Stations<br />

(Purport of Law)<br />

Article 1. This Law specifies the special cases<br />

of application of the Fisheries Cooperative Association<br />

Law (Law No. 242 of 1948 ; hereinafter<br />

referred to as " Law ") to Fishermen's Cooperative<br />

Associations and Federations of Fishermen's<br />

Cooperative Associations which establish<br />

and operate, in accordance with the provisions<br />

of Article ll paragraph 1 item 7 and item 8<br />

(businesses of Fishermen's Cooperative Association)<br />

or Article 87 paragraph 1 item 7 and item<br />

9 (businesses of Federation of Fishermen's Cooperative<br />

Associations) of the Law, fishery<br />

coast stations as prescribed in the Radio Law<br />

(Law No. 131 of 1950)..<br />

(Special Cases, concerning, Qualifications^ for<br />

Membership of Association)<br />

Article 2. Any Fishermen's Cooperative Association<br />

(hereinafter referred to as " Association")<br />

as prescribed in the preceding Article<br />

may, in accordance with the Articles of Incorporation,<br />

regard any juridical person who<br />

operates fishing by use of, fishing vessel equipped<br />

with ship station as prescribed in the Radio<br />

Law and is not the person as prescribed in<br />

Article 18 paragraph 3 (qualifications for as-<br />

sociate membership) of the Law and any corporation<br />

composed chiefly of persons who<br />

operate fishing by use of fishing vessel equipped<br />

with ship station as a person qualified for<br />

membership as prescribed in the same paragraph.<br />

2 With regard to the member as prescribed in<br />

the preceding paragraph, he shall not, regardless<br />

of the provision of Article 19 paragraph 2<br />

(units of capitalization) of the Law, possess<br />

more than one unit of capitalization.<br />

(Separation of Account)<br />

Article 3. Any Association which carries on the<br />

establishment and operation of fishery coast<br />

stations and the functions incidental thereto<br />

(hereinafter referred to as " fishery radio functions")<br />

shall make a, separate accounting<br />

between the fishery radio functions and other<br />

functions (hereinafter referred to as " general<br />

functions ").<br />

(Resources for Expenditures for Fishery Radio<br />

Functions)<br />

Article 4. General expenditures necessary for<br />

the fishery radio functions carried on by an<br />

Association shall be covered exclusively by the<br />

assessment and charges for use collected from<br />

the members who utilize the said functions,<br />

the amount carried forward as prescribed in<br />

Article 7 and donations or the subsidy from<br />

the national government or local public body<br />

to the said functions.<br />

(Restriction on Utilization of General Functions)<br />

Article 5. Any member of an Association as<br />

prescribed in Article 2 paragraph 1 shall, in<br />

the case where he utilizes the general functions<br />

carried on by the Association and other Fishermen's<br />

Cooperative Association, be regarded as<br />

a^ non-member of the Association and tither<br />

Fishermen's Cooperative, Association with regard<br />

to the application of the provision of<br />

Article ll paragraph 3 (utilization by non-member)<br />

of the Law. ^<br />

(Particulars to be entered in List of Members)<br />

Article 6. With regard to a member who utilizes<br />

the fishery radio functions, the fact shall<br />

be entered additionally in the list of the members,<br />

and in the case where he is the member


as prescribed in Article 2 paragraph 1, the fact<br />

shall be entered as well.<br />

(Carrying forward of Surplus Fund)<br />

Article 7. Any surplus fund obtained by the<br />

fishery radio functions carried on by an Association<br />

shall be carried forward to the following<br />

business year for the purpose of covering<br />

the expenditures for the said functions.<br />

(Special Cases concerning Qualifications for<br />

Membership of Federation)<br />

Article 8. Any Federation of Fishermen's Cooperative<br />

Associations (hereinafter referred to<br />

as "Federation") as prescribed in Article 1<br />

may regard any juridical person who operates<br />

fishing by use of fishing vessel equipped with<br />

ship station in accordance with the Articles of<br />

Incorporation, and1 is not the person as prescribed<br />

in Article 88 (qualifications for membership)<br />

of the Law or any corporation composed<br />

chiefly of persons who operate fishing<br />

by use of fishing vessel equipped with ship<br />

station as a person qualified for membership<br />

as prescribed in item 3 (qualifications for associate<br />

membership) of the same Article.<br />

2 With regard to the member as prescribed in<br />

the preceding paragraph, he shall not, regardless<br />

of the provision of Article 19 paragraph 2<br />

of the Law which applies with the necessary<br />

modifications in Article 92 paragraph 2 (modified<br />

application of provisions), possess more than<br />

one unit of capitalization.<br />

(Restriction on Utilization of General Functions)<br />

Article 9. Any member of an Association as<br />

prescribed in Article [2 paragraph 1 and any<br />

member of a Federation as prescribed in paragraph<br />

1 of the preceding Article shall, in the<br />

case where he utilizes the general functions<br />

carried on by the Federation to which the<br />

member of the Association or the member of<br />

the Federation belongs and other Federation<br />

of Fishermen's Cooperative Associations, be<br />

regarded as a non-constituent member of the<br />

Federation and other Federation of Fishermen's<br />

Cooperative Associations with regard to the<br />

application of the provision of Article 87 paragraph<br />

3 (utilization by non-constituent member)<br />

of the Law.<br />

(Modified Application of Provisions)<br />

1 Article 10. The provisions of Article 3, Article<br />

4, Article 6 and Article 7 shall apply with the<br />

necessary modifications to the Federation. In<br />

this case, " the member as prescribed, in Article<br />

2 paragraph 1" in Article 6 shall read "the<br />

member as prescribed in Article 8 paragraph 1".<br />

Supplementary Provision :<br />

This Law shall come into force as from the<br />

day of its promulgation.<br />

to the Enforcement Order of the<br />

Police Law<br />

In accordance with the provision of Article 40<br />

paragraph 2 of the Police Law (Law No. 196<br />

of 1947), the Cabinet establishes this Cabinet<br />

Order.<br />

The Enforcement Order of the Police Law<br />

(Cabinet Order No. 51 of 1948) shall be partially<br />

amended as follows :<br />

Annexed Table No. 1 shall be amended as<br />

follows :<br />

1 In Minami-akita-gun, Akita-ken, next to Kitaura-machi<br />

shall be added " ; Iidagawa-machi."<br />

In Tokyo-To, next to Musashino-shi, shall be<br />

added " Mitaka-shi," and in Kitatama-gun, " Mitaka-machi<br />

; " shall be deleted.<br />

In Saitama-ken, next to Chichibu-shi shall be<br />

added " Tokorozawa-shi;" in Kitaadachi-gun,<br />

next to Yamato-maehi shall be added " ; Hatogaya-machi<br />

; " and in Iruma-gun, " Tokorozawamachi;"<br />

shall be deleted.<br />

Cabinet Order for Partial Amendment to<br />

the Enforcement Order of the Japanese<br />

National Railways Law<br />

For the purpose of enforcing the Japanese<br />

National Railways Law (Law No. 258 of 1948)<br />

and in accordance with the same Law, the<br />

Cabinet establishes this Cabinet Order.<br />

The Enforcement Order of the Japanese National<br />

Railways Law (Cabinet Order No. 113 of<br />

1949) shall be partially amended as follows :<br />

Article 1 to Article ll inclusive shall be amended<br />

as follows :<br />

(The Budget)<br />

Article 1. The Budget of t)ieJapanese National<br />

Raiways shall consist of General Provisions,<br />

Income and Expense Budget and Obligation.<br />

(General Provisions of Budget)<br />

Article 2. The General Provisions of Budget<br />

of the Japanese National Railways shall contain<br />

the regulations concerning the following matters<br />

in addition to general regulations of Income<br />

and Expense Budget and Obligation :<br />

1. Increase of Income and Expense Budget due<br />

to the increase amount of handled business;<br />

2. Maximum amount of long-term borrowings<br />

and of railway bonds to be issued;<br />

3. Maximumamount of short-term borrowings ;<br />

4. The designation of appropriation as pre-<br />

'scribed in Article 39-(ll) of the Japanese<br />

National Railways Law (hereinafter referred<br />

to as "Law");<br />

5. The total amount of pays to the officers and<br />

personnel ;<br />

6. Maximum amount of the act to incur obligation<br />

as prescribed in Article 39-(2) paragraph<br />

2 of the Law;<br />

7. The disposition of profit' a& prescribed in<br />

Article 41 paragraph 2 of the Law, and the<br />

amount of redemption 'of the long-term borrowings<br />

and railway bonds ;<br />

"8. Matters necessary for the execution of the<br />

Budget in addition to those mentioned in the<br />

preceding items.<br />

(Income and Expense Badget)<br />

Article 3. Income and Expense, Budget of the<br />

Japanese National Railways shall be classified<br />

into "Title" and "Item" in accordance with<br />

the nature of the income and the purpose of<br />

the expense.<br />

(Obligation)<br />

Article 4. As regards obligation, the reason of<br />

its necessity for each item the fiscal year in<br />

which the acts of obligation are to be incurred,<br />

and the limit to the amount of obligation shall<br />

be made clear, and the fiscal year, the term or<br />

the annual defrayal of the disbursement resulting<br />

from the obligation shall be shown in case<br />

of necessity.<br />

(Transfer of Appropriation)<br />

Article 5. As regards the appropriations trans-<br />

. ferred under the provision of Article 39-(ll) of<br />

the Law, the Japanese National Railways shall<br />

clearly set forth the reason and the amount<br />

in the Report on Settlement of Account.<br />

(The Expending of the Reserve Fund, Etc.)<br />

Article 6. The notification by the Japanese National<br />

Railways to the Minister of Transportation<br />

in cases where the Japanese National<br />

Railways expends the reserve fund under the<br />

provision of Article 39~(13) paragraph 1 of the<br />

Law shall be the report clarifying the reasons<br />

to be expended, the amount and the bases of<br />

computation.<br />

2 The notification by the Transportation Minister<br />

to the Minister of Finance and the Board<br />

of Audit prescribed under the provision of<br />

Article 39-(13) paragraph 2 shall accompany the<br />

report prescribed by preceding paragraph.<br />

3 As regards the amount of the reserve fund<br />

expended, the Japanese National Railways<br />

shall clarify the reason and the amount in the<br />

Report on Settlement of Account.<br />

Article 7. In cases where the Japanese National<br />

Railways expends the amount as prescribed in<br />

Article 39-(3) paragraph 2.of the Law, the<br />

Japanese National Railways shall notify to the<br />

Minister of Transportation with the report<br />

clarifying the reason, the amount and the bases<br />

of compuation.<br />

2 The provision of paragraph 3 of the preceding<br />

1 Article shall apply mutatis mutandis to the<br />

amount expended under the provision of Article<br />

39-(3) paragraph 2 of the Law.<br />

Article 8. The provision of paragraph 1 of the<br />

preceding Article shall apply mutatis mutandis<br />

to the case where the Japanese National Railways<br />

performs the act to incur obligation under<br />

the provision of Article 39-(2) paragraph 2.<br />

(The Carrying-over of Budget)<br />

Article 9. The notification by the Japanese National<br />

Railways to the Minister of Transporta-


tion in the case where the Japanese National<br />

Railways, under the provision of Article 39-(13)<br />

paragraph 1 of the Law, expends appropriation<br />

by carrying-over to the next fiscal year, shall<br />

be the Statement of Carrying-over by May, 31<br />

of the next fiscal year.<br />

2 The Statement of Carrying-over as prescribed<br />

in the preceding paragraph shall be prepared<br />

according to the same classification of Expenses<br />

Budget, and moreover, the following<br />

particulars shall be shown :<br />

1. The amount of the expense under the<br />

" Item " in which carrying-over is required ;<br />

2. Out of the amounts of expenses referred to<br />

in the perceding item, the amount already<br />

obligated and payable ;<br />

3. Out of the amount of expense mentioned<br />

in item 1, the amount required to be carried^<br />

forward to the following fiscal year ;<br />

4. Out of the amounts of expenses mentioned<br />

in item 1, the amount to be left unused.<br />

3 -The Japanese National Railways shall make<br />

clear the budget carried forward to the following<br />

fiscal year in the Report on Settlement of<br />

Account.<br />

4 The notification by the Transportation Minister<br />

to the Minister of Finance and the Board<br />

of Audit prescribed under the provision of<br />

- Article ,39-(13) paragraph 2 shall accompany<br />

the Statement of Carrying-over referred to in<br />

paragraph 1.<br />

(Fund/' Program)<br />

Article 1O. The fund program as prescribed<br />

in Article 39-(14) of the Law shall be classified<br />

into the funds financed by its own fund, borrowings<br />

and the fund obtained by the issue of<br />

railway bonds, as regards the sources 6i fund,<br />

and business operation, construction and betterment,<br />

and others as regards the expending<br />

of the same.<br />

2 The submission of the fund program shall be<br />

made by twenty days previous to the date of<br />

the beginning of each quarter of the fiscal<br />

year.<br />

3 The submission of the fund program in cases<br />

where the Japanese National Railways revises<br />

it shall be made on that occasion of revision.<br />

(Report on the Amount of Liability incurred<br />

on Account of Contract, Etc.)<br />

Article ll. Out of the reports pertaining to<br />

the amount of liabilities obligated on account<br />

of contract or acts to cause expense under the<br />

provision of Article 39-(15) of the* Law, the<br />

report based on the Budget of Expense shall<br />

follow'the same classification on the "Title"<br />

in the "^Executive Plan of the Budget ", and the<br />

report based on Obligation shall b*e prepared<br />

for each matter by the end of the next month.<br />

2 The estimated amount, settled amount, the<br />

balance and the amount not needed pertaining<br />

to the amount of liabilities obligated on account<br />

of contract or ac,ts to cause expenses shall be<br />

clarified in the Report as prescribed in^ the<br />

preceding paragraph.<br />

Article 12 shall be made Article 22 and the<br />

numbering of its succeeding Articles shall be<br />

moved down by ten and next to Article ll shall<br />

be added the following ten Articles:<br />

(Report on Income and Expense)<br />

Article 12. The report on the amount of income<br />

and expense, which the Japanese National Railways<br />

shall make pursuant to the provision of<br />

Article 39-(i5) of the Law, shall be Trial Balance<br />

prepared based on the classification of<br />

the " Title" prescribed in the Executive Plans<br />

of the Budget by the end of the next month.<br />

(Form and contents of the Report on Settle-<br />

ment of Account)<br />

Article 13. The Report on Settlement of Account<br />

as piescribed in Article 4G-(2) paragraph<br />

1 of the Law shall consist of the Report on<br />

accounts of settlement of Income and Expense,<br />

and the Statement concerning Obligation.<br />

2 The Report on Accounts of Settlement of<br />

Income and Expense as prescribed in the preceding<br />

paragraph- shall be prepared 'according<br />

to the same classification as Budget of Income<br />

and Expense, and the following items shall be<br />

shown therein :<br />

(1) Income<br />

1. lncorce estimated<br />

2. Income earned and accrued<br />

(2) Expense<br />

1. Estimated expense<br />

2. Expense to be carried forward from the<br />

preceding fiscal year<br />

3. Reserve fund expended<br />

4. Amount' expended under the provision of<br />

Article 39-(3) paragraph 2 of the Law<br />

5. Increased or decreased amount due to the<br />

transfer<br />

6. Amount payable<br />

7. Expense to be carried forward to the fol-<br />

lowing fiscal year<br />

8. Amount unused<br />

3 In the Statement concerning Obligation as'<br />

prescribed in paragraph 1, the amount of<br />

liabilities borne by the Japanese National<br />

Railways by virture of the act to incur obligation<br />

under the provisions of Article 39-(2)<br />

paragraph 1 and paragraph 2 of the sanie<br />

Article of the Law shall be shown clearly for<br />

each matter. '<br />

(Date of Submission of the Report of Set^ed<br />

Accounts)<br />

Article 14. The submission of the Settlement<br />

of Accounts of the Japanese National Railways


shall be made by August 31 of the following<br />

fiscal year.<br />

(Disposition of Profit)<br />

Article 15. The disposition of the profit for<br />

each business year of the Japanese National<br />

Railways shall be provided for by the Budget<br />

two years after the business year concerned<br />

at the latest.<br />

(Handling of Cash on the Business)<br />

Article 16. When the Japanese National Railways<br />

deposits the cash on the business with<br />

Treasury, the Bank of Japan shall handle it<br />

mutatis mutandis with the deposit of State in<br />

the Bank of Japan.<br />

(Extent of Utilizing City Bank, Etc. as Regards<br />

Cash on Business)<br />

Article 17. The period, for which the Japanese<br />

National Railways may deposits its cash on<br />

the business in a post-office or a city bank<br />

under the proviso to Article 42 paragraph 1 of<br />

the Law shall not exceed seven days except<br />

in the case of calamity or other unavoidable<br />

reasons.<br />

2 In addition to the provision of preceding<br />

1 paragraph, as regards the extent where tjie<br />

Japanese Na.tional Railways deposits the cash<br />

on the business in a post-office or a city bank<br />

under the provision of proviso to Article 42<br />

paragraph 1 of the Law, the President of the<br />

Japanese National Railways shall make preliminary<br />

arrangements after consultation with<br />

phe Finance Minister through the approval of<br />

the Transportation- Minister.<br />

(Rate, of Interest on Loans)<br />

Article 18, As< regards the rate of interest<br />

when the'Government makes a loan to the<br />

. Japanese National Railways under the provision<br />

of Article 42-(2) paragraph 1 of the Law,<br />

in case of a loan on a basis of public bonds<br />

issued by the Government, the interest yield<br />

for the issue price of the public bonds plus<br />

the rate of expenses relating to issuance of<br />

the public bonds shall be applied,.and in case<br />

of a loan on a basis of borrowing by the<br />

Government, the rate of interest of the borrowing<br />

shall be applied.<br />

, (Extent and Time of Redemption Program)<br />

Article 19. In cases where the notification as<br />

prescribed in Article 89~(5) of.the Law is made,<br />

theJapanese National Railways shall establish<br />

overall Redemption Program on the total<br />

amount of its long-term borrowings and failway<br />

bonds pursuant to the provision of Article<br />

42-(5) of the Law and submit the same to the<br />

Transportation Minister.<br />

(Assets)<br />

Article 20. The assets' of the ,Japanese National<br />

Railways shall be classified into Fixed<br />

Assets, Invested Assets, Operation Assets,<br />

Current Assets and other account for consoli-<br />

dation.<br />

(Capital and Liabilities)<br />

Article 21. In the Japanese National Railways<br />

the amount of assets as prescribed in the preceding<br />

Article shall be the capital (credit total),<br />

and such capital shall be categorized into the<br />

capital, the accumulated reserve, the provident<br />

fund, the long-term borrowing, the short-term<br />

borrowing and other adjustment accounts.<br />

Supplementary Provisions :<br />

1. This Order shall come into force as from<br />

the day of its promulgation ; provided that the<br />

provisions of Article 1 to Article 4 inclusive of<br />

revised Enforcement Order of the Japanese<br />

National""Railways Law shall apply to the<br />

budget for the fiscal year 1950-51 and thereafter,<br />

and the provisions; of Article 13 and<br />

Article 14 of the same revised Order shall apply<br />

to the Settlement of Accounts for the fiscal<br />

year 1950-51 and thereafter, and the provisions<br />

of Article ll, Article 12, Article 16 to Article 18<br />

inclusive, Article 20,, Article 21 of the same revised<br />

Order and the following paragraph shall<br />

apply as from April 1, 1950.<br />

2. With regard to the Settlement of Account<br />

and expending of reserve fund for the fiscal<br />

year 1949-50, former provisions, shall still pre-<br />

vail.<br />

In accordance with the provisions of Article 51<br />

of the Foreign Exchange' and Foreign Trade<br />

Control Law (Law No. 228 of 1949), the Ministerial<br />

Ordinance concerning Suspension of Export to<br />

.Mainland China, etc., shall be established as<br />

follows :<br />

January 5, 1951. However, the above provisions<br />

shall not. apply to the case where the Minister<br />

of International Trade and Industry approves<br />

This tramway connects Hodogaya Line with<br />

Gumyoji Line, both already in operation. As<br />

the adjoining area is dotted with schools, companies,<br />

and factories^ it becomes the shortest cut<br />

to the JNR line and also the loop line of the<br />

municipal street-car line, and thus greatly promotes<br />

the citizens' convenience. Hence, it is<br />

This railway line is indispensable for the<br />

exploitation of industry in the southern district<br />

of Okayama City and it has already been availed<br />

of as an industrial side line. In the event of<br />

this being opened to business as a privated<br />

railway, the transportation of raw materials<br />

and manufactured goods of large factories along<br />

the line will be far smoother. Moreover, by the<br />

completion of Okayama Port, it will be an<br />

arterary of amphibious. transportation and thus<br />

the passenger and freight transportation there<br />

will be perfected both quantitatively and qualitatively.<br />
