Residents,
On behalf of the Live Oak
Preserve Board of
Directors I would like to
wish you all a happy and
successful new year.
I believe that 2010 is going to be a great year
for our community now that we have
navigated through the rough waters of 2009.
As you know it was a big challenge for the
Master HOA to pick up the pieces as a result
of the builder leaving us last year. We started
with big budget deficits, poor service, and
facilities that were in great need of repair. We
had an unsustainable model that needed big
changes.
In less than a year I am proud to say that our
house is in order!
We are no longer running a deficit each
month and from a financial perspective we
are on a solid path. We have cut our
expenses and improved every area of the
operation that we have reviewed.
We also took the time to review things like
insurance to make sure that we were all
covered properly. We restored order to the
clubhouse to make it enjoyable for everyone
and have worked on improving the security
gates and systems. We even established a
long term plan to finish landscaping the
community over time that will increase the
value of all our homes. Continued on page 4
Letter Of Introduction Of IKare Publishing
At our November, 2009, meeting, your Board of Directors unanimously voted on accepting a
proposal from Karen at IKare Publishing to create and publish a Live Oak Preserve community
newsletter. The newsletter will directly be mailed to all of our residents every other month. Karen
has been publishing community newsletters for 30 years, and her business includes many new
Tampa communities like Cory Lake Isles, Seven Oaks, Heritage Isles, West Meadows, and
Tampa Palms North.
Based upon requests from our residents and our homeowner’s reactions to our previous
newsletters, the Board of Directors believe that you will enjoy Karen’s unique publishing style
and the helpful information contained within each newsletter. The Live Oak Preserve Newsletter
will be a very effective way of communicating with our neighbors. We hope that you will make an
effort to call on the local advertisers within our newsletter.
As a resident of Live Oak Preserve, you also have the opportunity to submit your own articles or
newsworthy pieces regarding Live Oak Preserve, planned events, announcements, or other
Continued…
Most importantly we had our first budget passed
as a board of home owners and our monthly HOA
payments will fall to $129.00 per month this year.
There is still a lot of work to be done for 2010 as
potential builders are looking at our remaining lots
to decide if they should invest in our community.
We need your support as we are looking forward
to reducing our expenses further and finding
better ways to improve this community.
New 2010 Budget
Approved at
October HOA Meeting
10/30/2009 - HOA fees are going down in 2010!
The Master HOA Board for Live Oak Preserve
approved a budget October 23 at a public budget
meeting that will reduce current monthly fees from
$164 to $129 a month. Total expenses were
reduced from a 2009 budget of $3,125,048 to
$1,596,528 for 2010. Most of the savings is due
to the termination of the Bulk Cable agreement
with Brighthouse Networks.
This past year has been a challenging year for
our community and reducing fees was a priority
for all involved in the development of this budget.
A special thanks to Greenacre Properties, the
volunteer Budget Committee, HOA Board
Members, Village Board Members and the
concerned residents that voiced their input in the
culmination of the final budget. While it was
important to reduce fees, it is equally important
that we maintain and improve our community.
There was a definite balance that needed to be
achieved to make LOP a premiere community
and a destination for potential home buyers.
With that said, it is important to understand that
we are all in "business together" and the timely
payment of your monthly HOA fees is the only
way to keep all our fees down and to build a
stronger community. Please find the new 2010
budget link below.
Note: A copy of the approved 2010 budget can
be found at www.liveoakvillages.com.
We are looking forward to a great partnership with
Live Oak Preserve Community Development District
What is a Community Development District?
A Community Development District (CDD) is an independent special purpose unit of local
government established pursuant to and governed by Chapter 190 of Florida Statutes. There
are more than 400 CDDs throughout Florida today. A CDD is a special-purpose unit created
primarily for the purpose of financing and then operating and maintaining community-wide
infrastructure and improvements in new communities. The CDD was developed in 1980 by the
state of Florida as a tool for local municipalities and developers for funding the rapid growth and
development of new communities. Generally, a landowner (usually a developer) petitions the
local government to create a CDD with broad powers that enables the CDD to generate revenue
to pay for these infrastructure items over a period of time up to 30 years. In the case of Live Oak
Preserve, bonds were issued and payable by the land-owners (purchasers of homes) for funding
development and construction of the roads, the community ponds, mitigation areas, landscaping
of some common areas, community fountains and a portion of the community street lighting.
The CDD maintains, operates and administers the property and improvements subject to its
control and establishes the fees or other financial obligations of the land owners. As it stands,
currently it is a 5 seat board composed of supervisors elected during the general election, by
qualified electors of the District. Each Supervisor serves a 4 year term. While the CDD may at
times express support for various community issues, it is not an organization that is meant
handle homeowner issues that are outside of the scope of managing the assets with which the
Board is entrusted through the ordinance that established it.
Where does the CDD get its funds?
Each property in the Live Oak I CDD receives an assessment which is collected with the County
Taxes each year. This assessment (tax) is based on the size and scope of your lot and contains
two parts:
Bond Repayment. - In CDD communities Florida developers take out Bonds to pay for
infrastructure. The repayment of these bonds are the responsibly of the property owners of a
district, as they receive the benefits of this infrastructure. The Live Oak Preserve bond will be
paid off May 10, 2034.
Operations/Maintenance - This portion of the assessment represents the ongoing costs of
maintaining infrastructure that a District owns as well as any established reserves.
What is a Home Owners Association?
Homeowners' associations, or HOAs, are formal legal entities created to maintain
common areas; they also have the authority to enforce deed restrictions. Most
condominium and townhome developments, and many newer single-family
subdivisions have HOAs, which are usually created when the development is built.
Covenants, Conditions and Restrictions (CC&R's) are issued to each homeowner, and
HOAs are established to ensure that they are adhered to in order to maintain the
quality and value of the properties involved.
Features of a Homeowners' Association:
► Membership is mandatory for all property owners within the development
► Members are charged mandatory fees and are responsible for payment.
► Homeowners associations have the authority to enact and enforce maintenance
and design standards in addition to those established by City/County ordinances.
► Homeowners' associations are corporations with formal bylaws and has a
governing board and property management company to handle operations,
maintenance, and enforcement issues.
► In Live Oak Preserve, you'll also find that the Homeowners' Association is made up
of a 5 member board that meets monthly and handles some of the following:
• Establish and collect maintenance fees needed to run neighborhood operations
• Maintain community landscaping
• Maintain recreational facilities
• Provide space for events or neighborhood functions
• Provide security (Gated Community)
• Arrange for street and gate maintenance
• Enforce deed restrictions including, but not limited to, exterior home
maintenance, control trash and blight
For a complete list of HOA responsibilities and bylaws please see the Master HOA
document found at www.liveoakvillages.com.
It Is That Time Of Year Again...How To Behave In Gyms!
Even though gyms have been popular for decades
now, and a majority of people today use them, it is
still amazing how many people walk into a gym
and attend gyms frequently without understanding
basic gym etiquette.
Whether you're a new to a gym, or a seasoned
veteran it might pay to review this list of common
gym etiquette to ensure that you are not
inadvertently becoming "that guy" or "that gal" that
everyone points to and complains about in the
gym.
Common Gym Courtesies
No Foul Language. The gym is a public place.
People of all ages, genders, religions and cultures
might be present on the premises. Be respectful of
the people around you and don't use foul
language.
Grunting. Occasional natural grunting under
extremely lifting conditions may be acceptable in
some hardcore gyms, but loud habitual or sudden
outbursts are never acceptable. They are seen as
rude, juvenile and egotistical. What it really says is
"look at me" I am a rude, inconsiderate novice.
Remember that the others around you are
concentrating on their own work out and don't
need to hear "the loud guy" screaming for
attention.
Pick up after yourself. Unless you own the gym,
you are guest. This means you are one of many
using the gym. So be courteous to others and
don't leave any water bottles, cans, food
wrappers, towels, or any other items behind. The
same goes for the locker room. Keep your locker
clean, orderly, and don't leave anything lying
around for the next guy. Your membership fee is
for use of the apparatus; it is not for maid service.
Be Aware of the Workout Area. Do not exercise
where others need to walk, high traffic paths, area
entries, in front of water
stations, etc. Do not stand in
front of the dumbbell rack or
weight trees since other
exercisers will need clearance
to get and put away their
dumbbells and weight plates.
Music. There's absolutely no problem with
listening to music while working out, but don't
have it blasting so loudly through your
headphones that (1) those around you can hear
the noise and (2) that you cannot answer others
when they need to ask you if you are using a
piece of equipment. Also unless you have a few
Platinum albums under your belt, no karaoke,
please!
Gym TV or Music Systems. If you do not like the
choice of music or what is playing on TV ask
others working out if they would mind if you
request a change. A safe choice is to bring your
own headset and portable music or video player.
Mirrors. There are two things to know about
mirrors. In most modern gyms, mirrors are
everywhere. Mirrors are there for more than just
vanity. Mirrors are there to help make sure you
are using proper technique, so unless you are
pressed up against one fixing your hair or
checking yourself out, don't be afraid to use the
mirrors. Secondly, respect others who are also
using them and try to avoid walking in front as
they are performing their set. If you want to use a
mirror, it's better to stand close to it so that your
actions are unambiguous to the rest of the crowd.
If you're looking at yourself in a mirror from
across the room, don't get mad if someone
passes in front of you.
Minimize What You Bring on the Gym Floor.
Keep your stuff off the Equipment and areas were
people need to walk - even if you are exercising
right next to it. Leaving stuff around is rude,
creates confusion (people do not know if
equipment is taken) and can also create a safety
issue if left on the floor. Your stuff may also get
stolen to!
Use Towels. Always have a towel handy,
especially if you wear tank tops, or sweat a lot.
Some gyms provide towel service and others
don't. ALWAYS bring a towel with you. Towels
help you keep your sweat to yourself, and they
help you avoid the sweat of others. There is
nothing worse than lying on a piece of gym
equipment with someone else's sweat all over it.
Most gyms have cleaning supplies located in the
cardio area to wipe down your machine-use them!
How To Behave In Gyms
Continued...
Control Offensive Body Odor. Exercising makes
you sweat and perspiration causes body odor.
Additionally many gyms are crowded and you in
many cases will be working out in close proximity
with others. Do everyone a favor and come to the
gym showered and wear effective deodorant.
Smelling good is great however don't take this to
an extreme. You are not going out to a club, so do
NOT douse yourself with cologne;
overcompensation can be just as unpleasant for
fellow members.
Germs. Wash hands to
decrease spread of
germs after (1) using
rest room (2) after
sneezing or coughing on
your hand and (3) after
workouts Also wipe
machines off before and
after use.
Don't Bang the Weights. Do not slam the
weights onto the equipment. This just makes you
look inconsiderate and like a "Class A" idiot. Just
do not do it. Enough said.
Don't Drop the Weights. As with grunting, just
don't. Weights make a loud noise when dropped,
which can throw others off their workouts. Not only
is dropping weights disrespectful to others but
dropping the weights can (1) damage the
equipment and (2) they can roll or bounce and
injure passerby's.
Wipe the Machines After Use. Nothing is worse
than walking to a machine and finding it covered
with sweat. If you happen to sweat all over a piece
of equipment, wipe it down, preferably using the
disinfectant provided by the gym.
Personal Trainers. Many gyms have rules
against personal training clients (if you do not
work for the particular gym) in their
establishments. There may be good reason for it
too, like insurances purposes. Proper gym
etiquette is to speak to the club manager and get
his or her approval if you wish to train others (as a
business) in the gym.
or whatever you want. But you know that some people
have more good things happen in their lives, and more
happy surprises. What you may not know is that there
are things you can do to be more like them and so be
luckier yourself. Here are a few tips to get you started.
Don't Take Advice From Your Fears
Letting fear make decisions is a bad habit that is sure
to get in the way of having more luck in your life. Acting
from fear also sabotages your self-growth. Did you
know that Johnny Carson had stage-fright every night
before he went on the air? He stepped out there
anyhow, and enjoyed doing the Tonight Show for
decades. Fear is just a feeling. Move forward despite it.
Breath Deep
Live Oak Preserve
You Can Call It Good Luck,
Or Cause And Effect….
Take several deep breaths through your nose from
time to time. Close your eyes, pay attention to your
breathing, and let the tension drain from your muscles
while doing this. This is like a mini-meditation..
Forget The Paranormal Explanations
Many people are looking for paranormal explanations
for luck, and for related phenomena like intuition and
creativity. But why? There are good psychological
explanations for why some people are luckier than
others that have nothing to do with psychic abilities.
There are exercises that have been shown to improve
one's luck whether or not we have a decent
explanation yet.
Why do people need an appeal to the paranormal?
Perhaps part of the reason is that if psychic powers
could bring you luck, it would be easier than making
changes in how you think and act. There is nothing
wrong with looking for an easier way - as long as the
search does not become an excuse for not taking the
steps that are proven to work.
In Richard Wiseman's ten-year study of lucky people,
he found definite differences between lucky and
unlucky people. What he didn't find, however, was any
indication of anything paranormal.
For example, he found that people described by
themselves and others as lucky were not any more
likely to win the lottery. No surprise there - a lottery is
random chance. On the other hand, people who are
considered lucky can win more often in business or
love or even artistic endeavors, and without paranormal
powers. They simply think and act in ways that promote
a better outcome - they apply principles of good luck
