259. Japan in<strong>for</strong>med WCPFC6 that it does not wish to apply <strong>the</strong> alternative measures in 2010<br />

<strong>and</strong> will participate in <strong>the</strong> FAD closure.<br />

260. Several CCMs raised concerns that <strong>the</strong> 2009 FAD closure had not been applied uni<strong>for</strong>mly<br />

in <strong>the</strong> EEZs of some PNA members that had provi<strong>de</strong>d additional exemptions <strong>for</strong> at least one<br />

distant-water nation fishing partner. Some CCMs suggested that a full set of in<strong>for</strong>mation should<br />

be avai<strong>la</strong>ble to TCC6 in 2010 to allow a full assessment of <strong>the</strong> implementation of each provision<br />

of CMM 2008-01 in 2009, <strong>and</strong> to review its application by individual fleets <strong>and</strong> coastal States.<br />

261. RMI, on behalf of FFA members, expressed appreciation <strong>for</strong> <strong>the</strong> data generated through <strong>the</strong><br />

application of <strong>the</strong> alternative measures, <strong>and</strong> stated that it remains open to incentive-based<br />

approaches in <strong>the</strong> future. However, it does not support application of <strong>the</strong> alternative measures <strong>for</strong><br />

2010 <strong>and</strong> 2011.<br />

262. WCPFC6 agreed that alternative measures <strong>for</strong> <strong>the</strong> high seas were only avai<strong>la</strong>ble in<br />

2009 <strong>and</strong> that no alternative measures would apply in 2010.<br />

FAD closures <strong>and</strong> catch retention<br />

263. Kiribati, on behalf of PNA members, presented a proposal (WCPFC6-2009/DP14) that<br />

would apply PNA provisions <strong>for</strong> FAD closures <strong>and</strong> catch retention to <strong>the</strong> high seas in <strong>the</strong> area<br />

between 20 o N <strong>and</strong> 20 o S where FAD closures <strong>and</strong> catch retention by purse-seine vessels are called<br />

<strong>for</strong> un<strong>de</strong>r CMM 2008-01.<br />

264. Some CCMs raised questions or concerns about <strong>the</strong> PNA provisions, including <strong>the</strong><br />

<strong>de</strong>finition of FADs, which covers living marine organisms <strong>and</strong> <strong>the</strong> term ―unfit <strong>for</strong> human<br />

consumption‖; <strong>and</strong> <strong>the</strong> specification of seven-day <strong>and</strong> 50-mile buffers during <strong>the</strong> FAD closure.<br />

265. One CCM suggested that ra<strong>the</strong>r than attempting to <strong>de</strong>fine ―unfit <strong>for</strong> human consumption‖<br />

that para. 27(b) of CMM 2008-01 be <strong>de</strong>leted.<br />

266. One CCM suggested waiting until more in<strong>for</strong>mation is avai<strong>la</strong>ble on <strong>the</strong> 2009 FAD closure<br />

from observer reports be<strong>for</strong>e agreeing on <strong>de</strong>tailed rules.<br />

267. PNA members noted that <strong>the</strong> proposal represents a potential extension to <strong>the</strong> high seas of<br />

rules, which are already applicable insi<strong>de</strong> PNA waters <strong>and</strong> which contain <strong>the</strong> majority of tropical<br />

tuna catches. These CCMs stated that if compatibility is to be ensured, <strong>the</strong> high seas rules should<br />

con<strong>for</strong>m to <strong>the</strong> PNA rules. It was also pointed out that compatibility of rules will benefit <strong>the</strong> ROP.<br />

268. One CCM, supported by several o<strong>the</strong>rs, stated a preference <strong>for</strong> a seasonal closure of <strong>the</strong><br />

entire purse-seine fishery ra<strong>the</strong>r than just a seasonal FAD closure.<br />

269. One CCM exp<strong>la</strong>ined that because <strong>the</strong>se PNA rules were in some cases different to <strong>the</strong><br />

specifications in CMM 2008-01, which had <strong>for</strong>med <strong>the</strong> basis <strong>for</strong> national legis<strong>la</strong>tion now being<br />

implemented, it would be difficult to adopt new rules at this point.<br />

270. After an initial discussion, most CCMs supported initial implementation of <strong>the</strong> proposal on<br />

an interim basis with a full review after one year.<br />

271. WCPFC adopted <strong>the</strong> PNA’s proposal <strong>for</strong> FAD closure <strong>and</strong> catch retention rules on<br />

<strong>the</strong> high seas as contained in WCPFC6-2009/DP14 as a CMM (CMM 2009-02 FAD Closure<br />
