Transhipment Notices <strong>and</strong> Dec<strong>la</strong>rations<br />
26. Pre-transhipment notices <strong>and</strong> WCPFC Transhipment Dec<strong>la</strong>rations, which, in accordance<br />
with <strong>the</strong> 2007 Rules <strong>and</strong> Procedures are non-public domain data, will be ma<strong>de</strong> avai<strong>la</strong>ble to<br />
Members <strong>for</strong> <strong>the</strong> purposes of fisheries monitoring, control or surveil<strong>la</strong>nce in accordance with<br />
<strong>the</strong>se Rules of Procedure, with <strong>the</strong> exception of paragraphs 14-25 <strong>and</strong> Section VI.<br />
27. The Executive Director, or <strong>de</strong>signee, shall make avai<strong>la</strong>ble, upon written request or<br />
pursuant to a st<strong>and</strong>ing request established in accordance with paragraph 50, to Authourized MCS<br />
Entities <strong>and</strong> Personnel copies of pre-transhipment notices <strong>and</strong> WCPFC Transhipment<br />
Dec<strong>la</strong>rations.<br />
Section V:<br />
Retention <strong>and</strong> Destruction Requirements<br />
28. Subject to paragraph 29, Authorized MCS Entities <strong>and</strong> Personnel shall <strong>de</strong>stroy any nonpublic<br />
domain data received un<strong>de</strong>r <strong>the</strong>se Rules <strong>and</strong> Procedures, including any copies or<br />
<strong>de</strong>rivatives of such data, including full erasure of all electronic data, within:<br />
(a)<br />
(b)<br />
(c)<br />
168 hours or 7 days following <strong>the</strong> completion of its MCS activities on <strong>the</strong> high<br />
seas per paragraphs 21 <strong>and</strong> 25 above; or<br />
168 hours or 7 days following <strong>the</strong> completion of MCS activities, including in<br />
areas un<strong>de</strong>r its national jurisdiction per paragraphs 13, 22 <strong>and</strong> 23 above; or<br />
72 hours or 3 days following <strong>the</strong> receipt of data not re<strong>la</strong>ted to current MCS<br />
activities covered by subparagraphs (a) <strong>and</strong> (b) above<br />
Members of <strong>the</strong> <strong>Commission</strong> shall ensure that <strong>the</strong>ir Authorized MCS Entities <strong>de</strong>velop <strong>and</strong><br />
maintain internal administrative procedures to track <strong>and</strong> document compliance with this<br />
paragraph.<br />
29. Authorized MCS Entities <strong>and</strong> Personnel may retain non-public domain data received<br />
un<strong>de</strong>r <strong>the</strong>se Rules <strong>and</strong> Procedures <strong>for</strong> longer than <strong>the</strong> periods specified in paragraph 28 only if it<br />
is part of an investigation, judicial or administrative proceeding of an alleged vio<strong>la</strong>tion of <strong>the</strong><br />
provisions of <strong>the</strong> Convention, any conservation <strong>and</strong> management measures or <strong>de</strong>cisions adopted<br />
by <strong>the</strong> <strong>Commission</strong>, or domestic <strong>la</strong>ws <strong>and</strong> regu<strong>la</strong>tions.<br />
30. Notwithst<strong>and</strong>ing paragraphs 28 <strong>and</strong> 29 above, all VMS data received by <strong>the</strong> <strong>Commission</strong><br />
pursuant to conservation <strong>and</strong> management measures adopted by <strong>the</strong> <strong>Commission</strong>, o<strong>the</strong>r <strong>de</strong>cisions<br />
of <strong>the</strong> <strong>Commission</strong> <strong>and</strong> <strong>the</strong> <strong>Commission</strong>‘s VMS SSPs shall be retained by <strong>the</strong> <strong>Commission</strong>, or<br />
service provi<strong>de</strong>rs contracted by <strong>the</strong> <strong>Commission</strong>, in accordance with <strong>the</strong> SSPs <strong>and</strong> any o<strong>the</strong>r<br />
procedures agreed by <strong>the</strong> <strong>Commission</strong>.<br />
Section VI:<br />
Provisions <strong>for</strong> Access <strong>and</strong> Dissemination of high seas VMS data <strong>for</strong><br />
Scientific Purposes<br />
31. The Executive Director, or service provi<strong>de</strong>rs contracted by <strong>the</strong> <strong>Commission</strong>, shall make<br />
avai<strong>la</strong>ble high seas VMS data <strong>for</strong> scientific purposes, as <strong>de</strong>scribed in paragraph 35 below, to<br />
Members of <strong>the</strong> <strong>Commission</strong>. However, VMS data <strong>for</strong> <strong>the</strong> area of high seas in <strong>the</strong> Convention<br />
Area north of 20N <strong>and</strong> west of 175E shall be ma<strong>de</strong> avai<strong>la</strong>ble only with <strong>the</strong> consent of <strong>the</strong><br />
Member(s) who provi<strong>de</strong>d <strong>the</strong> data to <strong>the</strong> <strong>Commission</strong>.<br />
