COVENANT NOT TO SUE OR OTHERWISE TAKE ACTION
The student Participant, and the parent(s)/legal guardian(s) of the student Participant, covenant and agree that they will forever refrain from instituting,
prosecuting, maintaining, proceeding on, assisting with or advising to be commenced a suit which arises out of, or may be, in whole or
in part, based upon, related to or connected with the released matters herein or any part of them.
CONSENT TO MEDICAL CARE AND TREATMENT
In the event the student Participant is injured during a Carroll Academy activity, the student Participant and the parent(s)/legal guardian(s)
of the student Participant, consent to treatment of the student Participant’s injury by a professional employed by or otherwise under contract
with Carroll Academy, subject to the provisions of the above Release and Waiver of Liability. The student Participant and the parent(s)/legal
guardian(s) of the student Participant, authorize Carroll Academy, at its discretion, to arrange for the student Participant’s transport to a hospital
or other medical facility for further medical attention. The student Participant and the parent(s)/legal guardian(s) of the student Participant,
understand and agree that Carroll Academy is not responsible for transporting the student Participant to a hospital or medical facility that participates
in any particular insurance/managed care plan.
PHOTOGRAPHIC CONSENT AND RELEASE
I hereby authorize Carroll University, Inc. (the “university”) and those acting pursuant to its authority to:
a. Record my likeness and voice on a photographic, video, audio, digital, electronic or any other medium.
b. Use my name in connection with these recordings.
c. Use, reproduce, exhibit or distribute in any medium (ex. print publications, CD, DVD, Internet) these recordings for any purpose that
the university, and those acting pursuant to its authority, deem appropriate, including promotional or advertising efforts.
I release the university and those acting pursuant to its authority from liability for any violation of any personal or proprietary right I may have in
connection with such use. I understand that all such recordings, in whatever medium, shall remain the property of the university. I have read and
fully understand the terms of this release.
REPRESENTATIONS AND WARRANTIES
I represent and warrant that I have the full power, capacity and authority to execute this document as the parent or legal guardian of the student
Participant. I further represent and warrant that I understand the terms and provisions of this document and its nature and effect.
APPLICABLE LAW
This document is made, executed and entered into and shall be governed by the laws of the state of Wisconsin. I expressly consent to the venue
and jurisdiction of the Wisconsin courts with respect to any dispute arising out of the student Participant’s enrollment and participation in the
above-referenced Carroll Academy program and associated activities.
