CAUSE OF INJURY:
Plaintiff claimed that she was injured as a result of a rear-end
motor vehicle accident that occurred on June 19, 2005. The
Defendant was stopped behind the Plaintiff at a red light. The
Plaintiff began moving forward. The Defendant also began moving
forward when the Plaintiff stopped his vehicle. The Defendant’s
vehicle struck the rear of the Plaintiff’s vehicle at a low
speed.
NATURE OF INJURY:
Plaintiff claimed that she sustained a disc herniation at C6-7
and a disc bulge at L4-5.

Plaintiff failed to appear for trial on September 12, 2011. In
the week before trial, Plaintiff acknowledged that she was aware
of the September 12, 2011 trial date.

The Court sanctioned Plaintiff and awarded Defendant his defense
attorney’s fees and costs associated with the preparation for
trial. The Court ordered that the sanctions would need to be
paid as a condition precedent to proceeding with the litigation.
An order to show cause hearing was held on September 26, 2011.
Plaintiff did not appear for the hearing. To date, Plaintiff
has not paid any money to Defendant.
