Directors I would like to<br />

wish you all a happy and<br />

successful new year.<br />

I believe that 2010 is going to be a great year<br />

for our community now that we have<br />

navigated through the rough waters of 2009.<br />

As you know it was a big challenge for the<br />

Master HOA to pick up the pieces as a result<br />

of the builder leaving us last year. We started<br />

with big budget deficits, poor service, and<br />

facilities that were in great need of repair. We<br />

had an unsustainable model that needed big<br />

changes.<br />

In less than a year I am proud to say that our<br />

house is in order!<br />

We are no longer running a deficit each<br />

month and from a financial perspective we<br />

are on a solid path. We have cut our<br />

expenses and improved every area of the<br />

operation that we have reviewed.<br />

We also took the time to review things like<br />

insurance to make sure that we were all<br />

covered properly. We restored order to the<br />

clubhouse to make it enjoyable for everyone<br />

and have worked on improving the security<br />

gates and systems. We even established a<br />

long term plan to finish landscaping the<br />

community over time that will increase the<br />

value of all our homes. Continued on page 4<br />

At our November, 2009, meeting, your Board of Directors unanimously voted on accepting a<br />

proposal from Karen at IKare Publishing to create and publish a <strong>Live</strong> <strong>Oak</strong> <strong>Preserve</strong> community<br />

newsletter. The newsletter will directly be mailed to all of our residents every other month. Karen<br />

has been publishing community newsletters for 30 years, and her business includes many new<br />

Tampa communities like Cory Lake Isles, Seven <strong>Oak</strong>s, Heritage Isles, West Meadows, and<br />

Tampa Palms North.<br />

Based upon requests from our residents and our homeowner’s reactions to our previous<br />

newsletters, the Board of Directors believe that you will enjoy Karen’s unique publishing style<br />

and the helpful information contained within each newsletter. The <strong>Live</strong> <strong>Oak</strong> <strong>Preserve</strong> Newsletter<br />

will be a very effective way of communicating with our neighbors. We hope that you will make an<br />

Most importantly we had our first budget passed<br />

as a board of home owners and our monthly HOA<br />

payments will fall to $129.00 per month this year.<br />

There is still a lot of work to be done for 2010 as<br />

potential builders are looking at our remaining lots<br />

to decide if they should invest in our community.<br />

We need your support as we are looking forward<br />

to reducing our expenses further and finding<br />

better ways to improve this community.<br />

New 2010 Budget<br />

October HOA Meeting<br />

10/30/2009 - HOA fees are going down in 2010!<br />

The Master HOA Board for <strong>Live</strong> <strong>Oak</strong> <strong>Preserve</strong><br />

approved a budget October 23 at a public budget<br />

meeting that will reduce current monthly fees from<br />

$164 to $129 a month. Total expenses were<br />

reduced from a 2009 budget of $3,125,048 to<br />

$1,596,528 for 2010. Most of the savings is due<br />

to the termination of the Bulk Cable agreement<br />

with Brighthouse Networks.<br />

This past year has been a challenging year for<br />

our community and reducing fees was a priority<br />

for all involved in the development of this budget.<br />

A special thanks to Greenacre Properties, the<br />

volunteer Budget Committee, HOA Board<br />

Members, Village Board Members and the<br />

concerned residents that voiced their input in the<br />

culmination of the final budget. While it was<br />

important to reduce fees, it is equally important<br />

that we maintain and improve our community.<br />

There was a definite balance that needed to be<br />

achieved to make LOP a premiere community<br />

and a destination for potential home buyers.<br />

With that said, it is important to understand that<br />

we are all in "business together" and the timely<br />

payment of your monthly HOA fees is the only<br />

way to keep all our fees down and to build a<br />

stronger community. Please find the new 2010<br />

What is a Community Development District?<br />

A Community Development District (CDD) is an independent special purpose unit of local<br />

government established pursuant to and governed by Chapter 190 of Florida Statutes. There<br />

are more than 400 CDDs throughout Florida today. A CDD is a special-purpose unit created<br />

primarily for the purpose of financing and then operating and maintaining community-wide<br />

infrastructure and improvements in new communities. The CDD was developed in 1980 by the<br />

state of Florida as a tool for local municipalities and developers for funding the rapid growth and<br />

development of new communities. Generally, a landowner (usually a developer) petitions the<br />

local government to create a CDD with broad powers that enables the CDD to generate revenue<br />

to pay for these infrastructure items over a period of time up to 30 years. In the case of <strong>Live</strong> <strong>Oak</strong><br />

<strong>Preserve</strong>, bonds were issued and payable by the land-owners (purchasers of homes) for funding<br />

development and construction of the roads, the community ponds, mitigation areas, landscaping<br />

of some common areas, community fountains and a portion of the community street lighting.<br />

The CDD maintains, operates and administers the property and improvements subject to its<br />

control and establishes the fees or other financial obligations of the land owners. As it stands,<br />

currently it is a 5 seat board composed of supervisors elected during the general election, by<br />

qualified electors of the District. Each Supervisor serves a 4 year term. While the CDD may at<br />

times express support for various community issues, it is not an organization that is meant<br />

handle homeowner issues that are outside of the scope of managing the assets with which the<br />

Board is entrusted through the ordinance that established it.<br />

Where does the CDD get its funds?<br />

Each property in the <strong>Live</strong> <strong>Oak</strong> I CDD receives an assessment which is collected with the County<br />

Taxes each year. This assessment (tax) is based on the size and scope of your lot and contains<br />

two parts:<br />

Bond Repayment. - In CDD communities Florida developers take out Bonds to pay for<br />

infrastructure. The repayment of these bonds are the responsibly of the property owners of a<br />

district, as they receive the benefits of this infrastructure. The <strong>Live</strong> <strong>Oak</strong> <strong>Preserve</strong> bond will be<br />

paid off May 10, 2034.<br />

Operations/Maintenance - This portion of the assessment represents the ongoing costs of<br />

maintaining infrastructure that a District owns as well as any established reserves.<br />

What is a Home Owners Association?<br />

Homeowners' associations, or HOAs, are formal legal entities created to maintain<br />

common areas; they also have the authority to enforce deed restrictions. Most<br />

condominium and townhome developments, and many newer single-family<br />

subdivisions have HOAs, which are usually created when the development is built.<br />

Covenants, Conditions and Restrictions (CC&R's) are issued to each homeowner, and<br />

HOAs are established to ensure that they are adhered to in order to maintain the<br />

quality and value of the properties involved.<br />

Features of a Homeowners' Association:<br />

► Membership is mandatory for all property owners within the development<br />

► Members are charged mandatory fees and are responsible for payment.<br />

► Homeowners associations have the authority to enact and enforce maintenance<br />

and design standards in addition to those established by City/County ordinances.<br />

► Homeowners' associations are corporations with formal bylaws and has a<br />

governing board and property management company to handle operations,<br />

maintenance, and enforcement issues.<br />

► In <strong>Live</strong> <strong>Oak</strong> <strong>Preserve</strong>, you'll also find that the Homeowners' Association is made up<br />

of a 5 member board that meets monthly and handles some of the following:<br />

• Establish and collect maintenance fees needed to run neighborhood operations<br />

The resident should answer the phone.<br />

If the person is allowed, the resident presses<br />

and holds 9 on their phone key-pad, and this<br />

will open the gate.<br />

If a resident does not answer the phone.<br />

Security will ask the guest to try and call the<br />

resident on their cell phone and see if the<br />

resident is home. If not, the guest must turn<br />

around.<br />

If the person is not allowed in, the resident<br />

hangs up the phone and they may call<br />

security to confirm. (813-973-8316.)<br />

Once the 4-digit code is known for the<br />

resident, next time a guest comes in all they<br />

need to press to call the resident is ## then<br />

the 4-digit code. This will call the resident.<br />

Security also has a guest list which is for<br />

guests allowed in no matter the day or time.<br />

(i.e. pet sitters, family members, lawn care<br />

service, etc.) Just let Security know to add<br />

them to your guest list.

It Is That Time Of Year Again...How To Behave In Gyms!<br />

Even though gyms have been popular for decades<br />

now, and a majority of people today use them, it is<br />

still amazing how many people walk into a gym<br />

and attend gyms frequently without understanding<br />

basic gym etiquette.<br />

Whether you're a new to a gym, or a seasoned<br />

veteran it might pay to review this list of common<br />

gym etiquette to ensure that you are not<br />

inadvertently becoming "that guy" or "that gal" that<br />

everyone points to and complains about in the<br />

gym.<br />

Common Gym Courtesies<br />

No Foul Language. The gym is a public place.<br />

People of all ages, genders, religions and cultures<br />

might be present on the premises. Be respectful of<br />

the people around you and don't use foul<br />

language.<br />

Grunting. Occasional natural grunting under<br />

extremely lifting conditions may be acceptable in<br />

some hardcore gyms, but loud habitual or sudden<br />

outbursts are never acceptable. They are seen as<br />

rude, juvenile and egotistical. What it really says is<br />

"look at me" I am a rude, inconsiderate novice.<br />

Remember that the others around you are<br />

concentrating on their own work out and don't<br />

need to hear "the loud guy" screaming for<br />

attention.<br />

Pick up after yourself. Unless you own the gym,<br />

you are guest. This means you are one of many<br />

using the gym. So be courteous to others and<br />

don't leave any water bottles, cans, food<br />

wrappers, towels, or any other items behind. The<br />

same goes for the locker room. Keep your locker<br />

clean, orderly, and don't leave anything lying<br />

around for the next guy. Your membership fee is<br />

for use of the apparatus; it is not for maid service.<br />

Be Aware of the Workout Area. Do not exercise<br />

where others need to walk, high traffic paths, area<br />

entries, in front of water<br />

stations, etc. Do not stand in<br />

front of the dumbbell rack or<br />

weight trees since other<br />

exercisers will need clearance<br />

to get and put away their<br />

dumbbells and weight plates.<br />

Music. There's absolutely no problem with<br />

listening to music while working out, but don't<br />

have it blasting so loudly through your<br />

headphones that (1) those around you can hear<br />

the noise and (2) that you cannot answer others<br />

when they need to ask you if you are using a<br />

piece of equipment. Also unless you have a few<br />

Platinum albums under your belt, no karaoke,<br />

please!<br />

Gym TV or Music Systems. If you do not like the<br />

choice of music or what is playing on TV ask<br />

others working out if they would mind if you<br />

request a change. A safe choice is to bring your<br />

own headset and portable music or video player.<br />

Mirrors. There are two things to know about<br />

mirrors. In most modern gyms, mirrors are<br />

everywhere. Mirrors are there for more than just<br />

vanity. Mirrors are there to help make sure you<br />

are using proper technique, so unless you are<br />

pressed up against one fixing your hair or<br />

checking yourself out, don't be afraid to use the<br />

mirrors. Secondly, respect others who are also<br />

using them and try to avoid walking in front as<br />

they are performing their set. If you want to use a<br />

mirror, it's better to stand close to it so that your<br />

actions are unambiguous to the rest of the crowd.<br />

If you're looking at yourself in a mirror from<br />

across the room, don't get mad if someone<br />

passes in front of you.<br />

Minimize What You Bring on the Gym Floor.<br />

Keep your stuff off the Equipment and areas were<br />

people need to walk - even if you are exercising<br />

right next to it. Leaving stuff around is rude,<br />

creates confusion (people do not know if<br />

equipment is taken) and can also create a safety<br />

issue if left on the floor. Your stuff may also get<br />

stolen to!<br />

Use Towels. Always have a towel handy,<br />

especially if you wear tank tops, or sweat a lot.<br />

Some gyms provide towel service and others<br />

don't. ALWAYS bring a towel with you. Towels<br />

help you keep your sweat to yourself, and they<br />

help you avoid the sweat of others. There is<br />

nothing worse than lying on a piece of gym<br />

equipment with someone else's sweat all over it.<br />

Most gyms have cleaning supplies located in the<br />

cardio area to wipe down your machine-use them!<br />

How To Behave In Gyms<br />

Control Offensive Body Odor. Exercising makes<br />

you sweat and perspiration causes body odor.<br />

Additionally many gyms are crowded and you in<br />

many cases will be working out in close proximity<br />

with others. Do everyone a favor and come to the<br />

gym showered and wear effective deodorant.<br />

Smelling good is great however don't take this to<br />

an extreme. You are not going out to a club, so do<br />

NOT douse yourself with cologne;<br />

overcompensation can be just as unpleasant for<br />

fellow members.<br />

Germs. Wash hands to<br />

decrease spread of<br />

germs after (1) using<br />

rest room (2) after<br />

sneezing or coughing on<br />

your hand and (3) after<br />

workouts Also wipe<br />

machines off before and<br />

after use.<br />

Don't Bang the Weights. Do not slam the<br />

weights onto the equipment. This just makes you<br />

look inconsiderate and like a "Class A" idiot. Just<br />

do not do it. Enough said.<br />

Don't Drop the Weights. As with grunting, just<br />

don't. Weights make a loud noise when dropped,<br />

which can throw others off their workouts. Not only<br />

is dropping weights disrespectful to others but<br />

dropping the weights can (1) damage the<br />

equipment and (2) they can roll or bounce and<br />

injure passerby's.<br />

Wipe the Machines After Use. Nothing is worse<br />

than walking to a machine and finding it covered<br />

with sweat. If you happen to sweat all over a piece<br />

of equipment, wipe it down, preferably using the<br />

disinfectant provided by the gym.<br />

Personal Trainers. Many gyms have rules<br />

against personal training clients (if you do not<br />

work for the particular gym) in their<br />

establishments. There may be good reason for it<br />

too, like insurances purposes. Proper gym<br />

etiquette is to speak to the club manager and get<br />

his or her approval if you wish to train others (as a<br />

business) in the gym.<br />

Forget The Paranormal Explanations<br />

Many people are looking for paranormal explanations<br />

for luck, and for related phenomena like intuition and<br />

creativity. But why? There are good psychological<br />

explanations for why some people are luckier than<br />

others that have nothing to do with psychic abilities.<br />

There are exercises that have been shown to improve<br />

one's luck whether or not we have a decent<br />

explanation yet.<br />

Why do people need an appeal to the paranormal?<br />

Perhaps part of the reason is that if psychic powers<br />

could bring you luck, it would be easier than making<br />

changes in how you think and act. There is nothing<br />

wrong with looking for an easier way - as long as the<br />

search does not become an excuse for not taking the<br />

steps that are proven to work.<br />

In Richard Wiseman's ten-year study of lucky people,<br />

he found definite differences between lucky and<br />

unlucky people. What he didn't find, however, was any<br />

indication of anything paranormal.<br />

For example, he found that people described by<br />

themselves and others as lucky were not any more<br />

likely to win the lottery. No surprise there - a lottery is<br />

random chance. On the other hand, people who are<br />

considered lucky can win more often in business or<br />

love or even artistic endeavors, and without paranormal<br />

powers. They simply think and act in ways that promote<br />

a better outcome - they apply principles of good luck<br />
