the 31 victims were shunted around different departments for days<br />
before be<strong>in</strong>g sent back to Caosheng village - where factory owner Wang<br />
B<strong>in</strong>gb<strong>in</strong>g’s father served as Party secretary. <strong>The</strong>y were then escorted<br />
to the railway station, given between 200 yuan and 400 yuan <strong>in</strong> travel<br />
expenses and sent home. Eight of the 31 victims went miss<strong>in</strong>g dur<strong>in</strong>g<br />
the trip home.<br />
A landmark year for labour legislation<br />
At the height of the Shanxi slave labour scandal <strong>in</strong> 2007, Ch<strong>in</strong>a’s national<br />
legislature, the National People’s Congress (NPC), passed the<br />
<strong>Labour</strong> Contract Law, the first of three major new labour laws to be<br />
approved <strong>in</strong> what would turn out to be a landmark year for both national<br />
and local labour legislation.<br />
<strong>The</strong> Shanxi slave labour brick factories were but an extreme example<br />
of the abuses and exploitation faced by rural migrant workers <strong>in</strong> Ch<strong>in</strong>a<br />
at the time. <strong>The</strong> majority of migrant workers did not have a contract<br />
with their employer and had little option but to accept whatever terms<br />
and conditions management imposed.<br />
<strong>The</strong> <strong>Labour</strong> Contract Law was designed to remedy this deficiency and<br />
plug the loopholes exposed <strong>in</strong> the exist<strong>in</strong>g <strong>Labour</strong> Law. Accord<strong>in</strong>g to<br />
Article One, the law was:<br />
Enacted and formulated <strong>in</strong> order to improve the labour<br />
contract system, specify the rights and obligations of both<br />
parties to the labour contracts, protect the legitimate rights<br />
and <strong>in</strong>terests of the workers and construct and develop a<br />
harmonious and steady employment relationship.<br />
<strong>The</strong> law confirms that all <strong>in</strong>dividual workers have the right to negotiate<br />
their own written employment contract with their employer, specify<strong>in</strong>g<br />
terms, conditions and benefits. It enhances specific <strong>in</strong>dividual<br />
rights by establish<strong>in</strong>g a statutory probationary period for a fixed term<br />
contract, improv<strong>in</strong>g health and safety regulations, requir<strong>in</strong>g redundancy
