PRESS RELEASE<br />

CIRCUIT COURT SENTENCING HEARINGS THIS WEEK:<br />

Cory Waialeale, 32, <strong>of</strong> Kapaa, was re-sentenced to a total<br />

maximum <strong>of</strong> 15 years in prison after being found in violation <strong>of</strong><br />

the terms and conditions <strong>of</strong> his probation in three separate<br />

criminal cases. Waialeale was originally sentenced for felony<br />

theft and fraud <strong>of</strong>fenses relating to taking his father’s ATM card<br />

and making unauthorized withdrawals on <strong>July</strong> 31, 2003. On January<br />

8, 2004 Waialeale was sentenced to concurrent probation terms for<br />

Criminal Property Damage in the Second Degree and Promoting a<br />

Dangerous Drug in the Third Degree.<br />

Motions to revoke Waialeale’s probation were filed on March<br />

14, 2005 after Waialeale’s probation <strong>of</strong>ficer reported that<br />

Waialeale was arrested for Family Abuse and other criminal<br />

<strong>of</strong>fenses on February 18, 2005, admitted to using methamphetamine


and cocaine, and failed to provide pro<strong>of</strong> <strong>of</strong> full time employment.<br />

Uasi Musika, 34, <strong>of</strong> Kilauea, was sentenced to five years in<br />

prison for Terroristic Threatening in the First Degree. Musika<br />

entered his guilty plea to the felony <strong>of</strong>fense on May 9, 2005.<br />

The <strong>of</strong>fense was committed on December 5, 2003 outside <strong>of</strong> Tomkat’s<br />

Grille in Koloa. After being informed by <strong>of</strong>ficers that he was<br />

under arrest for petty misdemeanor <strong>of</strong>fenses that occurred in<br />

Tomkat’s, Musika became belligerent, jabbed one <strong>of</strong>ficer in the<br />

chest, kicked the <strong>of</strong>ficer in the shin and threatened to kill both<br />

<strong>of</strong>ficers present.<br />

Sandy Kiilau, 39, <strong>of</strong> Lihue, was sentenced to five years in<br />

prison for Theft in the Second Degree. Kiilau entered her guilty<br />

plea to the felony <strong>of</strong>fense on May 17, 2005. The <strong>of</strong>fense occurred<br />

on <strong>July</strong> 16, 2004 at Kai Kane Hanalei. Kiilau took clothing <strong>of</strong>f<br />

the racks and concealed the items in a bag and left the store<br />

without paying for the items. When an employee <strong>of</strong> the store<br />

confronted Kiilau, she threw the items into nearby bushes.<br />

Derek Hepa, 36, <strong>of</strong> Kapaa, was sentenced to five years<br />

probation for Promoting a Dangerous Drug in the Third Degree<br />

(possession <strong>of</strong> methamphetamine). Special conditions to Hepa’s<br />

probation include one year in jail, substance abuse treatment,<br />

drug testing, and court fees. Hepa was also sentenced to 30 days<br />

jail for Reckless Driving and Driving While License Suspended or<br />

Revoked. Hepa could reduce the actual time he spends in jail by<br />

eing accepted to and successfully completing the Habilitat<br />

Substance Abuse Treatment program on Oahu, which is a residential<br />

treatment program that takes approximately two years to complete.<br />

Hepa entered guilty pleas to the felony <strong>of</strong>fense and traffic<br />

<strong>of</strong>fenses on May 12, 2005. Hepa was arrested after an <strong>of</strong>ficer saw<br />

him nearly cause a collision with oncoming cars on Olohena Road.<br />

When the <strong>of</strong>ficer pursued Hepa, he pulled into a private driveway<br />

and tried to walk away. The <strong>of</strong>ficer ordered Hepa back into his<br />

vehicle and asked for his license, registration and pro<strong>of</strong> <strong>of</strong><br />

insurance. The <strong>of</strong>ficer then learned that Hepa’s license was<br />

suspended, noticed that Hepa was acting suspiciously, and saw a<br />

glass smoking pipe commonly used to smoke methamphetamine on the<br />

passenger seat. Hepa was arrested, the pipe was seized, the<br />

<strong>of</strong>ficer obtained a search warrant for the vehicle Hepa was<br />

driving. When the search was done, the police found packets<br />

containing methamphetamine in Hepa’s fanny pack which was under<br />

the driver seat <strong>of</strong> that vehicle.<br />
