PRESS RELEASE
CIRCUIT COURT SENTENCING HEARINGS THIS WEEK:
Cory Waialeale, 32, of Kapaa, was re-sentenced to a total
maximum of 15 years in prison after being found in violation of
the terms and conditions of his probation in three separate
criminal cases. Waialeale was originally sentenced for felony
theft and fraud offenses relating to taking his father’s ATM card
and making unauthorized withdrawals on July 31, 2003. On January
8, 2004 Waialeale was sentenced to concurrent probation terms for
Criminal Property Damage in the Second Degree and Promoting a
Dangerous Drug in the Third Degree.
Motions to revoke Waialeale’s probation were filed on March
14, 2005 after Waialeale’s probation officer reported that
Waialeale was arrested for Family Abuse and other criminal
offenses on February 18, 2005, admitted to using methamphetamine
and cocaine, and failed to provide proof of full time employment.
Uasi Musika, 34, of Kilauea, was sentenced to five years in
prison for Terroristic Threatening in the First Degree. Musika
entered his guilty plea to the felony offense on May 9, 2005.
The offense was committed on December 5, 2003 outside of Tomkat’s
Grille in Koloa. After being informed by officers that he was
under arrest for petty misdemeanor offenses that occurred in
Tomkat’s, Musika became belligerent, jabbed one officer in the
chest, kicked the officer in the shin and threatened to kill both
officers present.
Sandy Kiilau, 39, of Lihue, was sentenced to five years in
prison for Theft in the Second Degree. Kiilau entered her guilty
plea to the felony offense on May 17, 2005. The offense occurred
on July 16, 2004 at Kai Kane Hanalei. Kiilau took clothing off
the racks and concealed the items in a bag and left the store
without paying for the items. When an employee of the store
confronted Kiilau, she threw the items into nearby bushes.
Derek Hepa, 36, of Kapaa, was sentenced to five years
probation for Promoting a Dangerous Drug in the Third Degree
(possession of methamphetamine). Special conditions to Hepa’s
probation include one year in jail, substance abuse treatment,
drug testing, and court fees. Hepa was also sentenced to 30 days
jail for Reckless Driving and Driving While License Suspended or
Revoked. Hepa could reduce the actual time he spends in jail by
2
eing accepted to and successfully completing the Habilitat
Substance Abuse Treatment program on Oahu, which is a residential
treatment program that takes approximately two years to complete.
Hepa entered guilty pleas to the felony offense and traffic
offenses on May 12, 2005. Hepa was arrested after an officer saw
him nearly cause a collision with oncoming cars on Olohena Road.
When the officer pursued Hepa, he pulled into a private driveway
and tried to walk away. The officer ordered Hepa back into his
vehicle and asked for his license, registration and proof of
insurance. The officer then learned that Hepa’s license was
suspended, noticed that Hepa was acting suspiciously, and saw a
glass smoking pipe commonly used to smoke methamphetamine on the
passenger seat. Hepa was arrested, the pipe was seized, the
officer obtained a search warrant for the vehicle Hepa was
driving. When the search was done, the police found packets
containing methamphetamine in Hepa’s fanny pack which was under
the driver seat of that vehicle.
