MINUTES<br />

MINUTES OF THE MEETING OF THE SUB-COMMITTEE OF NATIONAL<br />

COUNCIL FOR VOCATIONAL TRAINING (NCVT) DEALING WITH<br />

AFFILIATION HELD ON 15 th June 2010 AT 10.30 A.M. IN THE COMMITTEE<br />

ROOM, MINISTRY OF WATER RESOURCES, C-WING, SHRAM SHAKTI<br />

BHAWAN, NEW DELHI.<br />

Meeting <strong>of</strong> the Sub-Committee <strong>of</strong> NCVT dealing with affiliation was<br />

convened on 15 th June, 2010 at 10.30 A.M under the chairmanship <strong>of</strong> Director<br />

<strong>General</strong>/Joint Secretary. The details <strong>of</strong> members present in the meeting are at<br />

Annex ‘A’.<br />

Director <strong>General</strong>/Joint Secretary welcomed the members and apprised<br />

that a total <strong>of</strong> 343 affiliation cases <strong>of</strong> ITIs/ITCs [134 Govt. + 209 Pvt.] including 4<br />

de-affiliation cases <strong>of</strong> ITI/ITC, which were received from different States/UTs<br />

have been processed and are put up to the Sub-Committee <strong>of</strong> NCVT for granting<br />

affiliation. The following points were taken up for discussion:<br />

Item No. 1: Confirmation <strong>of</strong> minutes <strong>of</strong> the Meeting held on 30 th April,<br />

2010.<br />

Members were requested to go through the minutes <strong>of</strong> the last meeting<br />

held on 30 th April, 2010 and may convey their observations, if any. As there were<br />

no comments, the said minutes were confirmed.<br />

2. Members were apprised that all the proposals placed in the meeting have<br />

been scrutinized as per guidelines laid down for examination <strong>of</strong> proposals.<br />

3. The decision <strong>of</strong> the affiliation procedures taken by the Sub-Committee <strong>of</strong><br />

NCVT dealing with affiliation <strong>of</strong> trades/units <strong>of</strong> ITIs/ITCs from time to time in<br />

various meetings were conveyed to states/UTs. The Sub-Committee had<br />

emphasized in the last meeting to reiterate these instructions to all Principal<br />

Secretaries/Secretaries/Directors/Commissioners <strong>of</strong> States/UTs to follow the<br />

decisions in letter and spirit. Accordingly, members <strong>of</strong> the Sub-committee were<br />

informed that consolidated decisions have been circulated to all Principal<br />

Secretaries/Secretaries/Directors/Commissioners <strong>of</strong> States/UTs and <strong>DGET</strong> field<br />

Institutes & <strong>Directorate</strong>s for strict implementation. The instructions have also<br />

been placed on <strong>DGET</strong> Web-site.


4. It was also emphasized that State Directors should be advised to scrutinize the<br />

affiliation proposals thoroughly before sending the same to <strong>DGET</strong> (Hqs.), New<br />

Delhi to grant affiliation <strong>of</strong> trades/units <strong>of</strong> institutes.<br />

5. It was also decided that State Directors may be advised to conduct fresh<br />

SCIR/DIR <strong>of</strong> the cases which are rejected by the Sub-Committee <strong>of</strong> NCVT<br />

dealing with affiliation, instead <strong>of</strong> forwarding representations on the rejected<br />

cases.<br />

6. Based on the last meeting’s decision, it was again emphasized that <strong>of</strong>ficials <strong>of</strong><br />

State Govts. and members <strong>of</strong> the Standing Committee must be held accountable<br />

for any lapse/inconsistency and action should be taken against the erring<br />

<strong>of</strong>ficials and members <strong>of</strong> the Committee. Therefore, it was emphasized that<br />

shortcomings noticed in the proposals received from State/UT Govts. be<br />

communicated to them through a separate letter and they may be asked to<br />

report back to DGE&T as to what action has been taken by the concerned<br />

State/UT governments against <strong>of</strong>ficers who did not carry out inspections<br />

diligently.<br />

7. The Sub-Committee members emphasized that joint inspection <strong>of</strong><br />

affiliation <strong>of</strong> trades/units <strong>of</strong> randomly selected ITIs/ITCs should be conducted to<br />

ensure maintenance <strong>of</strong> quality and quantity <strong>of</strong> training as per NCVT norms.<br />

8. DG/JS emphasized that high degree <strong>of</strong> pr<strong>of</strong>essionalism and honesty be<br />

displayed by the committee members during inspections (preliminary inspection/<br />

SCIR/DIR/SIR) and all concerned be instructed accordingly. Any deviation will be<br />

severely dealt with.<br />

Item No.2: Consideration <strong>of</strong> recommendations in respect <strong>of</strong> inspection<br />

reports received from States/UTs.<br />

Sub-committee took note that 343 affiliation cases <strong>of</strong> ITIs/ITCs [134 Govt.<br />

+ 209 Pvt.] including 4 de-affiliation cases received from various States/UTs have<br />

been processed and the following was decided:<br />

Proposals recommended - 247<br />

Proposals rejected - 41 (18 Govt. + 23 Pvt.)<br />

Clarifications sought - 51<br />

New Institutes affiliated - 72 (5 Govt. + 67 Pvt. Institutes)<br />

De-affiliation cases - 4<br />

The meeting ended with a vote <strong>of</strong> thanks to the chair.<br />

ADDITIONAL AGENDA NO. 1<br />

Implementation <strong>of</strong> Judgment dated 03.02.2010 in WP No. 15670 <strong>of</strong> 2009 filed<br />

by Tathagat Education mIssion, ITC, Nasirganj, Distt. Patna- Regarding.<br />

The Tathagat Education Mission, ITC, Nasirganj, Distt. Patna was inspected by<br />

the Standing Committee on 30.10.2008 for affiliation <strong>of</strong> Trades–Electrician 4(2+2),<br />

Fitter 4(2+2) and Diesel Mechanic 2(1+1) Unit. On scrutiny <strong>of</strong> the report the Trades<br />

Electrician 4(2+2) Units and Fitter 4(2+2) Units were approved the affliation <strong>of</strong> trades<br />

w.e.f August 2008 and by the Sub-committee in its meeting held on<br />

30.12.2008.Trade Diesel Mechanic was rejected with the remarks “ Trainees tools &<br />

Kit not available. The clarification received from State <strong>of</strong> Bihar and Regional Director,<br />

RDAT, Kolkota was not satisfactory as no original list was enclosed, hence it was again<br />

rejected in the meeting <strong>of</strong> sub-committee held on 24.06.2009.<br />

The institute aggrieved with this rejection filed a Writ Petition No. 15670/2009<br />

and same was heared in the High Court <strong>of</strong> Patna. The Hon’ble High Court <strong>of</strong> Patna<br />

heard the Writ Peition No. 15670 <strong>of</strong> 2009, filed by Tathagat Educational Mission ITC,<br />

Nasariganj Danapur, Distt. Patna, Bihar on 19.01.2010 and directions made by the<br />

Hon’ble High Court <strong>of</strong> Patna at Paragraph 1 at page 4 <strong>of</strong> the order dated 19.01.2010,<br />

reads as follows:<br />

“Let the NCVT now take appropriate final decision on the grant <strong>of</strong> final<br />

permission for the session 2008 in the trade <strong>of</strong> Diesel Mechanic to the petitioner<br />

institution in the light <strong>of</strong> the present discussion within a maximum period <strong>of</strong> four<br />

months (later on corrected by Court as 4 weeks) from the date <strong>of</strong> receipt and/or<br />

production <strong>of</strong> a copy <strong>of</strong> this order, when the report dated 30.10.2008 and Annexure 8<br />

referred to above shall also have to be the subject matter <strong>of</strong> consideration.”<br />

The said Tathagat Education Mission ITC, Nasariganj Danapur, Distt. Patna,<br />

Bihar filed an interim application No.123/2010 and was heard on 03.02.2010 and the<br />

following observation was made by the Hon’ble High Court <strong>of</strong> Patna<br />

“clarified that the liberty granted to the NCVT in Paragraph 1 at page 4 <strong>of</strong> the<br />

order for further investigation or enquiry has necessarily to be read as limited to the


issue <strong>of</strong> availability <strong>of</strong> tools and kits for the Diesel Mechanic trade in light <strong>of</strong> Annexure<br />

-8 to the Writ Petition”<br />

In view <strong>of</strong> the directions <strong>of</strong> the Hon’ble High Court <strong>of</strong> Patna (Bihar), the<br />

matter was again placed before the NCVT Sub-Committee dealing with affiliation in<br />

it’s meeting held on 30.03.2010, when the Sub-Committee decided to conduct<br />

inspection to verify the availability <strong>of</strong> tool kit <strong>of</strong> Diesel Mechanic-2(1+1) units as per<br />

NCVT norm <strong>of</strong> the said Institute.<br />

Accordingly, the State Director, Bihar was requested to constitute the Standing<br />

Committee and send the inspection report at the earliest. The State Director, Bihar<br />

has now submitted fresh inspection report vide their letter dated 19.05.2010. On the<br />

basis <strong>of</strong> SCIR dated 01.05.2010, it is proposed for granting affiliation to the said ITC<br />

for the trade Diesel Mechanic-2(1+1) units w.e.f. August, 2010 as per NCVT norm.<br />

However, in it’s order dated 03.02.2010, the Hon’ble High Court <strong>of</strong> Patna<br />

further pointed out that:<br />

“It shall be the conjunctive responsibility <strong>of</strong> the NCVT and the State <strong>Directorate</strong><br />

to ensure that in the nature <strong>of</strong> the present controversy the students <strong>of</strong> the petitioner<br />

institution for the session 2008 are not allowed to suffer if ultimately NCVT grants<br />

such recognition by either deferring the examination date or holding fresh<br />

examination for the students <strong>of</strong> the said session, in the Diesel Mechanic Trade”.<br />

Hon’ble members <strong>of</strong> the Sub-committee deliberated on the issue and granted<br />

affiliation to the trade Diesel Mechanic-2(1+1) units <strong>of</strong> said ITC w.e.f. August, 2010.


Indira Gandhi Memorial ITC, Delhi Road Hapur, Distt- Gaizabad, U.P<br />

Agenda Item No.-I I<br />

(1) Honorable State Minister (<strong>Employment</strong> & <strong>Training</strong>) U.P had inspected the<br />

said institute and proposed to de-affiliate the trades <strong>of</strong> institute. The Director<br />

(<strong>Employment</strong> & <strong>Training</strong>) U.P inspected this institute on 20.02.2009 and also<br />

proposed to de-affiliated the trades <strong>of</strong> said institute.<br />

(2) In response to state Director Letter dated 20.02.2009 we requested to vide<br />

letter dated 27.02.2009 to State Director <strong>of</strong> <strong>Employment</strong> & <strong>Training</strong> U.P to<br />

constitute the standing committee for evaluation for De-Affiliation <strong>of</strong> Institute.<br />

(3) State Director, U.P requested on 18.03.2009 and reminder issued on<br />

27.05.09 to RD, RDAT Kanpur to constitute the committee for evaluation with<br />

copy endorsed to Sh. Yogendar Singh, JDT/<strong>Directorate</strong>.<br />

(4) The Regional Director, RDAT Kanpur, on 05.06.2009 had nominated one<br />

<strong>of</strong>ficer as a representative <strong>of</strong> NCVT for constitution <strong>of</strong> standing committee for deaffiliation<br />

in respect <strong>of</strong> said institute.<br />

(5) The Standing Committee inspected the institute on 30.11.09 for the trade<br />

Electrician- 6 (2+2+2) units (Addl.), Fitter – 3 (1++1+1) units (Addl.), ITE&SM- 2<br />

(0+0+2) units (Addl.), Wireman - 1 (0+0+1) Unit (Addl.) and recommended to<br />

grant affiliation <strong>of</strong> said trade/unit.<br />

(6) The committee <strong>of</strong> dated 30.11.09 recommended trade stenographer<br />

(Hindi) -2(1+1) for de-affiliation.<br />

Keeping in view as stated above, Hon’ble members <strong>of</strong> the Sub-committee<br />

granted affiliation to the trades Electrician- 6 (2+2+2) units (Addl.), Fitter – 3 (1++1+1)<br />

units (Addl.), ITE&SM- 2 (0+0+2) units (Addl.), Wireman - 1 (0+0+1) Unit (Addl.) <strong>of</strong><br />

said ITC w.e.f. August, 2010 and granted the de-affiliation to trade stenographer<br />

(Hindi) -2(1+1) units .<br />

The members also advised to bring such cases into the notice <strong>of</strong> Principal<br />

Secretary and thus separate letter will be issued to Principal Secretary <strong>of</strong> U.P. state.
