Volume 6 Issue 2 February 2011
Greetings from the desk of your Governor
My Lieutenants and I are getting off to a very
good start. We have been meeting with the
Directors of our programs, some but not all,
at this point. The purpose of the meetings
is to get the Lieutenants acquainted with
the goals and missions of the departments
and to meet the directors and staff. We
will manage day to day activities a little
differently than in the past, which we
are hopeful will deliver services in a cost
effective method, a more efficient manner,
to providing accountability and complete
transparency.
First, my administration has presented to
the Tribal Council, for their confirmation,
new judges for appointment to the lower
court. I am happy to report Ernest Jaramillo
has been confirmed as the Chief Judge,
Robert Medina and Joseph Richard Olguin
as the Associate Judges. Chief Judge
Jaramillo and Associate Judge Olguin are
tribal members and Judge Robert Medina
is a member of the Pueblo of Zia. All three
come with background experience as tribal
judges and we believe that these Judges
will serve our community with the utmost
respect of our rights as tribal members under
the Pueblo of Isleta Constitution. I want to
extend my sincere appreciation to outgoing
Chief Judge Verna Teller and Associate
Judge Anthony Abeita. Thank you for your
service to the Pueblo of Isleta and I want
to wish you all the success in your future
endeavors. We have had many discussions
with the Tribal Council with respect to both
the lower court and the appellate court
about some of the problems that exist. We
have had outside independent evaluators
analyze how the courts function, their rules,
their procedures, budget, and so forth.
The courts have realized many filings and
the dockets have became quite large. One
suggestion that came out of our discussions,
is to find new ways to solve problems and/or
settling disputes before reaching the courts,
possibly by using the mediation method.
This gives both parties an opportunity to
talk to someone that is independent and
who could make recommendations on issues
that could be resolved without having go
through the tribal court process. As many
of us know, the courts get bogged down with
their heavy case loads. As a result, it may
take some time before a case is scheduled for
a hearing. We realize courts are a necessity
in every day life, however, if we can settle
our differences outside the courtroom, all of
us would be better off.
Also on Friday, January 21st, the
administration, the Tribal Council, and
the Warcaptains met with our elders to
hear their concerns. This meeting was an
invitation by the Elders Program as a meet
and greet event. Just a note, I did not call
it the "elderly center". Hopefully, an official
name change is forthcoming. The list of
concerns is quite lengthy and quite honestly,
these are legitimate concerns. For example,
they asked about the status of the Long
Term Care Facility. The POI has secured
the 3 acre site where the center presently
sits and includes the property on which the
Tribal Courts, Police and Fire Departments
are situated. These buildings are to be
demolished once the buildings are vacated
and the Courts and the Departments have
moved into the new Tribal Services Complex.
We will proceed with award of a design
contract and hopefully soon afterwards
begin construction. I am hesitant to give a
schedule as things change from day to day,
however, we will pursue this project with
vigor. Our river is a major concern as well.
We all know the importance of our river as
it pertains to our traditional and cultural
values. Because of the reduced water flows
the center of the river, downstream from
the diversion dam, has built up with sand
bars and vegetation. It was asked of us to
take care of the river and to bring back the
life it once had. Again, we will continue to
work with all involved to do just that. Other
concerns included, clean up of the cemetery,
road maintenance and road safety, of course
the trains sounding their horns in the wee
hours of the mornings, education, and
lastly, requesting that the tribal leaders
accompany the elders to any meetings they
may have. Thank you so much for relaying
your concerns and questions to us. We are
and will address these continuing concerns
and problems as they arise.
Now that the 2011 New Mexico State
Legislature is in the sixty (60) day session,
we will take an active part in issues that
concern our Pueblo. The Native American
Petroleum Coalition (NAPC) has scheduled
a meeting with the Tribal leadership to
provide a legislative update and discuss
not just the gas tax deduction, but other
important tribal issues and to strategize
about how to approach this Legislative
session. In addition to the NAPC, the Tribal
Tax Advisory Coalition (TTAC), and the
New Mexico Indian Gaming Association
(NMIGA) will be present. Discussions
will center around Governor Martinez's
administration and potential new policies
and Cabinet appointments, including the
Secretary of Indian Affairs, the gas tax
deduction, the cigarette tax exemption,
voter redistricting and other items. We will
continue to provide you with updates as the
Legislature progresses.
It's important to me to hear from you on
what positive changes you would like to
see on how our tribal government operates.
I invite written comments from you on
your thoughts. Please make certain that
you sign your letter and provide contact
information. Our mailing address is Post
you and your family. Until next month,
ISLETA TRIBAL ENROLLMENT CENSUS OFFICE
ATTENTION: INDIVIDUAL INDIAN MONEY (IIM) ACCOUNT HOLDERS
The Office of Special Trustee (OST) for American Indians in
conjunction with the Isleta Tribal Enrollment/Census Office
is attempting to locate Isleta Pueblo tribal members with an
Individual Indian Money (IIM) account or for whom per capita
judgment funds are held.
There are two lists: one contains the names of adults whose
whereabouts are unknown and their per capita share is held in a
tribal trust holding account, the other is a list of individuals with
an IIM account whose current address is unknown.
Minors with an IIM account may access their funds upon reaching
18 years of age, providing they are able to manage their financial
affairs on their own. Individuals not able to manage their financial
affairs, as defined in 25 CFR 115.002, should be reported to the
BIA Social Services, Southern Pueblos Agency, at (505) 563-3748
at least 120 days prior to their 18th birthday. The Social worker
will need to assess whether the individual's account should be
supervised as an adult.
The Tribal Enrollment Office has the form OST 01-004/6 to give
any minors who reach the age of 18 to complete for access to their
account. The account holder will need to sign and date the form on
or after their 18th birthday. The account holder may request all of
their IIM funds and the account will be closed or they may request
a voluntary hold. Under the voluntary hold option, the account
holder may request funds for a one time disbursement, indicating
the amount to be disbursed, or they may schedule payments of their
IIM account funds. The frequency for the scheduled payments may
he disbursed monthly, quarterly, weekly or bi-weekly, indicating
the exact dollar amounts. The payments may also be made to a
third party.
The account holder may also choose a method of payment in the form
of direct deposit or by check, which will be mailed to the address
indicated on the statements that were mailed to the account holder
by the OST.
For information on updating your account, or to request
a form, please contact April V. Chavez, Tribal Enrollment
Coordinator at (505) 766-6624 or Peter J. Fredericks,
Fiduciary Trust Officer at (505) 563-3564.
Tax Exemptions for Members of the Pueblo of Isleta
If you are a member of a Native American Pueblo,
Tribe or Nation, or their spouse, and live on your
Pueblo or reservation, or are a tribal-government
owned business doing business on the Pueblo
or reservation, you are eligible to be excluded
from paying certain state taxes and charges that
can appear on your utility (natural gas, propane,
electric, water), telephone, and cable bills. The
law requires that customers must be certified as
members of a Pueblo, Tribe or Nation, and getting
their utility service on their Pueblo or reservation,
in order to receive this exemption.
Former Governor Robert Benavides, his staff,
and New Mexico Gas Company worked together,
along with the State of New Mexico, to make this
simpler for members of the Pueblo of Isleta and
other Native Americans. Pueblo of Isleta officials
and New Mexico Gas Company collaboratively
identified tribal members living on the Pueblo,
making it possible for New Mexico Gas Company
to exempt these customers.
How do I know if I've been exempted?
Look on the back of your New Mexico Gas
Company bill. If you do not see a charge for "Gross
Receipts Tax" at the bottom of the taxes and fees,
you have already been exempted and do not need
to do anything. [Please see the sample bill as a
guide.]
What if I haven't been exempted?
While most eligible customers of the Pueblo
were identified, if you still see a "Gross Receipts
Tax" charge on your bill, and are a member of
the Pueblo living on the Pueblo, fill out a Native
American Exemption Form and return it to New
Mexico Gas Company to have your account
exempted.
Where can I get a copy of the exemption form?
Copies are available online at www.nmgco.com/
Native_American_Tax_Exemption or from the local
tribal government office. Please fill out the form,
sign it and mail to:
WIC NOTES
A First!
Here are a few facts
about our WIC office:
The Pueblo of Isleta WIC program has
been recognized at the national level for
our implementation of the WIC Electronic
Benefits Transfer (EBT) card. POI WIC was
among the first WIC agencies to implement
EBT and the first tribal WIC organization in
the nation to do so. As other states migrate
from paper WIC checks to EBT, they will look
to POI WIC for guidance. We will be here to
share our lessons learned and best practices.
Tax Exemptions for Native Americans
Are you a member of a Native American nation, or the spouse of a member, and living
on your Pueblo or reservation?
If so, you are eligible to be exempt from certain taxes and charges* that may appear on
your utility (natural gas, propane, electric, water), phone and cable bills.
To apply to have these taxes taken off your bills, please fill out the attached form.
Give a copy to each of your utility, phone and cable companies. [Members of Santa
Clara, Tesuque or Ohkay Owingeh Pueblos are asked to return the form to their Tribal
Government office.]
For questions or more information on Native American tax exemptions, please contact
your Tribal Government office or the New Mexico Public Regulation Commission at
1-888-4ASK-PRC.
Keeping Current
In the spirit of offering the community the
best services possible, one of this year's
program goals is for the entire WIC staff to
update their certified education training.
All paraprofessional WIC staff are required
to complete the WIC certified education
training. The curriculum has been developed
and approved by USDA Food and Nutrition
Service and is recognized as an integral part
of WICs integrity training for staff. In order
to become certified, staff must pass all exams
with at least an 85%. The training is overseen
by the WIC Nutrition Coordinator. Updating
staff certifications is one of the ways WIC
is striving to keep staff current of the most
recent research and recommendations in
the ever changing fields of nutrition and
breastfeeding.
Got Breastmilk?
POI WIC is one of the few WIC programs
fortunate enough to have a registered
lactation consultant (RLC) on staff. Janette
is a member of the International Board of
Certified Lactation Consultants (IBCLC).
In the private sector breastfeeding mothers
pay for the services of an RLC. Here at the
WIC office all a mom has to do is stop by and
she and her baby can have her own private
consultation! Janette makes house calls too!
Go Baby!
Native American
Exemption Form
Pueblo of Isleta Public Library
Happy Valentine’s Day, Little Island!!! Now that your Christmas bills are somewhat manageable, it is
time to buy that special someone a little something to show your affection (preferably in the colors of
white, pink, & red). Maybe even a little box of Chocolate for that extra “oomph” effect. Well, continue
reading and you will find out that you may get that little something at your local library.
NEWS
Last month I forgot to mention that library
has a pretty good collection of fitness DVDs
which are free to borrow for up to three
days. These DVDs would be very beneficial
to those individuals who do not have the
time to make it to the gym on a daily basis
but could work out in their own living
room. Hopefully, this piece of information
is not too late for those individuals whose
New Year Resolution was to exercise more
frequently.
For the last two months the library has
been promoting a FREE Computer give
away to those community members in need
of a computer. Again, these computers are
older computers (Windows 2000 & Windows
XP) which were once used by various
departments of the Isleta Pueblo. The
computers would be completely wiped out to
its original settings without any software.
However, the library will install openoffice
which is similar to Microsoft Word which
would allow you to type papers, resumes,
and other documents. If you are interested
in this give away, you must submit a two
page essay to the library explaining how a
computer will enhance the lives of you and
your family. The last day to submit your
essay is Friday, February 25. Winners will
be selected by both the library staff and
library board. For further information, feel
free to call the library and speak to a library
staff member.
As mentioned in the opening paragraph,
the library is conducting its Third Annual
Valentine Candy Gram Fundraiser. Like
last year, the library will be offering five
various packages and will provide delivery
of the Candy Gram for an additional fee.
Candy Grams will consist of a Valentine
Card, Rose, Box of Chocolate, and a stuffed
animal depending on which package you
choose. For a visual of the Candy Gram
packages, see flyer which should be posted
somewhere in this newsletter. There is a
limited amount of stuffed animals, roses,
and boxes of chocolates so be sure to place
your order as soon as possible. Last year,
we completely sold out, so consider yourself
warned. Proceeds raised from the Candy
Grams will be used for upcoming library
programs. We hope to see or hear from you
soon.
In last month’s newsletter, I briefly
mentioned that a Homework/Reading
Incentive Program was in the works for
the months of January and February.
Well, I am pleased to inform you all that
the Incentive Field Trip will be to the New
Mexico Museum of Natural History and
Science, Dynamax Theatre, and Lodestar
Planetarium. Believe it or not but the
students actually choose the Museum over
places like iT’z and Hinkle Family Fun
Center. Those individuals interested in
participating in the Incentive Program
must earn a total of 25 points by doing
homework and/or reading for 20 minutes
(Kindergarten and up) or 15 minutes for all
toddlers whether or not the child is in Head
Start. Like all Incentive Programs before,
it is open to people of all ages. Lunch will
be provided by Dion’s Gourmet Pizza at the
library’s expense. There is a limit to the
number of participants who can actually go
on the field trip, so we will be taking the
first twenty individuals who obtain their 25
points. As of right now, the field trip date is
set for Saturday, February 19 but is subject
to change due to religious ceremonies.
For further information, feel free to call
the library and speak to a library staff
member.
Some of you might have noticed a big empty
plot of land fenced off in between the new
Elementary and the new housing complex
east of the Elementary. Well, I am pleased
to say that is the site of the NEW Library/
Education Complex. Ground breaking will
take place on Monday, January 31. The
complex should be completed between the
months of July and August of this year which
will affect this year’s upcoming Summer
Reading Program. Also, Jaynes Structures
have asked us to inform the community that
construction will busy during the hours of
7am – 3:30pm. Construction personnel and
vehicles may be around as early as 6:45am
and as late as 5:30pm. So, those of you
who have children attending the Isleta
Elementary and nearby residents, please
be advised of the heavy machinery in full
affect during those hours. Your cooperation
during the next eight months or so would be
helpful. Thank you.
Library CLOSURES:
The library will be CLOSED on two days
in the month of February. They are
Friday, February 4 due to American Indian
Legislation Day in Santa Fe. The Tribal
Libraries will have a table set up inside the
Round House, so if you are at the Round
House on this day, stop and visit with our
booth.
The library will also be CLOSED on
Monday, February 21 due to President’s
Day (A Federal Holiday).
UPCOMING PROGRAMS
The Second Group Elders on Library Visit
One of two Groups of Elders
on Library Visit.
On Monday, February 7, the library will be
offering Valentine’s Day pictures. Pictures
taken can be picked up like the other
Holiday pictures or they could be used in
one of the Valentines Activity during the
week. Whichever the case may be, stop and
strike a pose. Pictures will be taken from
4pm through 6pm.
As mentioned in the previous paragraph,
the library will be conducting a series of
Valentines Activities throughout the week
of February 7 through February 10. A
schedule of activities taking place each day
may be picked up at the library. This is
Page 10 Isleta Pueblo News February 2011
It appears I found my two banner holders for the Library Float in the
Child Abuse Parade, State Fair Parade, & even the Navajo Nation Parade.
(Picture was taken on site on New Library/Education Complex)
a perfect activity for individuals that
want to make that special someone a gift
from the heart. Many times, the Holiday
activities also serve as a good bonding time
between parents/guardians and children
or grandparents and grandchildren.
Activities normally start at 4:30pm
and end around 6pm, depending on the
amount of participants. We hope to see
you soon.
The 2nd Homework/Reading Incentive
Program has already been planned but
will not start until, Monday, February
28. This Incentive Field Trip will be to
the movies with dinner at Furr’s Fresh
Buffet. Participants will have the options
of choosing one of two movies which are 1)
Diary of a Wimpy Kid 2: Rodrick Rules or
2) Rango. Diary of a Wimpy Kid 2 is
based on a very popular book series for
Elementary and Middle School aged
students, and Rango is animated movie
about an Iguana who set out on an
adventure to find his true self. Again,
this Incentive program is open to students
of all ages. Look for a flyer within the
community as time gets closer to start
promoting the program.
RECAP
Elders from the Elders’ Center stopped by
for another visit at the library on Monday,
January 24. They have requested to visit
each month which is fine by us and we
love serving them as well. This visit was
by the biggest group to visit the library
from the Elders Center.
On Thursday, January 27 the library staff
traveled north to Santa Fe for Library
Legislation Day at the Round House.
Staff members met with librarians
from around the state, and visited our
Representatives (both House & Senate) to
remind them of how important libraries
are to our communities. We reminded
them of how libraries help community
members (registered voters) set up email
accounts so they may apply for jobs
online, apply for assisted living online,
provide Wi-Fi, tutoring for youth, while
providing a variety of FREE resources to
everyone. We also handed out brochures
of our library which also explained some
of the programs we conduct at the Pueblo
of Isleta. All of this was done with the
community in mind, which gave us added
determination to lobby and persuade
them NOT to cut any of the State Grants
which provide much needed funding for
our library such as the State Grant-In-
Aid, Tribal Libraries Program, GO Bond,
and the Capital Outlay money which is
being spent on the upcoming Library/
Educational Complex. That was a busy
day for all us, lucky there were enough
of us to split up and visit with not only
our Representatives but those also who
support American Indian Issues.
On that note, Keep fighting the “Good
Fight” people.
February 2011 Isleta Pueblo News Page 11
Parks & Recreation
With the start of February 2011 upon us, we have noticed a lot more usage by our Pueblo members probably due to keeping your New
Year's Resolutions. That's great. Keep up the good workout ethic. Bottom line and the true tell tale will be how many of you will continue
your schedule of working out at least 30 minutes per day. The other thing we have noticed are a lot more people utilizing the walking
and jogging trail around the Little League and Soccer Field. Again, it really doesn't matter what type of exercise you do whether it's
walking, jogging, playing volleyball, doing yoga or just working on yard work or washing the car, bottom line get that heart pumping. If
you have a concern about your health and over-all condition, by all means go see a doctor before beginning a workout regimen. Whatever
we do by exercising and watching our food (especially sugar and salt) intake, we can go a long way of leading a healthier life style, and
become more productive citizens and ward off diabetes and obesity. With the January 2011 coming to a close we did have a couple of big
events take place with College Career Day and a big Swim Meet hosted by us and our two High School feeder schools, Valencia and Los
Lunas High Schools.
College Career Day
Although Counselor Ben Analla
from the Los Lunas High School and
head of the Native American Club
for the High School will be placing
an article in this newsletter about
the event, I felt it was important
enough to recognize Ben Analla
and Ulysses Abeita, from the Isleta
Pueblo Adult Education Program
for the outstanding presentation of
organizing the College Career Day.
They were also assisted by many of
our Pueblo member students who
are part of the Los Lunas Native
American Club. Pictured right are
Ben Analla and Ulysses Abeita
posing prior to the start of the event,
and below them are the students
who were present representing the
Native American Club. Next to Mr.
Analla and Mr. Abeita is a picture
Swim Meet
Our 2nd big event was also held on January 22nd where we were the host
site for the Valencia/Los Lunas High School Invitational Swim Meet. The
New Mexico Activities Association sanctioned the event. The following teams
competed in the meet: Gallup and Miramura High Schools from Gallup, N.M.,
Santa Fe High School, Socorro High School, Hope Christian, St Pius High
School and of course Los Lunas and Valencia High Schools. Valencia and Los
Lunas High Schools are two of our feeder schools for our Pueblo of Isleta. The
eight teams that competed had over 158 swimmers participate and over 300
visitors/spectators come to our Pueblo. Competition began at 9:40 am and was
over by 12:30 pm. Our lifeguards from our Pueblo serve as the coaches for our
feeder high schools. Once again the comments from our visitors was nothing
but positive with many wondering what it would take to become members of
this beautiful facility. Like always the answer is, "it is only for Tribal members
and Tribal employees". Pictured are 3 pictures of the swim event that took
place.

is only valid for the location for which it was issue
1. Class F Business Permits are valid only for the location
calendar days prior to the expiration of the existing Permit.
C. Payment of permit fees are due at time of application or
Amending Business Permit
A. A Permittee must submit an amended application in the
following situations:
1. Any change in the information required in the Business
Permit application. An amended application must be submitted
within thirty (30) days of such change.
2. A change in the location of the business for which the Permit
was issued. An amended application must be submitted at
least thirty (30) days prior to the actual change in location. In
the event that the change in location could have a detrimental
impact on the health, safety or well-being of the Tribe or the
community, the Tribe reserves the right to deny the change in
location. Failure to get approval for the change in location shall
invalidate the Permit and subject the Permittee to enforcement
for doing business without a permit.
B. An amended Permit will be issued upon review of the
amended application information.
C. A change in the type of business from what was described in
the application and upon which the Permit was issued may require
the Permittee to obtain a second or different type of Business Permit
instead of simply amending the Business Permit application. For
example, if a retail cigarette vendor wishes to expand his or her
business to include wholesale distribution of cigarettes, then a
second permit will be needed for the wholesale operation, even
if it is in the same location as the retail operation. Or if an arts
and crafts vendor wishes to sell cigarettes, then a new permit will
be required for the cigarette sales, even if cigarettes are not the
primary items being sold. Or if there is a change in the structure
of the business such as changing from a sole proprietorship to a
partnership.
Section 13. Transfer of Business Permit
A Business Permit is issued to the Permittee and is not transferable
and is valid only for the business location specified in the application
and on the Business Permit itself.
In the event of a sale or transfer of a business to another family
member or individual, that family member or individual, as the
new owner, will have to apply for and receive their own Business
Permit and pay the required fees.
Section 14. Denial of Permit; Appeal Request; Hearing
A. An application for a Business Permit or a renewed Business
Permit may be denied if it is determined that:
1. the application is incomplete or the appropriate fee has not
been paid;
2. the applicant has materially misrepresented facts in the
application;
3. the applicant is presently in non-compliance with tribal law
or has engaged in a fraudulent, deceptive, dishonest or illegal
practice;
4. the applicant’s background or the business activity is
contrary to or threatens the political integrity, economic
security, safety, health or public welfare of the Tribe or the
public.
B. The applicant will be notified of the decision to deny the
application by certified mail, return receipt requested or by hand
delivery. The applicant shall have seven (7) days from receipt of
the notice of denial to file an appeal to the Tribal Council.
C. The appeal request shall be in writing, dated and signed
by the applicant, and shall include a concise statement of why the
initial denial decision should be reversed and any new or previously
unconsidered information that supports the applicant’s request.
The appeal request shall be submitted to the Tribal Council. The
Tribal Council shall set a hearing to be held within thirty (30) days
of receipt of the appeal to consider the appeal. The applicant shall
be timely notified of the date and time of the hearing. The Tribal
Council shall decide whether to uphold the decision to deny the
Permit or to reverse the decision and issue a Business Permit. The
decision of the Tribal Council shall be final and no further appeal
is allowed.
Policy, either upon the request of the Tax Administrator or upon
information of a violation, to determine whether all applicable
tribal laws and regulations and terms of this Policy are being
observed. All investigative reports of violations shall be brought
to the attention of the Tax Administrator and the Governor for
enforcement actions pursuant to this section.
B. The Pueblo of Isleta Fire Department or designated agent is
directed and authorized to make periodic inspections of all facilities
of any of the businesses issued Permits to determine whether
fire hazards are minimized, whether all proper precautions for
generally being conducted with a maximum amount of safety to
the public. All investigative reports of violations shall be brought
to the attention of the Tax Administrator and the Governor for
GIVING BABIES THE BEST START
Medical Centers Receive Recognition
for Supporting New Families
Hospitals typically give new mothers a 'gift bag', usually
a diaper bag, containing information provided by formula
companies. These bags contain information on infant feeding,
samples of infant formula, and coupons for formula. Evidence
has shown that this "gift" is really just a well-disguised
marketing effort for expensive brand name infant formula.
Public health professionals consider these gift bags to be a
serious obstacle to successful breastfeeding. Feeding formula
in the early weeks not only introduces health risks to the
baby, but also decreases milk production for breastfeeding
mothers.
The American Academy of Pediatrics Policy Statement on
Breastfeeding encourages pediatricians to "work actively
toward eliminating hospital practices that discourage
breast- feeding (e.g., promotion of infant formula in hospitals
including infant formula discharge packs and formula
discount coupons.)"
Currently, the following hospitals have stopped offering free
advertising for formula companies and are no longer giving
out these 'gift bags', they are:
