<strong>Working</strong> <strong>after</strong> <strong>Retirement</strong><br />
Fact <strong>sheet</strong> for retired members<br />
Use this <strong>fact</strong> <strong>sheet</strong> to help you understand basic information about<br />
working <strong>after</strong> a service retirement. If you decide to work for an employer<br />
other than the County of San Diego (or other participating employer), there<br />
is no effect on your SDCERA retirement benefit payments. However, if you<br />
return to work for the County of San Diego <strong>after</strong> you have retired, your<br />
retirement benefit payments may be affected.<br />
Temporary re-employment<br />
If you are temporarily re-employed with the County of San Diego (or other<br />
participating employer), there is no effect on your SDCERA retirement<br />
benefit payments. Temporary employment allows you to work in an hourly<br />
position requiring special skills or knowledge for up to 960 hours (equal to<br />
120 eight-hour days) per fiscal year (July 1 through June 30). You may also<br />
receive compensation as a juror, voter registration election officer, judge,<br />
Board of <strong>Retirement</strong> member, independent contractor or elected official<br />
without affecting your retirement benefit.<br />

You must wait 180 calendar days (90 calendar days for public safety<br />
officers) following the last day of employment as a regular employee<br />
before you can return as a temporary employee. You may request to be<br />
placed on the retiree list for temporary employment by completing and<br />
submitting the Request for Placement on Retiree List form available from the<br />
Department of Human Resources.<br />
Temporary employment will not reinstate you as an active member;<br />
therefore, your retirement benefit will not be suspended and will continue<br />
to be paid to you.<br />
Returning to active membership<br />
If you become re-employed by the County of San Diego (or other<br />
participating employer) in a permanent position working at least 20 hours<br />
weekly, you will become an active SDCERA member and your retirement<br />
benefit payments will be suspended.<br />
Before returning to permanent employment, you must apply to the Board<br />
of <strong>Retirement</strong> for reinstatement to active SDCERA membership using the<br />
Return to Active Membership Application for Retired Members form available<br />
at www.<strong>sdcera</strong>.org or from SDCERA. You must have the Department<br />
of Human Resources Medical Standards Unit complete a section of the<br />
form indicating that you have successfully completed a pre-employment<br />
medical exam.<br />

If you become re-employed, several changes to your benefits will occur:<br />
• Your retirement benefit payments will be suspended effective the<br />
date you return to work. In the event you receive a retirement benefit<br />
payment for time <strong>after</strong> you return to active membership, the amount<br />
must be returned in full to SDCERA.<br />
• If you are a retired Tier I, Tier II, Tier A or Tier B member who<br />
returns to work, you will be a Tier B member for your subsequent<br />
period of membership if you return within six months of termination<br />
OR if you return to work with the same employer (e.g., County<br />
employee returning to work for the County). You will be a Tier C<br />
member if you return to work with a different employer (e.g., court<br />
employee returning to work for the County) more than six months<br />
<strong>after</strong> termination.<br />
• If you are enrolled in an SDCERA-sponsored health plan, you will<br />
not be eligible for coverage in that plan once you return to work in a<br />
permanent position.<br />
• Your retirement benefit payments will be suspended; therefore, optional<br />
deductions such as CECO contributions, CalPERS Long Term Care,<br />
or dues for the Retired Employees of San Diego County (RESDC) and<br />
the Deputy Sheriffs’ Association (DSA) will no longer be paid from<br />
your retirement benefit payment.<br />
• When you terminate employment, your original retirement benefit<br />
payments resume (increased by any cost-of-living adjustments). You<br />
can opt to receive a refund of your member contributions and interest<br />
from your second period of employment, or you can opt to receive an<br />
additional monthly retirement benefit. The benefit will be calculated as<br />
a new and separate benefit based on your age at re-retirement, service<br />
credit and monthly final average compensation earned during your<br />
second period of employment.<br />

1937 (Government Code Section 31450 et seq.) and by the California Public Employees’ Pension Reform<br />
Act of 2013 (Government Code Section 7522 et seq.) as they have been adopted and implemented by<br />
the San Diego County Board of Supervisors and the SDCERA Board of <strong>Retirement</strong>. If there is any<br />
inconsistency between this <strong>fact</strong> <strong>sheet</strong> and the governing law, the law will govern. Decisions relating to the<br />
plan will be made <strong>after</strong> reference to the statutes and any resolutions, regulations and policies governing<br />
