5. DISCUSSION<br />
5.1 OPTIONS<br />
5.1.1 Option 1: Council to award the Towing <strong>of</strong> Obstructing Vehicles and<br />
Vehicles from Clearways contract to Nationwide Towing & Transport Pty<br />
Ltd for five (5) years ending 24 September 2017. This recommendation<br />
is supported by the <strong>Tender</strong> <strong>Evaluation</strong> <strong>Panel</strong>.<br />
5.1.2 Option 2: Council ceases to deliver the service <strong>of</strong> removing obstructing<br />
vehicles and informs Vicroads that it will no longer be removing vehicles<br />
parked in clearways.<br />
5.2 ALIGNMENT TO COUNCIL PLAN<br />
5.2.1 The Towing <strong>of</strong> Obstructing Vehicles and Vehicles from Clearways<br />
service supports and enables Council to deliver the following strategies<br />
in the Council Plan 2009-2013:<br />
5.2.1.1 review services to ensure they meet the community needs –<br />
1.3.2 , and<br />
5.2.1.2 ensure robust financial management and accountability through<br />
the annual budget process and public reporting – 1.4.1,<br />
5.3 POLICY IMPLICATIONS<br />
5.3.1 The TEP has strictly followed Council’s Contracts and Procurement<br />
Policy and as such the awarding <strong>of</strong> this contract will not pose any<br />
adverse policy implications<br />
5.4 FINANCE / RESOURCE IMPLICATIONS<br />
5.4.1 The expected gross cost <strong>of</strong> using the preferred contractor over the next<br />
five (5) years is estimated to be not more than $1,350,000 excluding<br />
GST. This being in accordance with budgetary projections for the<br />
service.<br />
5.4.2 The tender from Contractor Nationwide Towing & Transport Pty Ltd<br />
provides the best value for Council.<br />
5.5 LEGAL & RISK IMPLICATIONS<br />
5.5.1 An effective and timely Towing <strong>of</strong> Obstructing Vehicles and Vehicles<br />
from Clearways service is required to enable Council to meet its<br />
statutory obligations. Nationwide Towing & Transport Pty Ltd is well<br />
resourced with experienced personnel and this will ensure that Council<br />
avoids risk that may lead to financial loss or have a negative impact on<br />
the Council’s reputation.<br />
5.5.2 Nationwide Towing & Transport Pty Ltd operate a fully endorsed OH & S<br />
system. In accordance with the contract terms and conditions the<br />
contractor must submit a specific safety plan for the provision <strong>of</strong> Towing<br />
<strong>of</strong> Obstructing Vehicles and Vehicles from Clearways services.<br />
5.5.3 Nationwide Towing & Transport Pty Ltd complied with the insurance<br />
requirements <strong>of</strong> $20,000,000 public liability and $1,000,000 pr<strong>of</strong>essional<br />
indemnity.<br />
