Implementation <strong>of</strong> Judgment dated 03.02.2010 in WP No. 15670 <strong>of</strong> 2009 filed<br />

by Tathagat Education mIssion, ITC, Nasirganj, Distt. Patna- Regarding.<br />

The Tathagat Education Mission, ITC, Nasirganj, Distt. Patna was inspected by<br />

the Standing Committee on 30.10.2008 for affiliation <strong>of</strong> Trades–Electrician 4(2+2),<br />

Fitter 4(2+2) and Diesel Mechanic 2(1+1) Unit. On scrutiny <strong>of</strong> the report the Trades<br />

Electrician 4(2+2) Units and Fitter 4(2+2) Units were approved the affliation <strong>of</strong> trades<br />

w.e.f August 2008 and by the Sub-committee in its meeting held on<br />

30.12.2008.Trade Diesel Mechanic was rejected with the remarks “ Trainees tools &<br />

Kit not available. The clarification received from State <strong>of</strong> Bihar and Regional Director,<br />

RDAT, Kolkota was not satisfactory as no original list was enclosed, hence it was again<br />

rejected in the meeting <strong>of</strong> sub-committee held on 24.06.2009.<br />

The institute aggrieved with this rejection filed a Writ Petition No. 15670/2009<br />

and same was heared in the High Court <strong>of</strong> Patna. The Hon’ble High Court <strong>of</strong> Patna<br />

heard the Writ Peition No. 15670 <strong>of</strong> 2009, filed by Tathagat Educational Mission ITC,<br />

Nasariganj Danapur, Distt. Patna, Bihar on 19.01.2010 and directions made by the<br />

Hon’ble High Court <strong>of</strong> Patna at Paragraph 1 at page 4 <strong>of</strong> the order dated 19.01.2010,<br />

reads as follows:<br />

“Let the NCVT now take appropriate final decision on the grant <strong>of</strong> final<br />

permission for the session 2008 in the trade <strong>of</strong> Diesel Mechanic to the petitioner<br />

institution in the light <strong>of</strong> the present discussion within a maximum period <strong>of</strong> four<br />

months (later on corrected by Court as 4 weeks) from the date <strong>of</strong> receipt and/or<br />

production <strong>of</strong> a copy <strong>of</strong> this order, when the report dated 30.10.2008 and Annexure 8<br />

referred to above shall also have to be the subject matter <strong>of</strong> consideration.”<br />

The said Tathagat Education Mission ITC, Nasariganj Danapur, Distt. Patna,<br />

Bihar filed an interim application No.123/2010 and was heard on 03.02.2010 and the<br />

following observation was made by the Hon’ble High Court <strong>of</strong> Patna<br />

“clarified that the liberty granted to the NCVT in Paragraph 1 at page 4 <strong>of</strong> the<br />

order for further investigation or enquiry has necessarily to be read as limited to the
