Greetings from the desk <strong>of</strong> your Governor<br />

My Lieutenants and I are getting <strong>of</strong>f to a very<br />

good start. We have been meeting with the<br />

Directors <strong>of</strong> our programs, some but not all,<br />

at this point. The purpose <strong>of</strong> the meetings<br />

is to get the Lieutenants acquainted with<br />

the goals and missions <strong>of</strong> the departments<br />

and to meet the directors and staff. We<br />

will manage day to day activities a little<br />

differently than in the past, which we<br />

are hopeful will deliver services in a cost<br />

effective method, a more efficient manner,<br />

to providing accountability and complete<br />

transparency.<br />

First, my administration has presented to<br />

the Tribal Council, for their confirmation,<br />

new judges for appointment to the lower<br />

court. I am happy to report Ernest Jaramillo<br />

has been confirmed as the Chief Judge,<br />

Robert Medina and Joseph Richard Olguin<br />

as the Associate Judges. Chief Judge<br />

Jaramillo and Associate Judge Olguin are<br />

tribal members and Judge Robert Medina<br />

is a member <strong>of</strong> the <strong>Pueblo</strong> <strong>of</strong> Zia. All three<br />

come with background experience as tribal<br />

judges and we believe that these Judges<br />

will serve our community with the utmost<br />

respect <strong>of</strong> our rights as tribal members under<br />

the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> Constitution. I want to<br />

extend my sincere appreciation to outgoing<br />

Chief Judge Verna Teller and Associate<br />

Judge Anthony Abeita. Thank you for your<br />

service to the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> and I want<br />

to wish you all the success in your future<br />

endeavors. We have had many discussions<br />

with the Tribal Council with respect to both<br />

the lower court and the appellate court<br />

about some <strong>of</strong> the problems that exist. We<br />

have had outside independent evaluators<br />

analyze how the courts function, their rules,<br />

their procedures, budget, and so forth.<br />

The courts have realized many filings and<br />

the dockets have became quite large. One<br />

suggestion that came out <strong>of</strong> our discussions,<br />

is to find new ways to solve problems and/or<br />

settling disputes before reaching the courts,<br />

possibly by using the mediation method.<br />

This gives both parties an opportunity to<br />

talk to someone that is independent and<br />

who could make recommendations on issues<br />

that could be resolved without having go<br />

through the tribal court process. As many<br />

<strong>of</strong> us know, the courts get bogged down with<br />

their heavy case loads. As a result, it may<br />

take some time before a case is scheduled for<br />

a hearing. We realize courts are a necessity<br />

in every day life, however, if we can settle<br />

our differences outside the courtroom, all <strong>of</strong><br />

us would be better <strong>of</strong>f.<br />

Also on Friday, January 21st, the<br />

administration, the Tribal Council, and<br />

the Warcaptains met with our elders to<br />

hear their concerns. This meeting was an<br />

invitation by the Elders Program as a meet<br />

and greet event. Just a note, I did not call<br />

it the "elderly center". Hopefully, an <strong>of</strong>ficial<br />

name change is forthcoming. The list <strong>of</strong><br />

concerns is quite lengthy and quite honestly,<br />

these are legitimate concerns. For example,<br />

they asked about the status <strong>of</strong> the Long<br />

Term Care Facility. The POI has secured<br />

the 3 acre site where the center presently<br />

sits and includes the property on which the<br />

Tribal Courts, Police and Fire Departments<br />

are situated. These buildings are to be<br />

demolished once the buildings are vacated<br />

and the Courts and the Departments have<br />

moved into the new Tribal Services Complex.<br />

We will proceed with award <strong>of</strong> a design<br />

contract and hopefully soon afterwards<br />

begin construction. I am hesitant to give a<br />

schedule as things change from day to day,<br />

however, we will pursue this project with<br />

vigor. Our river is a major concern as well.<br />

We all know the importance <strong>of</strong> our river as<br />

it pertains to our traditional and cultural<br />

values. Because <strong>of</strong> the reduced water flows<br />

the center <strong>of</strong> the river, downstream from<br />

the diversion dam, has built up with sand<br />

bars and vegetation. It was asked <strong>of</strong> us to<br />

take care <strong>of</strong> the river and to bring back the<br />

life it once had. Again, we will continue to<br />

work with all involved to do just that. Other<br />

concerns included, clean up <strong>of</strong> the cemetery,<br />

road maintenance and road safety, <strong>of</strong> course<br />

the trains sounding their horns in the wee<br />

hours <strong>of</strong> the mornings, education, and<br />

lastly, requesting that the tribal leaders<br />

accompany the elders to any meetings they<br />

may have. Thank you so much for relaying<br />

your concerns and questions to us. We are<br />

and will address these continuing concerns<br />

and problems as they arise.<br />

Now that the 2011 New Mexico State<br />

Legislature is in the sixty (60) day session,<br />

we will take an active part in issues that<br />

concern our <strong>Pueblo</strong>. The Native American<br />

Petroleum Coalition (NAPC) has scheduled<br />

a meeting with the Tribal leadership to<br />

provide a legislative update and discuss<br />

not just the gas tax deduction, but other<br />

important tribal issues and to strategize<br />

about how to approach this Legislative<br />

session. In addition to the NAPC, the Tribal<br />

Tax Advisory Coalition (TTAC), and the<br />

New Mexico Indian Gaming Association<br />

(NMIGA) will be present. Discussions<br />

will center around Governor Martinez's<br />

administration and potential new policies<br />

and Cabinet appointments, including the<br />

Secretary <strong>of</strong> Indian Affairs, the gas tax<br />

deduction, the cigarette tax exemption,<br />

voter redistricting and other items. We will<br />

continue to provide you with updates as the<br />

Legislature progresses.<br />

It's important to me to hear from you on<br />

what positive changes you would like to<br />

see on how our tribal government operates.<br />

ISLETA TRIBAL ENROLLMENT CENSUS OFFICE<br />

ATTENTION: INDIVIDUAL INDIAN MONEY (IIM) ACCOUNT HOLDERS<br />

The Office <strong>of</strong> Special Trustee (OST) for American Indians in<br />

conjunction with the <strong>Isleta</strong> Tribal Enrollment/Census Office<br />

is attempting to locate <strong>Isleta</strong> <strong>Pueblo</strong> tribal members with an<br />

Individual Indian Money (IIM) account or for whom per capita<br />

judgment funds are held.<br />

There are two lists: one contains the names <strong>of</strong> adults whose<br />

whereabouts are unknown and their per capita share is held in a<br />

tribal trust holding account, the other is a list <strong>of</strong> individuals with<br />

an IIM account whose current address is unknown.<br />

Minors with an IIM account may access their funds upon reaching<br />

18 years <strong>of</strong> age, providing they are able to manage their financial<br />

affairs on their own. Individuals not able to manage their financial<br />

affairs, as defined in 25 CFR 115.002, should be reported to the<br />

BIA Social Services, Southern <strong>Pueblo</strong>s Agency, at (505) 563-3748<br />

at least 120 days prior to their 18th birthday. The Social worker<br />

will need to assess whether the individual's account should be<br />

supervised as an adult.<br />

The Tribal Enrollment Office has the form OST 01-004/6 to give<br />

any minors who reach the age <strong>of</strong> 18 to complete for access to their<br />

account. The account holder will need to sign and date the form on<br />

or after their 18th birthday. The account holder may request all <strong>of</strong><br />

their IIM funds and the account will be closed or they may request<br />

a voluntary hold. Under the voluntary hold option, the account<br />

holder may request funds for a one time disbursement, indicating<br />

the amount to be disbursed, or they may schedule payments <strong>of</strong> their<br />

IIM account funds. The frequency for the scheduled payments may<br />

he disbursed monthly, quarterly, weekly or bi-weekly, indicating<br />

the exact dollar amounts. The payments may also be made to a<br />

third party.<br />

The account holder may also choose a method <strong>of</strong> payment in the form<br />

<strong>of</strong> direct deposit or by check, which will be mailed to the address<br />

indicated on the statements that were mailed to the account holder<br />

by the OST.<br />

ANNOUNCEMENT<br />

The <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> Enrollment/Census<br />

Department and the Tribal Enrollment<br />

Committee are pleased to announce the<br />

approval <strong>of</strong> the Official Tribal Membership<br />

Roll and the Official Descendant Roll<br />

<strong>of</strong> 2011. These Rolls were prepared by<br />

the Enrollment/Census Department<br />

and submitted to the Tribal Enrollment<br />

Committee for review. Upon assessment<br />

<strong>of</strong> accuracy, the Rolls were submitted to<br />

the Tribal Council on January 25, 2011,<br />

for approval. The Tribal Council has<br />

approved the Official Rolls, and both the<br />

Official Tribal Membership Roll and the<br />

Official Descendant Roll will be available<br />

for public view.<br />

The Official Rolls can be viewed by<br />

the public at the Enrollment/Census<br />

Department beginning March 2, 2011.<br />

Viewing will be on Monday, Wednesday<br />

and Fridays, during the hours <strong>of</strong> 8:30am<br />

New Mexico Legal Aid's Native American Program, located in<br />

Santa Ana <strong>Pueblo</strong>, is <strong>of</strong>fering a FREE Tax Preparation Clinic<br />

beginning on January 26, 2011 through March 16, 2011.<br />

The Clinic will be open on Wednesdays and<br />

Fridays from 1pm-4pm.<br />

Taxes will be prepared by appointment only.<br />

Persons must be income eligible.<br />

To see if you are eligible and to schedule an appointment**,<br />

Please note that we cannot prepare returns for persons<br />

who have income from self employment AND who must use<br />

the Schedule C form or for persons who are married<br />

but filing separate returns.<br />

** To avoid any delays in processing your return, please bring<br />

the following items with you and your spouse (if you intend to<br />

file a joint return) to your appointment:<br />

• a photo ID,<br />

•social security cards for you, your spouse and<br />

children,<br />

• birthdates for everyone listed on your return,<br />

• Copies <strong>of</strong> last year's state and federal income tax<br />

returns,<br />

• Wage and Earning statements including W-2's and any<br />

1099s ,<br />

• Any interest and dividend statements,<br />

• day care expenses, and<br />

• if you would like to use direct deposit for your refund,<br />

you will also need your bank routing and account<br />

numbers.

Tax Exemptions for Members <strong>of</strong> the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong><br />

If you are a member <strong>of</strong> a Native American <strong>Pueblo</strong>,<br />

Tribe or Nation, or their spouse, and live on your<br />

<strong>Pueblo</strong> or reservation, or are a tribal-government<br />

owned business doing business on the <strong>Pueblo</strong><br />

or reservation, you are eligible to be excluded<br />

from paying certain state taxes and charges that<br />

can appear on your utility (natural gas, propane,<br />

electric, water), telephone, and cable bills. The<br />

law requires that customers must be certified as<br />

members <strong>of</strong> a <strong>Pueblo</strong>, Tribe or Nation, and getting<br />

their utility service on their <strong>Pueblo</strong> or reservation,<br />

in order to receive this exemption.<br />

Former Governor Robert Benavides, his staff,<br />

and New Mexico Gas Company worked together,<br />

along with the State <strong>of</strong> New Mexico, to make this<br />

simpler for members <strong>of</strong> the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> and<br />

other Native Americans. <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> <strong>of</strong>ficials<br />

and New Mexico Gas Company collaboratively<br />

identified tribal members living on the <strong>Pueblo</strong>,<br />

making it possible for New Mexico Gas Company<br />

to exempt these customers.<br />

How do I know if I've been exempted?<br />

Look on the back <strong>of</strong> your New Mexico Gas<br />

Company bill. If you do not see a charge for "Gross<br />

Receipts Tax" at the bottom <strong>of</strong> the taxes and fees,<br />

you have already been exempted and do not need<br />

to do anything. [Please see the sample bill as a<br />

guide.]<br />

What if I haven't been exempted?<br />

While most eligible customers <strong>of</strong> the <strong>Pueblo</strong><br />

were identified, if you still see a "Gross Receipts<br />

Tax" charge on your bill, and are a member <strong>of</strong><br />

the <strong>Pueblo</strong> living on the <strong>Pueblo</strong>, fill out a Native<br />

American Exemption Form and return it to New<br />

Mexico Gas Company to have your account<br />

exempted.<br />

A First!<br />

Here are a few facts<br />

about our WIC <strong>of</strong>fice:<br />

The <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> WIC program has<br />

been recognized at the national level for<br />

our implementation <strong>of</strong> the WIC Electronic<br />

Benefits Transfer (EBT) card. POI WIC was<br />

among the first WIC agencies to implement<br />

EBT and the first tribal WIC organization in<br />

the nation to do so. As other states migrate<br />

from paper WIC checks to EBT, they will look<br />

to POI WIC for guidance. We will be here to<br />

share our lessons learned and best practices.<br />

Tax Exemptions for Native Americans<br />

Are you a member <strong>of</strong> a Native American nation, or the spouse <strong>of</strong> a member, and living<br />

on your <strong>Pueblo</strong> or reservation?<br />

If so, you are eligible to be exempt from certain taxes and charges* that may appear on<br />

your utility (natural gas, propane, electric, water), phone and cable bills.<br />

To apply to have these taxes taken <strong>of</strong>f your bills, please fill out the attached form.<br />

Give a copy to each <strong>of</strong> your utility, phone and cable companies. [Members <strong>of</strong> Santa<br />

Keeping Current<br />

In the spirit <strong>of</strong> <strong>of</strong>fering the community the<br />

best services possible, one <strong>of</strong> this year's<br />

program goals is for the entire WIC staff to<br />

update their certified education training.<br />

All parapr<strong>of</strong>essional WIC staff are required<br />

to complete the WIC certified education<br />

training. The curriculum has been developed<br />

and approved by USDA Food and Nutrition<br />

Service and is recognized as an integral part<br />

<strong>of</strong> WICs integrity training for staff. In order<br />

to become certified, staff must pass all exams<br />

with at least an 85%. The training is overseen<br />

by the WIC Nutrition Coordinator. Updating<br />

staff certifications is one <strong>of</strong> the ways WIC<br />

is striving to keep staff current <strong>of</strong> the most<br />

recent research and recommendations in<br />

the ever changing fields <strong>of</strong> nutrition and<br />

breastfeeding.<br />

Got Breastmilk?<br />

POI WIC is one <strong>of</strong> the few WIC programs<br />

fortunate enough to have a registered<br />

lactation consultant (RLC) on staff. Janette<br />

is a member <strong>of</strong> the International Board <strong>of</strong><br />

Certified Lactation Consultants (IBCLC).<br />

In the private sector breastfeeding mothers<br />

pay for the services <strong>of</strong> an RLC. Here at the<br />

WIC <strong>of</strong>fice all a mom has to do is stop by and<br />

she and her baby can have her own private<br />

consultation! Janette makes house calls too!<br />

Better Blood<br />

WIC has a brand new way to help analyze<br />

our participants’ nutritional status. All WIC<br />

participants are aware <strong>of</strong> the blood iron test<br />

we conduct to determine if one is anemic.<br />

WIC purchased a new state <strong>of</strong> the art<br />

HemoCue analyzer. The new blood analyzer<br />

is extremely accurate and will allow WIC<br />

staff to determine the best course <strong>of</strong> nutrition<br />

counseling for our participants.<br />

Even if you are not a WIC participant, please<br />

stop by your WIC <strong>of</strong>fice anytime. We would<br />

love to show you around. You can even sample<br />

the recipe <strong>of</strong> the month we prepare for our<br />

nutrition classes.<br />

Introducing the <strong>Isleta</strong> Business Corporation<br />

(IBC). What is the IBC you ask? The general<br />

purpose <strong>of</strong> the IBC is to manage all business<br />

development efforts and tribal enterprises<br />

not currently under the management <strong>of</strong> the<br />

Hard Rock Casino or Tribal government on<br />

and <strong>of</strong>f the reservation. The Tribal Council<br />

chartered the IBC on December 30, 2010.<br />

Since being chartered the IBC has been<br />

tasked with overseeing the operations <strong>of</strong> the<br />

One Stop, Travel Center, Farm Enterprise<br />

and Comanche Ranch. The general purpose<br />

<strong>of</strong> the IBC is to generate growth and<br />

pr<strong>of</strong>itability for the businesses <strong>of</strong> <strong>Isleta</strong><br />

<strong>Pueblo</strong>. The IBC is overseen by the Tribal<br />

Council and is required to provide quarterly<br />

performance updates describing the return<br />

on investment and revenue.<br />

The IBC is made up <strong>of</strong> 5 members, 3 <strong>Isleta</strong><br />

tribal members and 2 non-<strong>Isleta</strong> tribal<br />

members. The members are: Harold<br />

Culbertson, who is a enrolled member <strong>of</strong><br />

the Fort Peck Sioux Tribe, Poplar, MT. Mr.<br />

Culbertson is a Certified Public Accountant<br />

with degrees from Portland State<br />

University, Portland, OR, with an emphasis<br />

in accounting, MBA from Harvard Business<br />

School, Boston, MA, with an emphasis<br />

in New Ventures and Small Business<br />

Management and a Doctorate in Business<br />

from the University <strong>of</strong> Washington, Seattle,<br />

WA. James Fitting is a non-Indian who<br />

retired from the Navajo Nation in 2006<br />

as the Assistant Attorney General for<br />

CHIEF FINANCIAL OFFICER<br />

The <strong>Isleta</strong> Business Corporation has recently been chartered by the<br />

<strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> to manage two gas stations and convenience stores<br />

and the tribal farm and ranch enterprise which have combined gross<br />

annual revenues <strong>of</strong> $33 million. The <strong>Pueblo</strong> is also providing funds<br />

for future economic development on and <strong>of</strong>f the reservation. The IBC<br />

BOD is accepting applications from member <strong>of</strong> the POI to serve as<br />

CFO to manage the finances. Preferred qualifications are 10 years<br />

<strong>of</strong> comparable financial management experience and a business<br />

degree (CPA preferred). Salary is dependent on experience. For<br />

LOGO DESIGN CONTEST<br />

The newly formed <strong>Isleta</strong> Business Corporation (IBC) is in need<br />

<strong>of</strong> a logo for use on memos, business cards, letterhead and signs.<br />

It needs a graphic identity and because it will represent tribal<br />

businesses, the IBC hopes someone from the tribe will design the<br />

logo!<br />

If you are an artist, or even if you are not, the IBC encourages<br />

you to submit a logo design. All submissions must be original<br />

work and not subject to any copyrights. Logos should capture<br />

the spirit <strong>of</strong> the <strong>Pueblo</strong> or illustrate the IBC's mission "To foster<br />

tribal self-sufficiency through business development consistent<br />

with cultural values and beliefs."<br />

Nathan Lucero is an <strong>Isleta</strong> tribal member<br />

who has studied at UNM and has obtained<br />

an Associate <strong>of</strong> Arts in Pre-Management<br />

(Business Management) from CNM. His<br />

background also includes construction<br />

management, casino management and is<br />

currently an Associate Broker / Realtor®<br />

for Red Mesa Realty. Michael Paquin is<br />

an <strong>Isleta</strong> tribal member who is a licensed<br />

New Mexico Contractor and owner/<br />

President <strong>of</strong> Landscape Technologies, Inc.<br />

headquartered in <strong>Isleta</strong> <strong>Pueblo</strong>. He has<br />

over 20 years experience in all phases <strong>of</strong><br />

construction, with emphasis in construction<br />

project management and safety program<br />

management. For the 2010 irrigation season,<br />

Michael was the assistant mayordomo for<br />

the Acequi Madre ditch system. Rafaela<br />

Kovacs is an <strong>Isleta</strong> Tribal member who<br />

recently finished the Masters <strong>of</strong> Business<br />

Administration program at UNM. She<br />

currently works at Kirtland AFB as a<br />

contract specialist and has experience in<br />

banking and retail management.<br />

The IBC is currently tasked with hiring<br />

a CEO (chief executive <strong>of</strong>ficer/president)<br />

and CFO (chief financial <strong>of</strong>ficer) for the<br />

corporation. Soon thereafter, the IBC will<br />

be tasked with hiring 7 additional positions<br />

including accounting pr<strong>of</strong>essionals, human<br />

resources support and IT personnel. The<br />

IBC employs 29 employees including<br />

convenience center personnel and farm/<br />

ranch employees.<br />

The IBC will continue to review business<br />

opportunities that will be pr<strong>of</strong>itable to<br />

the tribe. Currently the IBC is awaiting<br />

approval from BIA for the lease to open a<br />

Subway at the <strong>Isleta</strong> Travel Center. The<br />

One Stop is selling a non-branded fuel that<br />

can be sold at a lower price per gallon which<br />

allows for greater revenue.<br />

The IBC is headquartered temporarily in<br />

the American Legion Post building located<br />

at the old Head Start on TR 2. The IBC will<br />

relocate to the new government complex<br />

south <strong>of</strong> the Hard Rock upon completion.<br />

The IBC will continue to update you on<br />

Happy Valentine’s Day, Little Island!!! Now that your Christmas bills are somewhat manageable, it is<br />

time to buy that special someone a little something to show your affection (preferably in the colors <strong>of</strong><br />

white, pink, & red). Maybe even a little box <strong>of</strong> Chocolate for that extra “oomph” effect. Well, continue<br />

reading and you will find out that you may get that little something at your local library.<br />

NEWS<br />

Last month I forgot to mention that library<br />

has a pretty good collection <strong>of</strong> fitness DVDs<br />

which are free to borrow for up to three<br />

days. These DVDs would be very beneficial<br />

to those individuals who do not have the<br />

time to make it to the gym on a daily basis<br />

but could work out in their own living<br />

room. Hopefully, this piece <strong>of</strong> information<br />

is not too late for those individuals whose<br />

New Year Resolution was to exercise more<br />

frequently.<br />

For the last two months the library has<br />

been promoting a FREE Computer give<br />

away to those community members in need<br />

<strong>of</strong> a computer. Again, these computers are<br />

older computers (Windows 2000 & Windows<br />

XP) which were once used by various<br />

departments <strong>of</strong> the <strong>Isleta</strong> <strong>Pueblo</strong>. The<br />

computers would be completely wiped out to<br />

its original settings without any s<strong>of</strong>tware.<br />

However, the library will install open<strong>of</strong>fice<br />

which is similar to Micros<strong>of</strong>t Word which<br />

would allow you to type papers, resumes,<br />

and other documents. If you are interested<br />

in this give away, you must submit a two<br />

page essay to the library explaining how a<br />

computer will enhance the lives <strong>of</strong> you and<br />

your family. The last day to submit your<br />

essay is Friday, <strong>February</strong> 25. Winners will<br />

be selected by both the library staff and<br />

library board. For further information, feel<br />

free to call the library and speak to a library<br />

staff member.<br />

As mentioned in the opening paragraph,<br />

the library is conducting its Third Annual<br />

Valentine Candy Gram Fundraiser. Like<br />

last year, the library will be <strong>of</strong>fering five<br />

various packages and will provide delivery<br />

<strong>of</strong> the Candy Gram for an additional fee.<br />

Candy Grams will consist <strong>of</strong> a Valentine<br />

Card, Rose, Box <strong>of</strong> Chocolate, and a stuffed<br />

animal depending on which package you<br />

choose. For a visual <strong>of</strong> the Candy Gram<br />

packages, see flyer which should be posted<br />

somewhere in this newsletter. There is a<br />

limited amount <strong>of</strong> stuffed animals, roses,<br />

and boxes <strong>of</strong> chocolates so be sure to place<br />

your order as soon as possible. Last year,<br />

we completely sold out, so consider yourself<br />

warned. Proceeds raised from the Candy<br />

Grams will be used for upcoming library<br />

programs. We hope to see or hear from you<br />

soon.<br />

In last month’s newsletter, I briefly<br />

mentioned that a Homework/Reading<br />

Incentive Program was in the works for<br />

the months <strong>of</strong> January and <strong>February</strong>.<br />

Well, I am pleased to inform you all that<br />

the Incentive Field Trip will be to the New<br />

Mexico Museum <strong>of</strong> Natural History and<br />

Science, Dynamax Theatre, and Lodestar<br />

Planetarium. Believe it or not but the<br />

students actually choose the Museum over<br />

places like iT’z and Hinkle Family Fun<br />

Center. Those individuals interested in<br />

participating in the Incentive Program<br />

must earn a total <strong>of</strong> 25 points by doing<br />

homework and/or reading for 20 minutes<br />

(Kindergarten and up) or 15 minutes for all<br />

toddlers whether or not the child is in Head<br />

Start. Like all Incentive Programs before,<br />

it is open to people <strong>of</strong> all ages. Lunch will<br />

be provided by Dion’s Gourmet Pizza at the<br />

library’s expense. There is a limit to the<br />

number <strong>of</strong> participants who can actually go<br />

on the field trip, so we will be taking the<br />

first twenty individuals who obtain their 25<br />

points. As <strong>of</strong> right now, the field trip date is<br />

set for Saturday, <strong>February</strong> 19 but is subject<br />

to change due to religious ceremonies.<br />

Some <strong>of</strong> you might have noticed a big empty<br />

plot <strong>of</strong> land fenced <strong>of</strong>f in between the new<br />

Elementary and the new housing complex<br />

east <strong>of</strong> the Elementary. Well, I am pleased<br />

to say that is the site <strong>of</strong> the NEW Library/<br />

Education Complex. Ground breaking will<br />

take place on Monday, January 31. The<br />

complex should be completed between the<br />

months <strong>of</strong> July and August <strong>of</strong> this year which<br />

will affect this year’s upcoming Summer<br />

Reading Program. Also, Jaynes Structures<br />

have asked us to inform the community that<br />

construction will busy during the hours <strong>of</strong><br />

7am – 3:30pm. Construction personnel and<br />

vehicles may be around as early as 6:45am<br />

and as late as 5:30pm. So, those <strong>of</strong> you<br />

who have children attending the <strong>Isleta</strong><br />

Elementary and nearby residents, please<br />

be advised <strong>of</strong> the heavy machinery in full<br />

affect during those hours. Your cooperation<br />

during the next eight months or so would be<br />

helpful. Thank you.<br />

Library CLOSURES:<br />

The library will be CLOSED on two days<br />

in the month <strong>of</strong> <strong>February</strong>. They are<br />

Friday, <strong>February</strong> 4 due to American Indian<br />

Legislation Day in Santa Fe. The Tribal<br />

Libraries will have a table set up inside the<br />

Round House, so if you are at the Round<br />

House on this day, stop and visit with our<br />

booth.<br />

The library will also be CLOSED on<br />

Monday, <strong>February</strong> 21 due to President’s<br />

Day (A Federal Holiday).<br />

Valentines Activities throughout the week<br />

from the heart. Many times, the Holiday<br />

activities also serve as a good bonding time<br />

between parents/guardians and children<br />

or grandparents and grandchildren.<br />

Activities normally start at 4:30pm<br />

and end around 6pm, depending on the<br />

amount <strong>of</strong> participants. We hope to see<br />

you soon.<br />

The 2nd Homework/Reading Incentive<br />

Program has already been planned but<br />

will not start until, Monday, <strong>February</strong><br />

28. This Incentive Field Trip will be to<br />

the movies with dinner at Furr’s Fresh<br />

Buffet. Participants will have the options<br />

<strong>of</strong> choosing one <strong>of</strong> two movies which are 1)<br />

Diary <strong>of</strong> a Wimpy Kid 2: Rodrick Rules or<br />

2) Rango. Diary <strong>of</strong> a Wimpy Kid 2 is<br />

based on a very popular book series for<br />

Elementary and Middle School aged<br />

students, and Rango is animated movie<br />

about an Iguana who set out on an<br />

adventure to find his true self. Again,<br />

this Incentive program is open to students<br />

<strong>of</strong> all ages. Look for a flyer within the<br />

community as time gets closer to start<br />

promoting the program.<br />

RECAP<br />

Elders from the Elders’ Center stopped by<br />

for another visit at the library on Monday,<br />

January 24. They have requested to visit<br />

each month which is fine by us and we<br />

love serving them as well. This visit was<br />

by the biggest group to visit the library<br />

from the Elders Center.<br />

On Thursday, January 27 the library staff<br />

traveled north to Santa Fe for Library<br />

Legislation Day at the Round House.<br />

Staff members met with librarians<br />

from around the state, and visited our<br />

Representatives (both House & Senate) to<br />

remind them <strong>of</strong> how important libraries<br />

are to our communities. We reminded<br />

them <strong>of</strong> how libraries help community<br />

members (registered voters) set up email<br />

accounts so they may apply for jobs<br />

online, apply for assisted living online,<br />

provide Wi-Fi, tutoring for youth, while<br />

providing a variety <strong>of</strong> FREE resources to<br />

everyone. We also handed out brochures<br />

<strong>of</strong> our library which also explained some<br />

<strong>of</strong> the programs we conduct at the <strong>Pueblo</strong><br />

<strong>of</strong> <strong>Isleta</strong>. All <strong>of</strong> this was done with the<br />

community in mind, which gave us added<br />

determination to lobby and persuade<br />

them NOT to cut any <strong>of</strong> the State Grants<br />

which provide much needed funding for<br />

our library such as the State Grant-In-<br />

Aid, Tribal Libraries Program, GO Bond,<br />

and the Capital Outlay money which is<br />

being spent on the upcoming Library/<br />

Educational Complex. That was a busy<br />

day for all us, lucky there were enough<br />

<strong>of</strong> us to split up and visit with not only<br />

our Representatives but those also who<br />

support American Indian Issues.<br />

On that note, Keep fighting the “Good<br />

Fight” people.<br />

Parks & Recreation<br />

With the start <strong>of</strong> <strong>February</strong> 2011 upon us, we have noticed a lot more usage by our <strong>Pueblo</strong> members probably due to keeping your New<br />

Year's Resolutions. That's great. Keep up the good workout ethic. Bottom line and the true tell tale will be how many <strong>of</strong> you will continue<br />

your schedule <strong>of</strong> working out at least 30 minutes per day. The other thing we have noticed are a lot more people utilizing the walking<br />

and jogging trail around the Little League and Soccer Field. Again, it really doesn't matter what type <strong>of</strong> exercise you do whether it's<br />

walking, jogging, playing volleyball, doing yoga or just working on yard work or washing the car, bottom line get that heart pumping. If<br />

you have a concern about your health and over-all condition, by all means go see a doctor before beginning a workout regimen. Whatever<br />

we do by exercising and watching our food (especially sugar and salt) intake, we can go a long way <strong>of</strong> leading a healthier life style, and<br />

become more productive citizens and ward <strong>of</strong>f diabetes and obesity. With the January 2011 coming to a close we did have a couple <strong>of</strong> big<br />

events take place with College Career Day and a big Swim Meet hosted by us and our two High School feeder schools, Valencia and Los<br />

Lunas High Schools.<br />

College Career Day<br />

Although Counselor Ben Analla<br />

from the Los Lunas High School and<br />

head <strong>of</strong> the Native American Club<br />

for the High School will be placing<br />

an article in this newsletter about<br />

the event, I felt it was important<br />

enough to recognize Ben Analla<br />

and Ulysses Abeita, from the <strong>Isleta</strong><br />

<strong>Pueblo</strong> Adult Education Program<br />

for the outstanding presentation <strong>of</strong><br />

organizing the College Career Day.<br />

They were also assisted by many <strong>of</strong><br />

our <strong>Pueblo</strong> member students who<br />

are part <strong>of</strong> the Los Lunas Native<br />

American Club. Pictured right are<br />

up the College Career Day for our<br />

students to seek information and<br />

opportunities from.<br />

Swim Meet<br />

Our 2nd big event was also held on January 22nd where we were the host<br />

site for the Valencia/Los Lunas High School Invitational Swim Meet. The<br />

New Mexico Activities Association sanctioned the event. The following teams<br />

competed in the meet: Gallup and Miramura High Schools from Gallup, N.M.,<br />

Santa Fe High School, Socorro High School, Hope Christian, St Pius High<br />

School and <strong>of</strong> course Los Lunas and Valencia High Schools. Valencia and Los<br />

Lunas High Schools are two <strong>of</strong> our feeder schools for our <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong>. The<br />

eight teams that competed had over 158 swimmers participate and over 300<br />

visitors/spectators come to our <strong>Pueblo</strong>. Competition began at 9:40 am and was<br />

over by 12:30 pm. Our lifeguards from our <strong>Pueblo</strong> serve as the coaches for our<br />

feeder high schools. Once again the comments from our visitors was nothing<br />

but positive with many wondering what it would take to become members <strong>of</strong><br />

this beautiful facility. Like always the answer is, "it is only for Tribal members<br />

Little League<br />

Once again the Little League Season for 2011 is upon us.<br />

By the time everyone receives this newsletter, registration<br />

on Wednesday, January 26th at 5:30 pm till 8:00 pm and<br />

registration on Saturday, January 29th from 9:00 am<br />

until 1:00 pm will have been completed. If you happened<br />

to miss both registration dates, but are still interested in<br />

getting your child in, please call the New League Director<br />

and former Lt. Governor Max Zuni at 604-5581. He will try<br />

to accommodate anyone interested all the way up to the<br />

start <strong>of</strong> the season. Please keep in mind practice is very<br />

important to the development <strong>of</strong> our players, so please<br />

get them registered as soon as possible. Registration is<br />

$25 per child. All children from ages 4 years old by April<br />

30th to 18 years old who want to play baseball, s<strong>of</strong>tball or<br />

T-Ball will be accepted. Please bring in your original birth<br />

certificate and pro<strong>of</strong> <strong>of</strong> residency to the registration.<br />

Yoga<br />

Center are trying to get our <strong>Pueblo</strong> members involved in programs that<br />

are beneficial to our health and well being. If you aren't doing anything<br />

on Saturday mornings, come give it a try. I guarantee it, you will love the<br />

presentation and our instructor who is superb. Pictured below are the<br />

include Tiwa instruction, swimming,<br />

arts/crafts, snacks and much, much<br />

Elderly Aerobics<br />

Aerobics classes for the Elderly will begin on<br />

March 2011 at the New Rec. Center. Prior to the<br />

classes beginning, they will have a performance<br />

evaluation on Tuesday, <strong>February</strong> 22nd and<br />

Thursday, <strong>February</strong> 24th at 10:00 am. A<br />

requirement for participation is a doctor's release<br />

with the okay to workout. Seniors must be 55<br />

years and older. For more information please<br />

or Marcelina from the New Rec. Center at 869-<br />

8557. They will be working closely together on<br />

getting our Elders in shape and also on having<br />

fun while working out. What do you say seniors;<br />

New Rec. Center on March 23rd and 24th, 2011.<br />

Summer Employment Opportunity<br />

Anyone who is 16 years and older and interested in working in the Recreation field at the Old Rec. or New Rec. Centers during our busy<br />

summer program are asked to contact the Human Resources Department in mid-March for an application. The application process will<br />

take place from Monday, March 14, 2011 through Friday, March 25, 2011.<br />

Special Note: The Swimming Pool will be CLOSED for its annual maintenance from <strong>February</strong> 18th through <strong>February</strong> 28, 2011. Sorry for<br />

can plan accordingly. Invitations will be mailed out to all our<br />

TRIBAL COUNCIL APPROVED THE PUEBLO OF ISLETA BUSINESS PERMIT POLICY<br />

ON MAY 11, 2010 & REVISED AUGUST 12, 2010, FROM THAT DATE FORWARD THE FOLLOWING ARE<br />

INSTITUTED AND REQUIRED.<br />

Authority<br />

This policy is enacted pursuant to the sovereign authority <strong>of</strong> the<br />

<strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> and pursuant to Article V, Section 2, Subparts b<br />

and I <strong>of</strong> the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> Tribal Constitution.<br />

Section 2. Purpose<br />

The <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> Tribal Council hereby declares that the<br />

regulation <strong>of</strong> all persons engaged in trade and business on the<br />

lands <strong>of</strong> <strong>Isleta</strong> <strong>Pueblo</strong> is necessary to safeguard and promote the<br />

political integrity, economic security, and the health and welfare <strong>of</strong><br />

the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> ("Tribe"). The Tribal Council hereby declares<br />

that the Tribe has the exclusive authority to regulate the conduct<br />

<strong>of</strong> business within its lands and has the authority to grant, deny or<br />

withdraw the privilege <strong>of</strong> doing business within these lands.<br />

Section 3. Scope<br />

A. This Policy shall be applicable to persons engaged in<br />

business within the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> lands ("<strong>Pueblo</strong> Lands").<br />

B. Any person who has a business or conducts business at a<br />

location within <strong>Pueblo</strong> Lands shall be deemed to have consented<br />

to:<br />

1. be bound by the terms <strong>of</strong> this Policy;<br />

2. to the exercise <strong>of</strong> civil jurisdiction by the <strong>Isleta</strong> <strong>Pueblo</strong> Tribal<br />

Court in legal actions arising pursuant to this Policy; and<br />

3. to such enforcement actions arising pursuant to this<br />

Policy.<br />

Section 4. Administration <strong>of</strong> Policy<br />

The Governor shall be responsible to ensure the overall<br />

administration and enforcement <strong>of</strong> this Policy but shall delegate<br />

daily or routine administration and enforcement responsibility to<br />

the Treasury Department or the Tax Administration Division.<br />

Section 5. Definitions<br />

A. Business: any activity engaged in by any person, or caused<br />

to be engaged in by any person, with the object <strong>of</strong> gain, benefit or<br />

advantage, either direct or indirect, such as conducting a trade,<br />

pr<strong>of</strong>ession, or commercial activity involving the sale <strong>of</strong> any property<br />

or services.<br />

B. Business Entity: the person or organization that conducts<br />

or operates business activities under a specific name.<br />

C. Business Permit Policy: the <strong>Isleta</strong> Business Permit Policy<br />

that regulates the conduct <strong>of</strong> business and trade on the <strong>Pueblo</strong> <strong>of</strong><br />

<strong>Isleta</strong>. Also referred to as "Policy."<br />

D. Business Permit: the permit issued by the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong><br />

pursuant to the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> Business Permit Policy. Also<br />

referred to a "Permit."<br />

E. Business Permittee: any person or entity who has been<br />

issued and is the holder <strong>of</strong> a <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> Business Permit and<br />

who is subject to the <strong>Isleta</strong> Business Permit Policy. Also referred to<br />

as “Permittee.”<br />

F. Cigarette Vendor: any person that sells cigarettes or tobacco<br />

products. Also referred to as “Cigarette business.” There are two<br />

classes <strong>of</strong> cigarette vendors: 1) “retail cigarette vendor” and 2)<br />

“wholesale cigarette distributor.”<br />

G. Class <strong>of</strong> Business: the nature or class <strong>of</strong> business operation,<br />

such as agricultural, retail, wholesale, etc. This determines the<br />

type <strong>of</strong> Business Permit required.<br />

H. Corporation: a business organized under the federal, state or<br />

tribal laws that allow an artificial legal being to exist for purposes<br />

<strong>of</strong> doing business.<br />

I. Days: working days, and excludes weekends and holidays.<br />

If a deadline falls on a weekend or holiday, the deadline is extended<br />

until the next working day.<br />

J. Food Vendors: Any person who sells any food or food product<br />

intended for human consumption, including hot foods and foods<br />

intended for immediate consumption.<br />

K. Governor: the Governor <strong>of</strong> the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> or his<br />

designee.<br />

L. Joint Venture: the participation <strong>of</strong> two companies jointly in<br />

a third enterprise. Generally both companies contribute assets and<br />

share risks.<br />

M. Location: the physical place or area where the business<br />

activity is being conducted.<br />

N. Mobile Commercial Vendor: any non-tribal member person<br />

engaged in business that regularly sell goods or services on a<br />

schedule or by appointment or invitation by routine customers<br />

located within <strong>Pueblo</strong> Lands.<br />

O. Partnership: a business organization made up <strong>of</strong> two or more<br />

individuals who have entered into an agreement, either expressed<br />

or implied, to carry on a business venture for pr<strong>of</strong>it.<br />

P. Peddler: any person engaged in business <strong>of</strong> a temporary or<br />

transient nature who sells goods or services from a location which<br />

is not a permanent structure or building.<br />

Q. Person: any person or entity, including business, partnership,<br />

corporation, association, organization or other legal entity <strong>of</strong> any<br />

kind. Must be an adult over 18 years <strong>of</strong> age.<br />

R. Place <strong>of</strong> Business: the location where the business activity<br />

is conducted.<br />

S. Property Owned by the Tribe: property or lands owned or<br />

operated by the Tribe. Does not include land assignments to tribal<br />

members.<br />

T. Public Welfare: a governmental responsibility to ensure the<br />

businesses are generally being conducted with a maximum amount<br />

<strong>of</strong> safety to the public.<br />

U. <strong>Pueblo</strong> Enterprise: an unincorporated enterprise <strong>of</strong> the<br />

<strong>Pueblo</strong>, and any other entity in which the <strong>Pueblo</strong> owns not less<br />

than 51% <strong>of</strong> the capital and pr<strong>of</strong>its and interests, that engages in<br />

commerce on the <strong>Pueblo</strong> Lands.<br />

V. <strong>Pueblo</strong> Lands: all lands within the exterior boundaries <strong>of</strong><br />

the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong>, and lands now or hereafter held in trust by<br />

the United States for the <strong>Pueblo</strong>’s benefit, and any other Indian<br />

Country over which the <strong>Pueblo</strong> exercises sovereign governmental<br />

authority.<br />

W. Retail Cigarette Vendor: a person who sells cigarettes and/<br />

or tobacco products at retail to a consumer and the cigarettes and/<br />

or tobacco products are not intended for resale.<br />

X. Sole Proprietorship: a business where one person owns all<br />

<strong>of</strong> the assets, owes all <strong>of</strong> the liabilities and operates in his or her<br />

own capacity. Also referred to as a “Sole Proprietor.”<br />

Y. Tax Administrator: the Tax Administrator <strong>of</strong> the Tax<br />

Administration Division <strong>of</strong> the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong>.<br />

Z. Treasury Department: the Treasury Department <strong>of</strong> the<br />

<strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong>, which includes the Tax Administration Division.<br />

AA. Tribe: the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong>, a federally recognized Indian<br />

Tribe. Also be referred to as the “<strong>Pueblo</strong>.”<br />

AB. Tribal Council: the legislative branch <strong>of</strong> the <strong>Pueblo</strong> <strong>of</strong><br />

<strong>Isleta</strong>.<br />

AC. Tribal Court: the <strong>Isleta</strong> <strong>Pueblo</strong> Tribal Court.<br />

AD. Tribal Member: any individual who is an enrolled member<br />

<strong>of</strong> the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong>.<br />

AE. Tribal Member Owned Business: a business owned by an<br />

<strong>Isleta</strong> <strong>Pueblo</strong> Tribal Member who holds fifty-one percent (51%) or<br />

more ownership rights in the business.

AF. Wholesale Cigarette Distributor: a person who possesses,<br />

transports and sells cigarettes and/or tobacco products for wholesale<br />

or resale purposes.<br />

Section 6. Permit Required<br />

A. Any person who conducts or engages in business and whose<br />

business is located within <strong>Pueblo</strong> Lands shall be required to obtain<br />

a Business Permit issued by the Tribe. No person shall operate a<br />

business within <strong>Pueblo</strong> lands without a valid Business Permit as<br />

required by this Policy.<br />

B. Business Permits shall only be issued to adults. No minor<br />

child shall be allowed to hold a Business Permit.<br />

C. A separate Business Permit shall be required for each<br />

location or place <strong>of</strong> business.<br />

D. A separate Business Permit shall be required for each type<br />

<strong>of</strong> cigarette business conducted, even if the businesses are operated<br />

out <strong>of</strong> one location. For example, if there is a retail operation and<br />

a wholesale operation located at the same place <strong>of</strong> business, a<br />

Business Permit shall be required for each type <strong>of</strong> business and<br />

the appropriate fee paid for each type <strong>of</strong> Business Permit.<br />

E. The Tribal Council reserves the right to require a separate<br />

or additional permit for such businesses as deemed necessary for<br />

the regulation <strong>of</strong> business activity within <strong>Pueblo</strong> Lands.<br />

F. Businesses wholly owned and operated by the <strong>Pueblo</strong> <strong>of</strong><br />

<strong>Isleta</strong> are required to obtain a Permit under this Policy.<br />

Section 7.<br />

Class <strong>of</strong> Business<br />

A. Class A Businesses are exempt from the Business Permit<br />

Policy and are not required to register with the <strong>Pueblo</strong> or pay<br />

the Business Permit fee. The following are considered as Class A<br />

businesses:<br />

1. Charitable, religious, community, educational organizations,<br />

or private individuals which engage in activity to raise funds for<br />

social, educational, religious or other purposes that are for the<br />

benefit <strong>of</strong> the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> or tribal community member(s).<br />

2. Sellers <strong>of</strong> farming/agricultural produce that is solely<br />

cultivated on <strong>Pueblo</strong> lands.<br />

3. Sellers <strong>of</strong> Indian oven bread and other traditional food<br />

products.<br />

B. Class B Businesses are not required to pay the Business<br />

Permit fee but are required to register the business with the <strong>Pueblo</strong><br />

and obtain a Class B Business Permit. The following are considered<br />

as Class B businesses:<br />

1. Indian arts and crafts made or maintained for sale, whether<br />

wholesale or retail, by any <strong>Isleta</strong> tribal member.<br />

Registration shall consist <strong>of</strong> completing the Business Permit<br />

application and providing such information as may be required.<br />

Class B Businesses are expected to comply with all other<br />

requirements <strong>of</strong> this Policy.<br />

C. Class C Businesses are those businesses that provide<br />

general retail goods or services. In addition to general retail goods,<br />

businesses with a Class C Business Permit can also sell Indian<br />

arts and crafts as identified above. Class C Businesses include<br />

commercial food sales, other than Indian oven bread and other<br />

traditional food products, from a permanent or fixed location.<br />

D. Class D Businesses are those businesses that sell cigarettes<br />

and/or tobacco products at retail to a consumer and the sale <strong>of</strong> the<br />

cigarettes and/or tobacco products is not intended for resale. In<br />

addition to cigarettes and/or tobacco products, businesses with<br />

a Class D Business Permit can also sell general retail goods and<br />

Indian arts and crafts.<br />

E. Class E Businesses are those businesses that possess,<br />

transport and sell cigarettes and/or tobacco products for wholesale<br />

or resale purposes. This does not include retail sales <strong>of</strong> cigarettes<br />

and/or tobacco products.<br />

F Class F Businesses are those businesses or vendors who<br />

sell on a temporary basis and meet the definition <strong>of</strong> peddler.<br />

G. Class G Businesses are those businesses or vendors who<br />

sell goods or services on <strong>Pueblo</strong> lands to community members<br />

on a scheduled or appointment basis or at the invitation <strong>of</strong> the<br />

community members. Examples are commercial frozen food sales,<br />

propane sales and bottled water sales.<br />

H. Class H Businesses are those businesses wholly owned<br />

and operated by the <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong>.<br />

Section 8.<br />

Conditions <strong>of</strong> Permit<br />

A. Each Permittee shall comply with this Permit Policy, all<br />

applicable federal and tribal laws and regulations.<br />

B. Each Permittee consents to the civil jurisdiction by the<br />

Tribal Court in legal actions arising pursuant to this Policy and to<br />

such enforcement actions arising pursuant to this Policy.<br />

C. Each Permittee shall comply with the Order <strong>of</strong> the Governor<br />

to temporarily close businesses on <strong>Pueblo</strong> lands for tribal traditional<br />

activities.<br />

D. Each Permittee is responsible for updating all information<br />

that is required for a Business Permit application during the term<br />

<strong>of</strong> the Permit.<br />

E. The Business Permit shall be displayed in a conspicuous<br />

place at the business location identified on the Permit.<br />

Section 9. Additional Requirements for Certain Types <strong>of</strong><br />

Businesses<br />

A. A particular class <strong>of</strong> business such as cigarette vendors may<br />

be required to comply with additional requirements established<br />

under this Policy and/or another <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> Ordinance. Failure<br />

to comply with such other requirements is also considered grounds<br />

for revocation or other enforcement actions under this Policy and/<br />

or the applicable Tribal Ordinance.<br />

B. The Tribal Council reserves the right to impose additional<br />

requirements during the term <strong>of</strong> the Business Permit upon proper<br />

notice to the businesses affected when determined necessary in the<br />

best interest, health or welfare <strong>of</strong> the Tribe.<br />

C. Food Vendors: Individuals preparing the food product for<br />

commercial food sales shall complete a prescribed Indian Health<br />

Service Food Handler’s class and post or have available the<br />

certificate <strong>of</strong> completion on premises or readily available.<br />

D. Cigarette Vendors:<br />

1. All businesses that sell any quantity <strong>of</strong> cigarettes or tobacco<br />

products at retail must apply for a Class D Business Permit,<br />

and pay the required fee, even if the primary purpose <strong>of</strong> the<br />

business is not cigarette or tobacco product sales and would<br />

otherwise be exempt from the Business Permit fees based on<br />

the class <strong>of</strong> business such as Indian arts and crafts, agricultural<br />

products or traditional food sales.<br />

2. All cigarette vendors shall comply with all applicable tribal<br />

and federal laws relating to the sale and transportation <strong>of</strong><br />

cigarette and tobacco products on or from <strong>Pueblo</strong> Lands.<br />

3. Separate permits shall be required for retail cigarette<br />

operations and wholesale cigarette distributor operations, even<br />

if both <strong>of</strong> these businesses operate out <strong>of</strong> the same location.<br />

Section 10. Application and Fees<br />

A. An application for a Business Permit shall be submitted on<br />

such form as provided by the Tribe.<br />

All applications shall include the following information:<br />

1. A description <strong>of</strong> the business and the products/services<br />

sold.<br />

2. Name and address <strong>of</strong> the owner or owners <strong>of</strong> the business;<br />

3. Description and pro<strong>of</strong> <strong>of</strong> business structure such as sole<br />

proprietorship, corporation, partnership, or other.<br />

4. Description and pro<strong>of</strong> that the business is tribal member<br />

owned.<br />

5. Trade or business name used by the business.<br />

6. The location at which the business will be conducted. The<br />

Tribe may require pro<strong>of</strong> <strong>of</strong> ownership <strong>of</strong> land assignment where<br />

business is to be located.<br />

7. A statement regarding the applicant’s criminal history, if<br />

any.<br />

8. A statement that the applicant consents to the jurisdiction<br />

<strong>of</strong> the Tribe, including the Tribal Court, with regards to<br />

matters arising from the conduct <strong>of</strong> business and this Policy,<br />

and agrees to abide with all applicable tribal and federal laws<br />

and regulations.<br />

9. Any additional information that the Tribe deems necessary<br />

to make a determination on issuing a Business Permit.

C. The fees may be periodically amended at the discretion<br />

<strong>of</strong> the Tribal Council and Permittees shall be notified <strong>of</strong> any fee<br />

changes.<br />

D. No refund shall be made for businesses discontinued during<br />

a permit term.<br />

Section 11. Term <strong>of</strong> Permit and Renewal<br />

A. Except for Class F and Class G Business Permits, the Business<br />

Permit shall be valid for one (1) year from the date <strong>of</strong> issuance and<br />

is only valid for the location for which it was issue<br />

1. Class F Business Permits are valid only for the location<br />

designated by the <strong>Pueblo</strong> and specified on the Permit and<br />

peddlers are not allowed to solicit door-to-door on <strong>Pueblo</strong><br />

lands.<br />

B. A Permittee must apply for renewal at least thirty (30)<br />

calendar days prior to the expiration <strong>of</strong> the existing Permit.<br />

C. Payment <strong>of</strong> permit fees are due at time <strong>of</strong> application or<br />

renewal.<br />

Section 12. Changes in Business Structure and Location;<br />

Amending Business Permit<br />

A. A Permittee must submit an amended application in the<br />

following situations:<br />

1. Any change in the information required in the Business<br />

Permit application. An amended application must be submitted<br />

within thirty (30) days <strong>of</strong> such change.<br />

2. A change in the location <strong>of</strong> the business for which the Permit<br />

was issued. An amended application must be submitted at<br />

least thirty (30) days prior to the actual change in location. In<br />

the event that the change in location could have a detrimental<br />

impact on the health, safety or well-being <strong>of</strong> the Tribe or the<br />

community, the Tribe reserves the right to deny the change in<br />

location. Failure to get approval for the change in location shall<br />

invalidate the Permit and subject the Permittee to enforcement<br />

for doing business without a permit.<br />

B. An amended Permit will be issued upon review <strong>of</strong> the<br />

amended application information.<br />

C. A change in the type <strong>of</strong> business from what was described in<br />

the application and upon which the Permit was issued may require<br />

the Permittee to obtain a second or different type <strong>of</strong> Business Permit<br />

instead <strong>of</strong> simply amending the Business Permit application. For<br />

example, if a retail cigarette vendor wishes to expand his or her<br />

business to include wholesale distribution <strong>of</strong> cigarettes, then a<br />

second permit will be needed for the wholesale operation, even<br />

if it is in the same location as the retail operation. Or if an arts<br />

and crafts vendor wishes to sell cigarettes, then a new permit will<br />

be required for the cigarette sales, even if cigarettes are not the<br />

primary items being sold. Or if there is a change in the structure<br />

<strong>of</strong> the business such as changing from a sole proprietorship to a<br />

partnership.<br />

Section 13. Transfer <strong>of</strong> Business Permit<br />

A Business Permit is issued to the Permittee and is not transferable<br />

and is valid only for the business location specified in the application<br />

and on the Business Permit itself.<br />

In the event <strong>of</strong> a sale or transfer <strong>of</strong> a business to another family<br />

member or individual, that family member or individual, as the<br />

new owner, will have to apply for and receive their own Business<br />

Permit and pay the required fees.<br />

Section 14. Denial <strong>of</strong> Permit; Appeal Request; Hearing<br />

A. An application for a Business Permit or a renewed Business<br />

Permit may be denied if it is determined that:<br />

1. the application is incomplete or the appropriate fee has not<br />

been paid;<br />

2. the applicant has materially misrepresented facts in the<br />

application;<br />

3. the applicant is presently in non-compliance with tribal law<br />

or has engaged in a fraudulent, deceptive, dishonest or illegal<br />

practice;<br />

4. the applicant’s background or the business activity is<br />

contrary to or threatens the political integrity, economic<br />

security, safety, health or public welfare <strong>of</strong> the Tribe or the<br />

public.<br />

B. The applicant will be notified <strong>of</strong> the decision to deny the<br />

application by certified mail, return receipt requested or by hand<br />

delivery. The applicant shall have seven (7) days from receipt <strong>of</strong><br />

the notice <strong>of</strong> denial to file an appeal to the Tribal Council.<br />

C. The appeal request shall be in writing, dated and signed<br />

by the applicant, and shall include a concise statement <strong>of</strong> why the<br />

initial denial decision should be reversed and any new or previously<br />

unconsidered information that supports the applicant’s request.<br />

The appeal request shall be submitted to the Tribal Council. The<br />

Tribal Council shall set a hearing to be held within thirty (30) days<br />

<strong>of</strong> receipt <strong>of</strong> the appeal to consider the appeal. The applicant shall<br />

be timely notified <strong>of</strong> the date and time <strong>of</strong> the hearing. The Tribal<br />

Council shall decide whether to uphold the decision to deny the<br />

Permit or to reverse the decision and issue a Business Permit. The<br />

decision <strong>of</strong> the Tribal Council shall be final and no further appeal<br />

is allowed.<br />

Section 15. Inspections and Audits<br />

A. The <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> Police Department is directed and<br />

authorized to make inspections <strong>of</strong> all businesses under this<br />

Policy, either upon the request <strong>of</strong> the Tax Administrator or upon<br />

information <strong>of</strong> a violation, to determine whether all applicable<br />

tribal laws and regulations and terms <strong>of</strong> this Policy are being<br />

observed. All investigative reports <strong>of</strong> violations shall be brought<br />

to the attention <strong>of</strong> the Tax Administrator and the Governor for<br />

enforcement actions pursuant to this section.<br />

B. The <strong>Pueblo</strong> <strong>of</strong> <strong>Isleta</strong> Fire Department or designated agent is<br />

directed and authorized to make periodic inspections <strong>of</strong> all facilities<br />

<strong>of</strong> any <strong>of</strong> the businesses issued Permits to determine whether<br />

fire hazards are minimized, whether all proper precautions for<br />

emergency exit have been taken, and whether the businesses are<br />

generally being conducted with a maximum amount <strong>of</strong> safety to<br />

the public. All investigative reports <strong>of</strong> violations shall be brought<br />

to the attention <strong>of</strong> the Tax Administrator and the Governor for<br />

enforcement actions pursuant to this section.

C. The Tax Administrator is directed and authorized to<br />

contract with a qualified person or entity to conduct periodic and<br />

unannounced inspections <strong>of</strong> food service facilities on <strong>Pueblo</strong> Lands.<br />

These inspections shall be conducted at permanent facilities that<br />

<strong>of</strong>fer food such as restaurants and markets. Inspections may also<br />

be conducted at temporary booths associated with seasonal or<br />

tribal feasts and celebrations or at temporary locations operated<br />

by food vendors.<br />

D. The Tax Administrator will make systematic inspections<br />

and random audits <strong>of</strong> all businesses within <strong>Pueblo</strong> Lands to ensure<br />

compliance with this Policy, and shall make such other inspections<br />

and audits as required by all applicable federal and tribal laws and<br />

regulations.<br />

E. Every Permittee is required to cooperate with the Tax<br />

Administrator or any other authorized entity or agent in the course<br />

<strong>of</strong> its duties under this Policy. Failure to do so is a violation <strong>of</strong> this<br />

Policy.<br />

Section 16. Enforcement and Penalties<br />

A. Any person who fails to obtain a Business Permit that is<br />

required under this Policy or other Tribal law or regulation shall<br />

be issued a Notice <strong>of</strong> Violation. The Notice <strong>of</strong> Violation may require<br />

the person to show why they should not be enjoined from doing<br />

business on <strong>Pueblo</strong> lands without a Business Permit.<br />

B. Any Permittee who fails to comply with the terms <strong>of</strong> the<br />

Business Permit or any other applicable federal or tribal law or<br />

regulation shall be issued a Notice <strong>of</strong> Violation. The Notice <strong>of</strong><br />

Violation shall specify the basis for the non-compliance, and may<br />

require the Permittee to show why their Business Permit should<br />

not be revoked.<br />

C. The Notice <strong>of</strong> Violation shall be issued by the Tax<br />

Administrator and shall describe the specific violation and the<br />

penalty, if any. A Notice <strong>of</strong> Violation shall be sent to the Permittee<br />

by certified mail, return receipt requested or by hand delivery.<br />

D. Penalties for violation <strong>of</strong> this Permit Policy can include one<br />

or more <strong>of</strong> the following:<br />

1. Impose conditions on Permit to allow Permitee to correct or<br />

abate the violation and operate the business on the condition<br />

that no further violation <strong>of</strong> this Policy or other applicable<br />

federal or tribal law or regulation shall occur for the remainder<br />

<strong>of</strong> the permit term or other specified time<br />

2. Prohibition against the business from selling or conducting<br />

business within <strong>Pueblo</strong> Lands in the case <strong>of</strong> a Peddler or Mobile<br />

Commercial Vendors<br />

3. Suspension <strong>of</strong> the Permit<br />

4. Revocation <strong>of</strong> the Permit<br />

5. Civil fine not to exceed more than $500 per <strong>of</strong>fense<br />

6. Closure <strong>of</strong> the business<br />

7. Restrain or prevent the occupancy <strong>of</strong> the building, premises<br />

or structure where the business is located<br />

E. A Permittee may appeal any action taken by the Tax<br />

Administrator for the imposition and enforcement <strong>of</strong> penalties<br />

described in subparagraph 1, 2, 3 and 4 above to the Tribal Council.<br />

The Permittee shall have seven (7) days from receipt <strong>of</strong> the Notice<br />

<strong>of</strong> Violation to file a Notice <strong>of</strong> Appeal with the Tribal Council. The<br />

decision <strong>of</strong> the Tribal Council shall be final.<br />

F. A Permittee may appeal any action taken by the Tax<br />

Administrator for the imposition and enforcement <strong>of</strong> penalties<br />

described in subparagraphs 4, 5 and 6 above to the Tribal Court.<br />

The Permittee shall have seven (7) days from receipt <strong>of</strong> the Notice<br />

<strong>of</strong> Violation to file a Notice <strong>of</strong> Appeal with the Tribal Court.<br />

Section 17. Suspension or Revocation <strong>of</strong> Permit; Notice;<br />

Appeal<br />

A. A Permit issued under this Policy may be temporarily<br />

suspended or permanently revoked for any <strong>of</strong> the following:<br />

1. Fraud, misrepresentation or incorrect statement in the<br />

permit application;<br />

2. Fraud or misrepresentation made in the course <strong>of</strong> carrying<br />

on the business;<br />

3. The Permittee has engaged in unlawful activity or has<br />

repeated violations <strong>of</strong> this Policy;<br />

4. Conducting business in an unlawful manner or in such a<br />

way as to constitute a danger or nuisance to the health, safety<br />

or general welfare <strong>of</strong> the <strong>Pueblo</strong> or the public;<br />

5. Failure to comply with any other applicable federal or tribal<br />

laws or regulations or permitting requirements.<br />

B. Suspension<br />

1. The Tax Administrator shall issue a Notice <strong>of</strong> Suspension<br />

describing the specific grounds for suspension and the term<br />

<strong>of</strong> suspension. The Notice <strong>of</strong> Suspension shall be given to the<br />

Permittee directly or sent by certified mail with return receipt<br />

requested.<br />

2. The Permittee shall temporarily suspend all business<br />

operations relating to the Business Permit during the suspension<br />

period. Failure to comply with the suspension terms shall result<br />

in revocation <strong>of</strong> the Permit.<br />

C. Revocation<br />

1. The Tax Administrator shall issue a Notice <strong>of</strong> Revocation<br />

describing the specific grounds for revocation. The Notice <strong>of</strong><br />

Revocation shall be given to the Permittee directly or sent by<br />

certified mail with return receipt requested.<br />

2. As no business may operate without a valid Business Permit,<br />

the Permittee shall stop all business operations relating to the<br />

Business Permit upon revocation <strong>of</strong> the Permit.<br />

D. Appeal<br />

1. After receiving either a Notice <strong>of</strong> Suspension or a Notice <strong>of</strong><br />

Revocation, a Permittee may request an appeal to the Tribal<br />

Council. The Permittee shall have seven (7) days from receipt<br />

<strong>of</strong> the notice to file a Notice <strong>of</strong> Appeal to the Tribal Council. The<br />

Notice <strong>of</strong> Appeal shall be in writing, dated and signed by the<br />

Permittee.<br />

2. The Tribal Council shall set a hearing within thirty (30) days<br />

<strong>of</strong> receipt <strong>of</strong> the Notice <strong>of</strong> Appeal to consider the Appeal, with<br />

the Tax Administrator in attendance. The Permittee shall be<br />

timely notified <strong>of</strong> the date and time <strong>of</strong> the hearing. The parties<br />

may also have their legal counsel present at such hearing.<br />

The Tribal Council shall reverse a final determination <strong>of</strong> the<br />

Tax Administrator only upon a finding that it was arbitrary,<br />

capricious or an abuse <strong>of</strong> discretion. The decision <strong>of</strong> the Tribal<br />

Council shall be final and no further appeal is allowed.<br />

E. Operations During Appeal <strong>of</strong> Suspension or Revocation.<br />

1. If a Permittee timely files a Notice <strong>of</strong> Appeal, the Permittee<br />

shall be allowed to temporarily continue business operations<br />

until such time <strong>of</strong> a hearing and decision by the Tribal Council.<br />

If the Permittee does not timely file a Notice <strong>of</strong> Appeal, the<br />

Permittee shall temporarily suspend business operations for<br />

the specified suspension period, or stop business operations<br />

relating to the Business Permit in the case <strong>of</strong> a revocation <strong>of</strong><br />

the Business Permit. However, a Permittee may be ordered<br />

to immediately cease and desist the operation <strong>of</strong> the business<br />

pending an appeal if in the discretion <strong>of</strong> the Tax Administrator<br />

the violation is serious enough to threaten the health, safety or<br />

general welfare <strong>of</strong> the Tribe, the community or the public.<br />

F. The <strong>Pueblo</strong>, its <strong>of</strong>ficials, employees, and agents are not liable<br />

for any damage, loss or harm to the Permittee, or any aspect <strong>of</strong> the<br />

Permittee’s business, that may result or occur, directly or indirectly,<br />

from the suspension or termination <strong>of</strong> business operations required<br />

pursuant to this Policy.<br />

Medical Centers Receive Recognition<br />

for Supporting New Families<br />

Hospitals typically give new mothers a 'gift bag', usually<br />

a diaper bag, containing information provided by formula<br />

companies. These bags contain information on infant feeding,<br />

samples <strong>of</strong> infant formula, and coupons for formula. Evidence<br />

has shown that this "gift" is really just a well-disguised<br />

marketing effort for expensive brand name infant formula.<br />

Public health pr<strong>of</strong>essionals consider these gift bags to be a<br />

serious obstacle to successful breastfeeding. Feeding formula<br />

in the early weeks not only introduces health risks to the<br />

baby, but also decreases milk production for breastfeeding<br />

mothers.<br />

The American Academy <strong>of</strong> Pediatrics Policy Statement on<br />

Breastfeeding encourages pediatricians to "work actively<br />

toward eliminating hospital practices that discourage<br />

breast- feeding (e.g., promotion <strong>of</strong> infant formula in hospitals<br />

including infant formula discharge packs and formula<br />

discount coupons.)"<br />

Currently, the following hospitals have stopped <strong>of</strong>fering free<br />

advertising for formula companies and are no longer giving<br />

out these 'gift bags', they are:<br />
