I <strong>was</strong> <strong>unaware</strong> <strong>of</strong> <strong>the</strong> <strong><strong>be</strong>rm</strong> <strong>needing</strong> <strong>to</strong> <strong>be</strong> <strong>installed</strong> <strong>at</strong> <strong>this</strong> <strong>time</strong> . <strong>Since</strong> <strong>the</strong> drilling has slowed<br />
down so much here in our area we will <strong>be</strong> taking out most <strong>of</strong> <strong>the</strong> s<strong>to</strong>rage and getting our<br />
engineer <strong>to</strong> redraw a new plan for less s<strong>to</strong>rage <strong>to</strong> keep down <strong>the</strong> cost <strong>of</strong><br />
construction . I will get <strong>the</strong>m started on th<strong>at</strong> immedi<strong>at</strong>ely. Also <strong>the</strong> s<strong>to</strong>rage is temporary do I<br />
need <strong>to</strong> have containment on <strong>the</strong>se tanks if <strong>the</strong>y are moved in and out <strong>of</strong>ten? When out on <strong>the</strong><br />
pads where <strong>the</strong> drilling is <strong>be</strong>ing done all <strong>the</strong>y have is plastic under <strong>the</strong> tanks with cross ties<br />
for a <strong><strong>be</strong>rm</strong> . Please let me know.<br />

Thank you for <strong>the</strong> pho<strong>to</strong>s. It appears th<strong>at</strong> you have addressed <strong>the</strong> majority <strong>of</strong> <strong>the</strong> issues th<strong>at</strong> W<strong>at</strong>er<br />
Inspec<strong>to</strong>r Amy Beck and I noted during our inspection.<br />
However, <strong>the</strong>re were no pho<strong>to</strong>s or remarks addressing <strong>the</strong> 3’ lined emergency containment <strong><strong>be</strong>rm</strong><br />
required by your WMP around your onsite s<strong>to</strong>rage and detailed in <strong>the</strong> second viol<strong>at</strong>ion <strong>of</strong> your April<br />
1, 2013 inspection report (see pho<strong>to</strong> 6). Please send pho<strong>to</strong>graphic evidence <strong>of</strong> <strong>this</strong> correction. If<br />
you would prefer not <strong>to</strong> install <strong>the</strong> <strong><strong>be</strong>rm</strong>, you must revise your Waste Management Plan and acquire<br />
approval <strong>of</strong> <strong>the</strong> revision from your ADEQ permit engineer.<br />
Your response is currently inadequ<strong>at</strong>e until <strong>the</strong> above item is addressed. Your extended deadline<br />
expires May 15, 2013 - please let me know wh<strong>at</strong> you plan <strong>to</strong> do <strong>be</strong>fore COB <strong>to</strong>morrow.
