The UCJI Committee has created five new instructions and
revised 22 instructions.
• UCJI Nos. 40.01 and 40.01A (new), Assault and Battery: Revised for plainer
language and newly drafted to provide a complete set of instructions in this area.
• UCJI Nos. 44.06 and 44.07, Agency in the Hospital Context: New
instructions to address agency for medical malpractice cases.
• UCJI No. 14.01, Burden of Proof: Revised to include the available burdens
of proof.
• UCJI Nos. 65.18, 70.09–70.11, and 77.01 (new), Damages in Tort and
Contract for Lost Profits and Loss of Use: Revised (and one drafted) to
provide consistent treatment of Lost Profits.
• UCJI Nos. 75.02, 75.02A, and 75.02B, Punitive Damages: Revised to
comply with final installment of Philip Morris.
• UCJI Nos. 70.01 and 73.01, Preliminary Damages and Avoidable
Consequences: Revised for plainer language.
• UCJI No. 70.19, Noneconomic Damages: New instruction to be given after
verdict in limited circumstances.
• UCJI Nos. 80.02, 80.07, and 80.08, Landlord-Tenant: Revised to comply
with statutory changes.
• UCJI Nos. 90.03A, 90.04–90.10, Verdict Forms: Revised to split questions
of fault and causation.
