decision to file an opposition. It is in the interest of the users to get such
a solution without filing an opposition to get clearance of the legal
situation.
There are many more arguments but I remember that you asked us to
restrict on facts.
As it is not easy to make such a research I have concentrated of the cases
we had in our office during the last years and I asked Mr. von Kameke,
senior partner of Uexküll & Stolberg, to add some cases. Dr. Petra Weitzel
of the German Patent and Trademark Office asked the attendees of the
German Day to add more examples which I’ll send later.
Please find enclosed an overview of cases which shows application mark,
opposition mark, publication date, receipt watch notice, opposition
deadline, settlement date and way of settlement.
This overview seems to me very persuasive. I am sure that we will send
you more similar cases. You had promised to ask the office to make a
similar research. I would appreciate your comments on this.
