (C)<br />

item 2 item (1), item (2), item (3), item (4) and<br />

item (12)) and the each item of annexed Table<br />

No. 2 of the Law.<br />

3 Regarding the designation of similarity of uses<br />

provided for in the proviso to the same paragraph<br />

in case of applying mutatis mutandis of the<br />

provisions of the by-law given in the same paragraph<br />

in accordance with the provisions of Article<br />

87 paragraph 2 of the Law irrespective of the<br />

provision of paragraph 1, separate provision may<br />

be made by the same by-law.<br />

(Designation of Structures)<br />

Article 138. In accordance with the provisions of<br />

Article 88 paragraph 1 of tfie Law, the following<br />

items of structures (excluding those concerning<br />

operation, safety, etc., within the site of railway<br />

and tramway shall be designated :<br />

(1) Chimney exceeding 6m. in height (in case<br />

there is frame for support or stay lines, the<br />

same included and the stove-chimney excluded) ;<br />

(2) Reinforced concrete column, steel column,<br />

wooden column exceeding 15m. in height or<br />

other similar ones (excluding flag pole and<br />

transmission poles for electricity) ;<br />

(3) Advertisement tower, advertisement boanjn<br />

decoration tower, memorial tower, and other<br />

similar structures ;<br />

(4) Wooden elevated tank, silo and watch tower<br />

exceeding 8m. in height or other similar<br />

structures ;<br />

(5) Retaining walls exceeding 2m. in height,<br />

(Chimney and Stays at Chimney)<br />

Article 139. Regarding the chimney given in paragraph<br />

1 item (1), of the preceding Article in<br />

addition to applying mutatis mutandis the provisions<br />

of Article 36, Article 37, Article 40, Article<br />

41, Article 47, Article 51 paragraph 1, Article 52,<br />

Article 53, Section 5? Section 6 (excluding Article<br />

76 to Article 78 inclusive) and Section 7 (Article<br />

51 paragraph 1, Article 53, Article 71, Article 72,<br />

Article 74 and parts applying mutatis mutandis of<br />

Article 75 only) the following items shall apply<br />

respectively according to the structural requirement:<br />

(1) Chimney constructed of terra cotta pipes,<br />

concrete pipes or pipes of similar make shall<br />

use mortar with cement at each connection or<br />

joint, and it shall be tied firmly to the supporting<br />

frame, or supporting frame and stay wires.<br />

However, those exceeding 10 m. in height shall<br />

be built of self-supporting frames ;<br />

(2) Chimney of masonry construction shall be<br />

provided with steel frame to prevent it from<br />

falling down;<br />

(3) In reinforced concrete chimney, the thickness<br />

of concrete cover over steel bars shall be<br />

more than 5cm;<br />

(4) Chimney exceeding 16m. in height shall be<br />

of reinforced concrete construction which requires<br />

no stay wires.


2 Stay wires of achimney shall be fixed to areinforced<br />

concrete pile or to a building or structure<br />

free from getting rot or to a wooden pile treated<br />

with creosote or the like.<br />

(Reinforced Concrete Columns, etc.)<br />

Article 140. Regarding those given in Article 138<br />

item 2, the provisions of Article 36, Article 37,<br />

Article 40, Article 41, Article 47, Section 5 and<br />

Section 6 (excluding Article 76 to Article 78 inclusive)<br />

shall apply mutatis mutandis.<br />

(Advertisement Tower or Elevated Tank, etc.)<br />

Article 141. Regarding those given in Article 138<br />

item (3) or item (4), they shall be of construetion<br />

other than that of masonry or plain concrete<br />

structure.<br />

2 Regarding those given in the preceding paragraph,<br />

the provisions of Article 36, Article 37,<br />

Article 40 to Article 42 inclusive, Article 44,<br />

Article 46 paragraph 1, Article 47, Section 5 and<br />

Section 6 shall apply mutatis mutandis.<br />

(Retaining Walls)<br />

Article 142. Regarding the retaining walls mentioned<br />

in Article 138 item (5), in a addition to applying<br />

the provisions mutatis mutandis to the provisions<br />

which apply mutatis mutandis in Article<br />

36, Article 37 paragraph 3, Article 51 paragraph<br />

1, Article 62, Article 72 paragraph 1, Article 72,<br />

Article 73 paragraph 1, Article 74, Article 75,<br />

Article 79 and Section 7, the following items shall<br />

be required for their structures :<br />

(1) To be constructed of reinforced concrete,<br />

stone wall, and other constructions that use<br />

Supplementary Provisions :<br />

(Date of Enforcement)<br />

1. In this Cabinet Order, the provisions of Chapter<br />

I Section2 shall come into force as from the day<br />

of its promulgation and other provisions, as from<br />

November 23, 1950.<br />

(Special Case of First Examination of Qualification<br />

after the Enforcement of the Law)<br />

2. In the first examination of qualification after<br />

the enforcement of the Law irrespective of the<br />

provisions of Article 4 paragraph 3, a person who<br />

had administrative experience for more than 10<br />

years regarding the former Urban Building Law<br />

(Law No. 37 of 1919) or execution of the Building<br />

Standard Law and who also, within five years<br />

previous to the day of enforcement of the said<br />

examination of qualification, had post as chief of<br />

bureau, division, or section concerned with building<br />

administration in To, Do, Fu or prefecture,<br />

or Reconstruction Board, Construction Board or<br />

Ministry of Construction for more than one year,<br />

or a person who is recognized as having the<br />

knowledge and actual and practical experience<br />

equal or superior to those mentioned above, the<br />

subjects given in item (6) to item (8) inclusive<br />

shall be exempted.<br />

(Temporary Examination of Qualification)<br />

3. Examination for qualification to be conducted<br />

within one year reckoning from the day of enforcement<br />

of the Law, in addition to the examination<br />

of qualification under the provisions of<br />

Article 3 and Article 4, temporary examination<br />

for qualification may be held in accordance with<br />

the provisions of paragraph 4 and.paragraph 5 of<br />

the Supplementary Provisions.<br />

4. Temporary examination for qualification shall<br />

be conducted to test the knowledge and experience<br />

concerning technics and Laws and Ordinances on<br />

buildings necessary for confirmation thereof in<br />

accordance with the provisions of Article 6 paragraph<br />

1 item (4) of the Law in respect to buildings.<br />

5. Temporary examination for qualification shall<br />

be conducted on deliberation of past records and<br />

by tests ; deliberation of past records pertains to


uilding administration or practical experiences<br />

respecting building execution while tests shall be<br />

made on the subjects given in the first column<br />

as may be required. However, persons coming<br />

under the second column shall be exempted from<br />

the subjects shown in the left:<br />

6. Temporary examination for qualification in<br />

accordance with the provisions of the preceding<br />

three paragraphs shall be effective for the period<br />

of 3 years only reckoning from the day of the<br />

enforcement of the Law.<br />

(Special Cases of Fire Doors)<br />

7. In case of providing fire door in accordance<br />

with the provision of Article 64 of the Law, the<br />

buildings to bi built within the period of one<br />

year from the day of the enforcement of this<br />

Cabinet Order in the district to be designated<br />

upon obtaining the consent of fire-chief of chief<br />

of fire-station in charge of the district concerned,<br />

if the administrative agency concerned deems it<br />

extremely difficult to provide the fire door and<br />

other fire prevention equipments, the simplified<br />

fire-door constructions mentioned in any of the<br />

following items may take place of the fire-door B<br />

prescribed by the provisions of the same Article.<br />

In this case the provision of Article 110 paragraph<br />

5 shall not apply:<br />

(1) Those made of sheet metal, asbestos sheet,<br />

magnesium-cement sheet, fire-resisting lumber,<br />

wired glass and others of the similar materials,<br />

not coming under the ways of construction<br />

mentioned in Article 110 paragraph 2 item (1)<br />

or item (4) to item (6) inclusive;<br />

(2) Those with wooden frames covered outside<br />

with sheet metal.<br />

(Partial Amendment of Enforcement Provisions<br />

documents given in columns (a) and (b), for<br />

paragraph the drawings and documents given in<br />

columns (a), (b) and (c). However, the drawings<br />

and documents in column (a) may he combined<br />

2 In case times to be shown in the table of the<br />

preceding paragraph are shown in other drawings<br />

and documents which are to be submitted with<br />

the application, irrespective of the provision of<br />

the same paragraph, it is not required to include<br />

in the drawings and documents concerned.<br />

3 When special administrative agency deems it<br />

specially necessary for giving confirmation that<br />

the building in the submitted application is properly<br />

prepared in accordance with the provisions<br />

of the regulation based on the provisions of<br />

Article 39 paragraph 2, Article 40, Article 43<br />

paragraph 2, Article 53 paragraph 3 and Article<br />

68 paragraph 3 of the Law, it may, by regulations<br />

in addition to the provisions provided in<br />

the same paragraph, establish necessary provisions<br />

respect to drawings and documents to be<br />

submitted together with the application.<br />

4 In case the plans for construction of the building<br />

in the application are drawings and documents<br />

prepared by architect, the special _administrative<br />

agency may, irrespective of the<br />

provision of the paragraph 1, by regulation,<br />

prescribe to the effect that it need not to submit<br />

whole or a part of the drawings and documents<br />

given in column (c) of the same Table.<br />

(Form of Notice of Confirmation)<br />

Article 2. The notice of confirmation in accordance<br />

with the provision of Article 6 paragraph 2<br />

of the Law shall be given by filling in the column<br />

of confirmation notice in a copy of application<br />

for confirmation mentioned in paragraph 1 of<br />

the preceding Article.<br />

2 The notice to the effect that it fails to satisfy<br />

the requirements of the provisions of Article 6<br />

paragraph 3 of the Law shall be done by the<br />

notice of Form No. 2 in annexed sheet accompanied<br />

with the copy of the application for confirmation<br />

of paragraph 1 of the preceding Article<br />

together with the accompanying drawings and<br />

documents in the application.<br />

3 The form of notice for notifying to the effect<br />

that no decision will be possible as to whether<br />

it satisfy or fails to satisfy the requirements of<br />

the provisions of Article 6 paragraph 3 of the<br />

Law shall be as shown in Form No.3 in annexed<br />

sheet.<br />

(Application for Confirmation of Structural and<br />

Form of Notice of Confirmation)<br />

Article 3. Application for confirmation to be submitted<br />

to the building official in case one intends<br />

to erect a structure given in Article 138 of the<br />

Building Standard Law Enforcement Ordinance<br />

(hereinafter called *Ordinance") shall be as<br />

shown in Annexed Form No. 4 original and copy<br />

together with accompaniment of the following<br />

drawings and documents.<br />

2 In case application for confirmation respect to<br />

structure is to be submitted in combination with<br />

the application for confirmation of building, in place<br />

of the application for confirmation of the preceding<br />

paragraph, the application for confirmation of<br />

Article 1 paragraph 1 accompanied with the documents<br />

inscribed with the required matters in the<br />

column "outline of structure" within the Annexed<br />

Form No. 4 and the drawings given in the Table<br />

of the preceding paragraph (sketch map of<br />

surroundings of site or plot plan may be left out<br />

in case the items to*be shown in sketch map of<br />

surroundings of site or in plot plan are shown in<br />

sketch map of surroundings of site or in the plot<br />

plan required in Article 1 paragraph 1) shall be<br />

submitted.<br />

3 In case the plans for construction of structure<br />

in the application are drawings, specifications<br />

and documents prepared by architect, the special<br />

administrative agency may, irrespective of the<br />

preceding two provisions and by regulations,<br />

prescribe to the effect that the structural details<br />

given in the Table of paragraph 1.<br />

4 The provisions of the preceding Article shall<br />

apply mutatis mutandis respect to the notice of<br />

confirmation of structure.<br />

(Report of Completion of Work and Form of Inspection<br />

Completed)<br />

Article 4. Annexed Form No. 5 and Form No. 6<br />

shall be used respectively for written report<br />

(report, work completed) on work completed in<br />

accordance with the provisions of Article 7<br />

paragraph 1 of the Law and for certificate of inspection<br />

completed in accordance with the<br />

provisions of paragraph 3 of the same Article.<br />

(Form of Certificate of Identification)<br />

Article 5. Annexed Form No.7shallbe used as the<br />

certificate of identification to be carried by the<br />

public officials of city, town or village, or To,<br />

Do, Fu or prefecture concerned who are ordered<br />

by building official or by special administrative<br />

agency or commissioned by building official in<br />

accordance with the provisions of Article 13 of<br />

the Law.<br />

(Report of Starting of Work and Report of<br />

Removal)<br />

Article 6. The report (report on work to start) to<br />

the effect that the work onbuilding is to be started<br />

and report (report On removal) to the effect that<br />

the building has been removed as required bf<br />

the provision of Article 15 paragraph 1 of the<br />

Law, shall be submitted through the hands of building<br />

official by using the Annexed Form No. 8 and<br />

the Annexed Form No. 9 respectively.<br />

(Application for Designation of the Location of<br />

Road)<br />

Article 7. A person who wishes to be designated<br />

with the location of road as prescribed in the<br />

provision of Article 42 paragraph 1 item (5) of<br />

the Law shall submit two copies, original and<br />

copy, of application to the special administrative<br />

agency together with respective drawings given<br />

in the following table and the written consent of<br />

the owner of land to become the site of the road<br />

(hereinafter called "Land") or a person or persons<br />

holding the rights over the land or building or<br />

structure in the land:<br />

in case he enters the building actually used for the purpose of living place, he shall,<br />

in advance, obtain the consent of the resident thereof.<br />

Article 13. The public official of To, Do, Fu or prefecture who has been ordered by<br />

building official or the governor of To, Do, Fu or prefecture, or who has been delegated<br />

the power by the building official, in case he enters the building or construction<br />

field in accordance with the provision of paragraph 2 of the preceding.Article, he<br />

shall carry with him the certificate of identification and shall show him the same<br />

when requested by the person concerned.<br />
