Reduction of opposition period from 3 to 2 months<br />

Dear Mr. Campinos,<br />
During the meeting in Alicante on February 9, 2011introducing <strong>GRUR</strong> as<br />
NGO together with Dr. Hans Peter Kunz-Hallstein and during the German<br />
Day on March 4, 2011 we discussed the objective of OHIM to reduce the<br />
opposition period from 3 to 2 months. As you know I am against this<br />
proposal because of several reasons. From the perspective of the user the<br />
3 month period is a good means to avoid oppositions or to settle the<br />
oppositions as soon as possible after filing the opposition but without<br />
filing arguments. A lot of companies and/or representatives use the<br />
watch service of external companies to research the publications for their<br />
clients for potential oppositions. The reports of these research<br />
companies are sent to their clients some weeks after the publication of<br />
the trademark applications. There is not much time left to make an<br />
assessment about chances and necessity to file oppositions and/or to<br />
start negotiations for a settlement to avoid oppositions or at least to get<br />
a solution shortly after filing a formular position. Some representatives<br />
informed me that they have clients all over the world and even with the

means of electronical communication it needs time to consider the<br />
decision to file an opposition. It is in the interest of the users to get such<br />
a solution without filing an opposition to get clearance of the legal<br />
situation.<br />
There are many more arguments but I remember that you asked us to<br />
restrict on facts.<br />
As it is not easy to make such a research I have concentrated of the cases<br />
we had in our office during the last years and I asked Mr. von Kameke,<br />
senior partner of Uexküll & Stolberg, to add some cases. Dr. Petra Weitzel<br />
of the German Patent and Trademark Office asked the attendees of the<br />
German Day to add more examples which I’ll send later.<br />
Please find enclosed an overview of cases which shows application mark,<br />
opposition mark, publication date, receipt watch notice, opposition<br />
deadline, settlement date and way of settlement.<br />
This overview seems to me very persuasive. I am sure that we will send<br />
you more similar cases. You had promised to ask the office to make a<br />
similar research. I would appreciate your comments on this.<br />
