RESTRAINTS: GUIDELINE FOR NURSES AND MIDWIVES IN<br />

SOUTH AUSTRALIA<br />

A primary function of the Nurses Board of South Australia (nbsa) is to regulate<br />

nurs<strong>in</strong>g <strong>and</strong> midwifery practice <strong>for</strong> the protection of the public by:<br />

• ensur<strong>in</strong>g that the community is provided with nurs<strong>in</strong>g <strong>and</strong> midwifery care<br />

of the highest st<strong>and</strong>ard; <strong>and</strong><br />

• achiev<strong>in</strong>g <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g the highest professional st<strong>and</strong>ards of both<br />

competence <strong>and</strong> conduct <strong>in</strong> nurs<strong>in</strong>g <strong>and</strong> midwifery.<br />

nbsa safeguards the <strong>in</strong>terests of the community by determ<strong>in</strong><strong>in</strong>g the scope of<br />

nurs<strong>in</strong>g <strong>and</strong> midwifery practice, endors<strong>in</strong>g codes of conduct, professional<br />

st<strong>and</strong>ards, <strong>guidel<strong>in</strong>e</strong>s <strong>and</strong> <strong>in</strong><strong>for</strong>mation sheets.<br />

nbsa <strong>guidel<strong>in</strong>e</strong>s provide the nurs<strong>in</strong>g <strong>and</strong> midwifery professions with a regulatory<br />

perspective which may guide the development of organisational policy <strong>and</strong> assist<br />

<strong>nurses</strong> <strong>and</strong> <strong>midwives</strong> to underst<strong>and</strong> their professional obligation <strong>in</strong> relation to<br />

specific aspects of nurs<strong>in</strong>g or midwifery practice.<br />

Purpose<br />

This Guidel<strong>in</strong>e upholds the pr<strong>in</strong>ciple that ANY FORM OF RESTRAINT REQUIRED<br />

FOR EACH OCCASION IS ONLY USED AS A LAST RESORT. Use of restra<strong>in</strong>t<br />

should only occur when the risk of apply<strong>in</strong>g the restra<strong>in</strong>t to a person is<br />

outweighed by the risks associated with not apply<strong>in</strong>g a restra<strong>in</strong>t.<br />

The Guidel<strong>in</strong>e promotes the m<strong>in</strong>imisation of <strong>restra<strong>in</strong>ts</strong> across all health care <strong>and</strong><br />

community sett<strong>in</strong>gs <strong>and</strong> should be used with the nbsa Scope of Practice<br />

Decision Mak<strong>in</strong>g Tool 2006, <strong>and</strong> <strong>in</strong> conjunction with documents such as the<br />

Department of Health <strong>and</strong> Age<strong>in</strong>g Decision Mak<strong>in</strong>g Tool: Respond<strong>in</strong>g to issues of<br />

restra<strong>in</strong>t <strong>in</strong> Aged Care 2004.<br />

In the context of this document, the term nurse refers to both a registered nurse<br />

<strong>and</strong> an enrolled nurse.<br />

Scope<br />

This Guidel<strong>in</strong>e is applicable to all <strong>nurses</strong> <strong>and</strong> <strong>midwives</strong> practis<strong>in</strong>g <strong>in</strong> health care<br />

<strong>and</strong> community sett<strong>in</strong>gs <strong>in</strong> South Australia, <strong>in</strong>clusive of, <strong>and</strong> not limited to, acute<br />

care, aged care, community services, women <strong>and</strong> children services, mental<br />

health <strong>and</strong> disability services.<br />

Def<strong>in</strong>ition of Restra<strong>in</strong>t<br />

Restra<strong>in</strong>t is any device or action that <strong>in</strong>terferes with the ability of a person to<br />

make decisions or restricts their free movement. It may be classified by the<br />

nature of the control mechanisms such as:<br />

• verbal threats <strong>and</strong> <strong>in</strong>timidation;<br />

• physical use of mechanical <strong>restra<strong>in</strong>ts</strong> <strong>in</strong>clud<strong>in</strong>g equipment that can be used<br />

as <strong>restra<strong>in</strong>ts</strong>, applied to the person;<br />

• chemical control through adm<strong>in</strong>ister<strong>in</strong>g sedatives or psychotropic medication<br />

<strong>for</strong> the purpose of restra<strong>in</strong>t;<br />

• environmental controls, <strong>in</strong>clud<strong>in</strong>g seclusion 1 which prevents a person’s exit.<br />

Pr<strong>in</strong>ciples Guid<strong>in</strong>g Decision Mak<strong>in</strong>g <strong>and</strong> Practice<br />

1. The application of <strong>restra<strong>in</strong>ts</strong> <strong>in</strong> each occasion should occur only when other<br />

preventative measures have been considered or <strong>in</strong>itiated <strong>and</strong> subsequently<br />

deemed not adequate to protect a person who is at risk of personal <strong>in</strong>jury or<br />

<strong>in</strong>jur<strong>in</strong>g others.<br />

2. The use of <strong>restra<strong>in</strong>ts</strong> is based on the pr<strong>in</strong>ciple of safe practice <strong>and</strong> restra<strong>in</strong>t<br />

m<strong>in</strong>imisation.<br />

3. The decision to restra<strong>in</strong> is a cl<strong>in</strong>ical decision that must be made by qualified<br />

people <strong>in</strong>clud<strong>in</strong>g registered <strong>nurses</strong> <strong>and</strong> <strong>midwives</strong>, based on a comprehensive<br />

assessment that is undertaken <strong>in</strong> partnership <strong>and</strong> collaboration with the<br />

person, family/representative <strong>and</strong> members of the multi-discipl<strong>in</strong>ary health<br />

team. This cl<strong>in</strong>ical decision must then be documented <strong>in</strong> the person’s care<br />

plan.<br />

4. It is the responsibility of each nurse <strong>and</strong> midwife to ensure that she/he:<br />

• assesses the person’s behaviour <strong>and</strong> environment, recognis<strong>in</strong>g the need to<br />

<strong>in</strong>itiate preventative measures or actions that promote the safety of the<br />

person;<br />

• practises <strong>in</strong> the best <strong>in</strong>terests of the person which <strong>in</strong>cludes: assess<strong>in</strong>g the<br />

need, follow<strong>in</strong>g a clear plan of care, assess<strong>in</strong>g the risk to the person <strong>in</strong><br />

apply<strong>in</strong>g any <strong>for</strong>m of restra<strong>in</strong>t, <strong>in</strong>itiat<strong>in</strong>g <strong>restra<strong>in</strong>ts</strong> as part of a risk<br />

management strategy, provid<strong>in</strong>g ongo<strong>in</strong>g review <strong>and</strong> evaluation;<br />

• meets the safety, com<strong>for</strong>t <strong>and</strong> psychological needs, <strong>in</strong>clusive of nutrition,<br />

hydration, elim<strong>in</strong>ation <strong>and</strong> observation of sedation levels;<br />

• allows <strong>for</strong> release of restra<strong>in</strong>t <strong>for</strong> regular movement <strong>and</strong> exercise;<br />

• is accountable <strong>for</strong> the decision to <strong>in</strong>itiate <strong>and</strong> apply restra<strong>in</strong>t with<strong>in</strong> an<br />

evidence based framework <strong>in</strong> accordance with the Australian Nurs<strong>in</strong>g <strong>and</strong><br />

Midwifery Council (ANMC) Competency St<strong>and</strong>ards <strong>for</strong> Nurses <strong>and</strong><br />

Midwives; <strong>and</strong><br />

• is aware of the applicable legislation, professional codes <strong>and</strong> st<strong>and</strong>ards,<br />

<strong>guidel<strong>in</strong>e</strong>s, organisational policies <strong>and</strong> procedures relat<strong>in</strong>g to <strong>restra<strong>in</strong>ts</strong> <strong>in</strong><br />

the specific practice sett<strong>in</strong>g.<br />

5. Documentation expla<strong>in</strong>s <strong>and</strong> supports the decision <strong>for</strong> restra<strong>in</strong>t <strong>and</strong> provides<br />

an accurate record of the person’s care, <strong>in</strong>clud<strong>in</strong>g evaluation of <strong>in</strong>terventions<br />

<strong>and</strong> outcomes.<br />

6. Regular monitor<strong>in</strong>g <strong>and</strong> a decision mak<strong>in</strong>g trail <strong>in</strong>clusive of ongo<strong>in</strong>g review of<br />

the need <strong>for</strong> restra<strong>in</strong>t.<br />

7. Nurses <strong>and</strong> <strong>midwives</strong> are entitled to a safe work<strong>in</strong>g environment <strong>and</strong> are not<br />

obliged to put themselves at risk. The nurse or midwife has the right to<br />

withdraw <strong>and</strong> <strong>in</strong>itiate the organisational response that ensures the safety of<br />

all persons.<br />

8. Nurses <strong>and</strong> <strong>midwives</strong> can expect the management of health care <strong>and</strong><br />

community sett<strong>in</strong>gs to:<br />

• develop policies <strong>and</strong> procedures relat<strong>in</strong>g to <strong>restra<strong>in</strong>ts</strong> <strong>in</strong>clud<strong>in</strong>g the safe use<br />

of equipment provided <strong>for</strong> use as <strong>restra<strong>in</strong>ts</strong>;<br />

• ensure education <strong>and</strong> tra<strong>in</strong><strong>in</strong>g <strong>for</strong> staff; <strong>and</strong><br />

• keep abreast of best practice <strong>in</strong> relation to <strong>restra<strong>in</strong>ts</strong>.<br />

9. Nurses <strong>and</strong> <strong>midwives</strong> are expected to work proactively with management<br />

personnel of health care <strong>and</strong> community sett<strong>in</strong>gs <strong>in</strong> relation to restra<strong>in</strong>t <strong>and</strong><br />

seclusion by:<br />

• <strong>in</strong>itiat<strong>in</strong>g prevention programs;<br />

• ensur<strong>in</strong>g safe equipment is provided <strong>and</strong> used <strong>in</strong> compliance with<br />

manufacturer’s <strong>in</strong>structions to m<strong>in</strong>imise risk to the person;<br />

• promot<strong>in</strong>g effective communication <strong>and</strong> consultation; <strong>and</strong><br />

• establish<strong>in</strong>g <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g review processes to ensure organisational<br />

policies <strong>and</strong> procedures that guide practice are <strong>in</strong> accordance with<br />

Australian st<strong>and</strong>ards.<br />
