I apply to <strong>Ku</strong>-Ring-Gai Council for permission to undertake the works described above. I confirm that the<br />

Proposed Works are an accurate and true description of the works to be undertaken and I agree to carry out<br />

the above works in accordance with the Conditions attached to this <strong>Permit</strong>, which I have read and understood.<br />

I confirm that the contractor named above is experienced in carrying out works in the nature of the Proposed<br />

Works and holds a licence to undertake the Proposed Works and such licence will be current at the time the<br />

works are carried out if permission is granted. I also confirm that I will provide a copy of this <strong>Permit</strong> to the<br />

Contractor and ensure that he reads and understands its terms and conditions.<br />

I understand that the fees payable as part of this <strong>Permit</strong> are the genuine estimated costs to Council of<br />

reinstating the road to Council’s standard once the Proposed Works have been completed and that the<br />

<strong>2012</strong>/<strong>087933</strong>


einstatement works the Contractor is required to undertake pursuant to this <strong>Permit</strong> are temporary works<br />

necessary to keep the road safe until final restoration works are completed by Council. I further agree to pay<br />

any additional restoration charges which may be incurred by Council, as a result of the costs to restore the<br />

road to the condition it was in prior to the works being undertaken being greater than estimated.<br />

I accept full responsibility for the public safety and for injury to any person or persons and damage to any<br />

property, which may occur du<strong>ring</strong> the period of the works, or as a consequence of the Works the subject of<br />

this <strong>Permit</strong>. I agree to notify Council’s Restorations Supervisor on Telephone Number 9424 0194 on the<br />

completion of the work so that the final reinstatement works can be carried out by Council.<br />

GENERAL CONDITIONS FOR OPENING ROADS OR FOOTWAY AREAS<br />

IN MAIN, SECONDARY OR OTHER ROADS<br />

<strong>Permit</strong> is valid for six months from date of issue.<br />

Matters to be addressed prior to commencing works<br />

1) The Contractor must have experience in the proposed activity and hold a current public<br />

liability insurance policy from a reputable insurer to the value of not less than $20 000 000 for<br />

work on public roads. The Contractor shall produce a copy of a certificate of currency upon<br />

request by Council.<br />

2) No road surface shall be opened unless it is impracticable to tunnel or drive under the<br />

surface of the <strong>Road</strong>.<br />

Matters to be addressed du<strong>ring</strong> works<br />

1) At all times du<strong>ring</strong> restoration works provision is to be made for the safety of pedestrians and<br />

vehicular traffic.<br />

2) Work undertaken pursuant to this <strong>Permit</strong> shall be restricted to the following hours:<br />

7.00am - 5.30pm Monday to Friday, 8.00am - 5.30pm Saturday except that noise generating<br />

equipment or articles shall NOT be used after 12 noon on Saturdays.<br />

3) i) Adequate barriers and warning signs must be provided and, where the Works consist of<br />

excavation which is open overnight, adequate lighting with a minimum of three lights.<br />

ii) Where in Council's opinion, inadequate barricading and/or lighting of a road or footpath<br />

opening has been provided, Council may, without prior notification, install additional<br />

barricades and/or lamps, and charge the person or authority performing the opening.<br />

iii)<br />

All road opening works in concrete and asphalt roads must be saw cut or saw cutting<br />

charges will apply.<br />

4) Du<strong>ring</strong> progress of the Works, not less than 3.5 metres of the carriageway shall be left<br />

available in proper condition for general traffic.<br />

5) All surplus excavated material shall be removed from the site and disposed of at an approved<br />

tip site at the full cost of the Contractor or Applicant.<br />

6) Prior to commencing the Works, any damage to the road and/or footpath in the vicinity of the<br />

Works must be reported to Council. A failure to do so may result in the Contractor or<br />

Applicant being held responsible for all damage in the vicinity of Work.<br />

7) For openings in brick paved footpaths, any underlying concrete base shall be broken, not saw<br />

cut. No pavement less than 500mm wide shall be left between an opening and the edge of<br />

pavement, construction joining or previous opening. In such cases, the remaining pavement<br />

shall be included in the restored area.<br />

8) The location of all Public Utility Services, mains and cables shall be determined in advance<br />

and Council indemnified a<strong>gai</strong>nst any responsibility for damages to such services.<br />

Reinstatement Works<br />

1) Upon completion of the Works the subject of this permit, the opening shall immediately be<br />

filled up and consolidated and the road surface made good to the satisfaction of Council.<br />

2) Contractors are required to keep surface material separate from earth excavation and<br />

replace in proper order into backfilled trench.<br />

3) Contractors shall consolidate the opening by means of a vibrating or ramming machine or, if<br />

such is not used, then the trenches are to be backfilled and rammed in layers of not more<br />

than 0.2 metres in thickness.<br />

Where effective consolidation is not likely to be achieved, the Council may direct the<br />

Contractor (and/or the Applicant) to backfill the trench with sand in 0.15 metre layers and<br />

rammed, or a sand/cement mixture in ration of 14:1 at the cost of the Contractor or Applicant.<br />

4) All openings after proper consolidation are to be left level with the adjoining surface with a<br />

pre-mix bitumen.<br />

5) In the case of extensive openings, the person making the opening shall maintain it in suitable<br />

conditions for a period of six months, or until restoration is affected by the Council, whichever<br />

is sooner. Du<strong>ring</strong> this period the person making the opening shall be responsible for<br />

rectifying any subsidence.<br />

6) Council will make restoration of concrete footpaths in full slabs only except where a very<br />

narrow strip is taken from a concrete path, Council may elect to significantly widen the<br />

restoration rather than replace the whole path, depending on the existing footpath width.<br />

7) <strong>Opening</strong>s in grassed footpaths may be filled with the excavated material provided that the<br />

material is placed in the reverse order of excavation, to ensure that varying materials are<br />

retuned to their original levels. The materials are to be placed and compacted in layers, as<br />

for openings in paved areas. Existing turf, having been carefully cut and put aside, shall be<br />

placed to match the levels of adjoining turf, and irregularities corrected with suitable topdressing.<br />

The opening area is then to be watered heavily.<br />

Costs<br />

1) Charges apply to all openings made by any person or public authority in the course of building<br />

operations, unless agreed otherwise by Council.<br />

2). The charge for earth or gravel roads will apply where road shoulders of these materials are<br />

affected.<br />

3) For road asphalt areas of 1 m² or less the minimum charge shall apply. For concrete<br />

footpaths the minimum restoration charge shall be full slab replacement (from construction<br />

joint to construction joint)<br />

4) If the actual cost to the Council in undertaking the restoration of road openings over 10m² is<br />

greater than the fee charged as part of this <strong>Permit</strong>, then the Contractor or the Applicant is<br />

liable to reimburse Council for the difference upon receipt of notification to that effect.<br />

5) Council may seek reimbursement for the actual costs of resto<strong>ring</strong> road openings under 10m²<br />

in special circumstances.<br />

6) Several openings made at the one time less than twenty metres apart may be grouped as<br />

one.<br />

7) Where a bo<strong>ring</strong> machine is used and the road pavement is tunnelled, no charge will be made<br />

for the length of the bitumen surface left unaffected.<br />

8) Where damage is done by vehicles or other mechanical equipment to any road or footway<br />

pavement adjacent to an opening, the cost to Council of repai<strong>ring</strong> such damage shall be<br />

payable by the Contractor or the Applicant as a fee in addition to the opening restoration fee.<br />

9) Where the actual scope of Works carried out is greater than the estimated Proposed scope of<br />

works identified on the permit application form, the Contractor and/or the Applicant shall be<br />

liable for all costs associated with reinstating the additional parts of the road damaged as a<br />

consequence.<br />

Special Condition for Public Authorities<br />

1) The fee relating to longitudinal openings parallel to paths in grassed area of footpaths is a<br />

nominal charge only which shall apply to Public Authorities and is intended to cover<br />

maintenance only and not the full cost of restoration. Authorities shall therefore be expected<br />

to continue the present practice of backfilling, topsoil and returfing all affected grassed<br />

areas.<br />
