FEA Files ULP Seeking DoDEA
Budget/Spending Information
Continued refusals by DoDEA to reveal public
information about taxpayer spending, particularly
how it relates to non-educator positions <strong>and</strong> travel
within the agency, have prompted FEA to file an
Unfair Labor Practice seeking to force disclosure of
this information.
The ULP was filed in April after several
months of requesting budget information from
DoDEA. The ULP seeks to make DoDEA comply
with an FEA request for information such as:
• Listings of all non-educator positions within DoDEA,
broken down by name, title <strong>and</strong> position, <strong>and</strong> duty location
from 2007 to the present
• Information on the full costs involved in hiring,
employing <strong>and</strong> stationing all non-educator positions
throughout DoDEA over the same period. Such
information includes salaries <strong>and</strong> benefits, allowances,
moving costs, etc. for all such employees. The request
also covers the costs of hiring, appointing or transferring/reassigning
such non-educators including copies of
job postings <strong>and</strong>/or reassignment notices
• An accounting of appropriated funds incurred in travel
by any individual in DoDEA Headquarters dating back
to 2007
• Details on all funds spent by Headquarters staff for
renovating, refurnishing or decorating office space
since 2007
• Information on all purchases of electronic equipment
for Headquarters staff, such as computers, electronic
communication devices, etc.
• A listing of all funds spent on DoDEA Task Groups
since 2007
DoDEA has refused multiple requests from
FEA for this information despite the Association’s
right to this data for bargaining purposes, as well
as under the terms of an Executive Order from
President Obama.
“The Association needs this information for
purposes of bargaining <strong>and</strong> to fully represent the
interests of our bargaining unit members. Furthermore,
the very questionable spending priorities
DoDEA has exhibited recently are hurting our
members <strong>and</strong> the quality of education we will be
able to offer in our schools,” says FEA Executive
Director/General Counsel H.T. Nguyen. “Because
DoDEA has refused to reveal this information <strong>and</strong>
st<strong>and</strong> up to public scrutiny, we have found it necessary
to take legal action in order to find out exactly
where the taxpayers’ money has been going.”
The ULP was filed in mid-April with the
Federal Labor Relations Authority. It is hoped that
the FLRA will issue a ruling on the matter as early
as this summer.
“DoDEA has hidden behind a veil of secrecy
long enough,” says Nguyen. “It’s time for real transparency
<strong>and</strong> accountability.”
Thank you, for another year of great service. I
have visited over 100 schools this year <strong>and</strong> continue
to see countless examples of excellence in
education for our military families. Educators
continue to rise above all obstacles <strong>and</strong> keep test
scores high, the curricula comprehensive, <strong>and</strong>
the unique needs of each military community
addressed. Your work is recognized, appreciated
<strong>and</strong> will provide an impact on children for years
to come. Thank you.
What has Dr. Miles Added to the Budget?
FEA has serious concerns about the direction
Dr. Shirley Miles is steering a great school system.
Any business person will tell you that how
one spends limited resources clearly defines the
CEO’s priorities. Take a look at the course on
which Dr. Miles is steering DoDEA:
• Dr. Miles has spent millions of dollars creating
unnecessary new school positions – originally called
Resource Managers – with job responsibilities that
had been done by other school personnel for years.
• Dr. Miles has created a dual-layer of administration
with the addition of Area Superintendent positions
to mirror the existing Area Directors in Europe, the
Pacific, <strong>and</strong> Stateside. These Area Superintendent
positions, along with numerous new administrative
positions to support them, are a waste of taxpayer
money <strong>and</strong> serve no purpose other than removing
decision-making authority from the local level <strong>and</strong>
concentrating it in the h<strong>and</strong>s of people loyal only to Dr.
Miles.
• Dr. Miles continues to add new positions to her
Headquarters staff in Arlington.
• Dr. Miles has approved millions of dollars for training
programs for her administrative staff, including an
estimated $2.5 million to train 500 administrators in
Los Angeles this summer.
• Dr. Miles continues to push a “one size fits all”
professional development program for educators (“Us-
ing Data for Differential Instruction” or UDDI), focusing
on pre-packaged “sit <strong>and</strong> get” training instead of
meaningful professional development opportunities for
educators.
What does Dr. Miles Propose or Take Away
from the Budget? So how does Dr. Miles
expect to pay for these multi-million dollar new
items for a bloated administrative staff, along
with huge training programs geared solely for
above school level staff? One only has to take a
look at decisions Dr. Miles has already made:
• This school year, Dr. Miles has cut nearly three
dozen positions for services to academically at-risk
children worldwide. She had cut Reading Recovery
programs, literacy programs <strong>and</strong> remedial math
services.
• Dr. Miles proposed cutting over 350 middle school
positions, but under public pressure, reversed that
decision.
• Dr. Miles proposed cutting numerous kindergarten
instructional aides worldwide, but again, had to
reverse that decision based on the reaction of parents
<strong>and</strong> teachers.
• Dr. Miles continues to cut most summer professional
development programs to educators <strong>and</strong>, for the
second year in a row, offers no training for elementary
school teachers. She has even stated that when she
decides to restore training, it will only be UDDI training.
• Since September 11, mental health services have
been increased to meet the significant needs of
our students as their family members face frequent
deployments in the ongoing war on terrorism. Dr.
Miles appears to be reversing this trend, saying she is
“rightsizing” the counseling staff guidelines – another
word for “cutting.”
• DoDEA Headquarters recently floated a proposal
to cut school nursing positions in overseas schools
without any consideration to the unique needs faced
by families in foreign countries. Senior leaders tried to
downplay these cuts, saying that the reductions would
be met through “attrition.”
• FEA continues to get reports from schools around
the world that clerical services <strong>and</strong> other GS positions
(including supply clerks) are being cut. Dr. Miles
never fully funded the clerical needs to high school
counseling programs as originally proposed by her
own task group.
Transparency <strong>and</strong> Accountability? Dr. Miles
is fond of talking about “accountability” <strong>and</strong>
“transparency” but her actions, <strong>and</strong> those of
DoDEA under her leadership, demonstrate how
empty her words are.
FEA has made repeated requests for budgetary
information from DoDEA, especially as
it affects education programs worldwide. Those
requests have been consistently denied by Dr.
Miles <strong>and</strong> her staff (see page 1). In an effort to
keep participants on DoDEA Task Groups from
sharing any information, Dr. Miles has required
them to sign Confidentiality Agreements, which
are then used as a threat against any Task Group
members who wish to consult their peers for
input or information prior to making decisions
on a matter before the group.
All of these actions prompt one to ask:
if such persistent <strong>and</strong> extreme steps are being
taken by DoDEA to avoid transparency <strong>and</strong>
accountability for decisions being made, how
much confidence could anyone possibly have in
the quality of those decisions?
As we depart for the summer, rest assured
that FEA will continue to press for this information
<strong>and</strong> for a return to educationally-sound
decision making throughout DoDEA.
On behalf of the Association, I thank you <strong>and</strong>
congratulate you for another year of serving
our students <strong>and</strong> their families. While it has
been a very challenging year, I wanted to make
sure before the summer break starts our members
receive the thanks you rightly deserve.
Unfair Labor Practice
As you well know, FEA has been forced to take
legal action due to DoDEA management’s
failure to follow the law, such as management’s
unilateral implementation of changes. FEA
recently prevailed on an Unfair Labor Practice
(ULP) we filed with the Federal Labor Relations
Authority over such an instance.
In this case, FEA filed a ULP charge
against DoDEA for implementing m<strong>and</strong>atory
testing requirements unilaterally for DoDDS
FLES educators in FEA’s bargaining unit
without notifying FEA or bargaining over the
change.
The FLRA Washington Regional Director
issued a complaint against DoDEA for this
action <strong>and</strong> reached a settlement agreement.
As a result, there will be FLRA postings in all
DoDDS schools in the FEA unit, signed by
DoDEA Principal Deputy Director Charlie
Toth, stating that DoDEA will henceforth
meet its obligations to notify <strong>and</strong> bargain with
FEA on these changes. Please look for these
postings in your school.
“Target <strong>and</strong> Terminate”
FEA has received reports from members in
both DDESS <strong>and</strong> DoDDS schools, indicating
that some principals are beginning to use the
“target <strong>and</strong> terminate” training they received
at the beginning of this school year. In other
words, these principals have been trained <strong>and</strong>
now they are implementing that training by
going after educators.
The Association will do everything we
can to preserve targeted educators’ due process
rights in the face of unwarranted attacks.
Executive Order
On December 9, 2009, President Obama
signed Executive Order 13522, which contained
several important decisions <strong>and</strong> orders
from the President to the Executive Branch. In
Executive Order 13522, the President ordered
that:
“Management should discuss workplace challenges
<strong>and</strong> problems with labor <strong>and</strong> endeavor to
develop solutions jointly, rather than advise union
representatives of predetermined solutions to
problems <strong>and</strong> then engage in bargaining over the
impact <strong>and</strong> implementation of the predetermined
solutions.”
The President clarified in Section 3 of the
Executive Order that this means management
must engage unions at a much earlier stage, in
a process called “pre-decisional involvement.”
Association Business
H.T. Nguyen
FEA Executive Director
A Big Thanks <strong>and</strong> Updates Before Summer
As you are well aware, DoDEA management
has not engaged FEA at all. Instead,
DoDEA is still presenting FEA with “predetermined
solutions” in a final product form <strong>and</strong>
seeking to limit FEA’s involvement to “bargaining
over the impact <strong>and</strong> implementation of the
predetermined solutions.” Furthermore, FEA
has specifically asked DoDEA for information
on the DoDEA budget for bargaining, but
management has refused to provide any information,
prompting another ULP (see page 1).
As a member of the National Council on
Federal Labor-Management Relations, which
was created under Executive Order 13522,
I have raised the issue of agencies failing to
engage the unions in pre-decisional involvement.
I also noted that management providing
unions with a final product, rather than engaging
unions from the start, does not comply
with the Executive Order. I will continue to
raise these <strong>and</strong> other issues before this Council.
The Executive Order also created labormanagement
partnership councils at the
Agency level, which in our case is DoD. FEA,
which is one of the 10 DoD unions with
National Consultation Rights, is also a member
of this DoD council. I will continue to apprise
the Pentagon of DoDEA-specific problems
through this forum.
We can all be thankful we now have these
avenues to redress management actions.
FEA’s Legal Defense Fund Another Perk of Membership
Legal services are perhaps the most valued
benefit of membership in FEA, but what
happens if the alleged offending party is
not a DoDEA entity?
In certain cases, FEA members can
utilize the Association’s Legal Defense
Fund for assistance.
The Legal Defense Fund was created
by FEA in the early 1990s to help offset
members’ legal fees when pursuing legal
action against non-DoDEA entities.
Assistance from the Fund is available
only for actions against non-DoDEA personnel
because such cases must generally
be heard in local courts <strong>and</strong> FEA is unable
to represent members in actions that do
not directly involve DoDEA personnel.
The incident or injury prompting the
legal action must be the result of a schoolrelated
activity <strong>and</strong> cannot be covered by
other FEA/NEA legal services or the Asso-
Would You Like to Contribute to the
FEA Legal Defense Fund?
Your contribution will help other FEA members
pay for work-related legal actions against non-
DoDDS/DDESS personnel.
Send your donation, made out to “FEA,” to:
Barbara Wright, Business Manager
FEA
1201 16th St NW, Suite 117
Washington, DC 20036
Include “Legal Defense Fund” on the memo line
of your check. Donations are not tax deductible.
ciation’s Professional Liability Policy. Only
FEA members may apply for help from the
Fund.
See the box to the right for complete
Fund guidelines.
The Legal Defense Fund is not paid
for with FEA dues dollars. Instead, it is
funded by voluntary contributions from
individual FEA members (see box below
for donation information)
The Fund is not intended to be a
“Legal Aid Bank,” but rather is to be used
in cases that may be precedent-setting, or
whose outcome may have a positive effect
on many FEA members.
FEA members who wish to be considered
for assistance from the Legal Defense
Fund must contact their FEA UniServ
Director <strong>and</strong> Area Director. Approval by
the FEA Board of Directors is necessary
<strong>and</strong> there is a limit of $5,000 allowable per
incident.
“The Legal Defense Fund is something
we created to help our members
who feel that legal action is their best
option but they may not be able to afford
representation on their own,” says FEA
Executive Director/General Counsel H.T.
Nguyen. “Although FEA cannot represent
our members in cases not involving Do-
DEA personnel, this fund – more specifically,
their fellow members who contribute
to this fund – can offer them assistance.
“It’s another great benefit of membership.”
Guidelines for the FEA Legal
Defense Fund
• In order to qualify for any moneys from the FEA
Legal Defense Fund, the applicant must be an FEA
member <strong>and</strong> a member at the time of the incident.
• The legal injury – including but not limited to defamation
of character, sl<strong>and</strong>er, or libel to the member
– must come from non-DoDEA personnel.
• The legal injury must arise from school-related
activities.
• The application for moneys will be submitted in
writing to the FEA Area Director concerned. The
area UniServ Counsel, after consultation with local
counsel, will render an opinion as to the probability of
success in the appropriate court.
• If the Association concurs, an award up to $5,000
will be made in those cases with a high probability of
success.
• The member will execute an agreement, promising
to repay the award or any part that is recouped as
the prevailing party or otherwise. Further, the member
must agree to fully cooperate in the prosecution
of the case not to settle or otherwise compromise the
case without consultations with FEA.
• After receiving any moneys as a result of the case
being pursued, the member will have 30 days in
which to replace the award, otherwise a 10 percent
annual interest rate will be charged on the amount
owing.
• The FEA Legal Defense Fund is not obligated to
fully fund any legal action. The amount <strong>and</strong> number
of award(s) are at the sole discretion of the FEA.

Pre-Retired Membership A Great
Gift for Yourself or Colleagues
With one low payment now, you can assure yourself or one of your
fellow FEA members a lifetime of access to the many benefits of
association membership.
FEA/NEA Pre-Retired Membership is open to any current member
of FEA/NEA, regardless of the person’s retirement date. This
membership allows an individual to enroll in the FEA/NEA retirement
program, prior to actual retirement, for a one-time-only payment.
The current payment amount is $298. That amount will increase
after August 31, 2010.
Once you have paid your one-time dues fee for Pre-Retired
membership, you are automatically a retired member for life of both
FEA <strong>and</strong> NEA. Your retired membership will take effect once you
have retired from DoDEA. Members must continue to pay annual
FEA/NEA Active Member dues until the time of their retirement.
The Pre-Retired dues amount increases each year in proportion
to the overall FEA dues, so by pre-paying for your retired membership
now you can save significantly. If you are not retiring for another
5, 10 or 20 years, the cost of retired membership will have risen
significantly above today’s level by the time you do retire.
As an FEA/NEA retired member, you will be able to retain access
in your retirement to the many Member Benefits programs for
retired members, including various financial, insurance <strong>and</strong> investment
programs. You will also continue to receive FEA <strong>and</strong> NEA
publications. And, if you decide to substitute teach after your retirement
from DoDDS, you will continue to be covered by NEA’s liability
insurance.
Completing your Pre-Retired Membership is easy. Go to www.
feaonline.org/join/form.htm <strong>and</strong> follow the link for Pre-Retired Membership.
You can purchase the membership for yourself or any other
