DRIVING WHILE UNDER THE INFLUENCE OF<br />

INTOXICANTS—ANY COMBINATION OF INTOXICATING<br />

LIQUOR, CONTROLLED SUBSTANCES, OR INHALANTS—<br />

THREE OR MORE PRIOR CONVICTIONS<br />

<strong>Oregon</strong> law provides that a person commits the offense of driving<br />

while under the influence of intoxicants, with three or more prior<br />

convictions, if the person drives a motor vehicle on any premises open<br />

to the public while the person is under the influence of A/B/C/<br />

D/E/F , and has been convicted of driving while under the influence<br />

of intoxicants at least three times in the 10 years prior to the date of the<br />

current offense.<br />

In this case, to establish the crime of driving while under the<br />

influence of intoxicants, with three or more prior convictions, the state<br />

must prove beyond a reasonable doubt the following five elements:<br />

(1) The act occurred in __________ County, <strong>Oregon</strong>;<br />

(2) The act occurred on or about __________, 20___;<br />

(3) [Defendant’s name] drove a motor vehicle on premises open<br />

to the public;<br />

(4) While driving the motor vehicle [defendant’s name] was<br />

under the influence of A/B/C/D/E/F ; and<br />

(5) The defendant has been convicted of driving while under the<br />

influence of intoxicants at least three times in the 10 years prior to the<br />

date of the current offense.<br />

COMMENT: ORS 813.010, 813.326. See premises open to public, controlled<br />

substance, inhalant, and motor vehicle, defined in UCrJI No. 2700; controlled<br />

substance as a matter of law, defined in UCrJI No. 2707; under the influence of<br />

intoxicants, defined in UCrJI No. 2702. When the defendant stipulates to the prior<br />

convictions pursuant to ORS 813.326, the court should not give this instruction, but<br />

should instead give a modified version of UCrJI No. 2705 by substituting the words<br />

motor vehicle for the word vehicle.<br />
