in form of demand draft payable on on SBI, Kathara / BTPS,
Bank of India, Sawang in favour of CENTRAL COALFIELDS
LIMITED, KATHARA AREA in separate sealed envelop

2. SELLING OF TENDER PAPER : From 06.03.2013 to 11.03.2013 (up to 1 PM) from the office
of S.O.(Excv)(KTA), Kathara.
3. SUBMISSION / RECEIPT OF : On 12.03.2013 up to 3.00 P.M. in the office of the General
TENDER PAPER
Manager(KTA), Kathara in the tender box kept under the
custody of Security Section of G.M.(KTA)’s Office.
4. OPENING OF THE TENDER : On 12.03.2013 at 4.00 P.M. in presence of the T.C.
PAPER
members and attending tenderer or their authorized
representatives.
5. EARNEST MONEY : To be deposited in the form of Bank Draft payable on SBI,
Kathara / BTPS, Bank of India, Sawang in favour of
CENTRAL COALFIELDS LIMITED, KATHARA
AREA, without Earnest Money, no tenders will be
considered. No adjustment will be entertained in this
connection.
6. ESTIMATED VALUE : For the purpose of tender estimated value has been taken.
However, actual may differ.
7. INSPECTION OF JOB : The Job may be inspected at the site of Kathara Colliery.
8. GUARANTEE : The repair job shall be guaranteed for minimum 12 months or
3000 Working Hours which ever is earlier from the date of
completion of job.
9. OTHER TERMS & CONDITIONS : i) Inspection & Execution of jobs will be done at Kathara
Colliery of Kathara Area, Central Coalfields Ltd.
ii) The tenderes have to arrange required Tools & Tackles and
manpower for inspection and execution of the jobs. However
lifting and handling equipments will be provided by the
Project, if requested by the tenderer.
10. L. D. CLAUSE : If the delivery is not made within the stipulated period, penalty
@ 1/2% (half percent) of the value of the bill for each week or
part there of limited to 5% (five percent) and where felt
necessary, the limit of 5% can be increased to 15% (fifteen
percent) at the discretion of consignee and the same will be
deducted from bill.
11. PAYMENT : 90% payment will be released after handing over the items
after completion of required repair work. Balance 10% will be
released after satisfactory fitment and performance of the
repaired items for a period of 12 months or 3000 Working
Hours which ever is earlier. Payment will be made through
Electronic Transfer System / RTGS/NEFT/CBS/ Intra Bank
Transfer.
12. SAFETY : The safety of the workman engaged by the contractor shall be
the sole responsibility of the contractor. Contractor shall make
all possible measures to ensure safety as per statutory and
working requirement. Any claim on account of compensation
shall be born by the contactor.
13. SUBMISSION PROCEDURE : Tenders will be received in three separate sealed envelops

b) Containing copies of satisfactory completion
Performance certificate for HEMM repairing works
performed during last seven years ending last day of
month previous to the one in which bid applications are
invited (i.e. eligibility period) should be either of the
following:
Three similar completed works each costing not less
then the amount equal to 40% of the estimated value.
OR
Two similar completed works each costing not less then
the amount equal to 50% of the estimated value.
OR
One similar completed work costing not less then the
amount equal to 80% of the estimated value.
c) Current Sales Tax / VAT Clearance Certificate from
Sales Tax Department.
d) VAT / TIN Registration Certificate.
e) Partnership / Proprietorship / Company deed etc.
f) Photo copy of PAN Card, SSI/ NSIC Certificate
g) Bank Account operation statement or soundness
Certificate from any Indian Nationalized Bank.
h) Average annual financial turnover during the last three
years ending 31 st March of the previous financial years
should be at least 30% of the estimated cost.
i) Current affidavit, not older than 01 (One) Year from
the date of receipt of tender, certifying that the bidder is
not involved in any criminal cases, not related to any
employees of the company, not black listed by the
company and firm registration details.

N O T E : All original documents pertaining to above have to be produced before the Tender

NOTE : For purchasing the tender documents, an application is to be made by the party to Staff
Officer(Excv)(KTA), Kathara then only permission will be given to deposit cost of tender documents.
C) Envelop No. 3 : Only Price Bid.
Each envelops should be clearly superscribed the tender notice number and date, name of works, envelop
No. i.e. 1, 2 and 3 etc. If the above three envelops are not found in order, it is liable to be rejected.
After opening of 1 st envelop, if it is found in order in terms of NIT then only 2 nd envelops will be opened.
If 2 nd envelop is found in order in terms of NIT then only 3 rd envelop will be opened.

Service Tax: Service Tax, will be extra if payable by the company. The service provider has to give a
declaration on affidavit on a non-judicial stamp paper duly notorized to the effect that the service provider has
made payment of Service Tax of the preceding months every time while making claim for payment in
accordance with law.
General and other Terms & Conditions will be governed as per CCL rule circulated from time to time.
Management reserves the right to accept or reject any or all the tenders fully or partly without assigning
any reason whatsoever and is not bound to accept the lowest tender. Management further reserves its right to
cancel the tender without assigning any reason whatsoever.
This issues with the approval of the competent authority.

GENERAL TERMS AND CONDITION
1. DEFINITIONS:
a) The word ‘ADMINISTRATION’ wherever occurs in the condition it means the CENTRAL
COALFIELDS LIMITED represented by the General Manager(KTA), Kathara, or the Project
Officer of any other Officer who issued the work order.
b) The word ‘ Contractor’ wherever occurs the successful tenderer whose tender has been accepted by
the Administration.
c) The word ‘Work Order’ wherever occurs means work order, Delivery order or Supply Order as the
case may be.
2. SUPERVISION AND EMPLOYMENT BY CONTRACTOR:
a) The contract shall keep the work, a competent Supervisor and necessary assistants who shall
represent the contractor in his absence. Such supervisor and / or assistant shall be present at all
times to receive and comply all directives issued by the Administration.
b) The contactor shall comply only competent skilful and orderly men to do the work. The
Administration shall have all right to ask the contractor to remove any it will be binding on the
contractor to remove him within three hours.
c) The contractor shall not employ any person who is employed by the Administration nor shall
indulge in any activity which is detrimental to the interest of the Administration.
3. ORGANISATION OF WORK BY CONTRACTOR:
a) The contractor is deemed to have inspected into site and familiarizes himself with details of the
work.
b) The contractor shall at his own cost make his own arrangement for all materials, trucks, transport
arrangement, tools staff and labour required for the contracted work.
c) The contractor shall not sublet the work to any other party without approval in writing by the
General Manager(KTA), Kathara.
d) The contract shall familiarises himself with all statutes, rules and orders applicable to his work and
shall be governed by them. He shall be responsible for compliance of such statutes etc.
4. SAFETY PRECAUTIONS :
a) The contractor shall observe all safety precautions and measures as required or recommended by
all applicable statutes, rules, orders etc. and shall be responsible for compliance of the provisions of
such statutes etc. In case of any accident he shall be responsible for compliance with all
requirements of Workmen’s Compensation Act or any other similar laws in force and shall
indemnify the Company against any claim on this account.
5. PAYMENT TO WORKMEN EMPLOYED BY THE CONTRACTOR AND MAINTENANCE OF
RECORDS:
a) The contractor shall not pay less than the minimum wages to the labour engaged by him and as per
Minimum Wages Act or such other legislation of Award of Agreement or as directed by the
Administration. Decision of General Manager(KTA), Kathara shall be final and binding in this
matter.
b) The contractor shall also implement provisions of CMPF and Bonus Scheme.
c) In case of any injury on duty the contractor shall pay diet and medical expenses in addition to
injury allowance.
d) All accounts shall be maintained in ENGLISH/HINDI. The Administration shall have the right of
access the inspection to payment of labour. The Administration may arrange for witnessing the
payment to the labour by it representative.

6. INDEMNITY:
a) If any matter which is not expressly provided for or against the conditions of any matter or practice
appear prejudicial to the interest of the Administration or the public, the Administration may call
upon the contractor to remedy / modify or remove such matter or practice forthwith and this shall
be binding on the contractor.
b) The contractor shall in addition to any indemnity provided by Law indemnify the Administration
against all liabilities whatsoever arising out of the Workmen’s Compensation Act, 1923 or any
enactment and amendments thereto and shall be wholly responsible for observance of all statutory
rules and regulations under any act or award of the GOVT. in force in matters relating to employer
payment, retrenchment of labour and other matter relating to the work awarded to him. No claim
shall lie against the Administration or damage done by any act of GOD or on account of
circumstances beyond the control of the Administration.
7. DISPUTE :
In case of any dispute, question or controversy in any matter relating to the contract, the
decision of General Manager(KTA), Kathara shall be final and binding.
8. DAMAGES :
The contractor shall make good all damages which may be caused to property belonging to
the Administration or any other person by act or fault of the contractor or his servants in
connection with execution of the contract provided that the Administration at its own option
may make good such damages and charge the contractor the expenses thereof.
9. LICENCE :
The contractor shall have to obtain license application under the contractors labour
(Regulation & Abolition) Act 1970 and will produce.
10. DOCUMENTS TO BE SUBMITTED BY THE CONTRACTOR:
THE CONTRACTOR MUST SUBMIT THE FOLLOWING DOCUMENTS:
(A) ENVELOP NO. 1 : Only Earnest Money in the shape of Bank Draft.
(B) ENVELOP NO. 2 :
a) Complete Offer detailing the jobs to be carried.
b) Containing copies of satisfactory completion performance certificate for HEMM repairing works
performed during last seven years ending last day of month previous to the one in which bid applications are
invited (i.e. eligibility period) should be either of the following:
Three similar completed works each costing not less then the amount equal to 40% of the estimated value.

Two similar completed works each costing not less then the amount equal to 50% of the estimated value.
OR

INFORMATION REGARDING OWNERSHIP OF THE CONTRACTOR’S FIRM SUCH AS:
a) If it is Private Limited Co. the Registration No. of the Company, Name of the Directors and
name of the Director who shall be responsible for operating the contract.
b) If it is partnership firm Photostat copy of the partnership deed and name of the partner who
shall be responsible for operating the contract.
c) If it is proprietary firm, name of the proprietor and declaration to the effect that it is
proprietary firm.
d) The contractor shall have to obtain License under the Contract Labour (Regulation &
Abolition) Act 1970 and shall produce a Photostat copy of the same, if applicable.
N O T E : All original documents pertaining to above have to be produced before the Tender
Committee at the time of opening of tender.

C) Envelp No. 3 : Only Price Bid.
i. WORK OPRDER :
The work shall be ascertained by the contractor only against work orders issued by the Staff
Officer(Excv)(KTA), Kathara and have to be completed within stipulated period with entire
satisfaction of the Administration.
12) SECURITY MONEY :
The contractor shall deposit security money at the rate of 10% of the value of the work order,
which shall be deducted from each on account bill in equal installments after adjustment of
deposited 2% Earnest Money.
13) PARALLEL CONTRACT :
The Administration reserves the right to enter into parallel Contract separately with any other
party for getting the work done.
RISK OF THE CONTRACTOR :
If the contractor fails to execute the work awarded to the satisfaction of the Administration within
the stipulated period the Administration reserves the right to get the work executed even at a
different price and value of work shall be realized from any amount due to the contractor.
15) TERMINATION OF CONTRACT :
The Administration may terminate the CONTRACT / WORK ORDER at any time by giving 15
days notice without assigning any reason.
16) TAX AND DUTIES :
Tax and Duties shall be charged / paid extra as applicable as per rule.

17. RATE OFFER : The tenderer shall submit their offer as per format given in
scheduled of work / Bill of Quantity:
a) The envelops shall be inscribed with the heading as above in Capital Letters along with name of
Tenderer / Companies, Correction / Over writing should be signed by the tenderer. No additional terms
& Conditions other prescribed in the tender documents will be entertained and conditional tender shall
be liable to be rejected.
b) The tenderer should sign on all pages of the documents in token of acceptance of all the conditions.
c) Corrections where unavoidable, shall be made by crossing out and rewriting in the tender documents
may disqualify the tenderer.
d) The tender shall be submitted in English / Hindi.
e) Canvassing in connection with the tenders in any shape or from the strictly prohibited and tenders
submitted by tenderer(s) who resort to canvassing shall be liable to rejection.
f) The detailed Tender Notice shall be deemed to be part of the work contract.
g) Indenting tenderer(s) before submitting of their tender must satisfy themselves regarding their eligibility
as per criteria explained and must enclosed the required documents duly authenticated by the tenderers.
All other terms and conditions will remain same as per company rules circulated time to time.
