26 | Managing and Protecting our Historic Environment What is Changing? 1 2 New statutory designations Gardens and designed landscapes Historic Scotland compiles and maintains a statutory Inventory of Gardens and Designed Landscapes on behalf of Scottish Ministers. The purpose of the Inventory is to identify sites of national importance and to provide information on them as a basis for the sustainable management of change. Historic Scotland assesses sites for inclusion in the Inventory against guidance and criteria set out by Scottish Ministers in the SHEP (Annex 4). The Inventory was first published in 1987. It currently contains 386 sites ranging from the policies of historic country houses, to botanic garden collections, urban parks, small plantsman’s gardens, and even some cemeteries. The older sites in the Inventory contain the earthwork remains of medieval gardens, while the most recent are innovative 20th century gardens by designers and artists. The Inventory is available to search online via the Historic Scotland website at The website, PASTMAP www.pastmap.org.uk can also be used to search for the location of Inventory sites. Gardens and designed landscapes are afforded some protection in the planning system. The terms of the Town and Country Planning (Development Management Procedure) (Scotland) Regulations 2008 (DMPR) require planning authorities to consult Scottish Ministers in the case of applications for planning permission which may affect a garden or designed landscape (defined by reference to the Inventory). They also require applications to be accompanied by a design statement where an application relates to land situated within a garden or designed landscape. Historic battlefields The SHEP 2009 introduced a new policy for the protection of battlefields including the creation of a statutory Inventory. The purpose of the Inventory is to identify sites of national importance and provide information on them as a basis for the sustainable management of change through the planning system. Historic Scotland will be responsible for creating and maintaining the Inventory and for promoting it as a resource to enhance awareness, understanding, protection, management and interpretation of battlefields. Scottish Ministers’ policies for the treatment of battlefields of national importance, as set out in paragraph 3.66 of the SHEP, will be given effect by amendment to the DMPR. Proposed amendments to the DMPR will mean that in future the effect of proposed developments on Inventory battlefields will be a material consideration in the determination of a planning application. Historic Scotland has worked with planning authorities and other key stakeholders to develop guidance on the effective protection and management of inventory sites, as part of Historic Scotland’s Managing Change in the Historic Environment series.

Sites and Monuments Records (sometimes called Historic Environment Records) are maintained by local authorities and contain information on all the known monuments and historic sites in an area. Changes introduced by the Act Statutory Inventories of gardens and designed landscapes and of battlefields Section 11 of the Act inserts new sections 32A and 32B into the 1979 Act which create a new statutory duty for Scottish Ministers to compile and maintain (in such form as they think fit) an Inventory of gardens and designed landscapes and an Inventory of battlefields as appear to them to be of national importance. The Act will not change the level of protection currently afforded to these grounds or areas of land under the terms of the Town and Country Planning (Development Management Procedure) (Scotland) 2008 regulations. Grants Historic Scotland currently manages a number of grant schemes such as the Historic Buildings Repair Grants Scheme and the Archaeology Funding Programme.
