The annual real property tax foreclosure auction is scheduled for December 5, 2013 and<br />

will be held at the Yakima County Courthouse in a location yet to be determined. All<br />

prospective bidders will need to register at the auction. Auctions are held according to<br />

Washington State foreclosure laws (RCW 84.64) and all property offered during the<br />

auction is offered for sale “as-is and where-is” without any representation of warranty,<br />

expressed or implied. You can review these statutes on the legislative website at<br />

http://www.leg.wa.gov.<br />

The minimum deposit accepted at the auction is $1,000 per parcel, payable in certified<br />

funds (cash, bank certified check or money order). No personal or business checks are<br />

accepted. The minimum deposit must be paid to the on-site cashier immediately<br />

following the award of the highest bid. The highest bidder also has the opportunity to<br />

pay the full amount at that time or at the Treasurer’s Office within the time frame<br />

established in the Auctioneer’s Opening Statement. The $1,000 deposit will be forfeited<br />

if the balance is not paid with certified funds within the allotted time frame. There is no<br />

financing available through Yakima County.<br />

Notice & Summons will be filed with the County Clerk’s Office in September 2013 and<br />

will be published in the Yakima Herald Republic. This is a listing of all parcels<br />

remaining in the case at that time. Once the Notice & Summons is published, a copy<br />

can be purchased for a $0.15 per page copy fee. Approximately ten days prior to sale,<br />

Judgment is filed and a copy of that will be available for purchase for the $0.15 per page<br />

copy fee. All parties have the opportunity to redeem their parcels up to 4:00 p.m. the<br />

day before the sale, to keep them from going to auction.<br />

Once a parcel has been sold at our foreclosure auction, the purchaser will be required<br />

to complete and sign a Real Estate Excise Tax Affidavit before leaving the auction. A<br />

Tax Deed will be filed with the County Auditor’s Office transferring the property<br />

purchased to the new owner. The right of redemption is very limited and follows<br />

Washington State law. As stated previously, all parcels are sold as-is, where-is.<br />

The parcels that are not sold at the auction become tax title property that the County<br />

holds in “trust” for Yakima County and the various Taxing Districts. Should you be<br />

interested in purchasing one of these parcels, a letter of intent to purchase must be<br />

submitted to the Yakima County Treasurer. The Treasurer then seeks determination<br />

from the legislative authority as to whether the parcel can be sold. This list can be<br />

obtained from our Office and you can research property tax and assessment information<br />

on the County’s website at www.yakimacounty.us.<br />

According to Washington State law (RCW 42.17.260(9)), which prohibits the use of lists<br />

of individuals for commercial purposes, a Request for Public Records form, which is<br />

available in our Office, must be completed when requesting parcel information other<br />

than Notice & Summons or Minimum Bid Lists.<br />
