“Through years of
research and policy
experimentation, we
have learned a great
deal about regulatory
design. We know
how to make the
regulatory system
better, stronger,
and less costly.
Climate policy offers
the biggest challenge
— and the best
opportunity yet — to
achieve systematic
reforms that protect
the environment more
at less cost.”
“There is no question
that our patent system
needs further improvement.
It takes at least
34 months for the
Patent and Trademark
Office to finalize a
patent application. A
backlog of more than
700,000 patent
applications awaits
review. This creates
uncertainty for
inventors, investors,
and entrepreneurs, and
dampens innovation.
The America Invents
Act may not go as far
as one would like,
but it is certainly a
step forward.”
“Deciding issues
of executive war
powers requires
contextual and
pragmatic judgment
rather than abstract
classifications —
whether they are
liberal or conservative
in character.”
“The current
Voting Rights Act
is outdated. Liberals
who reflexively
defend the outmoded
policy are
as insensitive to the
political rights of
voters of color as
their conservative
counterparts who
maintain, without
evidence, that
race no longer
plays a role in the
democratic process.”
