State Politics Lead Agenda
Now that we
have the
politics of
the nation behind
us, it is time for
us, the voice of the
state’s hospitality
and tourism industry,
to re-focus our
Jan Marie Chesterton
efforts on the political
process here at home. The State
Legislature will have a new look come
January, and we will be on the front lines
educating any newly-elected officials on
our industry and the issues that matter
most to us.
transitioned from a newsletter format to
a magazine style to accommodate more
advertisers, additional in-depth articles
and regulatory details members need.
In this issue, our industry suppliers (Allieds)
are featured. Our Allied members
have a reputation of delivering great
products and services to our members,
so I encourage you to look at our list
of allied members if you are considering
anything from linens, to energy efficiency
to various insurance needs. Make
sure if you contact them you tell them
you are a NYSH&TA member, because
often times there is a preferred pricing
structure for you.
With that being said, as an industry we
can’t lose sight of the personal and professional
needs of those who were directly
impacted by Hurricane Sandy. The
struggles and problems will persist for
many of our members in the New York
City area and on Long Island and Staten
Island, so I encourage you to help, if
you can, by donating to a charity of your
choice that is assisting in the rebuilding
effort.
Our plan in Albany is to continue to build
on the legislative momentum we created
during this year’s Legislative Session.
During the first half of the year,
NYSH&TA, in partnership with other
tourism promotion agencies, was successful
in helping secure an increase for
tourism marketing and promotion in the
2012-2013 State Budget when compared
to 2011-2012. With State Budget spending
being cut at every corner, additional
funds to promote New York State as a
top-notch tourism destination, was a great
victory for the industry.
This issue of Focus magazine completes
our first year with a new look. Last Fall we
I would also like to take this opportunity
to bring your attention to the many accomplishments
of our members in our
“Members in the News” section on pages
26 to 32. To see all of the prestigious
awards our members have collected is
a testament to all of their hard work.
Please remember that all members are
encouraged to submit their good news to
us so we can give the proper recognition
in our magazine.
In closing, I can’t stress enough that the
deadline for pool lift compliance is January
31, 2013. The industry fought the
good fight to secure a lengthy extension
to the compliance date, but the time has
now come to be compliant.
We are here as your resource, so if
you have any questions on pool lift
requirements please call me directly at
Chairman’s Letter
A Busy Year with Multiple Successes
Your Association is
coming off a busy
summer season with
the celebration of its 125th
anniversary in Saratoga
Springs, the annual Summer
Fundraiser at the Saratoga
Race Course to benefit the
Education Foundation, and
getting settled into a new office space after
relocating in June. It was great to see nearly
200 people attend the 125th Anniversary
celebration in the same city the Association
was founded back in 1887. To see a complete
photo album of the event log on to www.
nyshta.org and click on the Facebook icon.
The relocation of offices with up-to-date
décor includes more advanced technological
capabilities for the staff and an overall cost
savings to the Association.
While the NYSH&TA staff was busy in
Albany, data suggests that our industry also
had a very busy summer. Many regions of the
state saw increased occupancy when compared
to last summer and hoteliers were able to boost
their average daily rate over the busy summer
months. Statewide, from January through
September, occupancy is up 2 percent when
compared to the same time period in 2011.
With this being my last chairman’s letter of
2012, I thought it was a good time to review
some of the Association’s accomplishments
since January 1, as we begin to look toward
2013.
ADA Pool Lift Clarification
Following months of hard work by NYSH&TA
and the American Hotel & Lodging
Association, the Department of Justice (DOJ),
in May, announced a substantial postponement
of the ADA Pool Lift compliance date for
existing pools and spas. The new compliance
date is January 31, 2013. This date allowed the
industry an additional nine months beyond the
original date of March 15, 2012.
For the complete details on this issue call
NYSH&TA at 800-642-5313. It is a complex
issue, so make sure you know the facts.
OTC legislation
In my home county of Saratoga I have spent
the past few months supporting efforts to
amend their tax law to hold third party online
travel agents, such as Expedia and Travelocity,
responsible for paying their fair share of
occupancy tax.
Recently, the Saratoga County Board of
Supervisors voted to pass room occupancy tax
legislation that would require travel companies
to collect and pay taxes when selling to
customers online.
While this is a local issue for me, if our efforts
are successful, this could easily set a precedent
for other municipalities around the state to
collect their fair share of occupancy taxes
which in turn will help fund greater tourism
promotion.
The new permissible wage deductions will now include costs associated with:
• Discounted mass transit tickets, passes, or user cards
• Fitness or health club and/or gym membership dues
• Cafeteria, vending machine, and pharmacy purchases made at the employer’s place of
business and gift shops run by hospitals, colleges and universities
Legal Bulletin: ADA Compliance (Service Animals)
Does New York State ADA relating to service animals apply to owner-occupied establishments renting five
or fewer rooms over the exemption provided for in Title III of the Federal ADA?
FEDERAL DEPARTMENT OF JUSTICE:
Title III (public accommodations and commercial facilities) - Title III entities must permit service animals
to accompany people with disabilities in all areas where members of the public are allowed to go.Your
establishment is covered by the ADA as a place of public accommodation if it is a private entity and is a place of
lodging (including inns, hotels, and motels), regardless of whether it is a for-profit or non-profit establishment.
The ADA exempts from this requirement owner-occupied establishments renting five or fewer rooms.
New York’s ADA: There is NO reference in New York’s ADA that specifically provides for the inclusion
of owner-occupied establishments renting five or fewer rooms as “public accommodations”
In part, New York’s ADA is applicable to the following places of “public accommodation”:
“…all places included in the meaning of such terms as: inns, taverns, road houses, hotels, motels, whether
conducted for the entertainment of transient guests
or for the accommodation of those seeking health,
recreation or rest, or restaurants………”
Federal ADA: Allows for the States, if they so
choose to provide greater or additional protections
or application of the Federal Law. If a State were
to choose to provide these protections/applications, it
would have to do so through enacting legislation and
in certain cases regulations providing for the greater
protections/applications.
ABSENT SPECIFIC STATUTORY LANGUAGE
TO THE CONTRARY, NEW YORK LAW DOES
NOT PROVIDE GREATER PROTECTIONS
THAN THOSE AFFORDED BY THE FEDERAL
MEMBER ALERT
Housekeeper considered manual workers.
For purposes of wages and pay schedules,
housekeepers are considered to be manual
workers under Article 6 of the New York State
Labor Law. Therefore, housekeepers must be
paid weekly to ensure your compliance with the
Law.
The application of the Hospitality Wage Order
as it relates to housekeepers is not relevant to how
they are to be paid in accordance with New York
State Law. Please review your current policy and
make the appropriate changes if necessary.
“I Love NY Brand” Legislation –
Vetoed by the Governor
Legislation, put forth by NYSH&TA that establishes
a Tourism Economic Development Fund, has been
vetoed by the Governor.
The bill that was introduced by Legislative Tourism
Committee Chairs (Assembly member Marge Markey
(D- Queens) and Senator Betty Little (R- Queensbury),
would have ensured that any revenue generated from
the use of the “I LOVE NY” brand shall be deposited
in the Tourism Economic Development Fund, and to
be made exclusively available to fund the promotion
of tourism.
The Governor vetoed the legislation, citing that
this new fund is unnecessary because the licensing
revenue from the “I LOVE NY” trademark is
already dedicated to tourism marketing through an
administratively created Special Revenue Fund that is
used solely for tourism marketing. We will continue
to work with the Governor’s office and his Tourism
Advisory Council to gather information and purpose
of the Special Revenue Fund.
Further, NYSH&TA, along with Wilson Elser
continue to advocate and work with the Governor in
hopes of getting much needed funding and industry
improvements advanced in the upcoming legislative
session in January.
Election Update
Although the 2012 scheduled Legislative Session
concluded, Governor Cuomo and Legislative Leaders
have indicated a post Election Day special session is
possible. Issues being discussed are an increase in the
minimum wage, housing issues as well as legislative
pay raises. NYSH&TA will continue to provide updates
on election results and a possible special session
legislative agenda.
This bulletin was prepared by Wilson, Elser, Moskowitz,
John Irvin Retires
John Irvin, a member of the
NYSH&TA Board of Directors for
a decade, and the General Manager
of The Otesaga Hotel, Cooperstown, is
retiring.
Before retiring, Irvin was asked to look
back at his 40-plus-year career in the hotel
industry and to describe what value being an
active NYSH&TA member provided him over the
past 10 years.
“I’ve been doing this for a long time, and I have no regrets whatsoever. I have had my high
points and low points, as you do in any profession, but the one thing I will say about this
industry is it allows anyone to grow who wants to,” Irvin said. “I didn’t have a degree in
hotel management, but I wanted to move up in sales and I did through a lot of hard work. I
wanted to try operations, and someone took a chance on me and I succeeded in that to end
up at the Otesaga. I know general managers from every discipline in the hotel – controllers,
chief engineers, housekeepers, sales and front-office people. They have all become successful
because they put the effort into it, and again, this is an industry that allows that to happen.”
During his tenure on the NYSH&TA Board, Irvin served on the multiple committees and
participated in two Association Strategic Planning Sessions.
“
I
think NYSH&TA is the most active state Association I’ve ever been
involved with, and I have found that extremely helpful as a hotel
operator, not only from the knowledge I’m able to garner from the staff
when I have legal or environmental issues, but also the camaraderie
among the membership. Everyone is willing to work with each other
and I’ve found that extremely helpful in my 10 years of leadership.
- John D. ” Irvin
“I’ve always believed if you’re going to be a member of any organization you should be
active in it. Consequently, having the opportunity to join the board was important to me,” Irvin
said. “I have had the opportunity to go to Washington for the legislative summits, to serve on
various committees, and every one of those responsibilities have hopefully helped not only our
industry in the state but certainly helped me grow as a professional. Serving on the NYSH&TA
Board is that next step of being a NYSH&TA member, and anyone who has an opportunity to
do it, should, because it’s a great opportunity for the Association and the individual.
Pool Lift Deadline Approaching;
is your property ready?
Compliance with Pool/Spa Accessibility Requirements Necessary
The January 31, 2013, deadline for pool and spa accessibility under
the Americans with Disabilities Act (ADA) is approaching and
AH&LA is urging members to review their compliance needs.
AH&LA, along with industry partners, worked exhaustively to
secure a one-year extension and clarification of the January 31, 2012,
Department of Justice (DOJ) Guidance. In May 2012, DOJ granted
a one-year extension to January 31, 2013, and issued two guidance
documents related to its interpretation of the requirements for pool
and spa accessibility in the 2010 Standards for Accessible Design.
According to the current DOJ guidance, by January 31, 2013, all
existing pools and spas at lodging facilities must do the following if
it is “readily achievable”:
• Provide at least one means of entry (pool lift or sloped entry) as
long as it is readily achievable. Pools with 300 linear feet of wall
or more must have a pool lift or entry, and one additional means of
entry which can be one of the following: (1) pool lift; (2) sloped
entry; (3) transfer system; (4) transfer wall; or (5) pool stairs.
• Have the pool lift out in position and ready for use all hours the
pool is open.
• Each body of water (e.g., pools, spas) must have a separate means
of entry (except there are special rules for clusters of spas).
• Pool lifts must be attached to the pool deck or apron in some
manner unless it is not readily achievable to affix them.
If you have any questions as the deadline approaches please contact
NYSH&TA at 800-642-5313.
Industry News
Where do owners, developers, architects,
and other key professionals go wrong
when it comes to compliance with the
ADA? For the most part, many assume that plan
approvals by building departments are a guarantee of
compliance. What they do not realize is that building
departments assess building code compliance, not
compliance with federal laws, including the ADA.
Inspections of properties cited in cases against
owners of lodging facilities have revealed common
oversights. These oversights are usually the result of
the misunderstanding or misapplication of technical
guidelines developed to ensure access for people
with disabilities. The following are a few of the more
common oversights.
Avoid Common Oversights that Violate the ADA
By: Peter A Stratton
Director of Accessibility Compliance and Consulting
including running slopes which do not exceed 1:12
(8.33 percent) and cross slopes which do not exceed 2
percent. For the most part, remediation often requires
removal and replacement of the curb ramp.
Hazards Created by Protruding Objects
Objects which protrude from walls can be extremely
hazardous for people with visual disabilities. Wallmounted
objects, such as lighting, which are installed
lower than 80 inches and more than 27 inches above the
finished floor must not project more than 4 inches into
the circulation path. Typical fixes include replacing
features with similar low-profile models or providing
a permanent cane-detectable barrier the hazardous
object.
Excessive Running and Cross Slopes
Running slope is measured parallel to the direction
of travel; cross slope is measured perpendicular to the
direction of travel. The cross slope of an accessible
route must be no more than 2 percent, which is relatively
flat. Typically, extreme cross slope occurs at where the
route along the sidewalk continues across the slope of
the curb ramp. In this case, the running slope of the
curb ramp, which is permitted to be up to 1:12 (8.33
percent), is also the cross slope of the accessible route
across curb ramp. Providing a pathway around the top
of the curb ramp so that a person is not required to
negotiate across the slope of the curb ramp is one way
to eliminate this common oversight.
The running slope of an accessible route should
be kept as low as possible to provide easy access.
Accessible routes which slope up to 1:20 (5 percent)
are referred to as “walks” and those which slope
between 1:20 (5 percent) and 1:12 (8.33 percent)
are considered “ramps.” Remediation of excessive
running slopes can be extremely expensive, including
provisions for additional accessible by-pass routes or
removing and replacing steep routes where a by-pass
route is not possible.
Steeply Sloping Curb Ramps and Gutters
Noncompliant curb ramps are by far one of the most
prevalent conditions found during a site inspection.
Curb ramps are subject to a number of criteria,
Controls Located Out of Reach Range
Features intended to be used by guests must be located
within accessible reach range. It is not uncommon to
find light switches, outlets and other operable parts
which are out of reach. Remediation almost always
involves relocating operable parts within accessible
reach range.
Clear Width at Doors of Less than 32 Inches
All doors which are meant for user passage within
all guestrooms are required to provide a clear opening
width of no less than 32 inches. It is not uncommon
to find doors within guestrooms which do not
provide proper clear width, especially those doors
between connecting rooms. Remediation, in most
cases, involves removing and replacing the door and
associated buck.
Why Hoteliers Need To Be Proactive
To Comply with OSHA Standards
Industry News
The Occupational
Safety
& Health Administration
(OSHA) is
the U.S. governmental
agency with the responsibility
to enforce Workplace
Safety & Health
Standards. OSHA inspects
workplaces to
By Joel Paradee,
ensure compliance
G.C.G. Risk Management
with these standards.
Employers in violation
can receive fines, timelines for when hazards must be
fixed, and in large cases, OSHA may send a press release
about the results, creating bad public relations for
your business.
Preparation is Key
While a hotel or resort may not be on the list of “High
Hazard Industries”, hotels are inspected at the rate of
nearly one per day throughout the country, and many
have been given expensive fines that could be avoided
with proper planning.
• Ensure your OSHA Recordkeeping Forms are
up-to-date and accurate within 7 days.
• Create or maintain a Safety Committee to discuss
safety issues at your Hotel.
• Create a plan for receiving an OSHA Inspector
and drill occasionally.
• Work with Safety &
Insurance Professionals to
conduct preemptive mock
inspections to identify
potential violations before
OSHA arrives.
Inspection Tips
Allow the OSHA Inspector to
conduct the inspection properly.
You have the right to ask the
inspector for a warrant, but statistically
in such cases it results in
more violations and higher fines.
The inspector will have an opening
conference with management
and any union representatives to
explain the process and their “Scope of Inspection”.
The Scope of Inspection includes the reason they have
arrived, and what specific areas they plan to inspect.
This limits the inspection to just these areas unless there
is “due cause” to expand it.
Take pictures of alleged violations and keep notes.
Just because an OSHA Inspector thinks something is
a violation, doesn’t mean that it is. Your notes and pictures
can be valuable when disputing violations in your
defense later on.
Receiving Citations
If you receive citations, there is a 15-day period in
which you are allowed to contest citations you feel are
inaccurate, have excessive penalties, or the timeline to
fix the issue is too short.
Many of these issues can be discussed during an Informal
Conference. During this informal conference,
you may come to an agreement with OSHA that works
for both parties. Attempt this early in the 15-day time
frame to allow time to contest properly if an agreement
cannot be reached.
Don’t pay retail. There are a number of adjustments
that can be made to reduce the total cost of citations
such as; Good Faith, Size of Business, History of Violations,
and Gravity of Violations.
Insurance Coverage For Bed Bug Claims
By Marshall Gilinsky and Kenneth Sharperson
Bed bugs are undergoing a resurgence—both
beneath the sheets and in the press—and
causing problems for many different types
of facilities, especially hotels. As a result of this
resurgence, there have been an increasing number of
lawsuits against hotel owners and operators by guests
who allege that they have been bitten and injured by
bed bugs.
Property owners must be aware that they can be liable
for damages awards and bear the expense of defending
against these claims. They may, however, have insurance
coverage available for all of the risks associated with
bed bugs.
The number of bed bug-related personal injury
lawsuits is growing. Many of the lawsuits brought
against property owners allege negligence, breach of
implied warranty of habitability, nuisance, battery, and
fraud. Under any of these potential theories of liability,
a property owner may be liable for any bodily injury
caused to the claimant as a result of being bitten by bed
bugs on the property owner’s premises.
If liability is established against your business, then
there may be a significant
damages award. For example, in
2003, a jury entered a judgment
of $2,000 and $372,000 in
punitive damages against
particular hotel in down town
Chicago. Under many CGL
(Commercial General Liability)
policies, the property owner’s
insurance will pay the judgment.
When confronted with a claim
alleging injuries caused by
bed bugs on your property,
you should immediately look to your CGL policy to
determine whether there is coverage. The CGL policy
will likely respond to a claim by a guest who claims to
have been injured by bedbugs on your property. Because
CGL policies cover all liabilities except those which are
specifically excluded, step one is to read the policy with
an eye for any exclusion pertaining to bedbugs.
If there is no such exclusion, the typical CGL policy
also provides for a legal defense for these types of
claims. This “defense costs” coverage is important
because even if the allegations are false, defense is
likely to be expensive.
Marshall Gilinsky
Kenneth Sharperson
Policyholders who face business downturns due
to bed bug publicity also may have means to obtain
coverage for income losses associated with bed bug
infestations, including loss of attraction and business
interruption coverage. Loss of attraction coverage may
be available if there is a diminution of business due to
loss of potential customers as a direct result of bed bug
issues. Business interruption coverage may or may not
be triggered depending on the policy at issue. Many
businesses may have to shut down for a period while
remediating bedbug infestations. Business income
losses suffered during and
following bed bug remediation
may be covered under business
interruption coverage.
If your hotel is faced with
income loss or liability stemming
from a bed bug infestation, think
“insurance” first, file notice
promptly and pursue coverage
aggressively. It is important to
review your insurance policy
with an attorney specializing in
insurance recovery to determine
the best approach to protect your company with any
available insurance.
Strategies to Green Your Energy Profile While Reducing Energy Costs
In New York and across the country, numerous
factors, including the negative impact of costly
imports and the growing demand by guests for
environmentally-friendly choices, are driving hotels to
evaluate existing energy usage patterns and determine
effective and affordable strategies to address these
challenges.
For hotels and hospitality professionals preparing
to tackle this issue, here are some practical ways to
diversify energy consumption and cut back on energy
costs in the process:
Renewable Energy Certificates (RECs): Did You
Know?
One available means to incorporate renewable energy
into an energy portfolio is through the purchase of
RECs.
RECs are designed to recognize the environmental
attributes of renewable energy such as solar, wind,
hydro and biomass. REC purchases support the
operation and financing of renewable energy and lessen
our dependence on fossil fuel generation. The most
immediate environmental impact is the avoidance of
harmful chemicals and greenhouse gases that would
have been released into the atmosphere by fossil fuel
generated sources. RECs also can be applied by hotels
toward Leadership in Energy and Environmental
Design (LEED) certification and similar environmental
programs.
On-Site Power: Did You Know?
Constructing on-site renewable generation is another
viable and potentially profitable means of limiting
dependency on fossil fuels and ensuring reliability of
power supplies.
On-site power systems may generate enough
renewable electricity to directly meet the energy
demands of the hotel and its operational systems.
These systems also drastically reduce emissions and
reduce demand on local electric grids, freeing up
hundreds of watts of power.
earn economic incentives by reducing their electricity
load at times when the power grid is under stress.
When demand starts to increase on the hottest or
coldest days of the year, hotels participating in a load
response program agree to reduce their energy output for
a specific period of time to make more energy available
on the regional power grid. This helps prevent blackouts
and power failures. Once enrolled, hotels earn payment
for participating in the program and receive additional
payments for reducing their energy output when the
regional power grid is under stress. Most hotels have
backup generation, and in many areas these properties
can be enrolled in load response programs for payments
in the tens of thousands of dollars.
Heating, Ventilating and Air-Conditioning (HVAC):
Did You Know?
According to the U.S. Department of Energy (DOE),
HVAC accounts for 40%–60% of the energy used in
U.S. commercial buildings. That makes it a good
target for energy savings. Scheduled maintenance on
HVAC is important, including cleaning burners and air
conditioning coils, replacing and cleaning air filters, and
checking ducts and pipe insulation for damage. Without
proper maintenance, this system will run inefficiently,
wasting energy.
In a year that has seen the Mirror Lake Inn Resort and Spa in Lake
Placid receive the AAA Four Diamond Award of Excellence for
the 28th consecutive year, Wine Spectator Magazine has issued the
resort its Award of Excellence for the 13th straight year.
In addition, International Business Times ranked Lake Placid second
in its list of 10 Best Lake Vacations in the U.S. In the same breath, IBT
achievement, once again, for our staff at the The View Restaurant, while
the IB Times ranking is wonderful for Lake Placid's place among summer
destinations and our history of satisfying travelers with discriminating
tastes. Kudos to our staff for making us stand out once again."
"The Wine Spectator Award is one of the benchmarks of upscale
restaurants," said The View Restaurant Manager Katie Welch. "Our
dining room staff was quite proud to receive the news of this accolade,
and it reinforces our commitment to the wine connoisseur who wishes to
dine with us. We will continue to choose the finest vintages to meet the
expectations of Mirror Lake Inn guests."
40 | FOCUS Fall/Winter 2012

Over 44,400 hotels globally
participate with STR.
ARE YOU ONE OF THEM?
Let us help you gauge your competition, benchmark performance and
identify opportunities to increase your revenue with the STAR Report.
Already participating?
Check out our great add-ons:
Segmentation (free to add): Break down your performance by source of business
and source of revenue.
Ranking: Determine if you have the highest or possibly the lowest occupancy,
ADR or RevPAR of your comp set.
Additional Comp Sets: Works just like your first comp set allowing you to compare
performance against a different group of competitors.
RPM: Visualize your comp set like never before. See how your property performs
versus the individual competitors in your comp set. Data is displayed in a
scatterplot chart, with each property numerically labeled by its RevPAR ranking.
Bandwidth: See your performance trends directly against your competitive set
and have an understanding of the range of performance achievements in your
set. Segmentation Bandwidth also available.
Not ready to commit to the STAR Report? Try out the Hotel Survey. It’s free
and allows you to gauge performance against your market.
