(Purport of Law) 

Article 1. This Law specifies the special cases 

of application of the Fisheries Cooperative Association 

Law (Law No. 242 of 1948 ; hereinafter 

referred to as " Law ") to Fishermen's Cooperative 

Associations and Federations of Fishermen's 

Cooperative Associations which establish 

and operate, in accordance with the provisions 

of Article ll paragraph 1 item 7 and item 8 

(businesses of Fishermen's Cooperative Association) 

or Article 87 paragraph 1 item 7 and item 

9 (businesses of Federation of Fishermen's Cooperative 

Associations) of the Law, fishery 

coast stations as prescribed in the Radio Law 

(Law No. 131 of 1950).. 

(Special Cases, concerning, Qualifications^ for 

Membership of Association) 

Article 2. Any Fishermen's Cooperative Association 

(hereinafter referred to as " Association") 

as prescribed in the preceding Article 

may, in accordance with the Articles of Incorporation, 

regard any juridical person who 

operates fishing by use of, fishing vessel equipped 

with ship station as prescribed in the Radio 

Law and is not the person as prescribed in 

Article 18 paragraph 3 (qualifications for as-

sociate membership) of the Law and any corporation 

composed chiefly of persons who 

operate fishing by use of fishing vessel equipped 

with ship station as a person qualified for 

membership as prescribed in the same paragraph. 

2 With regard to the member as prescribed in 

the preceding paragraph, he shall not, regardless 

of the provision of Article 19 paragraph 2 

(units of capitalization) of the Law, possess 

more than one unit of capitalization. 

(Separation of Account) 

Article 3. Any Association which carries on the 

establishment and operation of fishery coast 

stations and the functions incidental thereto 

(hereinafter referred to as " fishery radio functions") 

shall make a, separate accounting 

between the fishery radio functions and other 

functions (hereinafter referred to as " general 

functions "). 

(Resources for Expenditures for Fishery Radio 

Functions) 

Article 4. General expenditures necessary for 

the fishery radio functions carried on by an 

Association shall be covered exclusively by the 

assessment and charges for use collected from 

the members who utilize the said functions, 

the amount carried forward as prescribed in 

Article 7 and donations or the subsidy from 

the national government or local public body 

to the said functions. 

(Restriction on Utilization of General Functions) 

Article 5. Any member of an Association as 

prescribed in Article 2 paragraph 1 shall, in 

the case where he utilizes the general functions 

carried on by the Association and other Fishermen's 

Cooperative Association, be regarded as 

a^ non-member of the Association and tither 

Fishermen's Cooperative, Association with regard 

to the application of the provision of 

Article ll paragraph 3 (utilization by non-member) 

of the Law. ^ 

(Particulars to be entered in List of Members) 

Article 6. With regard to a member who utilizes 

the fishery radio functions, the fact shall 

be entered additionally in the list of the members, 

and in the case where he is the member

as prescribed in Article 2 paragraph 1, the fact 

shall be entered as well. 

(Carrying forward of Surplus Fund) 

Article 7. Any surplus fund obtained by the 

fishery radio functions carried on by an Association 

shall be carried forward to the following 

business year for the purpose of covering 

the expenditures for the said functions. 

(Special Cases concerning Qualifications for 

Membership of Federation) 

Article 8. Any Federation of Fishermen's Cooperative 

Associations (hereinafter referred to 

as "Federation") as prescribed in Article 1 

may regard any juridical person who operates 

fishing by use of fishing vessel equipped with 

ship station in accordance with the Articles of 

Incorporation, and1 is not the person as prescribed 

in Article 88 (qualifications for membership) 

of the Law or any corporation composed 

chiefly of persons who operate fishing 

by use of fishing vessel equipped with ship 

station as a person qualified for membership 

as prescribed in item 3 (qualifications for associate 

membership) of the same Article. 

2 With regard to the member as prescribed in 

the preceding paragraph, he shall not, regardless 

of the provision of Article 19 paragraph 2 

of the Law which applies with the necessary 

modifications in Article 92 paragraph 2 (modified 

application of provisions), possess more than 

one unit of capitalization. 

(Restriction on Utilization of General Functions) 

Article 9. Any member of an Association as 

prescribed in Article [2 paragraph 1 and any 

member of a Federation as prescribed in paragraph 

1 of the preceding Article shall, in the 

case where he utilizes the general functions 

carried on by the Federation to which the 

member of the Association or the member of 

the Federation belongs and other Federation 

of Fishermen's Cooperative Associations, be 

regarded as a non-constituent member of the 

Federation and other Federation of Fishermen's 

Cooperative Associations with regard to the 

application of the provision of Article 87 paragraph 

3 (utilization by non-constituent member) 

of the Law. 

(Modified Application of Provisions) 

1 Article 10. The provisions of Article 3, Article 

4, Article 6 and Article 7 shall apply with the 

necessary modifications to the Federation. In 

this case, " the member as prescribed, in Article 

2 paragraph 1" in Article 6 shall read "the 

member as prescribed in Article 8 paragraph 1". 

Supplementary Provision : 

This Law shall come into force as from the 

day of its promulgation.

In accordance with the provision of Article 40 

paragraph 2 of the Police Law (Law No. 196 

of 1947), the Cabinet establishes this Cabinet 

Order. 

The Enforcement Order of the Police Law 

(Cabinet Order No. 51 of 1948) shall be partially 

amended as follows : 

Annexed Table No. 1 shall be amended as 

follows : 

1 In Minami-akita-gun, Akita-ken, next to Kitaura-machi 

shall be added " ; Iidagawa-machi." 

In Tokyo-To, next to Musashino-shi, shall be

Cabinet Order No. 348 

Cabinet Order for Partial Amendment to 

the Enforcement Order of the Japanese 

National Railways Law 

For the purpose of enforcing the Japanese 

National Railways Law (Law No. 258 of 1948) 

and in accordance with the same Law, the 

Cabinet establishes this Cabinet Order. 

The Enforcement Order of the Japanese National 

Railways Law (Cabinet Order No. 113 of 

1949) shall be partially amended as follows : 

Article 1 to Article ll inclusive shall be amended 

as follows : 

(The Budget) 

Article 1. The Budget of t)ieJapanese National 

Raiways shall consist of General Provisions, 

Income and Expense Budget and Obligation. 

(General Provisions of Budget) 

Article 2. The General Provisions of Budget 

of the Japanese National Railways shall contain 

the regulations concerning the following matters 

in addition to general regulations of Income 

and Expense Budget and Obligation : 

1. Increase of Income and Expense Budget due 

to the increase amount of handled business; 

2. Maximum amount of long-term borrowings 

and of railway bonds to be issued; 

3. Maximumamount of short-term borrowings ; 

4. The designation of appropriation as pre- 

'scribed in Article 39-(ll) of the Japanese 

National Railways Law (hereinafter referred 

to as "Law"); 

5. The total amount of pays to the officers and 

personnel ; 

6. Maximum amount of the act to incur obligation 

as prescribed in Article 39-(2) paragraph 

2 of the Law; 

7. The disposition of profit' a& prescribed in 

Article 41 paragraph 2 of the Law, and the 

amount of redemption 'of the long-term borrowings 

and railway bonds ; 

"8. Matters necessary for the execution of the 

Budget in addition to those mentioned in the 

preceding items.

(Income and Expense Badget) 

Article 3. Income and Expense, Budget of the 

Japanese National Railways shall be classified 

into "Title" and "Item" in accordance with 

the nature of the income and the purpose of 

the expense. 

(Obligation) 

Article 4. As regards obligation, the reason of 

its necessity for each item the fiscal year in 

which the acts of obligation are to be incurred, 

and the limit to the amount of obligation shall 

be made clear, and the fiscal year, the term or 

the annual defrayal of the disbursement resulting 

from the obligation shall be shown in case 

of necessity. 

(Transfer of Appropriation) 

Article 5. As regards the appropriations trans- 

. ferred under the provision of Article 39-(ll) of 

the Law, the Japanese National Railways shall 

clearly set forth the reason and the amount 

in the Report on Settlement of Account. 

(The Expending of the Reserve Fund, Etc.) 

Article 6. The notification by the Japanese National 

Railways to the Minister of Transportation 

in cases where the Japanese National 

Railways expends the reserve fund under the 

provision of Article 39~(13) paragraph 1 of the 

Law shall be the report clarifying the reasons 

to be expended, the amount and the bases of 

computation. 

2 The notification by the Transportation Minister 

to the Minister of Finance and the Board 

of Audit prescribed under the provision of 

Article 39-(13) paragraph 2 shall accompany the 

report prescribed by preceding paragraph. 

3 As regards the amount of the reserve fund 

expended, the Japanese National Railways 

shall clarify the reason and the amount in the 

Report on Settlement of Account. 

Article 7. In cases where the Japanese National 

Railways expends the amount as prescribed in 

Article 39-(3) paragraph 2.of the Law, the 

Japanese National Railways shall notify to the 

Minister of Transportation with the report 

clarifying the reason, the amount and the bases 

of compuation. 

2 The provision of paragraph 3 of the preceding 

1 Article shall apply mutatis mutandis to the 

amount expended under the provision of Article 

39-(3) paragraph 2 of the Law. 

Article 8. The provision of paragraph 1 of the 

preceding Article shall apply mutatis mutandis 

to the case where the Japanese National Railways 

performs the act to incur obligation under 

the provision of Article 39-(2) paragraph 2. 

(The Carrying-over of Budget) 

Article 9. The notification by the Japanese National 

Railways to the Minister of Transporta-

tion in the case where the Japanese National 

Railways, under the provision of Article 39-(13) 

paragraph 1 of the Law, expends appropriation 

by carrying-over to the next fiscal year, shall 

be the Statement of Carrying-over by May, 31 

of the next fiscal year. 

2 The Statement of Carrying-over as prescribed 

in the preceding paragraph shall be prepared 

according to the same classification of Expenses 

Budget, and moreover, the following 

particulars shall be shown : 

1. The amount of the expense under the 

" Item " in which carrying-over is required ; 

2. Out of the amounts of expenses referred to 

in the perceding item, the amount already 

obligated and payable ; 

3. Out of the amount of expense mentioned 

in item 1, the amount required to be carried^ 

forward to the following fiscal year ; 

4. Out of the amounts of expenses mentioned 

in item 1, the amount to be left unused. 

3 -The Japanese National Railways shall make 

clear the budget carried forward to the following 

fiscal year in the Report on Settlement of 

Account. 

4 The notification by the Transportation Minister 

to the Minister of Finance and the Board 

of Audit prescribed under the provision of 

- Article ,39-(13) paragraph 2 shall accompany 

the Statement of Carrying-over referred to in 

paragraph 1. 

(Fund/' Program) 

Article 1O. The fund program as prescribed 

in Article 39-(14) of the Law shall be classified 

into the funds financed by its own fund, borrowings 

and the fund obtained by the issue of 

railway bonds, as regards the sources 6i fund, 

and business operation, construction and betterment, 

and others as regards the expending 

of the same. 

2 The submission of the fund program shall be 

made by twenty days previous to the date of 

the beginning of each quarter of the fiscal 

year. 

3 The submission of the fund program in cases 

where the Japanese National Railways revises 

it shall be made on that occasion of revision. 

(Report on the Amount of Liability incurred 

on Account of Contract, Etc.) 

Article ll. Out of the reports pertaining to 

the amount of liabilities obligated on account 

of contract or acts to cause expense under the 

provision of Article 39-(15) of the* Law, the 

report based on the Budget of Expense shall 

follow'the same classification on the "Title" 

in the "Êxecutive Plan of the Budget ", and the 

report based on Obligation shall b*e prepared 

for each matter by the end of the next month.

2 The estimated amount, settled amount, the 

balance and the amount not needed pertaining 

to the amount of liabilities obligated on account 

of contract or ac,ts to cause expenses shall be 

clarified in the Report as prescribed in^ the 

preceding paragraph. 

Article 12 shall be made Article 22 and the 

numbering of its succeeding Articles shall be 

moved down by ten and next to Article ll shall 

be added the following ten Articles: 

(Report on Income and Expense) 

Article 12. The report on the amount of income 

and expense, which the Japanese National Railways 

shall make pursuant to the provision of 

Article 39-(i5) of the Law, shall be Trial Balance 

prepared based on the classification of 

the " Title" prescribed in the Executive Plans 

of the Budget by the end of the next month. 

(Form and contents of the Report on Settle- 

ment of Account) 

Article 13. The Report on Settlement of Account 

as piescribed in Article 4G-(2) paragraph 

1 of the Law shall consist of the Report on 

accounts of settlement of Income and Expense, 

and the Statement concerning Obligation. 

2 The Report on Accounts of Settlement of 

Income and Expense as prescribed in the preceding 

paragraph- shall be prepared 'according 

to the same classification as Budget of Income 

and Expense, and the following items shall be 

shown therein : 

(1) Income 

1. lncorce estimated 

2. Income earned and accrued 

(2) Expense 

1. Estimated expense 

2. Expense to be carried forward from the 

preceding fiscal year 

3. Reserve fund expended 

4. Amount' expended under the provision of 

Article 39-(3) paragraph 2 of the Law 

5. Increased or decreased amount due to the 

transfer 

6. Amount payable 

7. Expense to be carried forward to the fol- 

lowing fiscal year 

8. Amount unused 

3 In the Statement concerning Obligation as' 

prescribed in paragraph 1, the amount of 

liabilities borne by the Japanese National 

Railways by virture of the act to incur obligation 

under the provisions of Article 39-(2) 

paragraph 1 and paragraph 2 of the sanie 

Article of the Law shall be shown clearly for 

each matter. ' 

(Date of Submission of the Report of Setêd 

Accounts) 

Article 14. The submission of the Settlement 

of Accounts of the Japanese National Railways

shall be made by August 31 of the following 

fiscal year. 

(Disposition of Profit) 

Article 15. The disposition of the profit for 

each business year of the Japanese National 

Railways shall be provided for by the Budget 

two years after the business year concerned 

at the latest. 

(Handling of Cash on the Business) 

Article 16. When the Japanese National Railways 

deposits the cash on the business with 

Treasury, the Bank of Japan shall handle it 

mutatis mutandis with the deposit of State in 

the Bank of Japan. 

(Extent of Utilizing City Bank, Etc. as Regards 

Cash on Business) 

Article 17. The period, for which the Japanese 

National Railways may deposits its cash on 

the business in a post-office or a city bank 

under the proviso to Article 42 paragraph 1 of 

the Law shall not exceed seven days except 

in the case of calamity or other unavoidable 

reasons. 

2 In addition to the provision of preceding 

1 paragraph, as regards the extent where tjie 

Japanese Na.tional Railways deposits the cash 

on the business in a post-office or a city bank 

under the provision of proviso to Article 42 

paragraph 1 of the Law, the President of the 

Japanese National Railways shall make preliminary 

arrangements after consultation with 

phe Finance Minister through the approval of 

the Transportation- Minister. 

(Rate, of Interest on Loans) 

Article 18, As< regards the rate of interest 

when the'Government makes a loan to the 

. Japanese National Railways under the provision 

of Article 42-(2) paragraph 1 of the Law, 

in case of a loan on a basis of public bonds 

issued by the Government, the interest yield 

for the issue price of the public bonds plus 

the rate of expenses relating to issuance of 

the public bonds shall be applied,.and in case 

of a loan on a basis of borrowing by the 

Government, the rate of interest of the borrowing 

shall be applied. 

, (Extent and Time of Redemption Program) 

Article 19. In cases where the notification as 

prescribed in Article 89~(5) of.the Law is made, 

theJapanese National Railways shall establish 

overall Redemption Program on the total 

amount of its long-term borrowings and failway 

bonds pursuant to the provision of Article 

42-(5) of the Law and submit the same to the 

Transportation Minister. 

(Assets) 

Article 20. The assets' of the ,Japanese National 

Railways shall be classified into Fixed 

Assets, Invested Assets, Operation Assets, 

Current Assets and other account for consoli- 

dation. 

(Capital and Liabilities) 

Article 21. In the Japanese National Railways 

the amount of assets as prescribed in the preceding 

Article shall be the capital (credit total), 

and such capital shall be categorized into the 

capital, the accumulated reserve, the provident 

fund, the long-term borrowing, the short-term 

borrowing and other adjustment accounts. 

Supplementary Provisions : 

1. This Order shall come into force as from 

the day of its promulgation ; provided that the 

provisions of Article 1 to Article 4 inclusive of 

revised Enforcement Order of the Japanese 

National""Railways Law shall apply to the 

budget for the fiscal year 1950-51 and thereafter, 

and the provisions; of Article 13 and 

Article 14 of the same revised Order shall apply 

to the Settlement of Accounts for the fiscal 

year 1950-51 and thereafter, and the provisions 

of Article ll, Article 12, Article 16 to Article 18 

inclusive, Article 20,, Article 21 of the same revised 

Order and the following paragraph shall 

apply as from April 1, 1950. 

2. With regard to the Settlement of Account 

and expending of reserve fund for the fiscal 

year 1949-50, former provisions, shall still pre- 

vail.

Reason 

This tramway connects Hodogaya Line with 

Gumyoji Line, both already in operation. As 

the adjoining area is dotted with schools, companies, 

and factories^ it becomes the shortest cut 

to the JNR line and also the loop line of the 

municipal street-car line, and thus greatly promotes 

the citizens' convenience. Hence, it is 

expected that the construction will be of great

This railway line is indispensable for the 

exploitation of industry in the southern district 

of Okayama City and it has already been availed 

of as an industrial side line. In the event of 

this being opened to business as a privated 

railway, the transportation of raw materials 

and manufactured goods of large factories along 

the line will be far smoother. Moreover, by the 

completion of Okayama Port, it will be an 

arterary of amphibious. transportation and thus 

the passenger and freight transportation there 

will be perfected both quantitatively and qualitatively.
