"STANDARDS FOR IMPOSING LAWYER SANCTIONS<br />

"<strong>In</strong> making this <strong>re</strong>commendation for discipline, the Hearing Panel conside<strong>re</strong>d the<br />

factors outlined by the American Bar Association in its Standards for Imposing Lawyer<br />

Sanctions (he<strong>re</strong>inafter 'Standards'). Pursuant to Standard 3, the factors to be conside<strong>re</strong>d<br />

a<strong>re</strong> the duty violated, the lawyer's mental state, the potential or actual injury caused by<br />

the lawyer's misconduct, and the existence of aggravating or mitigating factors.<br />

"Duty Violated. The Respondent violated his duty to the profession to maintain<br />

his professional integrity.<br />

"Mental State. The Respondent knowingly and intentionally violated his duty.<br />

"<strong>In</strong>jury. As a <strong>re</strong>sult of the Respondent's misconduct, the Respondent caused<br />

actual injury to the legal profession.<br />

"Aggravating or Mitigating Factors. Aggravating circumstances a<strong>re</strong> any<br />

considerations or factors that may justify an inc<strong>re</strong>ase in the deg<strong>re</strong>e of discipline to be<br />

imposed. <strong>In</strong> <strong>re</strong>aching its <strong>re</strong>commendation for discipline, the Hearing Panel, in this case,<br />

found the following aggravating factors p<strong>re</strong>sent:<br />

"A Pattern of Misconduct. The Respondent engaged in [a] pattern of misconduct<br />

by posting, <strong>re</strong>moving, and <strong>re</strong>-posting inappropriate photographs on the <strong>In</strong>ternet and by<br />

allowing the purported minor to view the inappropriate photographs.<br />

"Multiple Offenses. The Respondent committed multiple offenses by violating<br />

KRPC 8.4, Kan. Sup. Ct. R. 208, and Kan. Sup. Ct. R. 211.<br />

"Illegal Conduct, <strong>In</strong>cluding that <strong>In</strong>volving the Use of Controlled Substances. The<br />

Respondent was convicted of a misdemeanor by his plea to the amended charge of<br />

indecent exposu<strong>re</strong> to a minor. Accordingly, the Hearing Panel concludes that the<br />

Respondent engaged in criminal conduct.<br />
