TABLE 1 – COMPOSITION OF TEP Name Title Rod Burke Ken Waixel Kristen Argus Chairperson Member Member 3.1.3 All TEP members signed the standard form indicating they had no conflict of interest to declare and that they would keep the tender information confidential. 3.2 Tenders received and Evaluation 3.2.1 Details of the tenders received are shown in Table 2 below. Nationwide Towing & Transport Pty Ltd 3.2.2 The one tender submitted was prepared in conformance with the specifications and contract conditions and has been referred to the TEP for their review and evaluation. In this instance, the TEP decided not to interview tenderers given that there was only one tenderer, and that they are the current contractor for the service. 3.2.3 The TEP decided it would not score the Transition Plan criteria as Nationwide Towing & Transport Pty Ltd is Council’s current service provider for this service. 3.2.4 The following total scores were agreed against the evaluation criteria detailed in Table 3 below. Nationwide Towing & Transport Pty Ltd 920 3.2.5 The final weighted score which takes into account all of the evaluation criteria (excepting Transition Plan), including price, has been used to determine the recommended contractor that Council should engage for the delivery of its Towing of Obstructing Vehicles and Vehicles from Clearways service over the five (5) years. The following factors have been taken into account in scoring the tender against the agreed criteria. 3.2.6 Price Nationwide Towing & Transport Pty Ltd has been assigned the maximum possible score as it was the only tender submitted. 114
AGENDA - ORDINARY MEETING OF COUNCIL – 24 SEPTEMBER 2012 Whilst no other tender was submitted, the schedule of rates from Nationwide Towing & Transport Pty Ltd is based on their current rate plus a CPI increase, and is consistent with our current budget expectations. 3.2.7 Capacity Nationwide Towing & Transport Pty Ltd rating is supported by their commitment and ability to resource the contract with in excess of 60 staff. This is consistent with the current resourcing requirements for this service. Nationwide Towing & Transport Pty Ltd has also highlighted their capacity to supplement their standard resources in peak periods. 3.2.8 Relevant Experience Nationwide Towing & Transport Pty Ltd’s rating is underpinned by the following factors: It is Council’s current service provider for this service. Their demonstrated performance including their ability to meet the Key Performance Indicators. Their proven reliability within the Victorian local government sector in providing this form of towing service. This is demonstrated by their contracts delivering a similar service to four (4) other councils, Vicroads and the Victoria Police. Their in depth knowledge of the service requirements, and The minimal delivery and regulatory risk to Council as demonstrated by their consistent achievement of deadlines as the current contractor for this service with the City of Port Phillip. 3.2.9 Financial Evaluation A comprehensive financial evaluation was conducted on Nationwide Towing & Transport Pty Ltd. A report prepared by Council’s Financial Compliance Accountant highlighted a potential risk in the financial capacity of Nationwide Towing & Transport Pty Ltd. 3.2.10 The TEP has taken this factor into account when considering our recommendation, and the TEP is satisfied that any potential risk is mitigated by our ability to exercise the Termination clause within the Contract Conditions should the contractor be unable to perform the contract. 3.2.11 Reference Checks A reference check was conducted for Nationwide Towing & Transport Pty Ltd. 3.2.12 This check indicated that Nationwide Towing & Transport Pty Ltd has delivered its service requirements in accordance with budget and contract timelines. 4. CONSULTATION AND STAKEHOLDERS 4.1 Council has undertaken an initial consultation with the key stakeholder, VicRoads. The consultation process has assisted with the development of the specification and ensures the service will meet the community expectations. 115
