announced today that the Acting Director of Professional Regulation, Donald W. Seasock; and

following disciplinary orders in the month of May 2010.
Division of Banking
BANKS AND TRUSTS
Builders Bank, Chicago – consent order to stop engaging in unsafe and unsound
banking practices.
HomeStar Bank and Financial Services, Manteno – consent order to stop engaging in
unsafe and unsound banking practices.
Midwest Bank and Trust Company, Elmwood Park – Division of Banking took
possession and control of bank on May 14, 2010 for the purpose of receivership.
RESIDENTIAL MORTGAGE
First American Funding Company, LLC, Columbus, WI – residential mortgage
license (MB.6759277) fined $1,000 per Consent Order.
GMAC Mortgage, LLC, Fort Washington, PA – fined $50,000 per Settlement
Agreement.
HLMC Mortgage, Inc., Country Club Hills – residential mortgage license
(MB.6760252) fined $20,000 for various violations found in examination.
Residential Plus Mortgage Corporation, Des Plaines – residential mortgage license
(MB.0006264) fined $25,000 for conducting unregistered loan originator activities. (This Order is

Durrel M. Castile, Chicago – LO License (031.0011828) revoked for a conviction that
was financially related and would be grounds for denial at the point of original application.
Jeremiah N. Clement, Hanover Park – ordered to cease and desist from performing
loan originator activities without a loan originator registration and fined $15,000.
Karmel Kifarkis, Chicago – LO License (031.0001884) suspended for 180 days and
fined $15,000 for allowing a loan to be originated with registrant’s name and registration number
and without registrant actually working on the loan file. (This order is currently under appeal)
Javier Mendoza, Hoffman Estates – LO License (031.0000420) fined $20,000 and
revoked for knowingly using a name and registration number belonging to another loan originator
and knowingly submitting fraudulent information to lenders to conceal his personal conflict of
interest in the transactions. (This order is currently under appeal)
Julian Mendoza, Hoffman Estates – ordered to cease and desist from performing loan
originator activities without a loan originator registration and fined for $15,000. (This order is
currently under appeal)
Gregory Pusch, Chicago – LO license (031.0000697) suspended for 180 days and fined
$15,000 for thwarting a Department investigation and aiding a licensee in concealing violations.

Patricia Vargas, Hoffman Estates – LO license (031.0010693) fined $20,000 and revoked
for knowingly allowing loans to be originated with Registrant’s name and Registration without

Chicago - CILA License (3342) fined $5,075 for the following violations: Licensee was not
operating under licensed name, the annual percentage rate was not accurately disclosed, the loan
document or other legal instrument contained blanks, security was not properly disclosed,
original documents, or approved equivalent, not cancelled or returned following payoff, and
executed copy of paid contract or other legal document retained in the file but not stamped
“PAID IN FULL” or equivalent.
Genesis Financial & Payment Systems, Inc., 505 North LaSalle Street, Suite 350,
Chicago - CI License (3021) fined $148,000 for the following violations: Licensed location did
not prominently display the hours of operation, licensed location did not prominently display the
license or renewal certificate, licensee was conducting other business without required approval,
licensee moved without 10 day notice or the applicable preapproval from the Director, licensee
not operating under licensed name, the annual percentage rate was not accurately disclosed,
licensee did not properly maintain loan records for two years after final entry, security was not
properly disclosed, original documents, or approved equivalent, not cancelled or returned
following payoff, licensee charged a fee not allowed, evidence of a signed or acknowledged
Truth-In-Lending Disclosure was not in the file of original papers, licensee was maintaining a
limited purpose branch without the written approval of the Director, and paid contract was not
properly dated.
Genesis Financial & Payment Systems, Inc., 505 North LaSalle Street, Suite 250,
Chicago - CILA License (3021) fined $17,775 for the following violations: The annual
percentage rate was not accurately disclosed, the file of original papers for the loan was not
properly maintained, licensee charged a fee not allowed, and licensee was maintaining a limited
purpose branch without the written approval of the Director.
CURRENCY EXCHANGE SECTION
Grand Hamlin Currency Exchange, Inc., 3746 W. Grand Avenue, Chicago –
Currency Exchange License (3749) fined $2,600 for failure to maintain the statutorily required
minimum net worth.

David Eckdahl, Downers Grove – certified public accountant license (065-018107)
reprimanded and fined $1,000 for presenting himself as licensed to the public and representing
taxpayers before the IRS without current CPA licensure or registration.

Ronald Ciaglia, Crest Hill – auctioneer license (440-000659) indefinitely suspended for
a minimum of five years and fined $5,000 due to improper sale of reserve items, failure to return
unsold auction items, unprofessional conduct, improper commission fees and failure to obtain
